4. Councilman Hubbard moved; seconded by Councilwoman
Groves, to approve the minutes of the March 11, 1982,
Council meeting.

Motion carried 5-0; Councilman Freeman abstaining due
to absence from the meeting.
5. Mayor Faram opened the public hearing and called for
anyone wishing ~o speak in favor of this request to
please come forward.
Mr. Robert Boustring, 3712 Sweetbriar, Bedford,
Board Member Fort Worth Christian College,
appeared before the Council.
Mr. Boustring stated they had a problem with the
gym at the college flooding and he felt that if this
request was approved it would eliminate the problem.
Mr. Boustring stated it would also provide housing
for their teachers.
Mr. Don Ferguson, 7401 Christoper Court, North
Richland'Hills, appeared before the Council.
Mr. Ferguson stated he felt this rezoning would help
the flood problem and the 60 foot wide street would
help with the traffic problem.

Mrs. Carolyn Bonham, 1625 Weyland Drive, North Richland
Hills, appeared before the CQuncil.
Mrs. Bonham stated she felt this rezoning would be
a good thing. Mrs. Bonham stated she lived in
the sub-division next to this property.
Mr. Douglas Davis, 6204 Abbott Avenue, Nbrth Richland
Hills, appeared before the Council.
Mr. Davis stated he was a member 'of the Citizen Advisory
Committee for Area #3. Mr. Davis stated he wanted it known
that he had no interest whatsoever in this property. The
developers knew he was a member of the committee and
asked him to make a survey of the neighbors. Mr. Davis
stated he made the survey and there was no resistance
to the building. Mr. Davis stated he strongly recommended
that the Council approve this request.
Mr. Forest Grubb, 6528 Topper, appeared before the Council.
Mr. Grubb stated he had been a member of the North Richland
Hills Planning and Zoning Commission and recognized the flooding
problems. Mr. Grubb stated he felt this development would
enhance the flood control.

Mr. Theron Bonham, Representative of TLB-GSC Enterprises,
Incorporated, appeared before the Council.
Mr. Bonham stated they also had developed the adjacent
sub-division. When they developed the sub-division, they
had put in a channel and when the last two big rains
came he talked with Mr. Bronstad and Mr. Forester who
looked at the channel during the rains and it handled
the run-off fine~
Mr. Bonham asked that the Council approve this request.
Mayor Faram called for anyone wishing to speak in opposition
of this request to please come forward.
Mr. John Gibbs, 5728 Bermuda Drive, appeared before the
Council.
Mr. Gibbs stated he was not really in opposition to this
request, but would like to ask a couple of questions.
Mr. Gibbs asked what was going to happen to the traffic
on Holiday Lane and what would happen to the water downstream.
Mayor Faram asked Mr. Gibbs to be more specific.
Mr. Gibbs stated he was refering to the water at thë
bridge"at the high school.
Mayor Faram stated the developers if granted the request,
would be required to take the water course to a recognized
drainage channel at the developers cost.
There being no one else wishing to speak, Mayor Faram
closed the public hearing.
6. Councilman Kenna moved, seconded by Councilman Freeman,
to approve PZ 82-2, Ordinance No. 941.
Motion carried 6-0.
7. Mayor Faram opened the public hearing and called for
anyone wishing to speak in favor of this request to
please come forward.
Mr. Neal Cukerbaum, 4950 West Grove, Dallas, representing
Cambridge Companies, appeared before the Council.
Mr. Cukerbaum stated it was their intent to develop a
shopping center. Mr. Cukerbaum stated they wanted to
have mixed office space, one story and multi-story
buildings and a hotel-motel building. Mr. Cukerbaum
stated there was a limitation on the height of
buildings in Local Retail zoning was the reason
they wanted commercial zoning.

Mayor Faram stated he had a problem with the commercial
zoning because of the number of undesirable businesses
that could be placed in commercial.
Mayor Faram asked if the request could be altered.
Mr. Cukerbaum stated he would not be against deed
restrictions on the property against undesi'rable users.
Mayor Faram askeØ Mr'. Cukerbaum what kind of time limit
he was on in getting this property rezoned.
Mr. Cukerbaum stated he was not on such a tight time limit
that this request could be delayed until the next meeting.
Mayor Faram called for anyone wishing to speak in opposition
to this request to please come forward.
There being no one else wishing to speak, Mayor Faram
closed the public hearing.
8. Councilman Freeman moved, seconded by Councilman Kenna, to
postpone PZ 82-3, Ordinance No. 942, until the meeting of
April 12, 1982.
Motion carried 6-0.
9. Mayor Faram opened the public hearing and called for anyone
wishing to speak in favor of this request to please come
for\-/ard.
Mr. Burk Collins, Owner of Riéhland Square Shopping
Center, appeared before the Çouncil.
Mr. Collins stated that a Chinese restaurant was
planned for this site and they wanted to sell mixed
beverages. .
Mayor Faram asked Mr. Collins if he was aware
that the permit would be issued in a specific name
and would be non-transferable.
Mr. Collins stated the permit would be in the name
of Tommy Lok.

10. Councilman Hubbard moved, seconded by Councilman Ramsey,
to approve PZ 82-4, Ordinance No. 943, permit to be in
the name of Tommy Lok and non-transferable.

Mr. Burk Collins, Owner Richland Square Shopping Center,
appeared before the Council.
Mr. Collins stated this site was also going to be
used for a restaurant and they wanted to be able to sell
alcoholic beverages. Mr. Collins stated the permit
would be in the name of Chris Arkas.
Mayor Faram called for anyone wishing to speak in opposition
to this request to please come forward.
There being no one else wishing to speak, Mayor Faram
closed the public hearing.
12. Councilman Hubbard moved, seconded by Councilman Kenna,
to approve PZ 82-5, Ordinance No. 944, permit to be
in the name of Chris Arkas and non-transferable.
Motion carried 6-0.
13. Mayor Faram read the following ordinance caption:
"AN ORDINANCE DETERMINING THE NECESSITY FOR AND ORDÉRING
AND PROVIDING FOR THE IMPROVEMENT OF A PORTION OF THE
FOLLOWING STREET: RUFE SNOW DRIVE FROM ST. LOUIS SOUTH-
WESTERN RAILROAD NORTH TO FAIR MEADOWS DRIVE IN THE CITY
OF NORTH RICHLAND HILLS, TEXAS, LETTING CONTRACT TO

Mr. Al Rich, 6636 Avalon, Watauga, appeared before the
Council.
PUBLIC HEARING
RUFE SNOW DRIVF
IMPROVEMENTS
Mr. Rich stated he really did not understand what was happening
in the way of assessments and payments. Mr. Rich stated it was
his understanding that the city wanted to purchase close
to 1800 square, feet of his property at $1.20 a square foot
and then wanted him to pay approximately $1,235.00 for curb
and gutter. Mr. Rich stated it was his understanding that
he could not be assessed at more than what the improvements
would increase his property. Mr. Rich stated he could not
see how his property would increase in value, by losing 1800
square feet of property for a six inch curb. Mr. Rich stated
he understood the need for the street improvement, but he
could not see the city paying him $1,235.00 for his property
and him having to spend part of it for curb and gutter that
he really did not want.
Mayor Faram asked Mr. Rich if it was his contention that
his property would not increase in value.
Mr. Rich stated he was pretty well convinced that it
would not improve his property.
Mr. MçEntire stated there had been an agreement made between
North Richland Hills City Council and Watauga City Council,
with respect to disagreement on values. Mr. McEntire stated
there would be independent appraisers appointed by each city.
Mr. McEntire advised Mr. Rich that it was the feeling that
the widening of Rufe Snow would increase the value of his
property.
Mr. Rich stated he did not feel it would increase his value
anymore than it would everyone elses.

Mayor Faram stated that in his meeting with the Mayor, City Manager,
Councilmen Garcia and Suratt, he made a commitment to them that
he felt the Council would honor. The agreement was that the
City of Watauga and the City of North Richland Hills could select
a neutral appraiser and base the purchase price on the appraisal
if there was a disagreemen~. Mayor Faram asked Mr. Rich if
he would be willing to settle on the agreement that was made.
Mr. Rich stated he did not particularly like the idea.
Mayor Faram advised Mr. Rich that if the appraisal came up
different an adjustment would be maQe. Further, if the
contract estimate came in cheaper than what had been forecast
there may be some additional credits coming to him.

Mr. Rich stated that to get the appraisers would be fine.
He thought everything would be settled tonight.

Mayor Faram stated that hopefully the ordinance would be
approved tonight, but there could be exceptions, if
he felt he had been unfairly dealt with, then he would
be exception number one.
Mrs. Mary Hensarling, 6613 Sunset Road, North Richland
Hills, appeared before the Council.
Mrs. Hensarling stated she agreed there was a need to
improve the street, but felt everyone that it would
benefit should have to pay. Mrs. Hensarling stated
she did not feel they should be assessed.
Mrs. Hensarling stated the street was behind
her house and would not benefit or increase the
value of her property. Mrs. Hensarling asked when
and who devised the assessment plan for Rufe Snow.
Mr. Albin stated that Resolution No. 79-28 set
the rates for assessments.
Mrs. Hensarling asked if she could find out how close
the street would come to her fence.

Mr. Albin showed Mrs. Hensarling a map showing how
close the street would be to her fence.
Mayor Faram advised Mrs. Hensarling that property was
not going to be assessed anymore than it would
increase in value.
Mr. Chip Driver, 6636 Sunset, North Rich1and Hills,
appeared before the Council.
Mr. Driver stated that he would like to know what
he was being charged for.
Mayor Faram stated that Mr. Driver had 117 feet of
frontage and his total assessment would be $1,209.93.

Mr. Driver asked how close Rufe Snow would be to
his property line.
Mr. Albin showed Mr. Driver his property on the map and
where the street would be located.

Mr. Driver stated his house was only 38 feet from
Rufe Snow at the present time. Mr. Driver stated
the street would be next to his fence line and all
I . he got out of the deal was paying money out. Mr. Driver
stated he agreed the improvements were needed, but he
was having to pay for everyone elses property values
to go up. Mr. Driver stated the whole community would
go up in value and why should a chose few have to be
the ones to pay.
Mayor Faram stated that corner lots normally had a
greater assessment because there was more frontage,
but by the same token they were higher in value.
Mr. Davis stated he did not feel corner lots were
higher in. value.
Mayor Faram advised t1r. Driver that-the street improvement
was not totally at his expense, the rest of the taxpayers
would share the expense. Mayor Faram stated the assessment
against the property would raise the value and if it did
not then it would be adjusted.
Mr. Driver stated that if it raised the price of his house,
and when he got ready to sell, no family would want to
move into a house with a five lane road that close. .
Mayor Faram stated it was not inconceivable that Mr. Driver's
property sometime down the road might turn into a commercial
package.
Mayor Faram asked Mr. Driver if he did agree the street
improvements were needed.
Mr. Driver stated he did agree the improv~ments were needed.
Mayor Faram asked Mr. Driver if he took exception to the
assesslnent.
Mr. Driver stated he did take exception to the assessment.
Mayor Faram stated Mr. Driver's property would be'
appraised by an independent certified appraiser.

Mr. Driver asked if he could have an appraiser.
Mayor Faram stated yes, if he wanted to pay for a certified
appraiser, then the city would accept his figures.

Mr. Driver stated he wanted to talk to his father-in-law
about this first, but he would like to be an exception.
Mr. Driver stated that if no one objected to him getting
an appraiser, and if he did, he would be in touch with the
city officials within three days.
Mayor Faram advised Mr. Driver that if he chose an appraiser
then he would have to pay for it. Mayor Faram advised
Mr. Driver to make sure the appraiser was certified.
Mr. C. B. Pippin, 6701 Rufe Snow Drive, Watauga, appeared
before the Council.
Mr. Pippin stated he would also be speaking in behalf of
his mother at 6640 Summertime. Mr. Pippin stated
the letter he received stated the assessment was $10.69 a
front foot for curb and gutter. r1r.Pippin stated that
in the Watauga Council meeting it was his understanding
that he would be contacted and see if an ágreement could
be reached. Mr. Pippin stated no one had contacted him.
Mayor Faram stated the figure that was quoted was an engineer's
estimate and was an upper figure. Mayor Faram stated the
figure could be adjusted downward, but not higher depending
on how the bids came in.
Mr. Pippin stated there was an existing curb on half of his
property at the present time.
Mayor Faram asked if the existing curb met specifications.
Mr. Albin replied no.
Mr. Pippin stated that the street would come within 6 feet
of his mother's bedroom and if that improved the property
value, he would like to know how.
Mr. Albin showed Mr. Pippin the map on the propsed street.
Mr. Albin stated the street would not be that close, only
the working right-of-way.
Mayor Faram advised Mr. Pippin that the city would deal
with each individual property owner.
Mr. Pippin asked that if the property did object, would the
city get in touch with them individually.
Mayor Faram stated yes.
There being no one else wishing to speak, Mayor Faram closed

Mayor Faram stated he also extended his thanks to Mr. Harrison.

Councilman Ramsey stated he felt t1ayor Faram was to be commended
for his time and efforts put forth on this project.
Councilman Ramsey stated he felt there were a lot of
citizens that owed Mayor Faram their gratitude.
Councilman Ramsey stated that he wanted to personally
.express his appreciation to Mayor Faram.
Mayor Faram called a recess.
Mayor Faram called the meeting back to order. The
same Council Members and Staff were present as recorded
at the beginning of the meeting.
17. Mr. Line stated the staff recommended the bid be awarded
to Alexander & Alexander and Crawford, Mitchell and
Thomas as indicated. The Council needed to authorize
$100,987.00 for a year period. Mr. Line stated the
Council also needed to authorize $22,177.00 from the
General Fund to cover the initial cost to implement
this plan.
Councilman Ramsey moved, seconded by Councilman Freeman,
to approve the staff's recommendation and authorize
the expenditure.

Councilman Kenna stated the insurance plan was put together
by Councilman Freeman 'and Mr. Bill Burk and felt the
city owned them a real thanks. Councilman Kenna stated
he wanted to also thank Ron McKinney for the fine job he
did on the insurance.
Councilman Hubbard stated that with the insurance plan would
be a savings to the city of $111,655.00 during the next
three years.
Councilman Freeman stated Mr. Burk had spent many hours
reviewing the insurance and working with the staff, he
would like for the city to recognize t·1r. Burk.
Mr. Line stated a resolution could be presented to Mr. Burk
at the next Council meeting.

bids that would be submitted for this project.
Councilman Hubbard moved, seconded by Councilwoman Groves,
to approve the refurbishing of Johnson and College Hills
ground storage tanks.

20. Councilman Hubbard moved, seconded by Councilman Ramsey,
to approve payment to Austin Road Company in the amount
of $41,242.05, Booth Calloway.
Motion carried 6-0.
21. Councilman Kenna moved, seconded by ·Councilwoman Groves,
to approve payment to Austin Road Company in the amount
of $4,399.12 for Rufe Snow Drive.
Motion carried 6-0.
22. Mr. Line stated the report summarized most of the
activity on the drainage improvements in the city at the
present time. The report also gives the status of
some of the major projects in various stages of preparation
that had not yet begun. Mr. Line stated the staff recommended
approval by the Council for authorization to obtain bids or
proposals from Aerial Photographing mapping companies for
city wide topographic mapping, which is needed to give the
engineerinq firm the tools to develop the next phase, an
overall master drainage plan.
Mr. Line stated the Staff also asked for authorization to
negotiate a contract with the engineering firm to develop
the drainage master plan that was needed for guidance for
future growth in the city.
Mr. Line stated the proposals would be brought back to
the Council for approval and appopriation of funds to cover
the cost.

respect to photographic maps and the other to work with
the consulting engineering firm for a master drainage project.

adequate insurance protection to prevent any liabilities or losses incurred
by the City from becoming an unnecessary burden to its' taxpayers; and
WHEREAS, the costs to provide such insurance is rising annually at
an alarming rate; and
WHEREAS, the time had come to renew the City's insurance policies;
and
"WHEREAS, the City desired to obtain the best insurance coverage
at the best price; and
WHEREAS, Mr. Bill Burk, a Citizen of North Richland Hills and a
member of the insurance profession, provided his professional advice and
guidance at no cost to the City; and
WHEREAS, Mr. Bill Burk's recommendations based upon his review of
the City's insurance needs and his evaluation of the bids that were received
will save the taxpayers more than $100,000 during th~ next three years; now

P & Z wh~re they ap,proved the preliminary plat. Item #3 of the Cit~ Enqineer's letter
dªted Oecember 29. 1981 stated Mr. Culp would be required .to extend the 12" water &
sewer lines and install a fire hvd·rant. Mr. Culp stated this would be a financial
strain since he is just wanting to build such a small building.
Mr~ Culp has already signed a covenant for "the pro rata.
The Planning & Zoning Commission approved the preliminar.¥ plat and waived item #3 with
the stipulation that at such time the water & sewer is available that Mr. Culpwould
extend it to his property.
The Planning & Zoning Commission recommended approval of the final ~lat with a vote of
4 to 1 with Mr. Hannon voting against.

of water line, along with related gate valves, fire hydrants,
street bores, and pavement replacement (estimated cost of this
water line extension = $15,500).
The owner believes that an expenditure of this magnitude would
be unreasonable for the type of expansion he plans. Should
. there be any utility improvements in this area in the future,
the owner is agreeable to participating with his pro rata share
of the cost.

1. We would note that this subdivision is adjacent to a plat previously
submitted as the Ðalworth Industrial Park Addition, which was
denied approval by the Council. However, the Ðalworth Industrial
Park plans included water, sewer and storm drainage construction
which this submittal does not include. This addition is presently
. served by a 2-inch water line in Ðavis Blvd. and an on-site septic
. sewer system.
2. As this lot, which is zoned industrial, developes, the present water
and sewer systems \'/hich serve this lot may be insufficient to
handle industrial-type demands. Fire protection coverage has not
been provided, and we would discourage the continued use of the
existing septic sewerage system unless the Developer can demonstrate
to the City's satisfaction that such existing faciliti·es are sufficient
to support the future needs o'f this subdivision.
3. As indicated in our Dalworth Industrial Park review letter dated
April 2, 1981, we \'lOuld recommend that a 12-inch \'/ater line along
the east right-of-way line of Ðavi.s Blvd. be extended northward
from ~,1ain Street to provide adequate fire protection coverage of this
lot and adequate water service to meet industrial type demands.
The Fire Chief has indicated that a minimum 12-inch line is required
for fire protection to industrial areas, therefore, City participation
in this line would not appear to be necessary. An additional minimum
8-inch water line extension within this development from the proposed
12-inch line in Davis Blvd. along with dedicated utility easements
would be required to provide a 30Q-foot radius of fire coverage
to the existing bUildings along with future structures in this
subdivision.
4. Any construction \"/ithin the Davis Blvd. right-of-\.¡ay should be
approved by the Highway Department.

In accordance with your instructions to us in the regular council meeting
of March 22, 1982, we have obtained proposals from four (4) aerial
topographic mapping firms for your consideration of Contract award. A
summary tabulation showing the various proposals submitted along with
proposal letters from each firm are enclosed for your review.
The purpose of this project is to obtain 111 = 200 foot scale, 2-foot
contour interval topographic grid map sheets of the entire City of
North Richland Hills for use in preparing a comprehensive drainage master
plan study required to identify potential flooding areas and propose plans
of improvement. These maps will also serve as invaluable tools for all
types of City development and construction planning. Part of the cost of this
topographic map preparation can be recovered by selling copies of these maps
to Developers for their use in subdivision planning.
We would recommend that this Contract be awarded to Dallas Aerial Surveys, Inc.,
for Proposal Item B.l in the amount of $39,800 for a total project completion
time not to exceed 180 calendar days. This proposal includes the preparation
of about 36 grid sheets showing all roads, streets, highways, railroads, creeks,
major drains, dams, tanks, bridges, culverts, buildings, houses, fences, power
poles, outline of timber areas, cross-county power and pipelines, swimming
pools and parking lots, etc., along with topographic contours at 2-foot
intervals with spot elevations at intersections and high points. The
topographic maps will be prepared on 3611X2411 mylar reproducible sheets.
This proposal also provides for 111 = 500' scale negatives to be used in
preparing the grid maps. The 500 scale negatives will assure greater
horizontal and vertical accuracy, and this scale is the same scale as the
City's overlay mapping system which includes the official city base map,
zoning map, water system and sewer system maps. Contact prints can be made
from the 500 scale negatives to aid in updating these overlay maps.
We would further recommend that the preparation of photo film positives not
be included in this co'ntract at this time since aerial photos such as these
can be obtained from the Tarrant County Appraisal District later this year when
this work is completed by their consultants, Williams-Stackhouse, Inc.

We will make a new aerial flight using a preC1SLon aerial camera at an
altitude so as to provide a photo scale of 1"=1000'.
We will furnish~ the neces~ary horizontal and vertical controls. Horizontal
control 'established shall originate from and tie into existing survey markers
of the U.S. Coast and Geodetic Surveys in the vicinity and will have an accuracy
of second order or better. All coordinate computations shall be based on the
Texas State Coordinate System. All vertical control will originate from and tie
into existing bench marks of the U.S Coast and Geodetic Survey and/or other
competent agencies The map control will be collocated and expanded using a
Kern CPM-l comparater.

Map shall be drawn at a scale of 1"=200'
Contours shall be shown at 5 foot intervals.
All roads, streets, highways, railroads, creeks, major drains) dams,
tanks, bridges, culverts, landmark buildings, outline of timbered areas,
cross-country power and pipelines, and major fences will be shown.
Grid lines shall be shown at 1000 foot intervals based on the Texas State
Coordinate System.
All drafting will be by the scribing process and will be of excellent
quality of workmanship. The finished map sheets shall be on mylar film.
Sheet size will be 24 x 36 inches with a map area of 20 x 30 inches, the
remaining area being used for border and title block purposes.
Photo film sheets will be produced to closely match the above mentioned

We will make the aerial flight as soon as possible after written
notification to proceed. Such work shall be completed and delivery of all
photo film sheets and topographic maps shall be made within 120 calendar

days of the date of the contract. As the foliage on the trees have already
begun to develop, the' proper flying time for a contour mapping project has
already passed. Because of the current need for the maps) we could draw the
necessary maps, then if there are any contour gaps in the mapping area, we

contours.
The cost to render the above services will be Twenty-six Thousand,

In response to your recent request, we are pleased to furnish the following proposal for
mapping the City of North Richland Hills (approximately 12,000 acres).
A portion of this proposal is based upon using material our firm is contracted to prepare
for Tarrant Appraisal District. This material is owned exclusively by Tarrant Appraisal
District, and their permission for its use will be required.
PROPOSAL FOR 2' CONTOURS
. Aerial Photograph~
As soon as weather conditions permit, we will obtain new aerial photography of the City.
This will be taken at a scale of 1" = lQDO' (llQ.0' above ground), using a Wild RC-IO (3Y.z"
focal length) mapping camera. - ,- -- -====-
Due to foliage considerations at this time of year, we recommend that the photography
be taken in color, rather than black and white. This will help to provide our map com-
pilers with better visibility in those areas with heavy vegetation growth.
Although we acquired aerial photography of the same area in February of this-year, it
was taken from an altitude (7800') not suitable for mapping to a 2' accuracy. __
Field Control Surveys

Once the photography work is completed, we wjll mobilize a survey crew to the Rroject
area to obtain both horizontal and vertical control. ~

The horizontal control will be established utilizing second order survey techniques, and
will be referenced to the Texas State Plane Coordinate System.

Vertically, the surveys will be established to third order accuracies, and will be refer-
enced to mean sea level.
The network of control obtained in the field will then be expanded by use of analytical
aerotriangulation techniques. This will be accomplished utilizing a V AX/VMS computer
sy.stem and a program obtained from the U. S. Geological Survey.
Map Compilation
Utilizing Kern PG-2 stereoplotters, we will then compile topographic maps at a scale
of 1 II = 200' with a 2' contour interVal. .
In areas of heavy vegetation growth, we will utilize the higher altitude black and white
photography taken for Tarrant Appraisal District to supplement the new coverage. Al-
though we could not plot with the same degree of accuracy, this photography was taken
when foliage conditions were optimum, and it would be possible to map areas which would
now be obscured.
As an economical measure, the maps will contain only limited planimetric detail. This
will include roads, railroads, and major drainage features. Other detail ~uch as buildings,
wooded areas, poles, fence lines, etc. would not be compiled, but would be visible on
photo sheets which would correspond in scale and area to each of the map sheets.

Once compiled, the mapping will be final drafted (scribed), and copied into a 24" x 36"
sheet format. There will be a total of 37 sheets, the layout of which will be the same
as that for Tarrant Appraisal District. . Each sheet will be delivered in the form of a
reproducible stable-base my lar .
A mylar sheet index will also be prepared and delivered.
Map Accuracies
The accuracy of the mapping will be as follows:
Ninety percent of all well defined planimetric detail will be plotted
to within 1/40" at map scale, and no such feature will be in error by
more than 1/20".
Ninety percent of all solid-line contours will be accurate to within
one-half the con~our interva~ and no such contour will be in error by
more than one full interval.

In areas of dense vegetation (heavy brush, trees, etc.) where visibility
of the ground is obscured, the contours will be shown as dashed lines
and plotted as accurately as photogrammetric methods permit.
Photo Sheets
As mentioned previously, we will prepare photo sheets to correspond to each of the map
sheets. These will be at a scale of 1" = 200', and will be printed in the form of reproduc-
ible screened film positives.

of the orthophotos we are in the process of c~mpiling. If not, we will prepare scal~-

In accordance with your letter dated March 24~ 1982, we are pleased
to fU,rnish the fo.l1owing proposal for photogrammetric mapping services
on referenced project.

Aerial photography will be completed v/ith a~ focal length Wild
Rca precision aerial mapping camera. . This aerial photography will be
. flown with 60% forward overlap and 30% sidelap between adjacent strips.
The scale of the aerial photography will, be depenpent on the contour
interval selected. Aerial photograþhy will be flown at a scale of
111=500· fo.r the portrayal of ',two foot contours and 1"=10001 for the
portrayal of. five foot contours. The delivery items will consist of
one set of .911 x 9" contact prints and an index to the photography.
Necessary horizontal and vertical field control will be established
within the designated mapping area to provide basic requirements for
aerotriangulation to meet· National Map Accuracy Standards. 'Traverse
work for establishing the required horizontal control will' be completed
with one second optical reading theodolites and Hewlett-Packard distance
measuring equipment. Level lines for establishing required vertical
control ,will be accomplished with Zeiss Self-Leveling Levels arid Phil a- .
del phi a Rods. All traverses and level lines will be initiated at estab-
lished monumented stations within the,ar~a and will be closed to .similar
stations or completed as loops to provide for final adjustment of the
completed data.

Analytical aerotriangulation procedures will be initiated utilizing
glass diapositiv~s from the original aerial film'wherein these data .will
be PUGGED on our Wild PUG equipment to provide a ,minimum of six horizontal
and vertical points per stereo model. These PUGGED data ·will subsequently
be measured on our Mann Comparator interfa~ed with an AutoTrol Digitizer
and an IBM Cardpunch. These resulting measurements will be adjusted to
the established horizontal and vertical control by strip and block adjust-
ment utilizing our CATS analytical aerotriangulation reduction program.

Several months ago I requested the State to survey this
intersection to determine if signalization was warranted.
The State has notified me that the study is complete and the
intersection does warrant signalization. In terms of pedestrian
traffic~ automobile traffic and interruption of traffic~ this
signalization is needed for safety and for public convenience.
I respectfully request Council's approval to proceed immediately
with plans and sPecifications in order that we can complete the
project before the school term begins in September.
This is a relatively simple intersection to signalize with the
exception of a railroad pre-emptor. I feel the pre-emptor
is essential because of the proximity of the railroad on Davis
and Main as well. My estimate of the total project including
engineering is $~8,500.
I recommend that we employ P.A.W.A. to engineer this project should
it be approved. They are traffic engineering specialists and have
worked for us on other projects.
Funds for this project could be appropriated from General Fund
Surplus.

The Tarrant Housing Finance Corporation (the
IICorporationll) is proceeding with a program to issue single
family mortgage revenue bonds (the "Bonds") in order to
finance qualified rehabilitation loans under the Federal
Mortgage Subsidy Bond Act of 1980. Such loans are intended
to finance the acquisition and rehabilitation of homes
located in Tarrant County that meet the requirements of the
home enhancement loan program, the parameters of which are
outlined in the attachment to this letter.
The Corporation was created and operates pursuant
to the Texas Housing Finance Corporations Act, Article
12691-7, Vernon's Texas Civil Statutes, as amended, (the
"Act It). The Act provides that in order for the proceeds of
the Bonds to be used to finance rehabilitation loans for
homes located within a city in Tarrant County, the popula-
tion of which exceeds 20,000, the governing body of such
city must first approve the use of the proceeds of the Bonds
for such purpose. Accordingly, we have enclosed for your
consideration a proposed resolution which would evidence
your approval of the use of the proceeds of the Bonds to
finance rehabilitation loans for homes located within your
City limits.

Because the Corporation wishes to sell the Bonds
as soon as market conditions are, favorable, the underwriters
for the Bonds have respectfully requested that you conside~
the enclosed resolution at your earliest convenience. Upon
adoption of this resolution, please return to us five
certified copies of the resolution. The sixth copy is for
the City's records.
In the meantime, should you have any questions

Must agree to, close loans with due diligence, but in any case
must make commitments within 12 months, and close within 16

5. May offer from other funds to make a rehabilitation loan in
addition to the one in the program, even if the total acquisition
cost exceeds guideline amounts. Such a loan would be
subordinate to a loan und'er this program.
1. Is structured to mature with the underlying loans, but subject
to call in the event of early loan payments.
2. f\~ust be registered.
3. Will be rated by both services, possibly "AA."
4. Will include reserves equal to about 13% of the mortgage pool.
Fees and Expenses
1. The mortgage rate may not exceed the bond coupon rate by
more than 1 %.
2. Lenders will be asked to put up a 3% fee, 1% commitment and
2% origination.

The fees may be recovered from the seller; if no seller, then
at the option of the lender, from the owner.
4. The second rehabilitation loan will be at such rates and for
such terms as are mutually agreeable between the lender and
homeowner.
5. Servicing will be 3/8 of 1 % net fee to lender at closing of the
permanent loan.

TARRANT COUNTY HOUSING FINANCE CORPORATION
SINGLE FAMILY MORTGAGE REVENUE BONDS
REHABILITATION LOAN PROGRAM, SERIES 1982
WHEREAS, the Tarrant County Hous'ing Finance
corporation (the "Corporation") was created by a Resolution
adopted by the Commissioners Court of Tarrant County, Texas
(the "County") pursuant to Article 12691-7 I Vernon I s Texas
civil statutes, as amended (the "ActU);
.
WHEREAS, pursuant to the Act, the Corporation
intends to issue its single Family Mortgage Revenue Bonds
Rehabilitation Loan Program, Series 1982 (the "Bonds") in
order. to provide funds to purchase from participating
lenders mortgage loans that have been made to eligible
borrowers to finance owner occupied single family resi-
dential housing within the County.
WHEREAS, the Act requires that the governing body
of any ci ty located wi thin the County, the population of
which .exceeds 20, 000, must approve the usè of the proceeds

§ 33.07. Additional Penalty for Collection Costs
(a) A taxing unit or appraisal district may provide, in the manner
required by law for official action by the body, that taxes that re-
main delinquent on Ju1y 1 of the year in which they become delin-
quent incur an additional penalty to defray costs of collection, if the
unit or district or anothér unit thàt collects taxes for the unit has
contracted with an' attorney' pursuant to Section 6.3~ of this code.
The amount of the penalty may not exceed 15 percent, of the amount
of taxes, penalty, and interes~ 4ue. .' .' .... .
(b) A~ tax lien attaches to .the property on which the tax is. im-
posed to secure payment of the penalty.
(c) If a penalty is imposed pursuant to this section, a taxing ,unit
may not recover attorney's fees in a suit to' collect dëlinqucnt taxes

(d) If a taxing' unit or apprais~l'distri~t provide; fo~ a penalty un-
der this section, the collector shall deliver a notice of delinquency and
of the penalty to the property owner at least 30 and not more than 60

You will notice that this section became effective on January
1, 1982. It applies to 1981 taxes which remain delinquent after
July I, 1982, and to subsequent years taxes which remain delin-
quent after the appropriate July 1. It does not apply to 1980 'and
previous years delinquent taxes.
The Property Tax Code also provides for additional compen-
sation for attorneys representing taxing units and for the
recovery of costs and expenses in the following sections:
§ 6.30. Attorneys Rep~esenting Taxing Units
(a) The county attorney or, if there is no county attorney, the dis- I
trict attorney shall represent the state and county. to enforce. .the
collection of delinquent taxes if the commissioners court does not con-
tract with a private attorney as provided by Subsection (c) of this
section. '
(b) The- governing body of a taxing unit other than a county may
determine who represents the unit to enforce the collection of de1in-
quent tax~s. If a taxing unit collects taxes for another taxing unit,
. the attorney representing, the unit to enforce the collection ~f delin-

From the foregoing, it is my opinion that we, as your attor-
neys, are authorized to be paid on the basis of twenty per cent
(20%) of the amount of taxes, penalty and interest collected from
January I, 1982. We ask that the City approve this new basis for
our fees by having the Mayor execute this .letter in the space
provided..below.
On cases involving taxes for the years 1980 and prior years,
we will ask for fifteen per cent (15%) of the total amount of
taxes, penalties and interest due on cases we file in court. This
amount will be yours and would offset the amount paid to us as
attorneys' fees.
For the 1981 taxes, you must notify the property owner at
least thirty (30) and not more than sixty (60) days prior to July 1
of the imposition of the penalty on July 1 if the taxes remain
delinquent on such date.
If the provisions of Section 33.07 are adopted, you will not
be able to collect attorneys fees in a suit to collect delinquent
taxes (Section 33.07[c]) as you could under Section 33.48 were it
not for such adoption.
, The law prior to January 1, 1982, allowed recovery of
reasonable attorneys' fees -- up to 10% -- on cases filed in
court. A taxing unit was allowed to contract with an attorney for
up to 15% of the amount collected. The new law allows you to
impose a 15% penalty on taxes delinquent after July I,
irrespective of whether suit is filed to collect. The taxing unit
may now pay its attorney 20% of the amount collected.

Although it is impossible to forecast the financial impact of
this change, I believe it will be in the interest of the City to
adopt the ordinance and the provisions of Section 33.07. There
will be some confusion until all delinquent taxes have become
subject to the new penalty. This will have to be worked out.
We believe it is important -- particularly at the present
time -- to furnish us delinquent accounts for collection as soon
as possible. On those accounts which have more than one year
delinquent, we need up to date lists of both real and personal
property as soon as possible so that we may proceed with pending
litigation and so that the suits which we are currently filing may
include an intervention for the ci ty showing all delinquent
amounts owed. Those accounts which are delinquent only for 1981
should be turned over to us on July 1.
If the Council approves the new basis for our fees, please
have the Mayor sign in the space provided below and return a copy
to us for our files. We appreciate very much the privilege of

WHEREAS, Sec. 33.07 of the Property Tax Code provides that a penalty
of not more than 15% of the Tax, penalty and interest may be added to such
tax, penalty and interest on delinquent taxes after July 1 of the year in
which they become delinquent when a tax unit has retained a private attorney
for the collection of delinquent; and,
WHEREAS, in order to defray the cost of collection of such delinquent
taxes it is advantageous to the taxpayers of the City of North Richland Hills
to adopt the provision of Sec. 33.07 of the Texas Property Tax Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH RICHLAND HILLS
TEXAS, THAT:

The city adopt the provisions of Sec. 33.07 of the Property Tax
Code so that hereafter an additional penalty of 15% of the
