and 10.
This motion was seconded by Mr. Bowen and the

Mr. Largent said they had received the City
Engineer's letter and they Q~ve no problem

charges on this property, but he did have
some recommendati ons in rega'rds to thei r

In response to Kn~wlton-English-Flowers letter of May 14, 1981,
we offer the following comments:
1. The statement certifying to the accuracy of the topographic
map has been added to the drainage study map.
2. This tract is owned by Tommy F. Abbott, Jr.. The large
tract surrounding Lot 23C is owned by Mr. E.F. Abbott.
3. The Owner's address has been added to the plat.
4. A proposed zoning of l-F 12 has been added to the plat.
5. In regard to pro ratas, the owner has no objection to
abiding by whatever policies are deemed fair by the
Utilities Director.
6. Any revisions to the proposed locations of the water and
sewer taps will be forwarded to Knowlton-English-Flowers.
If there are any questions regarding these comments, please do
not hesitate to call.

David Barfield came forward to represent
Key Branch Industries. He said the
Commission would recall that they applied
at ,the last session for PJanned Development
and was told that Planned Development was
not acceptable. He said all they want to
do is build this office building. He showed
the Commission a replica of the buï-lding'~' .H'e .
said it was strictly an offiëe type building.
Mr. Barfield showed~the CommissJon, their site
plan showing where the parking space would be.
Mr. Barfield said' the reason he wants to tie
thè. land down to this particular zoning is
because he plans to bui,ld' hi s home ne,xt to
this property. He ·said the property has a
lot of trees which, he wants to leave unhanne,d.
He said he wants to leave the back of this
lot undisturbed..
Mr. Barfield said he feels this proposed
building would be a nice addition to the city.
He said it would be a $300,000 to $500,000
building. He said it would house ICS Computer
Service and his office. Mr. Barfield said
there would proBably be 30, to 40 people working
there. He said there would be covered parking
on the back for six to seven cars and then
an additional parking for approximately 70 cars.
Mr. Bowen said in this particular request~ the
Commission does not need to take the plans into
consideration.
Mr. Greenfleld said the plans are not a matter
that this Commission needs to consider.,'
The Chairman asked Mr. Forester if, it can be
specified how a building will be used in
Specific Use zoning.

Mr. Forester said he did not think you could in
Specific Use, -but you could in Planned Develop-
ment.
Mrs. Cålvert said Mr. Barfield was told that if
he came in for Local Retail-Specific Use~ it
could be tied down to an office building.

The Chairman said the Commission has
studied this request and find that it does
not fulfill Article 8, Section,l of the
Zoning Ordinance dealing with Planned
Development 'districts. He said another
problem is that the materials that were
pertinent to this request were not submitted
at the same time and the City Staff, City
Engineer, City Planner or Commission did not
get to study them.

The Chairman said the Commission would like
to deny this request and request that
Mr. Barfield meet with the City Staff to
seek reapplication to try to work the problem
out.
Mr. ,Barfield said he would like to state
what he is trying to do. He said IJlr. Þlurphy
has given him permission to do something
with his property. He said he was going to
build his home next to this property. He
said he asked for Planned Development so
he 'could control what goes on this property.
He said he would be the builder and part
o\~er of this property. He said he didn~t
want Commercial zoning but wanted a
specific building with a speci~ic use.
Mr. Greenfield said Mr. Barfield's designation
was wrong for what he was as~ing for. He
said he should meet with the City Staff and
see what can be worked out. 'He said they
have to work within the Zoning Ordinance.

to do it and if Mr. Barfield owned the
property he would have control even if
he got a COTIlmercial zoning.
Mr. Tucker said the intent of. Planned
Development is mixed occupancy~ He said
more 'specific use is needed.

Mr. Barfield said that was his main concern;
what would happen several years from now
to the property. He said he wanted to tie
it to a specific definite use so it will
be that way 'from now on.
Mr. Monroe said the problem the Planning
and Zoning Commission is having is trying
to relate what Mr.. Ba'rfield is asking to.
the ordinances. He said Mr.. Barfield could
detail what he wants done with this pr~perty
through Deed Restrictions. He said he could
obtain a Commercial Zoning and then obtai'n
legal council to do a deed restriction.
He said the difficulty was in allowing less
than a two acre tract to be put into a
Planned Development District.
Mr. Barfield ~aid he would withdraw and
would make the proper application.
Mr. Oscar Oggier, ó821 Precinct Line, came
forward, He said the property was sold
by David Barfield in October, 1980. He
said he respects the wisdom of the Staff
and Board. He said Mr. B~rfield wants to
protect the. neighborhood but he sold the
property in 1980 without any consideration
to it.
Cleta Oggier, 6821 Precinct Line, came
forward. She said she had a petition
signed by most of the people within 200 ft.
She asked if another petition would need to
be signed if Mr.. Barfield comes in again.

We have reviewed the referenced materials for this subdivision and offer
the following comments:
1. In accordance with our comments by letter to the Commission
dated April 10, 1981, for PZ case 81-13, the Developer has provided
the items outlined for our review as required for a Planned Develop-
ment District in the Zoning Ordinance.

2. The Zoning Ordinance provides that the Council shall, after recom-
mendation by the Commission, specify maximum height, floor area
ratio, minimum off-street parking, etc., within the limits allowed
by the Ordinance after appropriate public hearing is held. Any
changes you wish to make in the plans submitted by the Developer
shall be incorporated in the Zoning Ordinance if approved.
3. The Developer is also required to submit a development schedule
and timetable of anticipated construction for the Planned Develop-
ment District. Such schedule, if adopted by the Council shall
become part of the plan. If the Developer does not meet the pre-
scribed schedule, the Council has the authority to amend the
Zoning Ordinance or take action to rezone the area if desired.

Mrs. Calvert said for IF-9 zoning the minimum
is a 1309 sq. ft. ~ouse. She said if the
Commission wishes, they may stipulate a
larger house, if they feel it necessary.
Mr. Bowèn asked Mr. Largent if he knew what
size house Ms. Wilson his in mind. '
Mr. Largent said he did not.
There was a discussion as to the size needed
for this area.
Mr. Tucker recommended that the Commission
approve the IF-9 zoning 'and not specify any
larger size. .
The Chairman called for those wishing to
speak in favor of or in opposition to this
request to please come forward. '
There being no one wishing to speak, the
Chairman closed the Public Hearing.
Mr. Bowen said the Commission has three
options: to approve as is, to deny, or to
postpone this request until the size of the
house is determined.

We have reviewed the referenced materials for this subdivision and offer
the following comments:
1. The IIThoroughfare Master Plan for North Central Texas" prepared
by the NCTCOG shows Crane Road to be a future C4U Street (Collector,
4 Lanes, Undivided) which would be a 48 foot street with a 70 foot
right-of-way requirement. The present right-of~way width on Crane
is 50 feet. Thus an additional 10 feet would be required off lot
6A for future widening of Crane Road.
2. Although the portion of Amundson Road which fronts on lot 6A is
not included in the City or Regional Thoroughfare Plan, we would
estimate that at least a 50-foot right-of-way width would be
required on Amundson Road for future widening. Thus an additional
five feet would be reuqired for right-of-way dedication off the north
side of lot 6A. This would leave a lot width of 80.3 feet which is
greater than the minimum required for the proposed IF-9 zoning.
3. The Owner should be required to sign a letter covenant agreeing
to participate in the costs of future paving and drainage improvements
on Amundson Road and Crane Road, in accordance with City Assessment
policy, at such time that these streets are rebuilt, if he has not
alre~dy done so.
4. We are not aware of any existing sewer system which would serve
this lot. If a septic system is proposed then percolation tests
should be performed and results furnished to the City and Health
Department.

We have reviewed the referenced materials for this subdivision and offer
the following comments:
1. The Owner's Acknowledgement and Dedication along with the
Notary Certification should be fully executed before approval.
2. The Developer should be required to extend the existing 8-in,ch
water line in Davis Blvd. down to this lot to provide fire
protection coverage since only a 2-inch water line presently
serves this area. We would request that the Developer's
Engineer submit plans for this extension to us for review before
you approve this replat. In addition, a sanitary sewer line
extension to serve this property is required and plans should
be submitted for this extension also. '
3. A Permit for construction within the Davis Blvd. right-of-way
should be obtained from the Highway Dept.
4. The acreage for this property should be shown on the replat.
5. The preparation date should be added to this replat.
6. 'The proposed zoning (Industrial) should be shown on the replat.

7. The replat contains a note showning that the southwest boundary
of this replat does not fall on the southern boundary of lot 21
since the tontigiousowner evidently claims the south 19.4 feet
of this lot. This 19.4 foot strip should accordingly also be
replatted and renumbered 21-R with the written consent of the
owner of this strip included on the replat. We would point out
that this fragmentation of lot 21 leaves a strip of land smaller
than the minimum lot requirements for the current zoning of this
property. We would suggest that the City Attorney be consulted
concerning this matter if this ,is a problem.

AN ORDINANCE CALLING AN ELECTION AUGUST 8, 1981, FOR THE PURPOSE OF SUBMITTING
PROPOSED NORTH RICHLAND HILLS CHARTER AMENDMENTS.
WHEREAS, the City Council is of the opinion that the proposed Charter
amendments herein submitted merit the consideration of the
citizens of North Richland Hills:
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF NORTH RICHLAND HILLS, TEXAS:
SECTION 1. An election is hereby called for August 8, 1981, at City Hall for
Voter Precincts 41, 49, 63, 72, 140, 191, 196, 209, 214, 215, and
238 between the hours of 7:00 a.m. and 7:00 p.m. The following shall
serve as Judge and Alternate Judge:

Absentee voting by personal appearance shall commence on
July 15,1981, at 8:00 a.m., and shall continue through
August 4,1981, at 5:00 p.m. Such absentee voting shall
take place in the office of the Ci,ty Secretary in the Ci ty

accordance with the election laws of the State of Texas, and
voting machines or paper ballots are hereby adopted as the
method of voting at such election.

fourteen (14) days prior to the date set for said election

The quantities and condition of the project have been verified on-site
by your representative, Bill Rutledge, as indicated by signature on the
estimate, and we have checked the item extensions and additions-.
We recommend that this payment in amount of $20,164.05 be made to
Austin Road Co. at P.O. Box 2285, Fort Worth, Texas 76113.
Along with a copy of this letter, the Contractor is being furnished a
