HomeMy WebLinkAboutOrdinance 2910 ORDINANCE NO. 2910 AN ORDINANCE AMENDING THE NORTH RICHLAND HILLS COMPREHENSIVE PLAN AND COMPREHENSIVE ZONING ORDINANCE BY AMENDING SECTION 118-1, DEFINITIONS, AND ADDING DEFINITIONS FOR THE USES OF PET DAY CARE, WEDDING CHAPEL AND WEIGHT LOSS CENTER AND AMENDING THE DEFINITION OF SPECIAL PERSONAL SERVICE SHOP; REPEALING SECTION 118-204 REQUIRING A CS SPECIAL USE PERMIT FOR USES WITHIN OR WITHIN 200 FEET OF RESIDENTIALLY ZONED PROPERTY; REPEALING SECTIONS 118- 354, 118-393 AND 118-423 REQUIRING SITE PLAN APPROVAL FOR CERTAIN MANUFACTURED HOUSING, COMMERCIAL AND INDUSTRIAL USES WITHIN 200 FEET OF EXISTING RESIDENTIALLY ZONED PROPERTY OR PROPERTY SHOWN AS RESIDENTIAL ON THE COMPREHENSIVE PLAN; AMENDING SECTION 118-242 TO REQUIRE SITE PLANS FOR ADMINISTRATIVE REVIEW; AMENDING SECTION 118-631 TABLE OF PERMITTED USES BY ELIMINATING THE CS DESIGNATION AND THE REQUIREMENT FOR SITE PLAN APPROVAL FOR COMMERCIAL USES WITHIN 200 FEET OF RESIDENTIALLY ZONED OR RESIDENTIALLY PLANNED DISTRICTS; AMENDING THE TABLE UNDER SECTION 118-631; ESTABLISHING A PENALTY; PROVIDING FOR SEVERABILITY AND FOR PUBLICATION. WHEREAS, staff and the Planning and Zoning Commission have recommended revisions to the comprehensive zoning ordinance to update and revise such ordinance to include additional and revised definitions and to eliminate requirements for requiring site plan approval of certain development by the Planning and Zoning Commission and Council where there is no discretion for requiring any changes therein, as well as to eliminate conflicting provisions and eliminate conflicts with state law; and WHEREAS, the City Council has determined that the amendment to the North Richland Hills Code of Ordinance herein made is in the best interest of the health, safety and general welfare of the citizens of the City of North Richland Hills, Texas; and WHEREAS, notice has been published of the time and place of a public hearing held before the City Council concerning the changes herein made, which public hearing has been duly held; and, WHEREAS, the City Council has determined that the amendment to the Comprehensive Zoning Ordinance herein made is in the best interest of the health, safety and general welfare of the citizens of the City of North Richland Hills; Ordinance No. 2910 Page 1 of 4 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF NORTH RICHLAND HILLS, TEXAS: Section 1. THAT Sec. 118-1 of the North Richland Hills Code of Ordinances hereby amended by adding thereto the following definitions: "Pet Day Care means an indoor facility dedicated to sheltering and caring for the basic needs of household animals, but not including medical assistance, breeding, grooming, outdoor runs, or overnight boarding. Wedding Chapel means a building set aside for the use of conducting a ceremony in which a representative of the state and family and friends come together to witness the joining together of two individuals in marriage. This facility can also be used for receptions and celebrations associated with a marriage ceremony. Weight Loss Center means a facility that provides equipment, counsel, and nutritional supplements intended to help individuals in their attempt to lose weight. It does not include surgical equipment designed to reduce weight." Section 2. THAT Sec. 118-1 of the North Richland Hills Code of Ordinances is hereby amended by amending the definition of Special Personal Service Shop to read as follows: "Special Personal Service Shop means an establishment where the primary use of the building or lease space includes any of or any combination of the following: psychic readers, tattoo parlors, body or piercing parlors, the sale of cigarette papers, bongs, or other smoking accessories. This definition shall not include massage therapy or acupuncture clinics, cigar or cigarette shops, or permanent cosmetics as part of a beauty salon." Section 3. THAT Section 118-242 of the North Richland Hills Code of Ordinances be amended to read as follows; "Sec. 118-242 Administrative Site Plan Approval. (a) No development or construction of any structure or occupancy of any land shall occur unless a site plan is first submitted and has been approved by the Development Review Committee (defined in Section 110-5 of the Code of Ordinances). A site plan must be submitted prior to or concurrently with building permit construction plans. The site plan must be approved prior to issuance of any building permit for development. No building or site shall be occupied unless all construction, development and operations conform to the site plan approved under this section. Failure to comply with the approved site plan may result in non-issuance or revocation of an occupancy permit. Site plan approval shall not be required for property zoned for single family dwelling purposes or any Ordinance No. 2910 Page 2 of 4 accessory uses incidental thereto. (b) If construction of a site with an approved site plan has not commenced within 12 months of the date of final approval of the site plan, the site plan shall be deemed to have expired, and a review and re-approval of the approved site plan by the DRC shall be required before construction commences on the project. Said review and approval shall be evaluated according to the standards of Article III, taking into account changes in the surroundings and in applicable ordinances which have occurred subsequent to the prior approval of the site plan. (c) The enforcement officer may approve minor modifications of a site plan approved under this section if such modifications are necessitated by final architectural and engineering design and do not materially change the circulation and building location on the site. Section 4. Sections 118-204, 118-354, 118-393 and 118-423 of the North Richland Hills Code of Ordinances are hereby repealed. Section 5. THAT Sec. 118-631 of the North Richland Hills Code of Ordinances is hereby amended by adopting by reference the table attached to this ordinance and by amending such section to read as follows: "Sec. 118-631. Table of permitted uses The following table presents the zoning district classifications and the permitted uses within those classifications. Uses are listed in accordance with permitted uses (P), used permitted by a special use permit (S), and prohibited uses (blank). Note: Procedures and conditions requiring a special use permit are contained in section 118-201 et seq." Section 6. This ordinance shall be deemed an amendment to the North Richland Hills Comprehensive Plan as well as to the specific code sections. Section 7. Penalty. Any person, firm or corporation violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to continue shall constitute a separate violation and punishable hereunder. Section 8. Severability. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and section of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. The City Secretary of the City of North Richland Hills is hereby directed to publish the caption and penalty of this ordinance in the official City newspaper. AND IT IS SO ORDAINED.
