BACKGROUND:
Each year in the "progress" issue of the t1id-Cities, the City
publishes ~n ad and an editorial. The ad in past years has shown a picture
of the City Hall and other pictures of interest, suggested by City Staff.
Usually the final pictures and ad layout are determined by the Mid-Cities
Staff Artist. The editorial is drafted by the City Staff and final article is
determined by space limitations and Mid-Cities Staff, as far as I can ascertain
from talking with one of their representatives.

BACKGROUND: This property is zoned ItCommercialll but has an old building on
the property which does not meet the com~ercial code.
All the Engineer's comments have been met.
Southwestern Bell Telephone Company requested a 5 foot easement on each side of
this property, but siDce the existing building sets so close to the property
line on one side, they could only grant the easement on the oposite side.
The Planning & Zoning Commission ap~roved the replat subject to the Engineer's
comments and the granting of the additional easements requested by Southwestern
Bell.

Dear Mrs. Calvert:
In response to Southwestern Bell Telephone Company's request for
additional easements on the above referenced Lot, we have added
an additional 5-foot utility easement on the east side of the
Lot.
The 5-foot easement requested on the west side of the Lot
cannot be added as there is an existing building which at
one point extends to within 1.5 feet of the west property line.
We have also added "Block A" as requested by Knowlton-English-
Flowers.
If there is any further questions regarding this Lot, please
do not hesitate to call.

Marvin Smith came forward. He said this
property is .at the corner of Harwood
Road and Grapevine Highway and lies
on the south side of Harwood Road.
Mr. Smith said this is distressed
property approximately 30,000 sq. ft.
with a 4,000 ft. frontage. He said it is
joined on the east by a large drainage
ditch.

a 4,000 sq. ft., 1 story building
with a glass front apd plenty of
off-street parking.
Mr. Smith said he did not want a conveniencE
store such as a 7-11, he is interested
in office space. He said he would
like to have a real estate office,
doctor's office, insurance agency,
beauty shop~ or barber shop. Mr. Smith
said there would be 3 or 4 spaces.,'

Alice Nunley, 5145 Jennings Drive, came
forward. She said she wasn't sure if she
was for or against this request.
Mrs. Nunley asked if it would be stipulated
that they must build certain things.
Mr. Horvath said that at the time of the
final plat is submitted, they ~ould have to
submit construction plans and layout.
Mrs. Nunley said what if they said it would
be office space but ~hen decided to build
something else.
Mrs. Nunley said she has a simular situation
on Grapevine Hwy. She said the neigbbors do
not like her, either.
Mrs. Nunley said this vacant lot does create
snake and rat problems; the city would be able
to increase their tax revenue, but there is
some flooding. She said the flooding happened
when they built Grapevine H\vy., but to put
more wat:'l::__J-nt.º- thi~"i..".t. ch nO"\4] might cause
proble~š. }Irs. Nu!.l~ _ c sked if they could re-
route the ditch.
Þlr. Greenf ield asked Mrs". Nunley if she 't,7as
saying she tbought it could present a problem.
Mrs. Nunley said she felt it should be re-routed.
Mr. Horvath said if the zoning is changed, then
before the plat is approved~ our engineer would
go out and make tbem bring tbe drai~age up to code
Mrs. Nunley said then whe would be in favor of
the approval of this zoning reques"t.

Mrs. Doyne Bird, 8320 Dude Ct. said they have
lived here 20 some odd years and hoped to stay
20 more years, but they have had to fight many
battles. She said they do have a flooding
situation. Mrs. Bird said if they were to get
a 9 inch rain, there would be serious problems.

Mr. Burroughs said he was concerned
about the retainer ~,'all, it \vould have
to be at least 5 ft. He said he had
tried to get the City to do something
about this drainage. t·rr. Burroughs
s.aid he had lost about 20 cubic ·yards
of his yard.
Mr. Burroughs said he doesn't know
about the snakes and rats.
Mr. Burroughs read a.letter from Cecil
& Gladys Wright who live at 5140
Jennings Drive and "tvere unable to attend.
The letter stated they "t~ere opposed to
this zoning request.
1-1r. Burroughs said he moved there to
raise his family and plans to live rigbt
èhere the rest of his life. He said his
house had never been flooded.
Mr. Greenfield asl(ed 1-Ir. Burroughs to
show the Co~~ission where his and the
Wright's property lies.

Mrs. Jerry Cozby, 5125 Jennings Drive,
came forward.
Mrs. Cozby asked if the city has a
master zoning plan. She said sfle felt
this would be spot zoning.
!vIr. Greenfield said the city does have
a master plan which is in a plan of
revision.
~tLS. Cozby asked if the Commission 'vould
consider this spot zoning.
Mr. Greenfield said they did not.
Mrs. Cozby said they have a very nice
neighborhood, but have approximately
5 lots v,7hich could be used for businesses.
Mr. Greenfield asked Mrs. Cozby to
show where her property lies.
Mr. Greenfield asked Mrs. Cozby if her
property had been flooded.

Mrs. Nunley said she feels Mr. Smith
is being denied the best use of his
property.
Mr. Greenfield said the singalization was
approved last week.
Mark Howe came forward. He said he was
wi th Aruerican Na tional 1-1ortgage and \.¡anted
to speak in favor of this request. He
said as far as the use of this property,
it would increase the tax revenue and was
well suited for the proposed use.
1-1r. Ho\ve' said in regards to the flooding,
this is their best opportunity to get the
drainage fixed; the City Engineer would
see to it tha tit is improved. }lr. Howe
said the city \vould probably be longer
in correcting this than Mr. Smith would be.

J. Dolan Lunsford, 3816 Diamond Loch E.,
came fon~ard. He said he is the O\nler
of ~he property. Mr. Lunsford said he
bought the property \vith the intention
of building a home on it, but when they
went to widen Harwood Road, 3 ft. was
taken off his side and none off TCJC's
èide which made it not large enough.
Mr. Lunsford said he was then assessed
$2,300.00 for curb and gutter.
t-lr. Lunsford said the lady ,..¡as wrong~ he
had had this property for sale for 10 years
and had only 2 buyers - both were for
COTnmercial use.
Mr. Horvath said the signals have been
approved and the bids let on the signal
lights at Grapevine Highway and RaDIood
Road.
~lrs. Nash asked ,"lhen they ,,,QuId be

Mr. Horvath said as soon as possible.

some of the people's problems) but he

Mr. Beryl Stewart, 409 Fieldstone representing
Dr. Waggener) appeared before the Council.
Mayor Faram asked if this property was part of the
property involved in litigátion.
Mr. Stewart stated yes, but they were prepared to
sign a convenant on this tract.

consideration of this item until the litigation had been
resolved.

tract, which would not make the ordinance effective until
that had been done.
Mayor Faram called for anyone wishing to speak in opposition

Councilman Brady asked t1r. Stelflart if he vlere suggesting
that YflCA \vould have to institute a suit for specific
performance if the request was not granted.
Mr. Stewart replied yes. Mr. Stewart stated this problem
came about when he came to City Hall and along with one
of the employees, looked at the zoning map.. This particular
piece of property had Local Retail printed on it, but the
oversight was an arrow pointing across the street to another
piece of property. Mr. Stewart stated it was his incorrect
assumpti on that thi s property Has zoned correctly: Hr. Ste\,·J3.rt
stated when he applied for a building permit it was denied
because the property was not zoned correctly.

Mr. Stewart stated the money was in escrow, but
the Doctor refused to release the money for closing
unti 1 the property VIas zoned correctly because he was
not going to give $59,000.00 for property he could
not use.

would be initiated from the YMCA for nonperformance
if the zoning was denied.
Mr. Stewart replied yes.
Mayor Faram stated that in light of the discussion
the Council would go back into executive session

r1r. Stewart stated he had looked at another piece
of property and it had multi-zoning. They made
application for a building permit and could not get
one because it had two different zonings.
Mayor Faram asked when the contract was signed on
the property being requested to be rezoned.
Mr. Stewart replied the contract was signed August 4, 1980.
Mayor F~ram asked if the contract was signed prior to
the lawsuit being filed.

WHEREAS, the City Council has been apprised of the content of a letter
dated November 19, 1980, from Donald H. Walden, P.E., Supervising
Planning Engineer with the State Department of Highways and Public
Transportation concerning the proposed addition of portions of
Precinct Line Road and Watauga Smithfield-Glade Road to the
Federal Aid Urban System; and,
WHEREAS, the Regional Transportation Council has recently approved this
revision; and,
WHEREAS, the State Department of Highways and Public Transportation has
requested documentation of this foregoing request by the City
of Hurst; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS:
Section 1.
That the State Department of Highways and Public Transportation is
hereby notified of the City of North Richland Hills' concurrence
to add Precinct Line Road from State Highway 26 to Watauga Smithfield
Road and Watauga Smithfield-Glade Road from Precinct Line Road to
State Highway 26 to the Federal Aid Urban System.
Section 2.
That the City Secretary is hereby authorized and directed to cause
transmission of a copy of this resolut-ion to the State Department
of Highways and Public Transportation as well as the City of Hurst.

In response to a request by the City of Hurst with concurrance from the
Cities of Colleyville and North Richland Hills, the Department has ini-
tiated action to add Precinct Line Road from S.H. 26 to Watauga Smith-
field Road, and Watauga Smithfield-Glade Road from Precinct Line Road to
S.H. 26 to the Federal-Aid Urban System. The Regional Transportation
Council, RTC, has recently approved the revisions. However, our Austin
office advises us that because these cities are not directly represented
on the RTC, it is necessary to obtain documentation of this request from
each city.
Therefore, we have been instructed to request your city to send us a let-
ter or resolu.tion, signed by an elected offici21: in support of the above
revisions.

SUBJECT: Check Protector/Signer
Per your instructions, I have investigated the cost to obtain a check
protector/signer for the City.
The best equipment, in my opinion, currently available is a Hedman 2300
distributed by F & E Check Protector Co. at a cost of $1800.00. This
price includes the check protector, a signer and one signature plate.
The signature plate can be made with either one or two signatures.
The machines have as security features the following:
1) The check protector and the signer can be separated and used in two
operations or locations.
2) Locks (all with different keys)
a) Check protector lockinq protecting operation.
b) Check s·igner locking signing operation.
c) Check signer locking a trip switch on electric current.
d) Check signer locking compartments containing removable signature
plate.
3) Check protector can be used without the signing operation.
4) Check signing can be done without the protecting operation.
5) Check signer has an enclosed, non~resettable counter.
The delivery time on equipment and signature plate is approximately one (1)

signatures approximately 16,000 checks per year, I offer the following
