The first case concerns the final plat of Holiday North, Section 10. I would like to point out to you that the eastern portion of this plat is located on the east side of the creek and the only outlet for this portion of this plat is Circle Drive which is on someone else's property. However, there is a street dedication going north from this plat and then going east back down to Carolyn Drive. I would like to request that this developer be required to improve the street outlet before this plat can be used. . The next case I would like to comment on 1S zoning case PZ 83-54 and it concerns the zoning of the railroad track. They are proposing to zone the railroad to the center of the freeway and this could create two problems. -=. The first being that since the railroad probably has prior rights over the freeway right of way they could conceivably put a billboard sign hanging over the freeway. The second being along the service road on the north side of the freeway the city intends to construct a crossing at the railroad for the purpose of access to a piece of city property that lies west of the railroad. Gordon Swift, Consulting Engineer, came forward to represent Folsom Investments. He stated they want to clean up the action in Walkers Branch. Mr. Swift stated the preliminary for this property was approved August, 1979 and the final was approved by the Planning and Zoning Commission December, 1981 and by the City Council January, 1982 and then recorded. Mr. Swift said after doing all the work on this property, the Flood Plain had been redesigned. He said after having a meeting with the City Staff, they found they needed to correct the City's Zoning Map. He said he owns some property across from Fox Rental which is adjacent to this property. Mr. Lunsford said with this realignment, he feels they have diverted more water than ever which has to go through 6 to 8 foot culverts. He asked what was going to be done about this. Councilman Davis stated there is a Capital Improvement Program for Richland Oaks area. He stated there is a problem at the intersection of Harwood Road and Grapevine Highway which is not controlled by the city. Councilman Davis said, hopefully, the flooding will be taken care of with the new concrete-lined channels. ~ . Mr. Lunsford asked if there would be construction within the existing Flood Plain. ~ Councilman Davis said there would be. Mr. Lunsford said what they have already done helped, but he is concerned about the effect this would have on his property. Mr. Hannon said this action will not allow Folsom to do anymore than he can already do; he is only redefining where the Flood Plain is. Councilman Davis showed Mr. Lunsford where the Flood Plain will be. . Mr. Lunsford said his concern was for the adjacent property owners. He said he had talked to the Corp of Engineers and they still show this area in the Flood Plain. Mr. Lunsford asked if the property owners would have any recourse if this does not work. Mr. Hannon said if we have made a mistake, you have recourse to the city and the developer, but he feels the city is making an effort to eliminate the problem. Mr. Lunsford said they may make it work now, but he is concerned for later when all the apartments are built and with all the asphalt. Councilman Davis said he felt the city is doing everything they can to correct the problem. Ann Robinson who lives in Richland Oaks, came forward. She asked if they plan to build up the property anymore. She said they have filled in a lot and with the other apartments built on the other side of the creek, the adjacent property keeps getting lower and lower. . Mr. McMillan with Folsom Investments came forward. He said they have filled in all .that is needed on~their property. ~ Ms. Robinson asked what they plan to put on this property. Chairman Tucker said it was not the place of this Board to find that out, that becomes a platting matter, but the property is zoned Multi Family and Local Retail. Mrs. Allen Chaffin, 5144 Jennings Drive, came forward. She said it was in the Flood Plain and now they have built it 7 feet above the highway. Mrs. Chaffin said the adjacent property will flood. She said they have alrèady bought flood insurance. Mrs. Chaffin said now, when they get only a 2 inch rain, the channel is full. . SUBJECT: Sign Ordinance DEPARTMENT: BACKGROUND: Public Works 1) Change in Section 2.10 adds bench signs as temporary signs. At the present time bench signs are not classified in any category. In June of 1984, our franchise runs out with the Bench Ad Sign Company. At this time bench signs should no longer be allowed in the right-of-way and they will probably start placing them on private property so they need to be controlled. 2) Section 3.9 changes the fees for less expensive signs. Under the old wording of this section all sign work required the payment of an examination fee of $50.00 plus a fee based on the value of the work. 3) A proposed change in Section 4.1 is to add the billboard sign as an allowable sign with any development. The owner or the occupant of the premises may . have no more than one of the four listed type of signs, including billboards. 4) Section 6.3 better identifies where subdivisions or development signs can be placed. Under the old wording they cannot be placed in any zoning category except on property zoned like the subdivision it was advertising. I think the intention of this was to keep heavy industrial type subdivision advertising and commercial type subdivision advertising out of single family and multi-family zoned areas. This new wording would still prevent any advertising of commercial or indus~rial type subdivisions in residential subdivisions. The change in this section also prevents subdivisions in other cities from advertising in our City except on the billboard signs along the freeway. Signs advertising single family subdivisions are the only signs allowed in single family and agriculture zoned areas. Only signs advertising two-family and single family subdivisions shall be allowed in two-family zoned areas. Only signs advertising multi-family, two-family and single family subdivisions shall be allowed in multi-family zoned areas. Signs in single family, two family, multi-family and agriculture zoned areas shall be erected on unimproved lots only. If a lot is to be improved all subdivision signs that may be present shall be removed before the lot is improved. The amount in the contract for liquidated damages show This tank repair is complete at this time and is back in service. to be $100 per day which amounts to $3,000. The tank was not completed at that time ~ccording to the plans and specifications. Myself and the city engineer inspected the tank and decided that 60% of the responsibility of not completing the tank in a proper manner was the contractor's and the city accepted 40% of the responsibility. Based on the 60/40% split of the responsibility I would recommend that we also split the liquidated damages based on that same percentages which means that the liquidated damages would be $1,800.
