HomeMy WebLinkAboutOrdinance 1946 ORDINANCE NO. 1946 AN ORDINANCE REZONING PROPERTY IN ACCORDANCE WITH ARTICLE 2, SECTION 200, OF ZONING ORDINANCE NUMBER 1874, PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL ON MARCH 22,1993; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to the City Council of the City of North Richland Hills, Texas, by the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 and the Official Zoning Map by rezoning certain property; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, on Case Number PZ 93-21, the following properties shall be rezoned from AG Agriculture to R-2 Single Family Residential: BEING a 30.165 acre tract of land situated in the Thomas Peck Survey, Abstract No. 1210, in the City of North Richland Hills, Tarrant County, Texas, and being a portion of that certain 25-acre tract of land described in deed to J.H. Davis, as recorded in Volume 3205, Page 358, Deed Records, Tarrant County, Texas, and all of that certain tract of land described in deed recorded in Volume 7169, Page 415, said deed records, being more particularly described by metes and bounds as follows: BEGINNING at an iron rod found at the southwest corner of said Davis tract and the northwest corner of Cherokee Estates, as recorded in Volume 388-73, Page 32, Plat Records, Tarrant County, Texas, siad iron rod being on the east right-of-way line of Davis Street, a gravel road not dedicated; THENCE North 00 degrees 01 minutes 24 seconds East, 659.56 feet along the west line of said Davis tract and said east right-of-way line to an iron rod found at the southwest corner of McKee Addition, as recorded in Volume 388-167, Page 23, Plat Records, Tarrant County, Texas; THENCE North 89 degrees 51 minutes 19 seconds East, 385.00 feet along the south line of said McKee Addition; THENCE North 00 degrees 12 minutes 33 seconds West, 865.13 feet along the east line of said McKee Addition to the centerline of Shady Grove Road; THENCE North 89 degrees 47 minutes 27 seconds East, 319.50 feet along said centerline; THENCE South 00 degrees 46 minutes 27 seconds West, 865.50 feet; THENCE North 89 degrees 51 minutes 19 seconds East, 975.57 feet to a found 60d nail at the northwest corner of a 13.09 acre tract described in deed to John W. Barfield, as recorded in Volume 8163, Page 363, said Deed Records, said 60d nail on the called east line of said Davis tract; THENCE South 00 degrees 23 minutes 19 seconds East, 463.70 feet along said east line and the west line of the said Barfield tract to an iron rod set in the northerly right-of-way line of North Tarrant Parkway, a variable width right-of-way, said iron rod being a point of non-tangency on a curve to the left having a radius of 2964.79 feet. a long chord bearing South 69 degrees 23 minutes 29 seconds West, 563.33 feet; THENCE along said curve and said northerly right-of-way line through a central angle of 10 degrees 54 minutes 11 seconds, an arc length of 564.18 feet to an iron rod set in the line of said Davis tract and the north line of said Cherokee Estates; THENCE South 89 degrees 54 minutes 36 seconds West 1141.34 feet along the south line of said Davis tract and the north line of said Cherokee Estates to the POINT OF BEGINNING and containing 1,314,006 square feet or acres or 30.165 acres of land, more or less. This property is generally located on the north side of North Tarrant Parkway, approximately 1200 feet west of Castle Creek Road. 2. THAT, the Official Zoning Map be redrawn to incorporate this zoning district boundary amendment and the herein described ordinance number be affixed to the property described herein. 3. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. 4. SAVINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. 5.
