WHEREAS, the City held a Charter Amendment election on August 8, 1981; - and WHEREAS, a canvas of the votes showed the following results: AMENDMENT NUMBER 1 Article V, Section 2, is amended to read as follows: IISECTION 2. QUALIFICATIONS - Each of the seven Councilmen and Mayor shall, on the date of election, be at least 21 years of age, a citizen of the 'United States of America and a registered, qualified voter of the State of Texas; shall reside and shall have resided for at least one year preceeding the election at wh'ich he is a candidate, within the corporate limits of North Richland Hills; and shall not be in arrears in the payment of any taxes or other liability due the City, or be disqualified by reason of any provision of any other section of this Charter. A member of the Council ceasing to possess any of the qualifications specified in this section or any other sections of this Charter, or convicted of a felony before or while in office, shall immediately forfeit his office. No Councilman shall hold.any other public office except that of Notary Public, member of the National Guard or any Military Reserve, or a retired member of the Armed Servi ces.' II FOR cX5 ¿ AMENDMENT NUMBER 2. Article V, Section 6, is amended to read as follows: ~' AGAINST /~1 SECTION 3. DATE OF ELECTION; CANDIDATES TO RUN FOR PLACES; PLACES DESIGNATED -- The regular munici'pal elections of 'the City of North Richland Hills shall be held on the first Saturday of April of each year, and the same shall be conducted and the results canvassed and announced by the election authorities prescribed by the Election Code of the State of Texas, and said Code shall . control in all municipal elections except as otherwise herein provided. The Mayor and Councilman Places 2, 4, and 6 shall be elected for two (2) year terms at the election in even-numbered years and Councilman Places 1, 3, 5, and 7 in the general election in odd- numbered years. Counci~men elected to Places 1, 3, 5 and 7 in the general election to be held on the first Satruday in April, 1982 shall serve for a period of only one (1) year, until the general election of April, 1983. Sections 3, 3a, 5 and 6 of Article XVII are each respectively amended to read as follows: "SECTION 3. CIVIL SERVICE COMMISSION There is hereby established in the City of North Richland Hills a Civil Service Commission, which shall consist of five (5) members, to be selected as follows. Members of the Commission shall be appointed by the Mayor of the City of North Richland Hills and such appointment shall be confirmed by a two-thirds (2/3) vote of the City Council of the City of North Richland Hills before any such appointments shall be effective. Of the first five (5) commissioners so selected under the provisions of this Act to comprise the Commission, two (2) shall be appointed for a term of one (1) year, and two (2) shall be appointed for a term of two (2) years and one (1) shall be appointed for a term of three (3) years, or until in each case a successor is appointed, confirmed and qualified. Any vacancies in said Commission, caused by death, resignation, removal or otherwise, or failure of any appointee to qualify within ten (10) days after appointment, shall be filled in the manner herein- above specified, and such appointment shall be for the unexpired term of the retiring Commissioner or the appointee failing to qualif;y. e Each such Commissioner shall be of good moral character, a resident of the City of North Richland Hills, shall have resided in said City for a pertod of at least one (1) year, shall have attained the age of twenty-one (21) years, and shall not have held any public office nor been a paid employee of the City within the preceeding three (3) years" "SECTION 3a. REMOVAL OF COMMISSIONERS Civil Service Commission members may be removed by two-thirds (2/3) vote of the City Council for failure to remain qualified under the provisions of Section 4 of this Article or failure to maintain interest in this Commission as manifested by good attendance at meetings. POWERS AND RESPONSIBILITIES The Civil Service Commission shall formulate policies, procedures, rules and regulations for conduct of all Civil Servi ce bus i ness, operatì ng a lways wi thi n the bounds of the Ci ty - Charter, the Constitution and laws of the State of Texas and the Federal Constitution. SECRETARY OF CIVIL SERVICE There is herby created the office of Secretary of Civil Service, which Secretary shall be appointed and removed by two-thirds (2/3) vote of the City Council. The 'Secretary shall serve as Secretary to the Commission, and shall perform all such work incidental to the Civil Service as may be required by the Commission. DEFINITIONS Any full-time employee of the City is entitled to City Civil Service coverage except any employee directly appointed by the City Council, or any supervisory personnel directly appointed by the City Manager. II "SECTION 8. CLASSIFICATION OF EMPLOYEES All employees shall be classified as above provided and shall be under Civil Service protection except the Chief or Heads of such .,' departmentst and persons appointed as second in command, by whatever name they may be known. The appointment of the second in command shall be made by the Chief or Head of such department with the approval of the City Manager. Said Chiefs or Department Heads shall be appoi nted by the Ci ty ~1anager. II IISECTION 12. PROBATIONARY AND FULL-FLEDGED EMPLOYEES A person who has received appointment to any depa~tment hereinunder shall serve a probationary period of twelve (12) months. All positións" in the City covered by this Article except that of Head of the Department and second dn command shall be classified by the Commission and the positions filled from the eligibility list as provided herein. Section 27, of Article XVII is hereby repea1ed, and Sections 14, Paragraph A, and Sections 18 and 25a, of Articlè XVII are each respectively amended to read as follows: e "SECTION 14, PARAGRAPH A. PROMOTIONS: FILLING VACANCIES All promotional examinations shall be open to all employees who have held a continuous position for two (2) years or more in the salary classification immediately below the classification for which the examination is to be held; except where there is not a sufficient number of members in the next lower position with two (2) years service in that position to provide an adequate number of persons to take the examination, then all employees in such tl~ssificat1on will be eligible to take the examination. If, after extending the examination to all employees in the classification immediately below the position being tested, and there is still an insufficient number to take the examination, the Commission may further extend the examination to the members in the second lower position in salary to that for which the examination is to be held"" "SECTION 18. APPEAL TO DISTRICT COURT e In the event any employee is disatisfied with the decision 'of the Commission, he may, within ten (10) days after the rendition of such final decision, file a petition in the court of appropriate jurisdiction, asking that his order of suspension, dismissãlc or demotion be set aside. Such cases shall be advanced on the docket of such court and shall be given a preference setting over all other cases and shall be tried under the Substantial Evidence Rule.1I "SECTION 25a. VACATIONS Those employees having completed one (1) but less that three (3) years of consecutive service with the City shall be entitlèd to·two (2) weeks vacation with pay each year; those employees having completed three (3) but less than eight (8) years of consecutive service with City shall be entitled to three (3) weeks vacation with pay each year; those employees having completed eight (8) but less than twenty (20) years'of consecutive service with the City shall be entitled to four (4) weeks vacation with pay each year; and those employees having completed twenty (20) or more years of consecutive servi ce wi th the Ci ty shall be enti tl'ed to five (5) weeks vacation with pay each year. PERSONAL SERVICES No contract shall ever be made which binds the Cityfdr personal serviGes, except for professional or City Manager services to be rendered for any stated period of time, but all appointive employees shall be subject to peremptory discharge, and when discharged .shall only be entitled to compensation up to and including the date of their discharge, any provision to the contrary in this Charter notwithstanding. Contracts for professional or City Manager services shall be for a term of no longer than five (5) years, and shall contain express language providing for termination without-cömpensation beyond the date of occurrence of any of the following: Conviction of a felony or other crime involving moral turpitude; violations of the provisions of the Charter or of any ordinance, rule, or of special orders applicable to such person. GOODS, MATERIALS, SERVICES OR SUPPLIES The City or any agent of the City acting for it shall not make any contract for goods, materials, services, or supplies for the current use of any department of the municipality for more than one year, except as in this Charter provided, unless said contract and the cost thereof has been included in the annual budget of the City and unless an appropriation has been made therefor,' and no contracts or purchases shall exceed the amount appropriated. All contracts shall be made upon specifications and competitive bids except in those cases where s'uch specifications and competitive bids are not required by state law or in contracts for professional services, and no contract shall be binding until it has been signed by a designated representative of the City. Whenever the cost of any contracts charged to any appropriation equals the amount of such appropriation, no person representing the City shall sign or make any additional contracts chargable to such appropriation. Afte'r close observation I have determined the bid from Northeast" National Bank to be the better of the two bids far'" the fol1ow-' ing reasons: ( e (1) The overdraft limitation of $10,0,000.00 for 5 days as opposed to Northeast's overd~aft for·$~,OOO~OOO. for 180 days creates a problem because the Utility Fund and Capital Improvement Fund is invested on a 3 to 6 month basis and overdrafts usually run 90 days or better which would necessitate prematurely cashing the Certificates of Deposit at a penalty which amounts to 90 days interest regardless of how long the deposit has been left with the bank. (2) The difference on the rates quoted 'for the small C/D is insignificant since it represents less than 10% of the outstanding deposit balances. (3) The 1/2 of 1% difference pn the 30 and 90 day C/Ds represents approximately 35% of the deposit balances. (4) The quote on the 180 day C/Ds, is the same on both bids. (5) The one year C/Ds constitutes 'approximately 40% of our deposits 'and is ~% better from Northeast than from First United bid. The checks that are furnished are a nominal item since we use our voucher checks and with the computer system we need to use only one bank account for all funds and using voucher checks that will print on the computer. . We have the privilege under the new contract of buying either Money Market C/Ds or Treasury Bills as an option on our part. He said there have been two car dealerships in this area that have had to close, up. He said the volume of cars fluctuate and his concern was not with the sale of Lot 3, but Lot 4 might be sold and leave Lot 3 land- locked. Mr. Hannon said he felt it would be better to plat the,two lots into one lot or plat it to show an easement or right of way so continuous use could be maintained for future and current owners. Mr. Nowell said their concern is a time problem. He said there is a contractual agreement for Lot 2R. He asked if they decide to go ahead and plat 4 and 3R into one lot, could the' same time frame still be maintained. Upon an investigation of the project site we would recommend that retaining walls be constructed along a portion of the north line of blocks 1 and 2 near Venice Street because of the large difference in elevation between these lots and the lots north of this development, upon which existing residential structures are built, and because of the extremely steep existing relief slopes. Reinforced concrete or masonry materials would be prefered for these walls although railroad timber ties would be acceptable if proper anchoring back into the earth can be achieved. If retaining walls are not constructed we would recommend that compacted earthen embankment fill be placed against the existing slopes at a grade no steeper than 3 to 1 and further that this embankment surface be seeded or sodded with grass to provide erosion protection. 2. We would recommend that all proposed structures in Block 1 be constructed with finished floor elevations at least 18" above the IOO-year flood plain on Mackey Creek. Mr. Tucker said he was concerned about the difficulty for the city to control this high use area when people come to these recreational facilities. He said he did not know if it was in the best interest of the taxpayers of North Richland Hills to consider this request at this time because it is so far from fire and police protection. Mr. Hannon said he did not believe that there should be a high density use so far from the core of the city and he was not sure that this type of dèvelopment should be a private development. ( Mr. Hannon said the Commission would need more detailed plans on the development in ordei to approve a Planned Development zoning. He said he did not think it would be fair to approve this request with inadequate water' lines after one man had ,already been turned down for that reason. Section B.13 of the Subdivision Ordinance requires that all open ditches in all subdivisions that are used to c.arry surface runoff shall be lined across the entire area of each subdivision being developed, except as otherwise determined by the City Council. We would note that the 100 year stann will produce velocities of about 8 feet per second which is above the maximum normally acceptable for unlined channels. 3. If the Council decides that this channel should be concrete lined then we would recommend that rock rubble or some other riprap material be placed at the south end of this channel to minimize damage to the downstream property resulting from high exit velocities. 4. The water system master plan shows a future 16-inch water line along the south side of this property. Each unit above described shall be and constitute a separate and independent unit of improvements and the assessments herein provided for shall be made for the improvements in each unit according to the cost of the improvements in that unit and according to the benefits arising from the improvements in that unit. III. The hereinabove described plans and specifications are hereby approved and adopted. IV. Each of the above described portions of streets, avenues, and public places in. the City of North Richland Hills, Texas, shall be improved by raising, grading, and filing same and by constructing thereon an asphaltic concrete surface together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where ,shown on the pl'ans and in strict accordance with the plans and specifications therefore. V. Bids having been advertised for as required by the Charter of the City of North Richland Hills, Texas, and the bid of having found to be the lo~estand best bid for the construction of said improvements, the work of constructing said improvements and contract therefore is hereby awarded to at and for the prices stated in the proposal of said company and as reported and recommended by the City·s Engineers, which said report and recommendation is on file with the City, the Mayor, and City Secretary, and 'hereby directed to execute the said contract in;·the name of the City of North Richland Hills, Texas, and to impress the corporate seal of the City thereon, the såid contract embracing, among other things, the prices for the work. V I. To provide for the payment of the indebtedness incurred by the City of North Richland Hills, Texas, by said contract, there is hereby appropri ated out of ava i lab 1 e funds and current revenues o·f the Ci ty, an amount sufficient to 'pay said indebtedness so incurred. VII. The cost of said improvements as herein defined shall be paid for as follows, to wit: Ordinance No. Page 6 (a) On Rufe Snow Drive between Interstate Loop 820 north to St. Louis Southwestern Rail Road, in the City of North Richland Hills, Texas, the property abutting on that portion of the street to be improved and the real and true owners thereof shall pay for these improvements at the rate of $263.68 per linear front foot (for all property fronting on said street which in no way exceeds nine-tenths (9/10th) of the estimated cost of the improvement in addi ti on to curb and gutters. ' (b) The City of North Richland Hills shall pay all of the remainder of the cost of said improvements after deducting the amounts herein specified to be paid by the abutting properties and the real and true own~rs thereof as set out above in subsection (a). The amounts payable by the abutting proþerties and the real and true owners thereof shall be assessed against such properti~s and the real and true owners thereof and shall constitùte a first and prior lien upon such properties and a personal liability of the real and true owners thereof, and shall be payable as follows, to wit: When the improvements are completed and accepted by the City on a particular unit, the sums assessed against property abutting upon such completed and accepted unit shall become payable in five (5) equal installments, .due respectively on or before thirty (30) days, one (1) two (2), three (3), and four (4) years from the date of such completion and acceptance, and the assessments against, the property abutting upon the remaining units shall be and become due and payable in such installments after the date of the completion and acceptance of such respective unit. The entire amount assessed against the particular parcels of property shall bear interest from 'the date of such completion and acceptance of the improvements on the u· lJpon which the particular property abutts at the rate 'of six percen 6%) er,annum, payable annually~except as to interest on th· allme , which shall be due and payable on the date said nstallment matures, provided that any owner shall have the-right to pay any and all such installments at any time before maturity by paying principal, with interest accured to the date of payment, and further provided if default be made in the payment of any installment promptly as the same matures~ then at the option of the City of North Richland Hills or its assigns, the entire amount of the assessment upon which default is made shall be and become immediately due and payable; büt it is specifically provided that no assessment shall in any case be made against any property or any owner thereof in excess of the spec;'al benefits to property in the enhanced value thereof by means of said improvements in the unit upon which the particular property abutts, as ascertained at the hearing provided by law in force in the City, nor shall any assessment be made in any case until notice and hearing as provided by law. Said assessment against the . respective lots and parcels of property and owners thereof shall be evidenced by certificates of special assessment which shall be excuted in the name of the City of North Richland Hills, PROVÐDED, however that the City of North Richland Hills retains the right to authorize payment of the sums assessed t e e e Ordinance No. Page 7 against property abutting upon such completed andæcepted unit in a period of not more than four (4) years in equal regular installments or not less thatn TEN AND NO/lOa ($10.00) each, the first of such installment to become due and payable not more than thirty (30) days after completion and acceptance by the City of the praticular unit, PROVIDEO FURTHER, that such method of payments sha 11 be authorized onlyi n instances \^lhere the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills, a lawful, valid a~d binding note and mechanic1s and materialman1s contract upon forms supplied by the City granting a mechanic·s lien upon and conveying the said abutting property in trust to secure the payment by said owner or owners according to the terms thereof of the sums assessed against such property. VIII. The assessments against the respective lots and parcels of property and the owners thereof may be evidenced by certificates of special assessment, which shall be executed in the name of the City by the Mayor of said City, and the City" Secretary shall attest the same and impress the corporate seal of the City thereon, and which may have attached thereto coupons in evidence of the several installments, which the assessment is payable, which certificates shall be issued to the City of North Richland Hills, shall recite the terms and time of payment, the amount of assessment, the description of the property, and the name of the owners, as far as known, ~nd shall contain such other recitals as may be pertinent thereto, and shall further recite substantially that all proceedi ngs wi tho"reference to the maki ng of such improvements have been regularly had in compliance with law, and the preequistes to the fixing of the assessment lien against the property described in said certificates and the personal liability of the owners thereof, have been regularly had, done,and performed, such recitals ~hall be prima facie evidence of the matters so recited, and no further proof thereof shall be required in any court, 'and the certificates shall provide substantially that if default be made in the payment of any installment promptly as the same matures, then, )at the option of the City of North Richland Hills, or its assigns, the entire amount of the assessment shall be and become immediately due and payable together with reasonable attorney's fees and costs of collection, if incurred, all of which, 'as well as the principal and interest on the assessment, shall be a first and prior lien against the property, superior to all other liens and claims except State, County, Schoql District and City ad valorem taxes. No error or mistake in naming any owner or in describing any property or any other matter or thing, shall invalidate any assessment or any certifica'te issued in evidence thereof, and the omission of improvements on any particular unit or in front of any property except by law from the lien of special assessment for street improvements shall not invalidate any assessment levied. The certificates referred to need not contain recitals in exactly the ~ords above provided for, but the substance thereof shall suffice, and they may contain other additional recitals 'pertinent thereto. The City Engineer of the City of North Richland Hills, Texas, be and he is hereby, ordered and directed to file with the City Council estimates of cost of such improvements in each unit. x. The City Secretary is directed to prepare, sign and file with the County Clerk of Tarrant County, Texas, a notice in accordance with the provisions of Article 1220a of Vernon's Texas Civil Statutes and amendments thereto. XI. The improvements provided for herein shall be made and constructed, notice given, hearing held and assessments levied and all proceedings taken and had in accordance with and under the terms of the powers and provisions of Chapter 106 of the Acts of the First Called Session of the Fourtieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Texas Civil Statutes, and under which law these pro~eedings are taken and had. 'XII. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. WHEREAS, the City Council of the City of North Richland Hills, Texas, has heretofore ordered that each of the hereinafter described ., portions of streets avenues and public places in the City of North Richland Hills, Texas, be improved by raising, grading, filling, paving together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers. and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on ,the Plans and in strict accordance with the Plans and Specifications therefore; and contract therefore has been made and entered into with , and WHEREAS, the City Council of the City of North Richland Hills has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates on the amounts per, front foot and proposed to be assessed against abutting property and the owners therefore, and ·such estimates have been examined. '., e Ordinance No. Page 5 The estimated cost of the improvements on Rufe Snow Drive from Interstate Loop 820 north to the St. Louis Southwestern Rail Road is $263.68/Ft. Ft; the estimated amount per lineral front foot to be assessed against the abutting property and the owners thereof is $26.84 Ft., for residential and $43.19 for other property. III. e A hearing be given and held by and before the City Council of the City of North Richland Hills, Texas, to all owning or claiming any property abutting upon said portion of street, avenue and public place, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the 10th day of August, 1981, at 7:30 p.m. ,in the Council Chambers in the City Hall in the City of North Richland Hills, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fourtieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being shown as Article 1105b Vernon's Texas Civil Statutes. Such notice shall be by advertisement inserted at least three times in the city's official newspaper published in the City of North Richland Hills, Texas, the first publication to be made at least twenty-one days before the date of said hearing. Said notice shall comply with and,be in accordance with the terms and provisions of said Act. The City Secreta'ry is further directed to give per~onal notice of the time ~and place of such hearing to all owners or any others claiming any property abutting on said portions of street, avenue and public place as well as to all owning or claiming any interest in any such property. Such personalmitce shall be given by the City Secretary mailing said notice, at least fourteen (14) days before the date of such hearing, postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest in said properties, to the last known address of said owne~ or persons. It shall not be necessary for the City ,Secretary to mail said notice to any owner or other person claiming an interest in the property to be assessed when the address of such owner or other person is unknown to the City Secretary and cannot ;'be determined by the City Secretary after reasonable investigation. In connection, the City Secretary shall perpare and file with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mai~ed, together with the last known address of the respective owners and those persons owning an interest in said property. The City Secretary shall certify that each of the parties named in said list whose address was known was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The Certificate of the City Secretary shal be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice, shall in nowise': invalidate said hearing or any assessments levied pursuant to said hearing, but notice of hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property or any interest therein when same shall have been given by newspaper e Ordinance No. Page 6 advertisement as first hereinabove provided. Such notice sh~ll describe in general terms the nature of the improvements for which assessments are proposed to be levied, the street or highway to be improved, the estimated amount per front foot proposed to be assessed, the estimated total cost of the improvements on each such street or highway, the time and place at which such hearing' shall be held, and may consist of a copy of the published notice containing such. information. IV. The City Secretary is hereby directed to engross and enrol' this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. v. LOUIS SOUTHWESTERN RAIL ROAD, IN THE CITY OF NORTH RICHLAND HILLS, TEXAS and, WHEREAS, estimates of the cost of the improvements on each such portion of streets, avenues and public places were prepared and filed and by Ordinance No. , approved and adopted by the City Council of the City, and a time and place was fixed for a hearing and the. proper notice of time, place and purpose of said hearing was given ðnd 'said hearing was had and held at the time and place fixed therefore, to wit, on the 10th day of August, 1981, at 7:30 p.m. o'clock, P.M. in the Council Chamber in the City Hall in the City of North Richland Hills, Texas, and at such hearing the following protests and objections were made, to wit: Ordinance No. Page 2 and a11 desiring to be heard were given full and fair opportunity to be heard, and the City Council of the City having fully considered all proper matters, is of the opinion that the said hearing should be closed and assesments should be made and levied as herein ordered: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, THAT: I . Said hearing be, and the same is hereby, closed and the said protests and objections, and any and all other protests and objections, whether herein enumerated or not, be and the same are hereby, overruled. I I . The City Council, from the evidence, finds that the assessments herein levied should be made and levied against the respective parcels of property abutting upon the said portions of streets, avenues and public places andaganist the owners of such property, and that such assessments and charges are r~gh·t and proper and are substantailly in proportion to the benefits to the respective parcels of property by means of the improvements in the unit for which such assessments are levied, and establish substantial justice and equality and uniformity between the respective owners of the respective properties, and between all parties concerned, considering the benefits received and burdens imposed, and further finds further that in each case the abutting property assessed is specially benefited in enhances value to the said property by means of the said improvements in the unit upon which the particular property abuts and for which assessment is levied and charge made, in a s~m in excess of the said assessment and charge made against the same by this ordinance, and further finds that the apportionment of the cost of the improvements is in accordance with the law in force in this City, and the proceedings of the City heretofore had with reference to said improvements~ and is in all respects valid and regular. III. There shall be, anØ is hereby, levied and assessed agains·t., the parcels of property hereinbelow mentioned, and against the real and true owners thereof (whether such owners be correctly named herein or not), the sums of money itemized below opposite the description of the respective parcels of property and the several amounts assessed against the same, and the owners thereof, as far as such owners are known, being as follows: See attached charts. .. Where more than one person, firm or corporation owns an interest in any property above described, each said person, firm or corporation shall be personally liable only for its, his or hers pro rata of the total assesement against such property in proportion as its, his or her respective interest bears to the total ownership of such property, and its, his or her respective interest in such property may be released from the assessment lien upon payment of such proportionant sum. v. The several sums above mentioned and assessed against the said parcels of property, and the owners thereof, and interest thereon at the rate of six percent (6%) per annual, together with reasonable attorney's fees and costs of collector, if incurred are hereby declared to be and are made a lien upon the respective parcels of property against wh,ich the same are assessed, and a personal liability and charge against the real and true owners of such owners be correctly named herein or not, and the said liens shall be and constitute the first enforceable lien and claim against the property on which such assessments are levied, and shall be a first and paramount lien thereon, superior to all other liens and claims, except State and County, School District and City valorem taxes. e The sums so assessed against the abutting property and the owner9 thereof shall be and become due and payable as follows, to wit: in five (5) equal installments, due respectively on or before thirty days (30) days, one (1), two (2), three (3), and four (4) years from the date of completion and acceptance of the improvements in the respective unit, and the assessments against the property abutting upon the remaining units shall be and'become due and payable in such installments after the date of the completion and acceptance of such respective unit, nd shall bear interest from said date at the rate of six percent 6%) per annum, payable annually with each installment exc the erst installment, which shall be due and payable at the maturity thereof, so that upon the completion and acceptance of the improvements in a particular unit, assessments against the property abutting upon such completed and accepted unit shall be and become due and payable in such installments, and with interest from the date of such completion and acceptance. Provided, however, that any owner shall have the right to pay the entire assessment, or any installment thereof, before maturity by payment of principal and accured interest, and provided further that if default shall be made in the payment of any installment of principal or interest promptly as the same matures, then the entire amount of the assessment upon which such default is made shall, at the option of said City of North Richland Hills, or its assigns, be and become immediately due and payable, and shall be collectible, together with reasonable attorney's fees and costs of collection, incurred. PROVIDED, however, that the City of North Rìchland Hills retains the right to authorize payment of the sums assessed against property abutting e ~ Ordinance No. Page 4 upon such completed and accepted unit over a period of not more~han four years in equal regular installments of not less that $10.00 each~ the first year installments to become due and payable not more than 30 days after the completion and acceptance by the City of the particular unit~ and PROVIDED FURTHER that such method of payment shall be authorized only in instances where the owner or owners of property abutting upon such comleted and accepted unit shall have executed and delivered to the City of North Richland Hills a lawful valid and binding note and mechanic's and materialman IS contract upon forms supplied by the City of North Richland Hills granting a mechanic's lien upon and conveying the said abutting property in trust to secure the payment of said owner or owners according to the terms thereof of the sums assessed against such property. VI. If default shall be made in ¡the payment of any assessment, collection thereof shall be enforced either by the sale of the property by the City of North Richland Hills as near as possible in the manner provided for the sale of property for the nonpayment of ad valorem taxes~ or at the option of the City of North Richland Hills~ or its assigns~ payment of said sums shall be enforced by suit in any court of competent jurisdiction~ or as provided in any mechanic's or materialman's contract as foresaid, and said ~i~ shall exercise all of its lawful powers to aid in the enforcement and collection of said assessments. VII. The total amount assessed against the respective parcels of abutting property~ and the owners thereof~ is in accordance with proceedings of the City relating to said improvements and assessments therefore, and is less than the proportion of the cost allowed and permitted by the law in force in the City. VIII. Although the aformentioned charges have been fixed, levied and assessed in the respective amounts hereinabove stated, the City Council does hereby reserve unto itself the right to reduce the aforementioned assessments by allowing credits to certain property owners where curb and/or gutter or paving presently exists. Notwithstanding the City Council has herein reserved the right to issue credits as hereinabove provided, it shall hot be required to issue such credits, and will not do so, if same would result in any inequity and/or unjust discrimination. The principal amount of each of the several assessment certificates to be issued the City of North Richland Hills, Texas, as hereinafter provided, shall be fixed and determined by deducting from the amount of any assessment hereinabove levied such amount or amounts, if any, as may hereafter be allowed by the City Council as a credit against the respective assessments. Ordinance No. 4IÞ Page 5 IX. For the purpose of evidencing the several sums assessed against the respective parcels of abutting property and the owners thereof, and the time and terms of payment to aid in the enforcement and collection thereof, assignable certificiates in the principal amount of the respective assessments less the amount of any respective credit allowed thereon, shall be issued by the City of North RichlandHills, Texas, upon completion and acceptance by the City of the improvements in each unit of improvement as the work in such unit is completed and accepted, which certificates shall be excuted by the Mayor in the name of the City and attested by the City Secretary, with the corporate seal of the City of North Richland Hills, or its assigns, and shall declare the said amounts, time and term of payment, rate of interest, and the date of completion and acceptance of the improvements abutting upon such property for which the certificate is issued, and shall contain the name of the owners, if known, description of the property by lot and block number, or front feet thereof, or such other descri"ptiòns as may otherwise identify the -same;, and if said property shall be owned by an estate, then the description of same as so owned shall be sufficient and no error or mistake in describing any property, or in giving the name of the owner, shall invalidate or in anyway impair such certificate, or the assessments 4IÞ levied. 4IÞ The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectible, with reasonable attorney's fees and costs of collection, if iricurred; and shall provide substantially that the amounts evidenced thereby shall be paid to the City Secretary of the City of North Richland Hills, Texas, who shall issue his receipt therefore, which shall be evidence of such payment on any demand 'for the same, and the City Secretary shall deposit the sums so received in a spearate fund, and when any payment shall be made to the City the City Secretary, upon such certificate shall, upon presentation to him of the certificate by the holder thereof, endorse said payment thereon. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Secretary the amount paid upon presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Secretary's Warrant for making such payment. Such payments by the Secretary shall be receipted for by the holder of such certificate in writing and by surrender ther~of when the principal, together with accured interest and all costs of collection and reasonable attorney's fees, if incurred have been paid in full. Said certificate shall furher recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law, and that all prerquisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters recited in such certificates, and no further proof thereof shall be required in any court. Ordinance No. Page 6 Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, whic~ coupons may be payable to the City of North Richland Hills, or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. Said certificates shall futher recite that the City of North Richland Hills, Texas, shall exercise all of its lawful powers, when requested to do so, to aid in the enforcement and collection thereof, and may contain recitals substantially in accordance with the above and other additional recitals pertinent or appropriate thereto; and it shall not be necessa~ that the recitals be in the exact form above set forth, but the substance thereof shall be sufficient. The fact that such improvements may be omitted on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywiseinvalidate, affect or impair the lien of such assessment upon other premises. x. Full power to make and levy assessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof, is in accordance with the law in forc'e of this City, vested in the City. XI. All assessments levied are a personal' liability and charge against the real and true owners of the premises described, notwithstanding such ~ners may not be named, or may be incorrectly named. XII. . The assessments so levied are for the improvements in the particular unit upon which the property described abutts, and the assessments for the improvements in any unit are in noway a~fected by the improvements or assessments in any other unit and in making assessments and in holding said hearing, the amounts assessed for improv~ents in anyone unit have been in n~ise connected with the improvements or the assessments therefore in any other unit. .' X I I I . The assessments levied are made and levied under and by virture of the terms, powers and provisions of an Act passed at the First Called Session of the Forthieth Legislature of the State of Texas, known as Chapter 106 of the Act of said Session and now shown as Article 1105b of Vernon's Texas Civil Statutes. e e e Ordinance No. Page 7 XIV. Several of the Council members also expressed their concern on the traffic problem in the residential area. ~he zoning request was granted with no further mention of access to Bridal Path Trail. When Jo BeeI's was built, the stockade fence that separates their property from the residential area on the west was constructed across the entrance to Bridal Path, thereby cutting off any chance for ~o Beels' traffic to exit onto Bridal Path. Jo Beel's is now requesti~gthat they be allowed to open their parking area to Bridal Path Trail. They have agreed to bear the cost of improving the street. Mr. Baenisch has requested that Bridal Path Trail, a dedicated street in Richland oaks Addition, Third Filing, be opened from Mesa Verde Drive to his west property line. This item was discussed during the platting of Jim Baenisch's property. At that time, we under- stood the roadway could be improved into Mr. Baenisch's property. However, it appears that there is some misunderstandings as to the intent of the council in approving the plat and the use of Bridal Path Trail. In this regard, we request that this item be placed on the City Council's agenda for further clarification.
