SUBJECT: TRA Contract
The enclosed attachment explains a new procedure we will have
to follow in the future concerning industrial waste.
We will be asked by TRA to amend our contract with them. We
will have the option of TRA doing the monitoring or doing it
ourselves.
At the present time, it appears that we do not have an industry
of the class that discharges waste of the type that needs
to be monitored.

Subject: Central Regional Wastewater System
Industrial Pretreatment Program Requirements
As stated to you in my letter dated October 19, 1982, the Authority is
continuing to develop a Pretreatment Program that will regulate industrial
users in your communi ty. The 1 etter a 1 so referenced certa in çiocumentat"; on
that is required by EPA in order to assure that agency that the Authority
will adopt an approvable Pretreatment Program. The attached PROPOSED
CONTRACT AMENDM.ENT to your exi sti ng Contract wi th the Author; ty for the
Central System is such a document.
The PROPOSED AMENDMENT ;s set forth in four categories:
(1) Permit application requirement for a permitting system
for all industries within your City
(2) Approved permit agreement between the Customer City
and each individual industry
(3) The enactment of certain ordinances which will accomplish
items 1 and 2 above
(4) The latitude for each Customer City to take full responsibility
of their program and to supply certain documents to the Authority
or to negotiate, under separate agreement, with the Authority in
order that portions of the program be carried out by Trinity
River Authority

The basic course of action that the Authority anticipates the program to
take is the following:
(l) Review all attached information and direct questions to this
office as needed
(2) Begin development of a permit system and permit agreement
(3) Begin development of ordinances to accomplish number 1 and 2
(4) The Authority will forward to each City a formal Contract
amendment upon approval of same by internal legal review
(5) Each Customer City's Council will be requested to approve the
necessary Contract amendment as well as all previously mentioned
ordinances
(6) Completion date for all referenced items is December 31,1982

questions or wish to discuss this matter further, please let me know.

PROPOSED CONTRACT AMENDMENT
RELATING TO INDUSTRIAL PRETREATMENT REGULATIONS
SECTION
INDUSTRIAL WASTES
This section of ~he existing Contract shall be amended as follows:
(1) The information required in an Industrial Waste disposal permit
a'pplication shall be deleted and replaced with the following
items of information:
Name and address of user
Property plat prepared by engineer or
architect showing location of water
and sewer connections, manholes, traps, etc.
Person to contact at facility
SIC Code
·
Type of processes employed
Number 'of employees
Hours/days of operation
Raw materials used
Hazardous materials at facility
Wastewater flow rates (average and maximum
flow in gpd)
Schedule of process waters and industrial
wastes to be produced before pretreatment
Typical analysis of the wasterwater streams
including concentration and maximum loading
of all priority and conventional pollutants
present in wastewater (user should commit to
presence or absence of each pollutant)
Evidence of treatability
Proposed pretreatment processes
·
Clear indication of any information applicant
deems confidential
Those industries required to obtain a permit will be those with
one or more of the following discharge characteristics:
1) High flow
2) Prohibited Pollutants (e.g. high BOD, T55)
3) Priority pollutants
.
The Authority shall be provided a copy of the Permit Application within
thirty days after receipt by ·City. Authority shall prov"ide comments on
said application within thlrty days of receipt. Failure to comment shall
be construed as concurrence by Authority.
(2) As a condition for approval of the above referenced permit
application, the City agrees to require the industry to
execute a separate document agreeing to the following:
furnish any additional information on wastewater
discharges as required by the City
abide by all applicable ordinances governing
industrial waste discharges
cooperate with approving authority in inspection,
sampling, and study of industrial waste facilities
and discharges
properly operate and maintain required pretreatment
and monitoring facilities at no expense to the City
notify POTW through specified modes of communications
in case of slug discharge, spills, or potentially
hazardous discharges
.
pay all applicable fees including:
1) permit fees (application, transfer, renewal)
if applicable
2) abnormal strength surcharges
3) monitoring fees and laboratory analysis costs
submit self-monitoring reports and compliance reports
as required by approving authority
notify approving authority through specified modes of
communication in case of change of:
1) ownership of facility
2) location of facility
3) responsible person at facility
4) product line/industrial processes employed
5) wastewater quantity or quality

(3) City agrees to enact ordinances as necessary which will enable the
City to accomplish the following:

4) additional costs incurred by City or POTW in
transporting or treating wastes
5) filing, revision, or renewal of permit application
provide public notification for instances of violation

deny/revoke permit, disallow/disconnect service, assess
civil or criminal penalties, and seek other available
legal remedies for:
1) discharge to sewerage system resulting in violation
of POTWs discharge permit conditions
2) hazard to health or life of POTW personnel or users
of receiving waters
3) violation of any applicable ordinance or regulation
4) false information transmitted to approving authority
through permit application, monitoring reports, etc.
'(4) All items contained herein are deemed the responsibility of each City;
however, under separate Contract agreement the Authority may provide
at City's request, any of the services as outlined herein.
The City shall furnish to the Authority all documents and records, in
addition to those outlined herein, as necessary to demonstrate compliance
by all industries.

PARKS MASTER PLAN
Request the subject of the Parks Master Plan be included on a Pre-Council
agenda on November 28, 1982. The $500,000 for park improvements has now
been received and a separate elP account has been established. The Parks
Master Plan was presented to the Council on September 13,1982 for their
review. The discussion on the 28th should be centered around the procedure
we should follow for the adoption of the Master Plan and implementation of
Phase I. Phase I includes the development of Northfield Park as a primary
site for adult recreation. This Northfield development includes (1) pro-
viding site grading and spreading; (2) constructing access roadway; (3)
providing road barriers including parking barriers; and (4) constructing
two adult softball fields including benches, bleachers, fencing and light-
ing. Phase I also includes construction at Norich Park of a parking lot,
. sidewalks, jogging trail with exercise station and trail posts, asphalt
bicycle and walking path, lighted tennis courts and basketball court,
renovated restroom facilities and picnic facilities.
Acquisition of additional park land primarily for RYA use is not included
or budgeted in the Phase I improvements.

Tom Vogt came forward to represent Mr.
St.Arnold. He said they had one request
from TESCO for an additional easement
along the westerly line of this property,
and they talked with TESCO and they agreed
to just half of what they had requested
and Ms. Calvert has a letter to that.
Mr. Vogt said the Engineer's comment
requested a vicinity map be put on the plat;
this will be done prior to going to council.
Mr. Hannon said we have the same situation
here as we had earlier in the meeting where
we have a replat on portions of various
plots.

Mr. Vogt said that was true. He said
Calloway Acres Addition was platted before
there was a R;chland Hills or a North
Richland Hills. He said this property was
platted in 1939 at the County and there is
no way you can force these people to sign

anything. He said these plots were
bought by metes and boundst which was
legal at that time. Mr. Vogt said he
ta 1 ked to an., a ttorney and thi s is the
only way they can do this legally.
Mr. Hannon asked when this one was
bought.
Mr. Vogt said this particular one was
bought 3 years agot but the people to
the west of this property purchased
their's by metes and bounds in the 1940's.
He said he felt this would fall under the
Grandfather clause.
Mr. Hannon said the reason for replatting
was because you can not build over a lot
line.
Mr. Riddle said that was correct. He said
he did not feel the Grandfather claûse
would apply here, it ;s only in zoning.
Mr. Riddle said we upgrade the building
codes and Subdivision Ordinance by Ordinance
and just because this was platted in 1939,
he would still have to meet the Subdivision
Ordinance of today.
Mr. Wood said it was platted and was
accepted by North Richland Hills and he
feels the present ordinances would apply.
Mr. Vogt said at that time it was legal
to purchase property by metes and bounds.
He said they realize they must platt but
he did not feel they should be dependant
on what your neighbors do. Mr. Vogt said
the city issued a building permit on the
north side of this property in the last
few years without requiring a replat.
Mr. Wood asked if they built across :lot
1 ; nes .
Mr. Vogt said Mr. St.Arnold has an existing
building on this property and it is across
a lot line now) he was not sure when this
was done, but the city did allow it. Mr.
Vogt said he discussed this with the City
Manager and he agreed this was the only way
to do it.

Mr. Vogt said the city could refuse an
occupancy permit on these plots until
each replats.
Mr. Tucker said'this was done a long
time ago and at that time, it was done
legally. He said this is the first
effort to conform to the law we have
now. Mr. Tucker said as the owners
sell or move, \Ale can at that time {'
require each to replat.
Mr. Hannon said we have 2 simular, but
different situations; one was created
back in integrity and the other was
really forming at this time. He said
the only question was the legality of
platting a portion of a lot.
Mr. Tucker said in a sense) this ;s
unplatted property, it is not platted
under our Subdivision Ordinance, it is
abstract land, bought by metes and
bounds. He said it should be platted,
not replatted.
Mr. Riddle said this is a legal plat;
;'f a city will not plat a piece of
pr·oper·ty, you ca n ta ke i t to the County
Commis·sioners and they can approve it
and tt becomes a legal plat recorded at
the court house. He said it does not
matter ;-f the City Fathers approve it or
the County Commissioners, it is a legal
plat.
Mr. Wood said he just wanted to state the
Commission is not tryi'ng to get out of
doing this, they just want to be sure they
do it properly.
Mr. St.Arnold came forward. He said he
feels thi's ;s an example of trying to
rectify the old ways and in doing so, the
little man gets'caught in the middle. He
sai'd he bought this property legally, and
all he wants is a building permit. Mr.
St.Arnold said there are 4 or 5 owners
that he would have to try to contact, and
he would be at the mercy of these people,
they might be out of town, out of the country,
or just might refuse to sign.

Mr. St.Arnold said he was suffering
because he can not put a small structure
on his property because of this situation.
He said since he was the first one trying
to fulfill the law as it was put to him,
whether it be platting or replatting, as
the property changes hands, you cou]d
require the same thing. He said he has

he had lived at this address for twel~e years.
He said he worked with Mr. Daley in dividing
it up to the property owners, and it was not
with the idea of having someone build us a
street. Mr. Ernst said they are not here
begging or trying to force anyone to build us
a street, all they are asking is for some con-
sideration be given to extending Mike street
at pro rata cost.

The Chairman stated this has been postponed

in favor of this development.

1. The minimum lot depth requirement for IF-9 zoning is 110 feet.
Lot 8 scales approximately 95 feet and Lot 11 scales approximately
90 feet as measured in accordance with VI. II. 40, P. 25, of the
Zoning Ordinance.
2. The south and east lot dimensions should be shown on Lot A-R.
Also a bearing from the northwest or southwest corner of Lot A-R
to the center of curvature of the west lot line should be shown

3. Drainage from Lots 7, 8, 9 and A-R appears to be eastward sheet
flow to adjacent platted lots. We would suggest that the City
Staff check with property owners along the west side of Stoneybrook
Drive from Brookhaven Drive to Hightower Drive to determine if any
drainage problems presently exist along the rear of their lots
which might be aggravated. due to development west of their area.
In any event, the Developer should demonstrate that he plans to
avoid any construction which would concentrate stormwater runoff
on any adjacent property without providing adequate downstream
discharge relief facilities.
4: The Developer should be required to pay his pro rata share of the
existing 24-inch water line in Hightower Drive which fronts Lot
A-R. We would estimate pro rata at $11.00 per front foot for a
total length of 351.32 feet for an equivalent 8-inch line as required
to serve Lot A-R. This pro rata also includes an allowance for the
existing fire hydrants on Hightower Drive and Davis Blvd.

compatible so you would not have a step in
the building line, but that would restrict
the building on Lot 3. He said Mr. Bonham
could not build the building on Lot 3 that
he wants to with the 25 foot building line.
Mr. Perkins said if they wanted to restrict
Lot 2R without effecting Lot 3, that would
be agreeable. He said Mr. Bonham has a
pretty nice size duplex he wants to put on
that lot and the 25 foot building line would
not permit this. 2,200 square foot duplex.

the following comments:
1. Utility companies should be contacted regarding any additional
easement requirements they may have for this plat.
2. Written permission from the State Highway Department should
be obtained for any construction wich may be required within
the. F.M. 1938 right-af-way in connection with this develop-
ment.

3. We note that fire hydrant coverage is not available for the
southwest corner of this property. We would suggest that
the Developer be required to install afire hydrant at the
northeast corner of the intersection of F.M. 1938 and
Lynda Street.

4. Existing water service to the facilities located in the south-.
west corner of this property is not shown on the water layout
sheet. All existing and proposed water and sewer facilities
~hould be shown on the plans.
5. We would suggest that the existing 6-;nch water line in Lynda
Street which dead ends at Tiffin Drive be looped into the
existing 6-inch stub at Davis Blvd. to provide better water
pressure and service to the area. City participation may be
.. in order if the Developer can demonstrate that such looping
is not required for future development of this property.

the following comments:
1. Notification of utility companies is a staff function.
2. The building setback line on North Forty Road has been in-
creased to 30 feet to meet the requirements of IF-l2 zoning.
There is no need for a setback line on Meadow Creek Road
since this street is to be closed.
3. I t has not been Ci ty policy to require engineer,ing plans on
replats.
4. The Owner will pay the pro rata for water and sewer lines,
but believes that the installation of a fire hydrant would
be an unfair monetary burden since fire protection is usually
a requirement for original platting.

We have reviewed the referenced materials for this subdivision and offer
the following comments:
1. All utility companies should be notified of this replat ;n accordance
with standard City procedures.
2. The present zoning ordinance requirement for building setbacks is
30 feet in 1F-12 zoning. The proposed building setback on North
Forty Road is 25 feet. The setback on North Forty Road shown on
the original plat, however, ;s only 15 feet. The proposed setback
on Meadow Creek Road is 15 feet while the original plat setback is
35 feet. Without knowing what the owner proposes to build on this
replatted lot, we would suggest that in the interest of consistency
with existing building setbacks in this subdivision, that at least
15 feet be provided on North Forty Road and 35 feet on Meadow Creek
Road.
3. We note from the City's water and sewer grid maps that neither water
nor sewer service is directly available to this property without
extensions frOITI the existing 2-inch water 1 ine and 8-inch sanitary
sewer main at Meadow Creek Road and North Forty Road. We would
request that the Owner's Engineer submit plans for service to this
lot to our office for use in updating the grid maps. Since we are
presently in the process of designing an underground storm sewer
system in North Forty and Meadow Creek Road, we also need this
information to avoid potential construction conflicts.

Enclosed is one copy of Contractor's Partial Pay Estimate No.2, dated
November 5, 1982, made payable to Austin Road Company in the amount of
$51,783.70, for materials furnished and work performed on the referenced
project as of October 31, 1982.
The quantities and condition of the project have been verified on-site
by your representative, Floyd McCallum, as indicated by signatul~e on the
estimate, and we have checked the item extensions and additions.
We recommend that this payment in amount of $51,783.70, based on 10%
retainage, be made to Austin Road Co. at P.O. Box 2285, Fort Worth,
Texas 76113.
Section 3.1.05(b) of the Contract Documents provides that "if the total
amount of contract awarded, as stated in the Standard Form of Agreement,
page SF-I, is $400,000 or more, then the amount of retainage shall be 5%
rather than 10%11. With the addition of change orders number 1 and 2 the
total -contract amount is now $414,464.20 -- the original contract amount
was $392,913.93. Please advise if you wish" to reduce the retainage from
10% to 5% on all subsequent partial payments on this project. Payment
this month, based on 5% retainage, would be $63,016.98 rather than
$51,783.70. ~
Along with a copy of this letter, the Contractor is being furnished a
blank estimate form for preparing next month's estimate.

CONTRACTOR'S FINAL REQUEST FOR PAYMENT NO. 12
Enclosed is one copy of Contractor's Final Pay Estimate No. 12, dated
November 10, 1982, made payable to Austin Road Company in the amount of
$45,738.43, for materials furnished and work performed on the referenced
project as of October 31, 1982. The quantities and condition of the job
have been verified on-site by your representative, Floyd McCallum, as
indicated by signature on the estimate, and we have checked all the item
extensions and additions. In the absence of any negative reports by
the City Staff concerning the condition of this project, we would
recommend that the above final payment be made to Austin Road Co. at
P.O. Box 2285, Fort Worth, Texas 76113.
This project includes asphalt paving and concrete curb and gutter con-
struction on Rufe Snow Drive from I.H. 820 to Industrial Park Blvd. along
with storm drain construction in Rufe Snow and portions of Trinidad Dr.,
Buenos Aires and Lewis Drive.
In accordance with Section 3.2.11(a) of the Contract, the two (2) year
term of the Maintenance Bond will begin on this date, and therefore, will
terminate on November 11, 1984.· The maintenance obligation includes repair
of all storm sewer breaks or stoppage, and malfunctions of other equipment
furnished and installed under this Contract including traffic signal mal-
functions. The maintenance obligation also includes sealing of pavement
cracks, repair of pavement buckling or other failures resulting from storm
drain backfill settlement or other subgrade failure, along with failure of
all concrete flatwork and other concrete structures such as storm drain
vaults and inlets. However, the Contractor is not responsible for main-
tenance or damage caused by construction or ~milar physical activities by
others at the site of the damage.

The total completion time for this project was 385 calendar days, including
additional time requi red for perfonning change orders, for a scheduled
completion date of October 31, 1982. Since work was complete on this date
liquidated damages were not incurred and therefore should not be assessed
on this project.
Along with the final Contractor's Estimate tabulation we are enclosing a
"Reconciliation Change Order" for your infonnation which accounts for
differences between the original estimated and actual as-built quantities.
Should you have any questions concerning this final estimat~, we will be .
present at the next Council meeting to answer them.

BACKGROUND:
We had esimtated $30,000 to ~eplace the carpet in City Hall and had placed

$309000 in the budget. The low and only bid is: $369520.60. 'Tb,ere are two
reasons for the higher bid: there is more yardage than we estimated and
we miscalculated the cost for moving the Library. I'have talked to
Qualitv Decorating and we have been able to g'et ''the. cost down' to $33. 793. 67.
We will accomplish this bv laving the Dew carpet over the old. carpet
except in the ~ibrarv.. This also elimina tes' the need to replace the
base mould. ~~e will also change to a iute back carpet. In addition,
we get a 5% discount for payment within 5 davs after completion of each,
area. ¡his drQPs the cost to $32,103.99.

In accordance with your instructions, bids were received on this date
for the referenced project. The project includes construction of a 2.0
million gallon elevated water storage tank and associated plant yard
piping and site fencing on the City site on Davis Blvd. just north of
Shady Grove Road. The individual bid tabulations are attached for your
review. As the tabulation indicates, bids were received from five (5)
contractors.
On the basis of the bids submitted, we would recoonnend that the Contract

In accordance with your instructions, bids were received on this date for
the referenced project. This project includes curb and gutter, asphalt
pavement and utility line reconstruction on the following streets:
1.. North Hill s Drive
2." Circular Drive
3. Reeves Street
4. Northcut Drive"
5. Orient Court
The individual bid tabulations are attached for your review. As the
tabulation indicates, bids were received from six (6) contractors.
The low bid submitted was from Stolaruk Corporation, P.O. Box 61587, Dallas,
Texas 75261, in the amount of $539,489.47 for a total construction period
of 200 calendar days. Recent projects by this company include paving con-
struction on Grapevine Highway fran I.H. 820 to North Colleyville and· on
Denton Highway from I.H. 820 to Belknap. We talked with Gary Treech and
Bill Dodson with the State Highway Departrrtent and they had no negative
comments regarding the work of Stolaruk Corporation on either pf these two
projects.
Therefore, on the basis of the bids submitted, we would recommend that this
Contract be awarded to Stolaruk Corporation in the amount of $539,489.47
for a period of 200 calendar days. The original engineer's estimate was
$580,000.

present at the November 22, 1982, Council meeting to review the bids.

Enclosed is a copy of Ordinance 865 and a copy of revised Sections 2, 3,
5. These revisions will make it possible to contract for the sale of
recovered property by a professional auctipneering co~any, which will
reduce the City I s cost for holding such auctions; "and which should

An ordinaoce providing for the disposition of stolen recovered property,
abandoned property, and found property, other than motor vehiclest in
the possession of the Police Depar~ent; providing a Saving Clause, pro-
viding a Penal Clauset directing publication; and naming an effective

date.
Be it ordained by the City Council of the City of North Richland Hills,
Texas:
ARTICLE 1. Disposition of Stolen Recovered, Abandoned, and Found
Property.
SECTION 1. All stolen.property, abandoned, and found property of
every kind,.except motor vehicles, vlhich'-shall remain
unclaimed with the Police Department for' a period of
thirty (30) days and which ;s not being held as evidence
-~ in a pending criminal case.without being claimed or re-
claimed by the owners, whether known or not, may be sold
at public auction, appropriated .to the·City·s use, or
des troyed, as requ; red by 1 aw. .~
SECTION 2. The Chief of Police shall give to the City Secretary a
list of all property subject to sale hereunder and
shall thereafter deliver such property to the City
Secretary before the date of sale and take a receipt
from such City Secretary showing in detail all property
so delivered.
SECTION 3. Thirty days notice of the time and place of sale of all
property to be offered for sale and a descriptive list
of the property to be offered for sale shall be posted
at the door of the Tarrant County Northeast Sub-Court
House and at any regular entrance to the North Richland
Hills City Hall· and a copy thereof sent by registered
mail to the last known address of the owner, if the name
F\' of such owner is known to the C; ty Secretary. Thereafter,

SECTION 4. The public auction provided for in the preceding section
shall be conducted at the place and hour designated in
the notice, all sales shall be for cash.
SECTION 5. The City Secretary shall conduct such public auction and
shall keep an accurate statement of each article sold and
the price bid and paid there for, and shall make a complete
report in writing to the Finance Director of the time,
place, and manner of conducting such sale. All funds
received on account of such auction shall be delivered
to the Finance Director who shall give his or her receipt
therefor.
SECTION 6. The Finance Director shall place .all funds received by
him or her under and by virtue of this Chapter to the
credit of. the General Fund, to be thereafter disbursed
as the City Council shall order." .'
, SECTION 7."' Any person violating any of the provisions of this Chapter
shall be deemed guilty of a misdemeanor.. In addition to
the penalties otherwise provided, any officer or employee
of the City violating any provision of.~·this ·Chapter shall
forfeit his office or employment·.

SECTION 8~ If any section, sub-section, sentence, clause, or phrase
of this ordinance ;·s held .for any reason to be invalid,
such decision shall not affect the validity of the re-
maining portion of this Code.
SECTION 9. Any person violating any of the provisions of this ordi-
nance shall be deemed guilty of a misdemeanor and shall
be punished by a fine not to exceed two hundred ($200.00).
SECTION 10. The City Secretary is hereby directed to publish the
caption, penalty clause and effective date of this ordi-
nance for five (5) days in the newspaper of genreal
circulation in the City of North R;chland Hills.
SECTION 11. This ordinance shall be in full force and effect from
and after the date of its passage and publication as
required by law and it is so ordained.

BE IT ORDAINED by the City Council of the City of North Richland Hills,

and Found Property," adopted December 8, 1980, and as heretofore amended, be and
the same is hereby amended at Section 2, Section 3, and Section 5 to read as
follows:
"Section 2.
The Chief of Police shall give to the City Purchasing Agent a list of
all property subject to sale hereunder and shall thereafter deliver such property
to the City Purchasing Agent showing in detail all property so delivered."
"Section 3.
Such property may be sold as individual items, or assembled in lots, at
the discretion of the City Purchasing Agent. Provided, however, that the head of
any department of the City of North Richland Hills may request, in writing, that
any items offered or to be offered for sale be assigned to his or her department.
The City Purchasing Agent may, at his or her discretion, assign such item or items
to such department or sell such items at public auction."
"Section 5.

BE IT ORDAINED by the City Council of the City of North Richland
Hills, Texas, that Qrdinance Number 980, "Levy and Collection of Ad Valorem
Tax on Property," adopted October 11,1982 is hereby amended at Section 1
and Section 2 to read as follows:
1.
That there is hereby levied and shall be collected as provided by law an
ad valorem tax for the year 1982 on all property, real and personal, except such
property as may be exempt from taxation by the Constitution and the statutes of
the State of Texas, situated within the corporate limits of the City of North
Richland Hills, Texas, on January 1, 1982, and that the amount to be applied to
the value of such property shall be $0. ;1 per $100.00 valuation.

That the tax so levied and assessed shall be apportioned to the following
