4. Mayor Pro Tem Ramsey moved, seconded by Councilwoman Hinkle, CONSIDERATION OF

Motion carried 5-0; Councilman Kenna abstaining due to APPROVED

5. Mayor Faram advised the Council that the Staff has recommended CONSIDERATION OF
denial of this request. REQUEST OF MID-
AMERICA OF TEXAS,
Councilman Kenna moved, seconded by Mayor Pro Tem Ramsey, to FOR WATER SERVICE AT
deny the request, based on the fact that the area was served 7724 PRECINCT LINE
by a two (2) inch water line and the citizens of North ROAD
Richland Hills in that area had low pressure problems at the DENIED
present time.
Mr. Gary Tennyson, 7724 Precinct Line Road, appeared before
the Council.

Mr. Tennyson stated he was requesting water service to
his building on precinct Line Road. Mr. Tennyson stàted
he had one employee at the site and needed the water for
drinking and clean-up purposes.
Mayor Faram asked what city the building was located in.
Mr. Tennyson stated the site was located in Tarrant County.
Mr. Line stated he had been informed that the City of Hurst
had ªnnex~tio11_._in· process and.had a..second reading-"oh the annexa-
tion scheduled for september 28, 1982.
Councilman Davis asked Mr. Tennyson if he had approached the
City of Hurst on providing water for the site.
Mr. Tennyson stated the city of Hurst did not have any water
lines in the area.
Councilman Newman asked Mr. Tennyson if the building was
already constructed and how soon he needed the water service.
Mr. Tennyson stated the building was already built and he
needed the water immediately.
Councilman Newman asked Mr. Tennyson what type of construc-
tion he did.
Mr. Tennyson stated he was in the telephone placement and
repair service.
Mayor Pro Tern Ramsey asked Mr. Tennyson if he was the owner
of the property.
Mr. Tennyson replied yes.
Mayor Pro Tern Ramsey asked where he obtained his building
permit.
Mr. Tennyson replied from Tarrant county.
Mayor Faram asked how many customers were on the line and
how many could the line service.
Mr. Riddle stated there were about 50 taps on the line at
the present time.
Mr- Albin stated the line could not service any additional
taps.

Councilwoman Hinkle asked if there had been complaints from
the customers on line on low pressure.
Mr. Albin stated yes.

6. Mayor Faram opened the public hearing on PZ 82-21, called PLANNING AND ZONING

Mr. Collins stated he was developing in North Richland Hills 2F-9 TWO FAMILY
and he would like to have this property rezoned for duplexes. DWELLING (LOCATED AT

Mayor Faram asked Mr. Collins when he planned on beginning
development.
Mr. Collins stated he planned on starting development in about
six months.
Mayor Faram asked Mr. Collins if he had been made aware of
the drainage problems pertaining to this property.
Mr. Collins stated he had been advised of the drainage
problems and thought it best to go ahead and get the property
rezoned and then work on the drainage problems.
Mayor Faram asked Mr. Collins if he agreed to the holding
pattern that was presently on the property.
Mr. Collins stated yes, and he felt the drainage problem
could be worked out.
Councilman Kenna asked Mr. Collins if he agreed to eliminating
lots 9 through 15, Block 15.
Mr. Collins stated yes.
Mayor Pro Tem Ramsey asked if the property had the hold on it
because some easements could not be obtained.
Mr. Albin stated that was correct, there were three easements
that had not been obtained.
May~r Faram asked Mr. Collins if he accepted all responsibility
for the drainage work.

Mr. Collins replied he would assume the responsibility on the
drainage.
Mayor Faram called for anyone wishing to speak in opposition
to this request to please come forward.
There being no one else wishing to speak, Mayor Faram closed
the public hearing.
7. Mayor Faråm advised the Council the Planning and zoning Com-
mission had recommended approval of IF-9, with the exception
of Lots 9 through 15, Block 15.
Councilman Davis moved, seconded by Councilman Kenna, to
approve PZ 82-21, Ordinance No. 975, with the exception of
Lots 9 through 15, Block 15, and description of lots being
deleted from the Ordinance.

8. Mayor Faram opened the public hearing on PZ 82-22, and called
for anyone wishing to speak in favor of this request to
please come forward.
There was no one present to speak.
Councilman Davis advised that there were two neighbors at
the Planning and zoning Commission meeting that spoke in
favor of this request.
Mayor Faram called for anyone wishing to speak in opposition
of this request to please come forward.
There was no one wishing to speak.
On the advice of the city Attorney, Mayor Faram recessed
the public hearing on PZ 82-22 until the October 11, 1982
Council Meeting.
9. Councilman Ramsey moved, seconded by Councilman Kenna, to
postpone this item until the October 11, 1982 Council
meeting.

10. Mayqr Faram opened the public hearing and called for anyone
wishing to speak in favor of this request to please come

Mr. Mike Jones, Teague, NaIl and Perkins, Consulting
Engineers, appeared before the Council.
Mr. Jones stated he represented Mr. Alley in this request.
Mr. Jones stated Mr. Alley planned to build a three to
five story office building and restaurant. Mr. Jones stated
the entrance to the office building would be from Weyland
Drive and the entrance to the restaurant would be from Air-
port Freeway.
Mayor Faram called for anyone wishing to speak in opposition
to this request to please corne forward.
There being no one wishing to speak, Mayor Faram closed
the public hearing.

Commission had recommended approval.

Councilwoman Hinkle moved, seconded by Councilman Davis, to
approve PZ 82-23, Ordinance No. 976.
Motion carried 6-0.
120 Mr. Line stated the street Santa Dominga Court was a dedicated
street. Mr. Line stated there was no development in the area
at this time and the owner of the property had requested the
name of the street be changed to Westchase because the name
of the planned development would be Westchase Garden Homes.
Mr. Line stated the staff had checked with the Post Office,
Police Department and Fire Department and they had no problems
wi th the name c}1ange.
Councilman Kenna moved, seconded by Councilman Ramsey, to approve
Ordinance No. 977.
Motion carried 6-0.
13.
Mr. Line stated the proposal was that the residential lots
that backup to Rufe Snow would be allowed to sign a covenant
and would not be assessed if no entries from the rear of the
lots onto Rufe Snow were made. Mr. Line stated that if the
rear entries were made then the property owner would have
to pay the assessment.

Councilman Ramsey moved, seconded by councilwoman Hinkle,
to waive the assessment on the residential lots that backed
up to Rufe Snow unless a curb cut onto Rufe Snow was ,made.
Councilman Kenna amended the motion, seconded by Councilman
Davis, to state "the assessment on the residential lots
backing up to Rufe Snow Drive would be waived if no rear
entrances onto Rufe Snow were made and/or a request for
rezoning was made to change the zoning from residential."
Amended motion carried 6-0.

Mrs. Mary Hensarling, 6613 sunset, appeared before the council.
Mrs. Hensarling stated that on residents that would benefit
from this action, she would like to thank the council and
Mr. Line.
14. councilwoman Hinkle moved, seconded by councilman Kenna, to
award the bid to the low bidder, Charlie Hilliard, in the
amount of $4,938.00.
Councilman Kenna stated that Charlie Hilliard had bid on
two pickups and asked Mr. Riddle how long they would
honor the bid.
Mr. Riddle stated they would honor the bid until January
1982, but it would have to be rebid because the funds
were appropriated in the 1983 budget.
Mayor Pro Tern Ramsey stated he would like for the staff
to look into obtaining three-wheel çushmans.
Motion carried 6-0.
15. Councilman Kenna moved, seconded by Councilman- Newman, to
accept the bid of Ladd uniform and Bucheimer Law Enforce-
ment Center as supplier of uniforms and leather goods for
the police Department.
Mayor Pro Tern Ramsey asked if this item would be out of
the 1982-83 budget.
Mr. Line stated yes.

16. Councilman Davis moved, seconded by Mayor Pro Tem Ramsey, to
approve Ordinance Number 978 adding at Section I, line-six,
after the words have been "with appropriate easements. II
Motion carried 6-0.
Mayor Pro Tern Ramsey stated he would like to compliment the
Planning and Zoning Commission and Councilman Davis, the
liaison, for this ordinance and felt it would be a benefit
to the City.
17.
Mrs. Doyne Byrd, 8020 Little Dude Court, appeared before the
Council.
Mrs. Byrd stated she was representing the Richland Oaks Home-
owners Association. Mrs. Byrd stated she had lived in the
Richland Oaks area for a number of years. Mrs. Byrd stated
the homeowners were at the City's mercy and in need of help.
Mrs. Byrd stated she knew the Council was aware of the problem
at Harwood and Grapevine Highway. She did not object to de-
velopment but felt this development would damage the residents
in Richland Oaks. Mrs. Byrd stated that if this shopping center
was developed it would need homeowners to keep it in business
and if the flooding problem was not solved there would be no
homeowners left in the area. Mrs. Byrd stated the City had
made mistakes in the past and were still making them. If the
drainage problems would be worked out ahead of time flooding
would not occur. Mrs. Byrd stated the developer had taken
care of his drainage problems, but the people downstream were
the ones it would damage. Mrs. Byrd stated that before any
development was done there should be plans for downstream.
Mayor Faram stated that the area in Richland Oaks was not
built by the lack of responsible planning by the City of
North Richland Hills, and he would ask Councilman Davis for
the history on how it all came about.
Councilman Davis stated that he did some checking on this
last week and the City did not create the drainage problem
as far as the lack of drainage and/or lack of enough wide
channeling. Councilman Davis stated there was a 30 foot
easement that was put through the area, which was probably
poor engineering at the time. Councilman Davis stated the
area was developed in September of 1956, three years before
Mrs. Byrd said she came to the area. Councilman Davis stated

the City was not ~ncorporated at that time, it was approved
by the commissioner's Court and the Planning and zoning
Commission of the City of Richland Hills because they'hªd
extrajudicial territory rights. Councilman Davis stated
it was probably poor planning, but it was not this city's
fault. Councilman Davis stated that how to remedy the
problem now is what needed to be addressed.
Mayor Faram stated he wanted to get the point clear that the
city did try to make plans and the City of North Richland
Hills did not create this problem, they inherited it.

Mayor Faram asked Mrs. Byrd if there were any results from
the meeting the residents of Richland Oaks had with the City
staff.
Mrs. Byrd stated they had to depend on the mercy of the city
to come up with the overall engineering plans to correct
their problem in Richland Oaks.

Mrs. Byrd stated she understood what Councilman Davis was saying,
but at the same time the City of North Richland Hills did not have
any water problems~ As the City developed, it had created the water
problems.
Mayor Faram stated there was a possibility of putting a concrete
liner on an area on the original drainage channel that was behind
the houses on Pearl and Jennings~ there was presently a 30 foot
and it would take a 40 foot easement, also possibly a temporary
working easement to put the drainage channel in. Mayor Faram
asked Mrs. Byrd if the people in the area would be willing to
donate to the city five feet on each side of the channel.
Mrs. Byrd stated the people in that· area would have to answer
for themselves. Mrs. Byrd stated she did not live right on
the creek, just right across from it.
Mayor Faram stated the required easements were the first thing
that needed to be addressed and secondly where the two channels
came together and went down to the properties that fronted on
Oakridge Terrace, that became private property of which the City
had no easements, would the people in that area dedicate ease-
ments so the City could go in and widen the channel.
Mrs. Byrd stated there were quite a few residents from that area
present and they would have to answer that question.

Mayor Faram stated that since Mrs. Byrd was the leader of this
group, would she take it upon herself to see if she could"
obtain the easements. Mayor Faram stated there were some
residents in the north end of the City trying to obtain ease-
ments to remedy a flooding problem there.
Mrs. Byrd stated she was not the one that started this, she
was asked to be one of the spokesmen.
Mayor Faram stated he was looking for a responsible party to
help the City get the necessary easements. Mayor Faram stated
that if the City was going to improve the property it seemed a
reasonable request to ask for the easements. Mayor Faram
asked if there was a member of the group that would take the
responsibility of trying to obtain the easements.
Mrs. Byrd stated she would like for each one of them to speak
for themselves.
Mayor Faram asked Mrs. Byrd if she was saying she could not
do it.
Mrs. Byrd stated she would do what she could to help.
Councilman Davis stated that there was some flooding problems
in Morgan Meadows and the problem had been that you will have
one homeowner that does not want_ to give an easement and the
City's hands were tied. Councilman Davis stated the Morgan
Meadows area was tied up on four easements, the City was ready
to fix the problem. Councilman Davis stated the City wanted
to remedy the problem in Richland Oaks, but needed some
cooperation. Councilman Davis stated Mrs. Byrd was not being
pinpointed, but the City could not do it all alone.
Mrs. Byrd stated she understood that, it had to be 100 percent
cooperation.
Councilman Kenna stated the City had a study underway on that
drainage problem and expected some type of plan in the near
future. Councilman Kenna stated the prime thing would be the
requirement of a 40 foot easement down through the center of
the neighborhood and make some improvements to the ditch to the
east. Councilman Kenna stated the portion that the Mayor men-
tioned that formed a bottleneck, the City had no easements and if
the easements could be obtained would be a great help to the City.
Councilman Kenna advised Mrs. Byrd there was nothing the City
could legally do about the development to the north of Richland
Oaks.

Mrs. Byrd asked what the plans were at the presen·t time for
Richland Oaks.
Mayor Faram stated that the first thing that had to be done
was obtaining the easements. The city could not send equip-
ment on private property and all of it was private property
to the south of Jerri Jo.
Mrs. Byrd asked if the easements were a hold-up now.
Mayor Faram replied yes.

Councilman Kenna stated that at one point in . time Morgan
Meadows, in the City's opinion, was the highest priority for
drainage problems and the City had not been able to apply
any funds in the area because of not being able to obtain
the necessary easements.
Mrs. Byrd asked if it was not the city's responsibility to
protect the homeowners from the development above them.
Mayor Fararn asked Mrs. Byrd if she meant stop the development.
Mrs. Byrd stated no, from her understanding this development had
been in the plans for quite awhile and she wondered why there
were not plans to take care of the flood control knowing the
development was going in.
Mayor Pro Tern Ramsey stated it could be discussed all night
about what had happened in the past. Mayor Pro Tern Ramsey
stated the city had not been sitting idly by waiting to watch
the neighborhood get washed away. Mayor Pro Tern Ramsey stated
the Mayor and himself had personally been in the area and was
well aware of the problem. Mayor Pro Tern Ramsey stated something
would be done, assuming the City could obtain the easements, if
the easements could not be obtained then the city was shut down.
Mrs. Byrd asked if the City would be libel if they asked Mr. Folsum
to postpone his construction due to the flooding downstream.
Mr. McEntire stated the city had an ordinance and Mr. Folsum had
complied with it, he had taken the drainage to the nearest recog-
nized outfall.
Mrs- Byrd asked whose responsibility it was to see that there was
not flooding downstream due to the development.
Mr. McEntire stated the city was doing what they could about the
drainage. Mr. Folsum had met the requirements of the ordinance.

Mr. Fred Finke, 8330 Jerri Jo, appeared before the Council.
Mr. Finke asked why the property could not be condemned.

Mayor Faram stated it was a matter of economics of trying to
buy all the land, it came to a total of $1,600,000.00. Mayor
Faram stated the City intended to work anyway it could to get
the problem solved.
Mr. McEntire asked Mr. Finke if he would help obtain the neces-
sary easements.
Mr. Finke replied yes.
Mayor Faram asked how many people that were in attendance that
had property between Jerri Jo and Jennings.
There were a number of persons present that had property that
backed up to Jerri Jo and Jennings.
Mayor Faram asked if there was anyone that would have a problem
giving a fiye foot easement.
Loretta Allen, 5100 Pearl, appeared before the Council.
Mrs. Allen stated she would be willing to give an easement,
but if she gave five feet her fence would end up in the middle
of her swimming pool.
Mayor Faram stated that if there had to be a variation maybe
the needed easement could be taken from the other side of the
channel.
Mayor Faram asked for the names of three people who would be
interested in helping the City obtain the necessary easements.

Mayor Faram stated he would ask the Council for their permission
to direct the City Engineer to make a survey and prepare ease-
ments in the area between Jerri Jo and Jennings; and contact the
people to see if the easements can be obtained and schedule a
meeting with the City Engineer to develop the requirements from
the south of Jerri Jo to see if the problem can be eliminated.

Mr. Peter Eggert, 7804 Daniel Drive, North Richland Hills,
appeared before the council. Mr. Eggert stated he was about
to speak on a very serious matter. Mr. Eggert stated he was
aware that a violation of one or more public offices could
be handled one of two ways, one administrative or the court
of law way. Mr. Eggert stated he had decided to bring the
~tter before the Council. Mr. Eggert stated he would still
like to reserve the right to go the judicial way later.
Mayor Faram asked Mr. Eggert to clarify what he was saying.
Mr.. Eggert stated what he was saying was that one or more
public offices could be handled in two ways, number one the
administrative and the other the judicial way and he wanted
to reserve the right to take it to a court of law later.
Mr. Eggert stated he would like to also make the council
aware and the City Attorney aware that he was putting the
persons names later on public notice. Mr. Eggert stated that
Mr. David Casey, Judge of Municipal Court, and Mrs. Bobbie
McCorkle, Court Clerk had both violated the law on the follow-
ing accountS: both had deprived the united states citizens of
their Constitutional rights. Both have deprived the Texas
citizens of their right granted "by the Constitution of the
State of Texas, and he would like to add that a violation of
'the constitution was very serious. Mr. Eggert stated both had
violated the Texas Rules of Criminal Procedures. Mr. Eggert
stated he had approximately twenty-five little cases and he had
picked out something that might interest everyone to show the
severity of this. Mr. Eggert stated that on september 2, 1982,
at 1:30 p.m., at regular Municipal Court setting he had entered
the Court because he was summoned to, he found out there was a
mixup on the court docket. ·Mr. Eggert stated the Court Clerk
walked up to him and advised him he was not on the docket.
Mr. Eggert stated he advised Mrs. McCorkle that he had a summons,
but he could see the police officer was not present and he
would motion the Court to dismiss his case. Mr. Eggert said
that Mrs. McCorkle changed the docket and called the officer in
with the Judge's consent.
Mayor Faram asked what had been violated, Mr. Eggert was on
the docket and every effort was made to hear your case.
Mr. Eggert stated the united States Constitution was violated.

did he want the case dismissed.
Mr. Eggert stated that at this point, certainly he wanted
the case dismissed.
Mayor Faram stated that because the officer was not present
did not prove his guilt or innocence and yet he wanted the
ticket dismissed.
Mr. Eggert stated that the guilt or innocence would come
later.
Mayor Faram stated they were making every effort to give
Mr. Eggert a fair hearing.
Mr. Eggert stated they were not, which he would prove.
Mr. Eggert stated that when he approached the bench he
asked for a court reporter, which he found out the court
did not have and he did not waive his right for jury.
Mr. Eggert stated the trial was set without jury, also
the City Attorney was not present. ~~. Eggert stated the
law books stated a judge could not be judge and attorney.
Mr. Eggert stated that was a violation of the law and he
was tried and sentenced. Mr. Eggert stated so many laws
had been violated it was unbelievable.
Mayor Faram stated he was going to take exception with
Mr. Eggert at this point, number one was that this Court
had operated the same way under the last two Municipal
Judges. Mayor Faram stated the City had chosen not to
have a prosecuting attorney present unless it was some
major case for the purpose being it was not a kangaroo
court. Mayor Faram stated it was his understanding
that any judge had the right to make interrogation.
Mayor Faram stated that Mr. Eggert was the very first
person in all of the years that had said it was a viola-
tion not to have a prosecutor present.
Mr. Eggert stated he had other things that would result
in the dismissal of Mr. Casey and Mrs. McCorkle.

Mayor Pro Tern Ramsey moved, seconded by Councilman Kenna, to
approve Ordinance No. 979.
Mayor Faram stated the City had been waiting on the tax
roll from Tarrant Appraisal to take action on the budget,
Mayor Faram stated that the City had received information
that the tax roll would probably be ready by the end of
October and the Council would be able to set a tax rate.
Mayor Faram asked that the City Staff exercise caution on
expenditures until the final figures from Tarrant Appraisal
District were received.
Mr. Line stated that he had advised the Department Heads to
use their discretion on purchases until the tax roll was
received.
Motion carried 5-0.
4. Mr. Line stated this item was placed on the agenda as
a precautionary measure. Mr. Line asked that this
item be deferred until the tax roll was received.

showed the Civil Service Secretary as reporting to
the·city Manager and it should show as reporting to
the Council. Mr. Line stated the correction would
be made on the chart.
Mayor Faram stated he would prefer a chart showing
each department and the classification and number of

Mr. Line stated that he agreed with Mayor Faram and
the chart would be changed accordingly.

to grant an appeal hearing on PZ 82-24, Byrd's Automotive.
Mayor Faram stated. he had been advised that the Appeal
Hearing could be held on November 8, 1982.
Councilman Hubbard amended his motion, seconded by
Mayor Pro Tern Ramsey, to state "grant the appeal hearing
on,PZ 82-24, to be held on November 8, 1982."
Amended motion carried 7-0.
8. Mr. Don Murphy, Lexus Investment, Dallas, appeared
befpre the council.

Mr. Murphy stated they were planning to build an apart-
ment complex and wanted to use fiberglass reinforced
cement on the exterior walls. Mr. Murphy stated the complex
would consist of 188 units and would be located at Glenview
Drive and King Arthur Circle. Mr. Murphy stated they
planned to do extensive landscaping, have brick driveways,
stained windows and brick retaining walls. Mr. Murphy
stated all of the units would have a view of the golf course.
Mr. Murphy stated that Dr. Kulag~ was interested in purchasing
part of the complex and was present to speak in his behalf.
Mr. Murphy introduced Mr. Bill Nicholes, Manufacturer of
the fiberglass reinforced cement, and advised the Council
that Mr. Nicholes was available to answer any questions
pertaining to the product.
Mayor Faram asked Mr. Nicholes to verify that the product
was equivalent to fire as brick.
Mr. Nicholes stated it has the same equivalence.
Councilman Fisher asked if the concrete panels would be
on the first floor only.
Mr. Nicholes stated the code permitted this type of covering
up to the ceiling line of the first floor.
Mayor Pro Tern Ramsey asked if the ordinance only required
brick up to the second story.

Mr. Howerton stated the request was to rezone Tract A,

Mr. Marion Massey, Attorney, appeared before the council
representing the applicant.
Mr. Massey stated that Mr. Gary Teague who was representing
the buyer of the property would assist him in making the
presentation.
Mr. Massey stated that on July 22, 1982 the Planning and
zoning Commission denied this request. Mr. Massey stated
th~ request had been presented to the Planning and zoning
Commission on two previous occasions and they had approved
it. Mr. Massey stated the Council had denied the request
on two previous occasions. Mr. Massey stated the subdivision
his client planned on developing would be compatible with
the existing buildings. Mr. Massey stated the development
would be a definite improvement for the overall
community. Mr. Massey stated they planned to bring the
sewer service from the north and it would be available to
the existing homes. Mr. Massey stated the main objection
from the present property owners in the area was the
condition of Eden Road and the added traffic. Mr. Massey
stated that the developer would be instrumental in getting
the road improved and the drainage. Mr. Massey stated the
County Commissioner had indicated the County would furnish
the equipment and the City would furnish the materials
for the improvement of the street and drainage. Mr. Massey
stated that the developer was willing to put up $10,000
for material for the work that was to be done.
Mr. .Massey stated another objection was the overcrowding
of the schools. Mr. Massey stated he had been in contact
with the superintendent of the School District and he had
advised him that at such time it was warranted a school
would be built in the area; the land had already been
dedicated.

Mr. Massey stated that at the time the case was presented
to the Planning and zoning Commission a petition was
presented against the request that had ten signatures
out of the twenty-two property owners that were notified.

property adjacent to this tract of land and if this

Councilman Hubbard asked Mr. Massey if the developer

made any comments on the development of his property.
Mr. Teague stated that Mr. Barfield was pursuing his plans
and would work in conjunction with the developers of the
pr9perty in question.
Mayor Pro Tem Ramsey asked how far the sewer line would
be taken and how it would benefit the present property
owners.

Mr. Teague stated the sewer would be brought from Little
Bear Creek and extend to the most westerly property line,
it would be approximately 1/2 mile closer to the present
property owners.
Councilman Davis asked if Mr. Barfield owned the property
all the way to Precinct Line Road.
Mr. Teague stated there were approximately 300 feet between
Mr. Barfield and Precinct Line Road that he did not own.
Councilman Davis stated that even if Mr. Barfield developed
his property there would still be 300 feet of property
between his property and Precinct Line Road.
Councilman Kenna stated the City needed some assurances
that the stubbed out street in the proposed development
did not go through to the Barfield property until a
street could be cut through to Precinct Line Road.
Mr. Massey stated they would do whatever the City wanted.
Councilman Kenna asked if the City had a comment from
the County on the improvements.
Mr. Riddle stated yes, all that was needed was the
~ easements for the drainage.

easements.
Mr. Riddle replied the developer.

Mr. Billy Wallace, 7401 Eden Road, appeared before
the council.
Mr. Wallace stated he was speaking for the homeowners
around him and up and down Eden Road. Mr. Wallace stated
the property owners still wanted 1,800 square foot homes
and 12,000 foot lots.

Mr. Wallace stated he felt that if the houses and lots
were smaller it would devalue his property. Mr. Wallace
stated there were seventeen houses in the area over 1,800
square feet and five with 1,300 square feet that had
been there for years. Mr. Wallace stated the Planning
and zoning commission denied this request because of the
condition of the street.
Mr. Wallace stated he had a contractor friend give him
an estimate on fixing the road and it would cost approxi-
mately $67,000.
Mr. Wallace stated that he had talked to the property owner
that owned the 300 foot strip next to Mr. Barfield and
was advised he was holding on to the strip of land for
commercial.
Mr. Wallace stated the houses that were there now had
sewer, septic tanks, and they were adequate.
Mr. Wallace stated that if the City wanted to help the
people in the area, fix Eden Road first then let the
property be developed.
Mayor Faram asked Mr. Wallace if the $67,000 was for
curb, gutter and drainage.

access, sewer, drainage, streets, bridges and funding.
Councilman Hubbard stated that according to the Planning
and Zoning minutes of July 22nd, Mr. Wallace had stated
th~t if the houses were brought up to a larger square
footage, they would not complain.
Mr. Wallace stated he would not have any objections
to the development as long as the houses were around
1,800 square feet and something was done to the street.
Mayor Pro Tem Ramsey stated that Mr. Wallace had referred
several times that he wanted the council's help. Mayor
Pro Tern Ramsey stated he had taken it upon himself and
contacted Mr. Goins and asked him to get in touch with the
neighbors so they could set down with the developer
and iron out some of the problems. Mayor Pro Tern
Ramsey stated he got word back that the neighbors had
rather deal with this in the form of the Council. Mayor
Pro Tern Ramsey stated it was difficult to work out these
type of problems in this type of form. Mayor Pro Tem
Ramsey stated the City had tried to- help because they
wanted the issue resolved.
Mr. ,Wallace stated no one had contacted him about
setting down and discussing it. Mr. Wallace stated the
homeowners and the Council had discussed it for the last
eighteen months and had not agreed on how to settle the
matter.
Mayor Pro Tern Ramsey stated that every time they thought
things were about settled, a new item came up. Mayor
Pro Tern Ramsey stated the problem with the road always
came up.
Mr. Wallace stated the road was still one of the problems.

Mr. Wallace stated he still wanted larger houses, why
ßhould he cause his house to deteriorate in price in
order for someone else to make a gain.
Mayor Faram asked Mr. Wallace if he would agree that
to build all 1,800 square foot homes adjacent to the
existing smaller homes would devalue them.
Mr. Wallace stated the houses on the west side of
Eden Road were larger than the ones on the east sideo
Mayor Faram stated that in the proposed development
the first lots in the subdivision would be 1,800 square
feet, the second 1,700 square feet and the third 1,500
square feet; if the existing homes with less square
footage did not devalue Mr. Wallace's property, did
he still feel the development would devalue his
property.
Mr. Wallace replied yes.

Mrs. Jean Wollenschlager, 7308 Eden Road, appeared before
the Council.
Mrs. Wollenschlager stated that there were only ten names
on the petition because five of the neighbors were on
vacation. Mrs. Wollenschlager stated that Birdville School
District did not have the money in hand to build another
school. Mrs. Wollenschlager stated that if this development
was approved the City was asking the present property
o~ers to put up with extra traffic.
Dr. Raymond Pankey, 7405 Eden Road, appeared before the
Council.
Dr.. Pankey stated that if the road was fixed and sewer ..
brought in, he would not object to the development.
Mayor Faram advised Mr. Pankey that the sewer would not
be put in at City expense.

Dr. Pankey stated he realized this, but the sewer would
be closer to the existing residents.
Mr. R. T. Koonce, 7244 Eden Road, appeared before the
Council.
Mr. Koonce stated he would not object to the size of
the houses if the lots were larger.
There being no one else wishing to speak, Mayor Faram
closed the public hearing.
12. Mayor Faram advised the Council this was an Appeal
Hearing and would require three-fourths vote of the
Coun'cil.
Councilman Hubbard moved, seconded by Councilman
Kenna, to approve PZ 82-20, Ordinance No. 983.

Councilman Kenna stated he personally felt the improve-
ment of Eden Road would be an asset to the community
and that the street should be started before the develop-
ment. Councilman Kenna stated that at the time the plat
was approved the City needed to make sure the stubbed
out street did not go through to the adjacent property
until a street could be put through to Precinct Line
Road. Councilman Kenna stated he also felt the size of
the homes were adequate.

the city taxes would be reduced from $0.69 to $0.60 per
100% valuation.

Hills and a retired school teacher and administrator.

"Ladies and gentlemen, let me first express my appreciation
and thanks for your permission to allow us to appear before
this council to present our petition to you at this time.
We are here as members and officers of the Tarrant county
Senior Alliance, an organization registered as a non-profit,
non-partisian and non-sectarian organization functioning
primarily to aid and assist Senior Citizens of Tarrant
county in many phases and needs' of their lives.

People, who are over 65 years of age and older, and own
their homes here in Tarrant County and in North Richland
Hills are confronted with the possibility of having to
pay increased homestead taxes in the future, due to the
recent re-evaluation of their homes by the Tarrant Appraisal
District.
While some older citizens are well off financially, the
large portion of citizens over 65 are dependent mainly on
Social Security or other limited retirement annuity for
their livelihood. Including the recent cost-of-living and
adjustment, the average SS retired worker receives $406.00
per month and the average for an elderly couple is $695.
According to a study by the National council on Aging 75%
or all persons 65 and over depend on Social Security or other
pensions. A study by a Texas Senate Committee concluded
that the income level of persons 65 and over in Texas is
about half that of those 65 and under. Certainly these
figures indicate that most older citizens have no margin
for increased taxes, utilities, medical costs, etc. When
these go up, some necessities such as food, clothing, and
other items must be cut.

The Texas Constitution and laws recognize that older citizens
who have paid full taxes during their working years, in fairness
and equity, are entitled to relief from taxation on their

living on fixed incomes near or below the national poverty level.
Unlike most other states, in Texas, a person's homestead is
cherished and protected, especially in his retirement years.
We recognize and appreqi~te the $12,730 ho~este~d exemptio~
granted by North Richland Hills, which has' given a substantial
measure of tax relief until the recent Peveto legislation and
Constitutional amendment approved by the voters, it was
recognized that additional adjustments might be necessary to
avoid hardships.

Many citizens in Richland Hills, North Richland Hills, Haltom
City, and other nearby towns in Tarrant County, have received
their tax appraisals and have found that their property has
been appraised at a much higher rate than before, therefore,
we are asking that you consider an exemption for the Senior
Citizens of North Richland Hills be increased in proportion to
percent of increase in the value of their property. As an
example, Fort Worth, has increased their exemption from $18,000
to $23,091, a 27!%, Arlington from $15,000 to $25,000 and~Tarrant
County from $23,000 to $40,000. Last Monday evening we asked
Richland Hills City Council to consider at least a 15% increase
in exemptions for'homestead taxes for their Senior Citizens.
We believe ~ost City Councils in Tarrant County can also match
these requests.

Thank you again for g~v~ng us a few minutes of your time, and,
one more thought, if you find an increase impossible for this
year, we would appreciate your consideration on this matter
next year when you present your tax rate to Tarrant Appraisal
District in 1982. Any question you may have we will try to
give you our best answer.
Mayor Pro Tern Ramsey stated that Tarrant Appraisal District had
added to all property in the Birdville School District, which
included North Richland Hills, 15% even though it was all ready
at a market value of 70%. Mayor Pro Tern Ramsey stated several
endeavored with the City of Hurst and went to the Tarrant
Appraisal District Review Board and it was not final yet, but
they agreed to roll back the appraised values 10% of the present
value shown. Mayor Pro Tern Ramsey stated the value shown would
be 10% less. Mayor Pro Tern Ramsey stated that hopefully later
this month, with the action just taken on establishing the tax
rate, there would be an 8% to 15% reduction in the tax rate.
Mr. Blanton asked if consideration was for all homes or just
Senior Citizens.
Mayor Pro Tern Ramsey stated it would include all homes.

Mr. Blanton stated their main concern was with houses
occupied by people over 65 years of age.

Mr. Line stated that the budget had already been passed for

Citizens, but was more burden going to be put on the young
people to protect the Senior Citizen.
Mr. Blanton stated he really could not answer that question.
Councilman Kenna stated the City was already committed this
year, but felt a close look should be taken at what was
provided for the elderly citizens as compared to the neighboring
cities.
Mayor Faram stated that he felt that some kind of equity had
to be found for the young people also.

Social Security Coverage for City Employees

BACKGROUND:
In 1980, notice was given to the Social Security Administration that
the City employees of North Richland Hills intended to opt out of the Social Security
system, based on the results of an employee vote to that effect. The required two-
year waiting period will expire January 1, 1983. Accordinqly, another survey has been

People, who are 65 years of age and older, and own their hones here
in Tarrant Co~nty and in North Richland Hills are confronted with
the possibilit:r of havinc3 to pay increased hOlestead taxes ':"n the
future, due to the recent re-evaluation of their homes by the Tarrant
Appraisal District. -
Wile some older citizens are well off financially, ~he large portion
of citizens over 65 are dependent mainly on Social Security or other
limited retirement annuity for their livelihood. Including the recent
90st-of-living adjustment, the average SS retired worker. receives
$406 per month and the average for an elderly couple is ~695. According
to a study by the National Council on Aging 75% :)f all persons 65 and
over depend on Social Security or other pensions. A study by a Texas .~.
Senate Committee concluded that the income le.vel ¿;f persons 65 w.nd !~1i:::t
in Texas is about half that of those DS and ~~~. ~Certainly these
figures indicate that most older citizens hawe no margin ~or increased
taxes, utilities, medical costs etc. When these 30 up, some necessities
such as food, clo~hing, and other items must be cut.
The Texas Constitution and laws recognize that alder citizens who have
paid full taxes during their ·"lOrkil~ years, in fairness and eq'..Üt;:r, are
entitled to relief from taxation on their homesteads in their retirement
years ~ben most of them are living on fixed limited inc~mes near or
below the national poverty level. Unlike many other states, ~n Texas
a person's homestead is cherished and protected, eSf.ecially in his
retirement years. We recognize and appreciate the ~12,730 homestead
exemption granted by North Richland Hills, which has given a substanti~
~easure of tax relief until the recent appraisals by the Tarrant
ApDraisal District. In enacting the Peveto legislation and Constitution-
al amendment approved by the voters, it was reco~nized that additional
adjustments might be necessary to avoid hardships.
Many citizens in Hichland Hills, North Hichland ~ills, Halt~m City,
and other near-bY tDvlns in Tarrant CJJ.nt~¡, have recei,red ::beir Tax
appraisals and have found that their property has been appraised at
a much higher rate than before, therefore, we are askin; that you

Two years have passed since we surveyed our employees on their de~ires to remain
in or withdra~ from Social Security. We are currently scheduled to withdraw on
January I, 1983. We would like to once again ask your opinion if we should with-
draw as scheduled on January I, 1983.
As a matter of information, your contribution and the City's contribution was 6.13
percent in 1980. It is currently 6.70 percent and if you elect to stay in Social
Security it will increase by an unknown amount on January 1, 1983. It is possible
that if Social Security is discontinued, it may not be replaced by any other plan.
This will result in a saving of 6.7 percent for you and 6.7 percent for the ~ity.

This property is located east of Eden
Road, approximately 1900 feet north of
Amundson Road with portions fronting
on Eden Road.
Marian Massey, Attorney, came forward to
represent Elmer and Lowell Allison and
with him was Mr. Gary Teague with Teague
Nall & Perkins to represent the purchaser
of the property, Aubrey Brothers.
Mr. Massey said they had been before the
Commission at least two times and their
requests were approved by the Commission.

Mr. Massey showed a drawing of the exist-
ing houses and their square footage and
compared them to the request they were
asking for. He said this IF-12-1800
zoning request would be compatible to
these houses. Mr. Massey said there were
two houses that were about 1100 sq. ft.,
another one showed 1600 sq. ft., another
1285 sq. ft., and the largest being 2002
sq. ft. He said they would have a buffer
zone of IF-9-1700 which would be divided
into 10 or 11 lots and then the remainder
would be IF-9-1500 sq. ft.
Mr. Massey said this development will
bring the sewer up to where it would be
available to the local residents. He said
he understands the city paid an enormous
amount for the TRA sewer and only has 26
customers on that line.
Mr. Massey said these 56 homes would help

the problem is the west side.
Mr. Wallace said this development would
create an additional 100 cars a day on
Eden Road. He showed pictures of the
road's condition as it is now. Mr.
Wallace said his son just broke an A-Frame
driving on Eden Road. He said all they
ever get is a little chat thrown in the
holes.
Mr. Wallace said if they approve this
request~ they will also be agreeing to
accept Mr. Barfield's addition.
Mr. Wallace said this zoning request has
been denied by the City Council twice,
previously.
Mr. Wallace said the city says they have
no plans to extend the sewer and they have
no future plans for Eden Road. He said
they are having a hard time with the road
now. He ~~id it needs major improvements
now.
Mr. Wallace said if they would get the
houses up to a larger square footage, they
would not complain. He said most of his
neighbors are on vacation and could not
attend this meeting.
Mr. Tucker said there had been a petition
submitted with 10 of the 22 property owners
names.

SUBJECT: Request of Elmer Allison for Zoning-PZ 82-20
The status of Eden Road is as follows:
The County is now doing engineering work on this street. The
improvements will involve raising the road bed, digging bar
ditches, putting in driveway drain pipe, raising the driveways,
crossing the road with new storm drains and replacing the
asphalt surface.
I had planned to resurface Rumfield and Eden, but it is obvious
we do not have the money to do both. I estimate the Eden Road
project to cost $22,000 to $24,000. We have $12,000 for the
project so we will have to cut back on the amount of work we do.
If the zoning is approved for Elmer Allison, they have agreed
to escrow money for their frontage on Eden Road. This would
give us another $10,000 to $12,000 and we could probably complete
the street work as it should be done. In either case, we will
be doing work on Eden Road in the next month or so. We also need
a temporary drainage easement across Mr. Allison's property so
that we might drain the water to the east f~om Eden Road.

Attachment 1 is the calculated 1982 total taxable value o~ all proper~y ($621,889,157)
after adjusting for the Appraisal Review Board's (TAD) announced "intent to roll back
i~s valuations on single family residences in the Birdvil1e I.S.D. Attachment I-A
contains the calculations needed to determine the ~ffect of a ten.percent.rQ11 back off
all single family homes in North Richland Hills. Attachment l-B is the calculations
needed to arrive at an additional 15 percent reduction in valuations off 1981 new sinq1e
family homes. 'Attachment l-C is the calculations used to arrive at thè 1982 adiusted
new construction figure" taking into account the 10% and 15% reductions. Attachment 2

AN ORDINANCE PROVIDING FOR THE LEVY AND COLLECTION OF AN AD VALOREM
TAX ON PROPERTY SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, ON THE FIRST DAY OF JANUARY, 1982, EXCEPT
SUCH PROPERTY AS MAY BE EXEMPT FROM TAXATION BY THE CONSTITUTION AND
THE STATUTES OF THE STATE OF TEXAS, ESTABLISHING A DELINQUENT DATE;
AND SETTING THE RATE OF PENALTY AND INTEREST AND PRESCRIBING ATTORNEY'S
FEES TO BE COLLECTED ON DELINQUENT TAXES; DECLARING A FIRST AND PRIOR
AND SUPERIOR LIEN ON ALL REAL PERSONAL PROPERTY AS OF JANUARY 1ST,
1982, TO SECURE PAYMENT; ORDAINING OTHER MATTERS RELATING TO THE SUB-
JECT AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS,
TEXAS:
1.
That there is hereby levied and shall be collected as provided by law an
ad valorem tax for the year 1982 on all property, real and personal, except such
property as may be exempt from taxation by the Constitution and the statutes of the
State of Texas, situated within the corporate limits of the City of· North Richland
Hills, Texas, on January 1, 1982, and that the amount to be applied to the value of
such property shall be $0.60 per $100.00 valuation.
2.
That the tax so levied and assessed shall be apportioned to the following
accounts and funds in the amount set forth:
General Fund:
Debt Service Fund:

$0.22
Collections of taxes levied shall be deposited to the credit of each of the above
accounts and funds in their proportionate share of the total levy and after taking
into consideration a three percent (3%) uncollectable factor which is to be accounted
for in the General Fund.
3.
That the taxes provided for herein are in accordance with the appropriate
State statutes.
4.
Ad valorem taxes levied by this Ordinance shall be due and payable on
October 1, 1982, and shall become delinquent on the first day of February, 1983.
Payment of such tax is due in one full installment.

If the tax is unpaid after February 1, 1983, such tax will become delinquent
and penalty and interest will attach and accrue as provided by the statutes of the
state of Texas including Articles l060a and 7336, V.A.T.·C.S.
6.
In the event the taxes become delinquent and in the event such delinquent
taxes are referred to an attorney for collection, an additional amount of t!~Jç-t~t 15'~o
percent (20%) of the total amount of tax, penalty and interest then due shall be
added as collection costs and paid by the taxpayer.
7.
Taxes herein levied and uncollected shall be a first, prior and superior lien
against the property, and the said lien shall be superior and prior to all other liens,
charges, and encumbrances, and such lien shall attach to personal property with the
same p~iority as to real property.
8.
The lien provided herein shall be attached as of January 1, 1982.
9.
Should any section, prOV~S10n or clause of this Ordinance be declared by a
court of competent jurisdiction to be invalid, the same shall not affect the validity
of this Ordinance as a whole or any part thereof other than the part so declared to
be invalid.
10.
This Ordinance shall become effective from and after the date of its approval
and adoption as provided by law.
PASSED AND APPROVED by the City Council of the City of North Richland Hills,
Texas, upon first and final reading, at a special meeting on the 30th day of September,
1982.

Enclosed is the· final priority list for the ClP. The changes are as
follows: Redondo, Lola and' R~veria have been changed to an asphalt' ·overlay.
Morgan Meadows west drainage has be~n changed from unfin~nced ~eeds ·to priority
two (2). If we obtain the easements for this project, it will then become priority 1.
The reason being it opens up the northwest corner of the'c,ity fdr development.
Bridle Path and Mesa Verde have been removed from the program because this area
is subject to replatting and the street configuration could change. Two streets
that need attention have been added. They are Vance Rd. from Corona to Shauna
and Holiday Lane from ~iveria to Loop 820.

Two drainage projects have been deleted. They a~e found on pages 22 and 23 of the
elP book and identified as Big Foss~l Watershed. These projects are not needed, and
~ONE
as ~ matt~r of fact cannot~e identified on the ground.

of the existing 6-inch cast·-iron water line in Dawn Drive with a new
6-;nch PVC water line along with a11 appurtenances required. Upon
'uncovery and inspection of ~he existing cast iron water line in Dawn
Drive, the Public Works Department Staff has determined that the existing
line is in such a state of deterioration that it should be replaced to
avoid future leaks under ~he proposed new pavement.

BACKGROUND: The 1982-83 adopted budget includes a $25,OOO-allocation for a management

study of the Public Works Department, the primary objectives of which are as follows:
·1. Establish standards for frequency and qµality .of various
Public Works activities, including street repair, ditch cleaning
and mowing, water and sewer main maintenance and cleaning, etc.
2. Establish optimum crew sizes· and .equipment requirements .fQr various
functions and activities.

The next step in selecting a firm to perform the required services
would be to call in for an interview representatives of the two best qualified
firms to give a basis for making the final selection. Before these firms are
asked to commit the time and expense involved in travel to North Richland Hills
for an interview, it is requested that the City Council determine, in view of the
higher than an~icipated cost of the study, whether or not this matter should be
pursued. It is believed that despite the higher cost, this would be a prudent
investment in improved productivity and efficiency of Public Works Department
operations.
