Councilman Hubbard moved, seconded by Councilwoman Hinkle, CONSIDERATION OF to approve the minutes of September 27, 1982. MINUTES OF THE REGULAR MEETING Mayor Pro Tem Ramsey stated that Councilman Newman was SEPTEMBER 27, 1982 present, but was not listed on the roll call. APPROVED AS CORRECTED Motion to approve as corrected carried 6-0; Councilman Fisher abstaining due to absence from the meeting. 5. Councilman Kenna moved, seconded by Mayor Pro Tem Ramsey, CONSIDERATION OF to approve the minutes of the Special meeting September 30, 1982. MINUTES OF THE SPECIAL MEETING Motion carried 5-0; Councilmen Hubbard and Fisher abstaining SEPTEMBER 30, 1982 due to absence from the meeting. APPROVED October 11, 1982 Page 2 6. Mayor Faram, on behalf of the City, presented Thomas Gaylor PRESENTATION OF FIVE with a five year certificate and service pin for five YEAR CERTIFICATE AND years of service with the City. SERVICE PIN TO THOMAS E. GAYLOR OF THE POLICE DEPARTMEN' 7. Councilman Hubbard moved, seconded by Mayor Pro Tem Ramsey, CONSIDERATION OF to grant an appeal hearing on PZ 82-24, Byrd's Automotive. GRANTING AN APPEAL HEARING ON PZ 82-24, Mayor Faram stated he had been advised that the Appeal BYRD'S AUTOMOTIVE Hearing could be held on November 8, 1982. GRANTED Councilman Hubbard amended his motion, seconded by Mayor Pro Tem Ramsey, to state "grant the appeal hearing on PZ 82-24, to be held on November 8, 1982." Amended motion carried 7-0. 8. Mr. Don Murphy, Lexus Investment, Dallas, appeared CONSIDERATION OF before the Council. REQUEST OF LEXUS INVESTMENT/DEVELOP- Mr. Murphy stated they were planning to build an apart- MENT FOR VARIANCE ment complex and wanted to use fiberglass reinforced FROM THE BRICK cement on the exterior walls. Mr. Murphy stated the complex ORDINANCE - MR. DON would consist of 188 units and would be located at Glenview MURPHY Drive and King Arthur Circle. Mr. Murphy stated they DENIED planned to do extensive landscaping, have brick driveways, stained windows and brick retaining walls. Mr. Murphy stated all of the units would have a view of the golf course. Mr. Murphy stated that Dr. Kulagawas interested in purchasing part of the complex and was present to speak in his behalf. Mr. Murphy introduced Mr. Bill Nicholes, Manufacturer of the fiberglass reinforced cement, and advised the Council that Mr. Nicholes was available to answer any questions pertaining to the product. Mayor Faram asked Mr. Nicholes to verify that the product was equivalent to fire as brick. Mr. Nicholes stated it has the same equivalence. Councilman Fisher asked if the concrete panels would be on the first floor only. Mr. Nicholes stated the code permitted this type of covering up to the ceiling line of the first floor. Mayor Pro Tem Ramsey asked if the ordinance only required brick up to the second story. October 11, 1982 Page 3 Mr. Riddle stated that was correct; the ordinance was changed in 1976 or 1977. Councilman Davis asked Mr. Nicholes if the concrete panels would cover all four sides. Mr. Nicholes stated they would be on all four sides. Councilman Davis asked what the cost difference was on brick and the concrete panels. Mr. Nicholes stated the cost was the same on both. Councilman Davis asked why they wanted to use the concrete panels instead of brick. Mr. Nicholes stated because the panels would allow more flexibility in design. Councilman Kenna asked if each unit would be sold. Mr. Murphy stated the units would be sold to investors. Councilwoman Hinkle asked how large the apartments would be. Mr. Nicholes stated each unit would have 800 square feet. Councilman Hubbard moved, seconded by Mayor Pro Tem Ramsey, to deny the request of Lexus Investment for a variance to the Brick Ordinance. Motion carried 6-1; Councilmen Kenna, Hubbard, Fisher, Ramsey and Newman and Councilwoman Hinkle voting for; Councilman Davis voting against. 9. Mayor Faram opened the public hearing on PZ 82-22 and PLANNING & ZONING called for anyone wishing to speak in favor of this request PUBLIC HEARING to please come forward. PZ 82-22, REQUEST 01 HERMAN SMITH, STONY- Mr. Loren Howerton appeared before the Council BROOKE, INCORPORATE! representing the applicant. Mayor Faram opened the public hearing and called for PLANNING & ZONING anyone wishing to speak in favor of this request to PUBLIC HEARING please come forward. PZ 82-20, REQUEST Of ELMER ALLISON TO Mr. Marion Massey, Attorney, appeared before the Council REZONE TRACT 3A, representing the applicant. ABSTRACT 1150, DAVID MOSES SURVEY Mr. Massey stated that Mr. Gary Teague who was representing FROM AGRICULTURE TO the buyer of the property would assist him in making the 1F-12-1800, 1F-9-17( presentation. Mr. Massey stated the Council had denied the request on two previous occasions. Mr. Massey stated the subdivision his client planned on developing would be compatible with the existing buildings. Mr. Massey stated the development would be a definite improvement for the overall community. Mr. Massey stated they planned to bring the sewer service from the north and it would be available to the existing homes. Mr. Massey stated the main objection from the present property owners rn the area was the condition of Eden Road and the added traffic. Mr. Massey stated that the developer would be instrumental in getting the road improved and the drainage. Mr. Massey stated the County Commissioner had indicated the County would furnish the equipment and the City would furnish the materials for the improvement of the street and drainage. Mr. Massey stated that the developer was willing to put up $10,000 for material for the work that was to be done. Mr. Massey stated another objection was the overcrowding of the schools. Mr. Massey stated he had been in contact with the superintendent of the School District and he had advised him that at such time it was warranted a school would be built in the area; the land had already been dedicated. Mr. Massey stated that at the time the case was presented to the Planning and Zoning Commission a petition was presented against the request that had ten signatures out of the twenty-two property owners that were notified. October 11, 1982 Page 5 Mr. Massey stated he had been in contact with Doug Long, Engineer for Mr. John Barfield who owned the property adjacent to this tract of land and if this request before the Council tonight was approved they intended to open a thoroughfare to Precinct Line Road. Mr. Massey stated that at the present time Mr. Barfield's property was landlocked. Councilman Hubbard asked Mr. Massey if the developer was willing to put $10,000 to $12,000 up front for the road improvements. Mr. Massey stated yes. Councilman Hubbard asked Mr. Massey if Mr. Barfield had made any comments on the development of his property. Mr. Teague stated that Mr. Barfield was pursuing his plans and would work in conjunction with the developers of the property in question. Mayor Pro Tern Ramsey asked how far the sewer line would be taken and how it would benefit the present property owners. Mr. Teague stated the sewer would be brought from Little Bear Creek and extend to the most westerly property line, it would be approximately 1/2 mile closer to the present property owners. Councilman Davis asked if Mr. Barfield owned the property all the way to Precinct Line Road. Mr. Teague stated there were approximately 300 feet between Mr. Barfield and Precinct Line Road that he did not own. Councilman Davis stated that even if Mr. Barfield developed his property there would still be 300 feet of property between his property and Precinct Line Road. Councilman Kenna stated the City needed some assurances that the stubbed out street in the proposed development did not go through to the Barfield property until a street could be cut through to Precinct Line Road. Mr. Massey stated they would do whatever the City wanted. Councilman Kenna asked if the City had a comment from the County on the improvements. Mr. Riddle stated yes, all that was needed was the easements for the drainage. October 11, 1982 Page 6 Councilman Kenna asked who needed to dedicate the easements. Mr. Riddle replied the developer. Mr. McEntire asked Mr. Teague if the developer would dedicate the easements. Mr. Teague stated they would dedicate the easements. Councilman Kenna asked if the street could be finished before the development was finished. Mr. Riddle stated the street could be finished except for the surface. Mayor Faram called for anyone wishing to speak in opposition to this request. Mr. Billy Wallace, 7401 Eden Road, appeared before the Council. Mr. Wallace stated he was speaking for the homeowners around him and up and down Eden Road. Mr. Wallace stated the property owners still wanted 1,800 square foot homes and 12,000 foot lots. Mr. Wallace stated he felt that if the houses and lots were smaller it would devalue his property. Mr. Wallace stated there were seventeen houses in the area over 1,800 square feet and five with 1,300 square feet that had been there for years. Mr. Wallace stated the Planning and Zoning Commission denied this request because of the condition of the street. Mr. Wallace stated he had a contractor friend give him an estimate on fixing the road and it would cost approxi- mately $67,000. Mr. Wallace stated that he had talked to the property owner that owned the 300 foot strip next to Mr. Barfield and was advised he was holding on to the strip of land for commercial. Mr. Wallace stated the houses that were there now had sewer, septic tanks, and they were adequate. Mr. Wallace stated that if the City wanted to help the people in the area, fix Eden Road first then let the property be developed. Mayor Faram asked Mr. Wallace if the $67,000 was for curb, gutter and drainage. October 11, 1982 Page 7 Mr. Wallace stated it included putting in new base, surfacing and headwalls. Mayor Faram asked Mr. Wallace if that figure included using county labor. Mr. Wallace stated no, it was just an estimate on what it would cost to fix the road right. Mayor Faram asked Mr. Wallace if the street was fixed like he was talking about, would there still be objections from the neighbors. Mr. Wallace stated he would still want the homes to be 1,800 square feet and the street fixed properly. Councilman Hubbard stated that Mr. Wallace mentioned access, sewer, drainage, streets, bridges and funding. Councilman Hubbard stated that according to the Planning and Zoning minutes of July 22nd, Mr. Wallace had stated that if the houses were brought up to a larger square footage, they would not complain. Mr. Wallace stated he would not have any objections to the development as long as the houses were around 1,800 square feet and something was done to the street. Mayor Pro Tem Ramsey stated that Mr. Wallace had referred several times that he wanted the Council's help. Mayor Pro Tem Ramsey stated he had taken it upon himself and contacted Mr. Goins and asked him to get in touch with the neighbors so they could set down with the developer and iron out some of the problems. Mayor Pro Tem Ramsey stated he got word back that the neighbors had rather deal with this in the form of the Council. Mayor Pro Tem Ramsey stated it was difficult to work out these type of problems in this type of form. Mayor Pro Tem Ramsey stated the City had tried to help because they wanted the issue resolved. Mr. Wallace stated no one had contacted him about setting down and discussing it. Mr. Wallace stated the homeowners and the Council had discussed it for the last eighteen months and had not agreed on how to settle the matter. Mayor Pro Tem Ramsey stated that everytime they thought things were about settled, a new item came up. Mayor Pro Tem Ramsey stated the problem with the road always came up. Mr. Wallace stated the road was still one of the problems. October 11, 1982 Page 8 Mayor Pro Tem Ramsey stated the City felt they had the road problem resolved and the homeowners still wanted 1,800 square foot houses. Councilwoman Hinkle asked what was to be done to Eden Road and when. Mr. Riddle stated the roadbed would be rebuilt, the culverts extended and the road resurfaced. Mr. Riddle stated the easements would have to be obtained first. Councilwoman Hinkle asked if the City was unable to get the easements. Mr. Riddle stated the developer had agreed to let the City have the easements. Councilwoman Hinkle asked if the City was ready to start work on the road. Mr. Riddle replied yes. Councilman Davis asked Mr. Riddle if the construction would get the water to drain to the east. Mr. Riddle replied yes. Councilman Davis asked Mr. Wallace if he would object to the development if construction was not started until the road was built. Mr. Wallace stated he still wanted larger houses, why should he cause his house to deteriorate in price in order for someone else to make a gain. Mayor Faram asked Mr. Wallace if he would agree that to build all 1,800 square foot homes adjacent to the existing smaller homes would devalue them. Mr. Wallace stated the houses on the west side of Eden Road were larger than the ones on the east side. Mayor Faram stated that in the proposed development the first lots in the subdivision would be 1,800 square feet, the second 1,700 square feet and the third 1,500 square feet; if the existing homes with less square footage did not devalue Mr. Wallace's property, did he still feel the development would devalue his property. Mr. Wallace replied yes. October 11, 1982 Page 9 Mayor Faram called a five minute recess. RECESS Mayor Faram called the meeting back to order. The same BACK TO ORDER Council members and Staff were present as recorded at the beginning of the meeting. Mrs. Jean Wollenschlager, 7308 Eden Road, appeared before the Council. Mrs. Wollenschlager stated that there were only ten names on the petition because five of the neighbors were on vacation. Mrs. Wollenschlager stated that Birdville School District did not have the money in hand to build another school. Mrs. Wollenschlager stated that if this development was approved the City was asking the present property owners to put up with extra traffic. Dr. Raymond Pankey, 7405 Eden Road, appeared before the Council. Dr. Pankey stated that If the road was fixed and sewer brought in, he would not object to the development. Mayor Faram advised Mr. Pankey that the sewer would not be put in at City expense. Dr. Pankey stated he realized this, but the sewer would be closer to the existing residents. Mr. R. T. Koonce, 7244 Eden Road, appeared before the Council. Mr. Koonce stated he would not object to the size of the houses if the lots were larger. There being no one else wishing to speak, Mayor Faram closed the public hearing. 12. Mayor Faram advised the Council this was an Appeal CONSIDERATION OF Hearing and would require three-fourths vote of the ORDINANCE FOR Council. PZ 82-20 APPROVED Councilman Hubbard moved, seconded by Councilman ORDINANCE NO. 983 Kenna, to approve PZ 82-20, Ordinance No. 983. Councilman Kenna stated he personally felt the improve- ment of Eden Road would be an asset to the community and that the street should be started before the develop- ment. Councilman Kenna stated that at the time the plat was approved the City needed to make sure the stubbed out street did not go through to the adjacent property until a street could be put through to Precinct Line Road. Councilman Kenna stated he also felt the size of the homes were adequate. October 11, 1982 Page 10 Mayor Pro Tem Ramsey called for the question. Motion to approve carried 7-0. 13. Mr. Line stated a correction needed to be made in the CONSIDERATION OF Ordinance on page two, Section 6, the collection per- ORDINANCE NO. 980 centage should be 15% and not 20%. PROVIDING FOR THE LEVY AND COLLECTION Mr. Line stated the tax proposal was based on the OF AD VALOREM TAX Tarrant Appraisal District tax roll. Mr. Line stated WITHIN THE CITY OF Tarrant Appraisal intended to reduce the rate 10% NORTH RICHLAND HILL on single family homes. Mr. Line stated it was projected TEXAS, ON THE 1ST that the tax roll would be $621,889,157. Mr. Line stated DAY OF JANUARY, 198 the city taxes would be reduced from $0.69 to $0.60 per APPROVED 100% valuation. Councilman Hubbard moved, seconded by Councilwoman Hinkle, to approve Ordinance No. 980. Motion carried 6-1; Councilmen Kenna, Fisher, Hubbard, Ramsey and Newman and Councilwoman Hinkle, voting for; Councilman Davis voting against. 14. Mr. Line stated this bid was to replace the outdated CONSIDERATION OF two-way radios in the Police Department. Mr. Line stated AWARDING BID FOR it was recommended that the low bid for the ten hand- PORTABLE AND MOBILE held radios and chargers be awarded to General Electric RADIOS - POLICE for $9,231.00 and the bid of Motorola in the amount of DEPARTMENT $9,020.00 for the mobile radios. Councilman Hubbard moved, seconded by Councilman Kenna, to award the bid for the hand-held radios and chargers to General Electric and Motorola for the mobile radios, total amount of $18,251.00. Motion carried 7-0. 15. Mr. Line stated this bid would replace the outdated CONSIDERATION OF base station in the Police Department. AWARDING BID FOR COMPLETE RADIO Councilman Hubbard moved, seconded by Councilwoman COMMUNICATIONS Hinkle, to award the bid to Com Center Corporation CONSOLE - POLICE in the amount of $12,610.00. DEPARTMENT APPROVED Motion carried 7-0. 16. Mr. Line stated the Capital Improvement Program CONSIDERATION OF was submitted to the Council in July and there had ADOPTION OF CAPITAL been several discussions since that time and some IMPROVEMENT PROJECTE changes had been recommended. Mr. Line stated the APPROVED recommendation was for the Council to approve the Program as revised. October 11, 1982 Page 11 Councilman Ramsey moved, seconded by Councilman Kenna, to approve the Capital Improvement Projects as revised. Motion carried 7-0. 17. Mayor Faram advised the Council this Change Order was CONSIDERATION OF to replace a water line in Dawn Drive. CHANGE ORDER #2, DAWN DRIVE, IN THE Councilman Kenna moved, seconded by Councilman Davis, AMOUNT OF $17,998.2: to approve Change Order #2, in the amount of $17,998.27. APPROVED Motion carried 7-0. 18. Councilman Fisher moved, seconded by Councilman Newman, CONSIDERATION OF to approve partial payment to Dallas Aerial Surveys, PARTIAL PAYMENT TO Incorporated in the amount of $20,000. Mr. Albin stated the maps were 70% complete, the Company was ahead of schedule. 19. Mayor Pro Tern Ramsey moved, seconded by Councilman Hubbard, CONSIDERATION OF to deny the Public Works Management Study. APPROVAL OF PUBLIC WORKS MANAGEMENT Motion carried 7-0. STUDY DENIED 20. Mayor Pro Tem Ramsey moved, seconded by Councilman Hubbard, INTRODUCTION OF to approve the revised Council Rules of Procedure. REVISED RULES OF CITY COUNCIL Mr. Line advised that the Council Rules were only being PROCEDURE introduced; they would have to be approved at the next Council meeting. Mayor Pro Tem Ramsey amended his motion, seconded by Councilman Hubbard, to state "accept the filing of the Council Rules of Procedure." Mayor Faram asked the City Attorney for a ruling on Section 2.2 of the Rules. Mr. McEntire stated a quorum would require four members and the Mayor Pro Tem. Mayor Faram asked the City Attorney to rule on Section 6.8, on who would excuse the member from voting. October 11, 1982 Page 12 Mr. McEntire stated the Council members could excuse the member from voting or the member himself. Mayor Faram stated he preferred that it be left up to the Chair if the member could be excused from voting. Mayor Faram stated he felt more study needed to be done on the Rules before final approval. Motion to accept the filing carried 7-0. 21. Mr. Blanton stated he was a resident of North Richland CITIZEN PRESENTATIO Hills and a retired school teacher and administrator. MR. HENRY BLANTON AND GEORGE PARKER Mr. Blanton make the following presentation: SENIOR CITIZEN ALLIANCE OF TARRANT "Ladies and gentlemen, let me first express my appreciation COUNTY, INCORPORATE and thanks for your permission to allow us to appear before RE: REQUEST FOR this Council to present our petition to you at this time. INCREASE IN SENIOR CITIZENS HOMESTEAD We are here as members and officers of the Tarrant County EXEMPTION FOR Senior Alliance, an organization registered as a non-profit, 1983-84 TAXES non-partisian and non-sectarian organization functioning primarily to aid and assist Senior Citizens of Tarrant County in many phases and needs of their lives. People, who are over 65 years of age and older, and own their homes here in Tarrant County and in North Richland Hills are confronted with the possibility of having to pay increased homestead taxes in the future, due to the recent re-evaluation of their homes by the Tarrant Appraisal District. While some older citizens are well off financially, the large portion of citizens over 65 are dependent mainly on Social Security or other limited retirement annuity for their livelihood. Including the recent cost-of-living and adjustment, the average SS retired worker receives $406.00 per month and the average for an elderly couple is $695. According to a study by the National Council on Aging 75% or all persons 65 and over depend on Social security or other pensions. A study by a Texas Senate Committee concluded that the income level of persons 65 and over in Texas is about half that of those 65 and under. Certainly these figures indicate that most older citizens have no margin for increased taxes, utilities, medical costs, etc. When these go up, some necessities such as food, clothing, and other items must be cut. The Texas Constitution and laws recognize that older citizens who have paid full taxes during their working years, in fairness and equity, are entitled to relief from taxation on their October 11, 1982 Page 13 homesteads in their retirement years when most of them are living on fixed incomes near or below the national poverty level. Unlike most other States, in Texas, a person's homestead is cherished and protected, especially in his retirement years. We recognize and appreciate the $12,730 homestead exemption granted by North Richland Hills, which has given a substantial measure of tax relief until the recent Peveto legislation and Constitutional amendment approved by the voters, it was recognized that additional adjustments might be necessary to avoid hardships. Many citizens in Richland Hills, North Richland Hills, Haltom City, and other nearby towns in Tarrant County, have received their tax appraisals and have found that their property has been appraised at a much higher rate than before, therefore, we are asking that you consider an exemption for the Senior Citizens of North Richland Hills be increased in proportion to percent of increase in the value of their property. As an example, Fort Worth, has increased their exemption from $18,000 to $23,091, a 27}8, Arlington from $15,000 to $25,000 and Tarrant County from $23,000 to $90,000. Last Monday evening we asked Richland Hills City Council to consider at least a 15% increase in exemptions for homestead taxes for their Senior Citizens. We believe most City Councils in Tarrant County can also match these requests. Thank you again for giving us a few minutes of your time, and, one more thought, if you find an increase impossible for this year, we would appreciate your consideration on this matter next year when you present your tax rate to Tarrant Appraisal District in 1982. Any question you may have we will try to give you our best answer. Mayor Pro Tem Ramsey stated that Tarrant Appraisal District had added to all property in the Birdville School District, which included North Richland Hills, 15% even though it was all ready at a market value of 70%. Mayor Pro Tem Ramsey stated several endeavored with the City of Hurst and went to the Tarrant Appraisal District Review Board and it was not final yet, but they agreed to roll back the appraised values 10% of the present value shown. Mayor Pro Tem Ramsey stated the value shown would be 10% less. Mayor Pro Tem Ramsey stated that hopefully later this month, with the action just taken on establishing the tax rate, there would be an 8% to 15% reduction in the tax rate. Mr. Blanton asked if consideration was for all homes or just Senior Citizens. Mayor Pro Tem Ramsey stated it would include all homes. Mr. Blanton stated their main concern was with houses occupied by people over 65 years of age. October 11, 1982 Page 14 Mr. Blanton asked if North Richland Hills had already passed the budget for the coming year. Mr. Line stated that the budget had already been passed for the coming year. Mr. Blanton stated any consideration on the request would be appreciated. Councilman Hubbard stated he was in sympathy with the Senior Citizens, but was more burden going to be put on the young people to protect the Senior Citizen. Mr. Blanton stated he really could not answer that question. Councilman Kenna stated the City was already committed this year, but felt a close look should be taken at what was provided for the elderly citizens as compared to the neighboring cities. Mayor Faram stated that he felt that some kind of equity had to be found for the young people also. 22. Mayor Faram adjourned the meeting of October 11, 1982. ADJOURNMENT . We have been asked to comment on the possibility of requiring the Developer to extend Meadowridge Court eastward from Lariat Drive to Rufe Snow rather than terminating Meadowrîdge Court as a cul-de-sac. This street would be located about 480 feet south of Meadow Lakes Drive which serves as the primary collection for Rufe Snow Drive access to the Meadow Lakes and Fossil Creek Trails Additions. Meadow Lakes Drive is a 50-foot wide street and is the same width as the new Rufe Snow Drive section north of I.H. 820 which has a capacity of 20,000 vehicles per day. Such capacity would seem to be sufficient to handle traffic from both the Meadow Lakes and Fossil Creek Trails Additions west of Rufe Snow. Attached is a sketch of the proposed alignment of Meadowridge Court which we have plotted on a copy of the tax map for this area. An extension of this street eastward shows that the distance between Meadowridge Court and Karen Drive, as measured along Rufe Snow, would be only 93 feet. As noted in "Subdivision Regulations in Texas Cities" by the Texas' Municipal League, "as a general practice, intersections should be staggered only if the distance between center lines is at least 125 feet; 150 feet is preferable.1I An extension of Meadowridge Court to Rufe Snow would constitute an unsafe intersection design due to the close proximity to Karen Drive. We would suggest that a future extension of Riviera Drive east- ward to Rufe Snow at Shauna Drive would better serve the area than an extension of Meadowridge Court. (See attached sketch). 2. The final plat should be sealed and executed by a Registered Publ ic Surveyor. 3. The zoning for this subdivision (IF-12) should be shown on the plat. 5. The building setback required for IF-12 zoning is 3D-feet rather than 25 as shown on the plat. 6. Lot 17 does not meet the IF-12 minimum depth requirement of 110 feet. The depth shown, as measured in accordance with Paragraph 40, Page 25, of the Zoning Ordinance, is only 76 feet. 7. As shown on the Drainage Study Sheet, the Developer is proposing to discharge a portion of excess street runoff onto the property north of this subdivision between several lots at 6 locations in grassed flumes. Section 2-05, 8.14, P.41, of the Subdivision Ordinance requires that all open ditches within a subdivision which carry surface runoff shall be concrete lined with a minimum thickness of 4-inches. 8. The Developer shall acquire written permission from all adjacent property owners for receiving concentrated storm- water discharge from each of the proposed drainage flumes. 9. Double water services should not be located on easements. The double service for Lots 10 and 11 should be broken into two single services. . 10. Note No. 2 on the Sanitary Sewer and Water System Layout Sheet specifies that A.C. water pipe may be used. The North Richland Hills water policy only permits ductile iron or PVC water pipe. 11. The size of the existing storm drain in Meadow Ridge Court should be shown on the plans. Also the Developer's Engineer shall verify that this existing storm drain has sufficient capacity to handle the stormwater generated on this subdivision. Intersections \ \ The minimum tangent dis tance between reverse curves should be at least 100 feet, to permit. drivers to recover from one curve to the next, and to provide adequate sight distance. It is also desirable to have not less than the same tange~t from the end of a curve to the inter- section of the next street. Intersection design is most important, since many accidents occur where streets and other rights-of-way converge. The number of intersections should be kept to a minimum con- sistent with traffi~ needs, and the number of streets permitted to converge at a single inter- section minimized. Traffic bottlenecks usually are the, result of poorly designed intersections rather than street width. Water surface profile calculations were performed by the Developer's Engineer for a discharge of 9,000 c.f.s., which represents a conserv- ative approximation of the IOO-year, fully urbanized Calloway Branch Channel discharge value. The computed water surface elevation for this discharge ;s 577.15 àt the Racetrac plat site. The IOO-year pre-existing discharge value presented in the City's current FIA report is 3,845 cfs with a corresponding water surface elevation of about 572.0. The October 13, 1981, recorded high water mark in this area was elevation 573.75. The City's "Flood Damage Prevention Ordi- nance", No. 807, requires that the lowest finished floor elevation be constructed at least 18-inches above the base flood (IOO-year) elevation as presented in the current FIA Report. The site layout plan presented in Ref. "E", shows a proposed finished floor elevation of the service station building of 576.06, which ;s 4.06 feet above the FIA 100 year level and 2.31 feet above the October 13 flood level. Article VI, Section 1 of the Charter of the City of North Richland Hills provides that "all powers and authority which are expressly or explicitly conferred on or possessed by the City Council..." In order to provide the framework for the execution of these powers and authority the following set of rules shall be in effect upon their adoption by the City Coun- cil and until such times as they are amended or new rules adopted in the manner provided for by these rules. 2. General Rules. 2.1 Meetings to be Public. All meetings of the City Council shall be open to the public (Charter, Article XVIII, Section 4). 2.2 Quorum. Four members of ,the City Council shall constitute a quorum. When the Mayor is absent and the Mayor Pro Tern is serving in his capacity as a non-voting member, four Council members in addition to the Mayor Pro Tem shall be required to constitute a quorum. 2.3 Minutes of Meetings. An account of all proceedings of the Council shall be kept by the City Secretary and shall be entered in a book constituting the official record of the City Council. 2.4 Questions to Contain One Subject. All questions submitted for a vote shall contain only one sub- ject. If two or more points are involved, any member may re- quire a division, if the question reasonably admits of a .. division. 2.5 Right of Floor. Any member desiring to speak shall be recognized by the Chairman, and shall confine his remarks to the subject under discussion or to be discussed. No member shall be allowed to speak more than once on anyone subject until every member wishing to speak shall have spoken. Page 1 . . . 2.6 City Manager. The City·Manager shall attend all City Council meetings unless expressly excused. He may make recommendation~ to the City Council and shall have the right to take part in all dis- cussions of the Council, but shall have no vote. 2.7 City Attorney. The City Attorney shall attend all meetings of the City Council unless expressly excused and shall upon request give an opinion, either written or oral, on questions of law. The City Attorney shall act as the City Council's Parliamentarian. 2.8 City Secretary. 2.9 2.10 2.11 2.12 The City Secretary shall attend all meetings of the City Council unless expressly excused, and shall keep the official minutes and perform such other duties as may be requested by the Council. Officers and Employees. Any officer or employee of the City, when requested by the City Manager, shall attend any meeting of the City Council. If re- quested to do so by the City Manager, they may present informa- tion relating to matters before the City Council. Rules of Order. Roberts Rules of Order Revised shall govern the proceedings of the City Council in all cases \mless they are in conflict with these rules. ~uspension of Rules. provisions of Section 8 shall not be suspended. Any other provi- sions of these rules not governed by state law, the City Charter, or City Code may be temporarily suspended by a unanimous vote of all members of the City Council present and voting. Amendment ot Rules. These rules may be amended, or new rules ,adopted by a majority vote of all members of the City Council, provided that the pro- posed amendments or new rules shall have been introduced into the record at a previous meeting of the City Council. Page 2 . . . 3. Types of Meetings. 3.1 Regular Meetings. The City Council shall meet in the Council Chamber of the City Hall on the second and fourth Monday of each month at 7:30 p.m. unless otherwise officially established by the City Council. The call for and conduct of all meetings of the City Council, both regular and special as provided in Section 3.2 hereof shall be in accordance with Article 6252-17, Vernon's Annotated Civil Statutes, known as the Texas Open Meeting Act. 3.2 Special Meetings. Special meetings may be called by the Mayor or any four members of the City Council. The call for a special meeting shall be filed with the City Secretary in written form, except that announcement of a special meeting, during any regular meeting at which all members are present, shall be sufficient notice of such special meeting. The call for a special meeting shall specify the day and the hour of the special meeting, an~ shall list the subject or subjects to be considered. No special meet- ing'shall be held until at least two (2) hours after the call is issued and the notice thereof is posted. 3.3 Recessed Meetings. Any meeting of the City Council may be recessed to a later time provided that no recess .shall be for a longer period than until the next regularly scheduled City Council meeting. 4. Chairman and Duties. 4.1 The Mayor, if present, shall preside as Chairman at all meetings of the Council. In the absence of the Mayor, the Mayor Pro Tern shall preside. In the absence of both Mayor and Mayor Pro Tern, the City Council shall elect a Chairman. 4.2 Call to Order. The meetings of the Clty Council shall be called to order by the Mayor, or in his absence, by the Mayor Pro Tern. In the absence of both Mayor and Mayor Pro Tern, the meeting shall be called to order by the City Secretary. 4.3 Preservation of Order. The Chairman shall preserve order and decorum, prevent clash of personalities or the impugning of members' motives to occur and confine members in debate to the question under discussion. Page 3 . . . 4.4 Points of Order. The Chairman shall determine all points of order, subject to the right of any member to appeal to the City Council. If any appeal is taken, the question shall be, "Shall-the decision of the Chairman be sustained?" 4.5 Questions to be Stated. The Chairman shall state all questions submitted for a vote and announce the result. 4.6 Substitution for Chairman. The Chairman may call any other member to take his place in the chair, such substitutions not to continue beyond adjournment. 5. Order of Business. 5.1 5.2 Agenda. The order of business of each meeting shall be as contained in the City Council agenda prepared by the City Manager. The agenda shall be a listing by topic of subjects to be considered by the City Coun- cil, and shall be delivered to members of the City Council each Thursday preceding the Monday evening meeting to which it pertains. Consent Agenda. In preparing the agenda, _the City Manager shall give consideration to the number and degree of complexity of items to be considered by the City Council for the purpose of conserving the Council's' time in meetings. Items which are anticipated to be routine and require little or no consideration by the Council shall be desig- nated by an asterisk, and s?all be considered as a part of the "Consent Agenda. II Prior to taking up the Consent Agenda, the Mayor shall determine if there are any items thereon which should be removed from the Consent Agenda for discussion. Any Council member may, upon request, remove any item from the Consent Agenda for discussion and individual action. Thereafter, all remaining ~ Consent Agenda items may be acted upon by a' single motion approv- ing the Consent Agenda. 5.3 Council Communications. The City Manager shall provide the City Council with a written analysis of and recommendation of items to be acted upon by the City Council at its meetings. These communications shall be Page 4 . . e 5.4 5.5 5.5.1 5.5.2 5.5.3 5.5.4 delivered to City Council members each Thursday preceding the Monday meeting at which time they will be discussed, unless an emergency condition makes it necessary to deliver the communica- tion on a subsequent day. Oral Presentations by City Manager. Matters requiring the Council's attention or action which may have developed since the deadline for delivery of the written Council Communication (Section 5.3) may, upon approval of the City Council, and after satisfying the requirements of the Open Meetings Act, be presented orally by the City Manager. Citizen Presentations. Any person desiring to present a subject for City Council considera- tion shall advise the City Manager's office of the fact not later than 5:00 p.m., on Wednesday preceding the meeting at which he wishes to have the subject to be considered. Said person shall make himself available for a conference with the City Manager at the Manager's re- quest at some time prior to said Council meeting. At the end of each agenda any person who has not been listed on the agenda as provided under 5.5.1, above, but who desires to speak at a Council meeting will be recognized by the Mayor and allowed to speak provided said person completes a form furnished inquiring as to name I address and topic. Presentation by citizens shall be limited to a time period of not more than three (3) minutes for each speaker. Any time spent by the citizen in responding to direct questions by City Council members will not be counted against the citizen's time allotment. These rules shall not apply to anyone appearing at a public hearing in response to official notice. 6. Consideration of Ordinances, Resolutions, and Motions. 6.1 Printed or Typewritten Form. All ordinances and resolutions shall be presented to the City Council only in printed or typewritten form. 6.2 City Attorney to Approve. All ordinances and resolutions shall be approved as to form and legality (Charter, Article VI, Section 6) by the City Attorney. Page 5 . . e 6.3 Ordinances - When Effective. Unless otherwise provided by applicable law, all ordinances, except those prescribing a fine or penalty, shall be effective from and after the date of passage, which may be upon one read- ing only; any ordinance prescribing a fine or penalty shall be effective from and after the publication thereof, in the offi- cially designated newspaper of the city. 6.4 Distribution of Ordinances. The City Secretary shall prepare copies of all proposed ordinances for distribution to all members of the City Council a~ the meeting a± which the ordinance is introduced, or at such earlier time as is expedient. 6.5 Recording of Votes. 6.6 6.7 The vote of each Council member shall be taken upon the passage of all ordinances and resolutions and entered upon the official record of the City Council. Majority Vote Required. Approval of every ordinance, resolution, or motion shall require the affirmative vote of a majority of all members of the City Coun- cil, except as otherwise provided for in these rules. Tie Vote. In the event of a tie vote on any motion the Mayor shall vote to break the tie. 6.8 Voting Required. No member shall be excused from voting except on matters involving the consideration of his own official conduct, or where his finan- cial interests are involved, or unless excused by the Mayor for other valid reasons (Ordinance Number 318, Paragraph 6.8). 6.9 ~ Order of Precedence of Motions. Main motion* * Can be amended - others cannot Reconsideration. ~ motion to reconsider any action of the City Council~can be made not later than the next succeeding official meeting of the City Council. Such a motion can only be made by a member who voted with the majority. It can be seconded by any member. No question shall be reconsidered twice except by unanimous consent of the City Coun- cil, except that action relating to any contract may be reconsidered at any time before the final execution thereof,. The Previous Question. When the previous question is moved and seconded it shall be put as follows: "Shall the main question be now put?" There shall be no further amendment or debate; but pending amendments shall be put in their order before the main question. If the motion for the previous question is lost, the main question remains before the City Council. An affirmative vote of two-thirds of the City Council shall be required to move the previous question. Withdrawal of Motions. A motion may be withdrawn, or modified by its mover without asking permission until the motion has been stated by the Chairman. If the mover modifies his motion, the seconder may withdraw his second. After the question has been stated, the mover shall neither withdraw ~ it nor modify it without the consent of the,Council. Amendments to Motions. No motion or proposition of a subject different from that under con- sideration shall be admitted under color of amendment. A motion to amend an amendment shall be in order, but more than one amendment to an amendment shall not be in order. Page 7 . . . 6.14 6.15 Appropriation of Money. Before formal approval by the City Council of motions providing for the appropriation of money, information 'm~st be presented to the City Council showing the purpose of the appropriation and the account to which it is to be credited. In addition, before finally acting on such an appropriation, the City Council shall obtain a report from the City Manager as to the availability of the appropriation. Transfer of Appropriations. Upon written recommendation of the City Manager, the City Council may at any time transfer an unencumbered balance of an appropria- tion made for the use in one department or division to any other department or division. 7. Cr~ation of Committees, Boards and Commissions. 7.1 7.2 City Council Committees. The City Council may, as need arises, authorize the appointment of "ad hoc" Council committees. Except where otherwise provided by the City Charter, the Mayor shall appoint members of the City Coun- cil committees, subject to the approval of the Council. Any com- mittee so created shall cease to exist upon the accomplishment of the special purpose for which it was created or when abolished by a majority of the City Council. Citizen Boards, Commissiõns and Committees. The City Council may create and establish other committees, boards and commissions to assist in the conduct of the City government ~ith such duties as the City Council may specify, not inconsistent with the City Charter or City Code. Memberships and selection of members shall be as provided by the City Council if not specified by the City Charter. Any committees, boards or commissions so created shall cease to exist upon the accomplishment of the spe- cial purpose for which they were created, or when abolished by ~ majority vote of the City Council. No committee so appointed shall have powers other than advisory to the City Councilor the City Manager, except as otherwise provided for in the City Charter. Page 8 . . . . 8. Consideration of Zoning Matters. The City Council shall consider matters referred by the P.lanning and Zoning Commission only after the following steps have been taken. 8.1 Where the Planning and Zoning Commission recommends approval of a proposed change in the zoning classification of property, the City Secretary shall cause to be published at least fifteen (15) days prior to said City Council consideration, notice of the time and place of such hearing and cases to be heard in an offi- cial paper of the City or in a paper of general circulation in the city. 8.2 All property owners within 200 feet of the property to be rezoned shall be notified in ,writing by depositing such notice, properly addressed and posted, in the United states mail at least ten (10) days prior to such hearing, stating the time and place of such hearing (Article 10l1f, T.R.C.S.). 8.3 In the event twenty (20) percent or more of the owners of real property within the area rezoned, or twenty (20) percent of the owners of real property adjacent within 200 feet of said revision protest against such change in the zoning in writing to the City Council through the City Manager, provided said written petition is filed with the City Secretary or City Manager by 12:00 o'clock noon the Thursday prior to the Council meeting at which said zoning matter is scheduled to be heard, such amendment shall not become effective except by the favorable vote of three-fourths of all members of the City Council (Article 10113, T.R.C.S.). 8.4 When the Planning and Zoning Commission recommends the disapproval of a requested rezoning of property to the City Council, before the City Council can reverse the recommendation of the Planning and Zon- ing Commission the City Council must: 1. Set a special hearing. 2. Give notice as provided in Sections 8.1 and 8.2 of these Rules of Procedure. 9. Cumulative Clause. 9.1 These City Council Rules of Procedure shall be cumulative of all other City Council Rules of Procedure of the City of North Richland Hills relating to the subject matter hereof, except where ordinances or other rules are, or parts thereof are, in conflict with the pro- visions of these rules, in which event such rules or parts of rules so conflicting are hereby expressly repealed.
