SUBJECT: Meeting of August 25, 1983
I have two other cases to make comments on concerning your
meeting in August.
The first case concerns the final plat of Holiday North,
Section 10. I would like to point out to you that the
eastern portion of this plat is located on the east side
of the creek and the only outlet for this portion of
this plat is Circle Drive which is on someone else's
property. However, there is a street dedication going
north from this plat and then going east back down to
Carolyn Drive. I would like to request that this developer
be required to improve the street outlet before this plat
can be used.

The next case I would like to comment on 1S zoning case
PZ 83-54 and it concerns the zoning of the railroad
track. They are proposing to zone the railroad to the center
of the freeway and this could create two problems.
-=.
The first being that since the railroad probably has prior
rights over the freeway right of way they could conceivably
put a billboard sign hanging over the freeway.
The second being along the service road on the north side of
the freeway the city intends to construct a crossing at the
railroad for the purpose of access to a piece of city property
that lies west of the railroad.
I recommend that you zone only that portion of the land which
lies north of the state highway right of way.

On October 4, 1983, an inspection of subject facility was made in
the company of yourself and Dr. Bill Anderson. Subject facility
has recently been renovated by Mr. Jack Sandlin in which a 500
gallon septic tank was added to an existing 500 gallon tank and
300 square feet of lateral line was installed. Previous1y, sub-
ject private sewage facility served the 15 year-old building
which is now being renovated for the clinic.

Soils in the area of the newly installed lateral line are Gasil
fine sandy loarns. and are suitable.for a leaching type disposal
system.
Dr. Anderson has operated a Veter~nary Clinic for many years uti-
lizing a private sewage facility for sewage dIsposal and is aware
of problems created by disposal of antibacterial compounds and
other chemicals that affect septic tank function.
Subject facil ity should be adequate for the proposed usage, wIth
waste water loading rates equivalent to those experienced when
the building was occupied previously.

This department will not require a soil percolation test or a per-
mit for subject facility provided grade-compatible space is re-
served for future repair if the need should arise, and surface

Mr. Bowen asked if they had subnitted
any water plans.
Mr. Elting said Cblleyville is
presently serving this property water.

being a tract of land out of the John McComas Survey, Abstract 1040, and
being more particularly described as follows;

Gordon Swift, Consulting Engineer,
came forward to represent Folsom
Investments. He stated they want to
clean up the action in Walkers Branch.
Mr. Swift stated the preliminary for
this property was approved August,
1979 and the final was approved by the
Planning and Zoning Commission
December, 1981 and by the City Council
January, 1982 and then recorded.
Mr. Swift said after doing all the
work on this property, the Flood Plain
had been redesigned. He said after
having a meeting with the City Staff,
they found they needed to correct the
City's Zoning Map. Mr. Swift said
this plan has been reviewed by the
City Engineer and City Staff and they
recommended they do this.

request to please come forward.
J. D. Lunsford, 3816 Diamond Loch
East, came forward. He said he owns
some property across from Fox Rental
which is adjacent to this property.
Mr. Lunsford said with this
realignment, he feels they have
diverted more water than ever which
has to go through 6 to 8 foot
culverts. He asked what was going to
be done about this.
Councilman Davis stated there is a
Capital Improvement Program for
Richland Oaks area. He stated there
is a problem at the intersection of
Harwood Road and Grapevine Highway
which is not controlled by the city.
Councilman Davis said, hopefully, the
flooding will be taken care of with
the new concrete-lined channels.

Mr. Lunsford asked if there would be
construction within the existing
Flood Plain.

Councilman Davis said there would be.
Mr. Lunsford said what they have
already done helped, but he is
concerned about the effect this would
have on his property.
Mr. Hannon said this action will not
allow Folsom to do anymore than he can
already do; he is only redefining
where the Flood Plain is.
Councilman Davis showed Mr. Lunsford
where the Flood Plain will be.

Mr. Lunsford said his concern was for
the adjacent property owners. He said
he had talked to the Corp of Engineers
and they still show this area in the
Flood Plain. Mr. Lunsford asked if
the property owners would have any
recourse if this does not work. He
said he felt this was compounding
their problem.

Mr. Hannon said if we have made a
mistake, you have recourse to the city
and the developer, but he feels the
city is making an effort to eliminate
the problem.
Mr. Lunsford said they may make it
work now, but he is concerned for
later when all the apartments are
built and with all the asphalt.
Councilman Davis said he felt the city
is doing everything they can to
correct the problem.
Ann Robinson who lives in Richland
Oaks, came forward. She asked if they
plan to build up the property anymore.
She said they have filled in a lot and
with the other apartments built on the
other side of the creek, the adjacent
property keeps getting lower and
lower.

Mr. McMillan with Folsom Investments
came forward. He said they have
filled in all .that is needed on~their
property.

Ms. Robinson asked what they plan to
put on this property.
Chairman Tucker said it was not the
place of this Board to find that out,
that becomes a platting matter, but
the property is zoned Multi Family and
Local Retail.
Mrs. Allen Chaffin, 5144 Jennings
Drive, came forward. She said it was
in the Flood Plain and now they have
built it 7 feet above the highway.
Mrs. Chaffin said the adjacent
property will flood. She said they
have alrèady bought flood insurance.
Mrs. Chaffin said now, when they get
only a 2 inch rain, the channel is
full.

Mrs. Chaffin said she wanted to make
it a matter of record that we are
concerned; when they blacktop this
property, there will be flooding.

Several changes to the sign ordinance are proposed, based on problems
experienced in its administration over the past several months.
It would have been desirable to discuss the proposed changes in a
Pre-Council Session prior to drafting the proposed changes, but time
and prior commitments did not permit this procedure. Therefore, I
would appreciate your calling Gene or me prior to the Council Meeting

1) Change in Section 2.10 adds bench signs as temporary signs. At the
present time bench signs are not classified in any category. In June of 1984,
our franchise runs out with the Bench Ad Sign Company. At this time bench signs
should no longer be allowed in the right-of-way and they will probably start
placing them on private property so they need to be controlled.
2) Section 3.9 changes the fees for less expensive signs. Under the old
wording of this section all sign work required the payment of an examination fee of
$50.00 plus a fee based on the value of the work.
3) A proposed change in Section 4.1 is to add the billboard sign as an
allowable sign with any development. The owner or the occupant of the premises may
. have no more than one of the four listed type of signs, including billboards.
4) Section 6.3 better identifies where subdivisions or development signs
can be placed. Under the old wording they cannot be placed in any zoning category
except on property zoned like the subdivision it was advertising. I think the
intention of this was to keep heavy industrial type subdivision advertising and
commercial type subdivision advertising out of single family and multi-family zoned
areas. This new wording would still prevent any advertising of commercial or
indus~rial type subdivisions in residential subdivisions. The change in this
section also prevents subdivisions in other cities from advertising in our City
except on the billboard signs along the freeway.

5) The change in Section 8.1 allows the Director of Public
Works to approve billboard signs instead of these matters having to come
before the Council. I think there was some conversation in one of our
meetings about the sign ordinance that the Council did not wish to have
these matters come before them.
6) Section 8.6 clarifies where a residential zoned boundary is.
At the present, the sign ordinance says you cannot have a billboard within
100 feet of a residential zoned boundary.

ORDINANCE NO.
BE IT ORDAINED by the City Council of the City of North Richland Hills,
Texas, that ORDINANCE NO. 1001, "Sign Ordinance", adopted January 24, 1983, is
hereby amended at Sections 2.10, 3.9, 4.1, 6.3, 8.1' and 8.6, to read as follows:
Section 2.10 - Last sentence to read "trailer, portable signs and bench
signs are classified as temporary signs"
Section 3.9 Add the following, "applicants for signs valued up to $500.00
are not required to pay the examination fee. Applicants for
simple copy of letter changes pay according to the monetary
value of the proposed work on a sign."
Section 4.1 (b) Anyone development may have a choice of but not more
than one ground sign, one roof sign, one projecting sign, or
one billboard sign. The billboard sign cannot advertise a
product or service that is sold on the premise or refer to
the premises in any manner.
Section 6. 3
Third sentence, "such signs shall be located on private
property only. Signs advertising single family subdivisions
are the only signs allowed in single family and agriculture
zoned areas. Only signs advertising two-family and single
family subdivisions shall be allowed in two-family zoned
areas. Only signs advertising multi-family, two-family and
single family subdivisions shall be allowed in multi-family
zoned areas. Signs in single family, two family, multi-family
and agriculture zoned areas shall be erected on unimproved
lots only. If a lot is to be improved all subdivision signs
that may be present shall be removed before the lot is
improved. Signs advertising any subdivisions outside the
city limits of North Richland Hills are not allowed to be
erected except as a billboard sign.
Section 8. 1
. (a) No billboard may be constructed unless a sign permit has
been issued and approved by the Director of Public Works.
Section 8. 6
(a) add, "a residential zone boundary is any single family or
two-family zoned area as shown on the official Zoning Map of
the City."

AN ORDINANCE AUTHORIZING AND ALLOWING, UNDER THE ACT GOVERNING THE
TEXAS MUNICIPAL RETIREMENT SYSTEM, "UPDATED SERVICE CREDITS" IN SAID
SYSTEM FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM
WHO PRESENTLY ARE IN THE EMPLOYMENT OF THE CITY OF NORTH RICHLAND
HILLS; PROVIDING FOR PARTICIPATION OF THE CITY IN THE SUPPLEMENTAL
DEATH BENEFITS FUNDS TO PROVIDE CERTAIN IN-SERVICE DEATH BENEFITS
FOR EMPLOYEES, AND DEATH BENEFITS FOR ANNUITANTS WHOSE LAST
EMPLOYMENT BEFORE RETIREMENT WAS WITH THE CITY OF NORTH RICHLAND
HILLS, TEXAS, AND ESTABLISHING AN EFFECTIVE DATE FOR SUCH ACTIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS:
Section l. Authorization of Updated Service Credits
(a) On the terms and conditions set out in Sections 63.40l through
63.403 of Title llOB, Revised Civil Statutes of Texas, 1925, as amended, each
member of the Texas Municipal Retirement S'ystem who has current service credit
or prior service credit in said System in force and effect on the lst day of
January, 1984, by reason of service in the employment of the City of North
Richland Hills, and on such date has at least 36 months of credited service
with said system, shall be and is hereby allowed "Updated Service Credit" (as
that term is defined in subsection (d) of Section 63.402 of said title) in an
amount that is lOO% of the "base Updated Service Credit" of the member _
(calculated as provided in subsection (c) of Section 63.402 of said title).
The Updated Service Credit hereby allowed shall replace any Updated Service
Credit, prior service credit, special prior service credit, or antecedent
service credit previously authorized for part of the same service.
(b) On the terms and conditions set out in Section 63.601 of said
title, any member of the Texas Municipal Retirement System who is eligible for
Updated Service Credits on the basis of service with this City, and who has
unforfeited credit for prior service and/or current service with another
participating municipality or municipalities by reason of previous service~
and was a contributing member on January l, 1983, shall be credited with
Updated Service Credits pursuant to, calculated in accordance with, and
subject to adjustment as set forth in said 63.601.
(c) In accordance with the provisions of subsection (d) of Section
63.401 of said title, the deposits required to be made to the Texas Municipal

account of current service shall be calculated from and after the date

4IÞ aforesaid on the full amount of such person's earnings as an employee of the
City.
Section 2. Supplemental Death Benefit Fund
That the City of North Richland Hills hereby elects to participate
in the Supplemental Death Benefits Fund of the Texas Municipal Retirement
System for the purpose of providing in-service death benefits for each of the
City's employees who are members of said System, and for the purpose of
providing post-retirement death benefits for annuitants whose last covered
employment was as an employee of the City, in the amounts and on the terms
provided for in Sections 62.004, 64.60l through 64.605, 65.3l4, 65.409. and
65.502 of Title 110B, Revised Civil Statutes of Texas, 1925, as amended.
Effective Date. Subject to approval by the Board of Trustees of
Texas Municipal Retirement System, the updated service credits and coverage
under the Supplemental Death Benefits Fund granted hereby shall be and become
effective on the 1st day of January, 1984.

However, the contractor did not complete the job on time and he had a 30 day
overrun on this job. The amount in the contract for liquidated damages show

to be $100 per day which amounts to $3,000. The tank was not completed at
that time ~ccording to the plans and specifications. Myself and the city
engineer inspected the tank and decided that 60% of the responsibility
of not completing the tank in a proper manner was the contractor's and the
city accepted 40% of the responsibility. Based on the 60/40% split of the
responsibility I would recommend that we also split the liquidated damages
based on that same percentages which means that the liquidated damages would
be $1,800.
