MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS, HELD IN THE CITY HALL, 7301

1. Mayor Faram called the meeting to order June 28, 1982, at
7:30 p.m.

3. The invocation was giyen by Reverend Brent Trotter, Associate
Pastor, North Richland Hills Baptist Church.
4. Councilman Hubbard moved, seconded by Councilwoman Hinkle, to
approve the minutes of the June 14, 1982 meeting.
Motion carried 7-0.
Mayor Faram presented the following proclamation:
"WHEREAS, it is the desire of the City Council of the
City of North Richland Hills, Texas, to extend public recog-
nition to RICHARD MATTOX for his heroic and courageous acts
of bravery whereby his actions contributed to the 'saving of
one David Andrew's life on May 19, 1982; and
WHEREAS, without regard for their personal safety and
well-being, RICHARD MATTOX and Rodger Shaver did rescue
David Andrews from his battered raft in the flood-swollen
waters of Fossil Creek; and
WHEREAS, the City Council of the city of North Richland
Hills takes great pride in the young people of our community
and thereby does publicly voice appreciation to RICHARD MATTOX
for his acts of compassion and bravery in the saving of a human
life;

NOW, THEREFORE, I, Dick Faram, by virtue of the authority
vested in me as Mayor of the City of North Richland Hills,
Texas, do hereby publicly applaud RICHARD MATTOX for his
heroic efforts on the 19th day of May, 1982. I do further
call upon all citizens of this community .to join hands with
the Mayor and Council in a gesture of gratitude for the
service this outstanding young man performed to another
in a time of need.

5. Mayor Faram advis~d the Council the Planning and Zoning
Commission recommended approval. The additional easements
had been incorporated into the plat.
Councilman Hubbard moved, seconded by Councilman Fisher,
to approve PS 82-l5.
Motion carried 7-0.
6. Mayor Faram opened the public hearing and called for anyone
wishing to speak in favor of this request to please come
forward.
Mr. Tim McClendon appeared before the Council.
Mr. McClendon stated he was requesting this property to be
rezoned from single family to local retail in order to build
an insurance office. Mr. McClendon stated he planned on re-
moving the existing residence and building a brick office
building.
Mayor Faram called for anyone wishing to speak in opposition
to this request to please come forward.
There being no one else wishing to speak, Mayor Faram closed
the public hearing.
7. Mayor Faram stated the Planning and Zoning Commission had
recommended approval.
Councilman Ramsey moved, seconded by Councilman Davis, to
approve PZ 82-12, Ordinance Number 960.
Motion carried 7-0.

8. Mayor Faram opened the public hearing and called for anyone
wishing to speak in favor of this request to please come
forward.
Mr. Chuck Owen, 6129 Abbott, appeared before the Council.
Mr. Owen stated they were requesting the rezoning for a
three acre tract. Mr. Owen stated .they planned to build
duplexes on the site. Mr. Owen showed elevations of the
type units they planned to build.
Councilman Hubbard asked Mr. Owen if they planned to construct
fences where the property backed up to Watauga Road and
Smithfield Road.
Mr. Owen stated they planned to construct fences.
Councilman Hubbard asked if the cars would enter from the rear
of the buildings.
Mr. Owen stated the vehicles would enter from the rear; they
felt that if the vehicles enter from the rear the duplexes
would look more like a one-family home.
Mayor Faram called for anyone wishing to speak in opposition to
this request to please come forward.
There being no one else wishing to speak, Mayor Faram closed the
public hearing.
9. Mayor Fararn advised the Council the Planning and Zoning Com-
mission had recommended approval.
Councilman Hubbard moved, seconded by Councilman Kenna, to
approve PZ 82-16, Ordinance Number 96l.
Motion carried 7-0.
10. Mayor Faram advised the Council that Mr. "Hughes had withdrawn
his request.
11. Mayor Faram stated approval would authorize the sale of
$4,500,000 General Obligation Bonds, to be sold 9-13-82.
Councilman Kenna moved, seconded by Councilwoman Hinkle, to
authorize the sale of $4,500,000 on September 13, 1982.
Motion carried 7-0.

Councilman Hubbard moved, seconded by Councilman Fisher, to
·approve Ordinance Number 962.
Motion carried 7-0.
13.
Mr. Line stated the proposal was to add one half-time staff
position. This person would be in charge of operating the
Cable TV studio which would serve the municipal cable as well
as the community cable needs. The studio would be furnished
and equipped with equipment that Black Hawk presently had
located in, an office on Watauga Road near Rufe Snow. This
arrangement would be temporary or possibly permanent depending
on the demand that occurs in the future for City-type programs
as well as community-type programs. Mr. Line stated the City
had received a letter from Black Hawk indicating they were
willing to provide the equipment, sound control ,room and what-
ever advice and training that would be required for the City
to get into the business. Mr. Line stated Black Hawk was
willing to re-estaDlish and reopen a separate studio at such
time in the future as demands for City-type and community-type
programs grew so great that two studios would be needed.
Mr. Line stated he felt it obvious that two fully equipped
and fully staffed studios were not needed at this time.
Mayor Faram stated that with the Cou~cil'.s permission, he would
depart from the rules and asked Mrs. Beverly Riley, Chairman of
the Cable TV Advisory Committee, to speak.
Mrs. Riley stated the Committee was very much in favor of this.
Councilman Hubbard moved, seconded by Councilman Ramsey, to
authorize the position and approve the transfer of funds.
Motion carried 7-0.
14.
Councilman Kenna moved, seconded by Councilman Davis, to
approve partial payment, Estimate #2, to R. E. Dow and Son
in the amount of $25,902.97, funds appropriated fr?m utility
Fund Surplus.
Councilman Hubbard asked if the job was completed.
Mr. Albin replied no.
Councilman Davis asked if the Council needed to act on the
request for an extension of time.
Mr. Line stated yes.

councilwoman Hinkle moved, seconded by Councilman Kenna, to
approve payment, Estimate #4 and final, to J. D. Griffith
in the amount of $26,024.71, funds to be appropriated from
Rufe Snow bonds.
Motion carried 7-0.

Mayor Faram advised the Council that the staff had recommended
the bid of Jack Williams Chevrolet be accepted.
Councilman Hubbard moved, seconded by Councilman Newman, to
accept the bid of Jack Williams Chevrolet in the amount of
$8,l70.69.
Councilman Fisher asked why local dealers did not bid.
Mr. Line stated he did not know why they did not bid, they
were invited to.
Councilman Davis asked what the pickup would be used for.
Mr. Horvath stated the pickup would be used by the city Garage.
Councilman Kenna asked if the funds were budgeted.
Mr. Line stated yes.
Motion carried 7-0.
17.
Mr. Line stated this was a recommendation to the Council for
establishing ranges for the non-classified employees to
establish a minimum and maximum for ten or twelve positions.
Mr. Line stated that previously there had been only a fixed
amount of salary, which necessitated going to the -Council on
individual salary increases. Mr. Line stated that in his
opinion that was conducive to putting the Council into an
administrative-type activity as opposed to a policy-making
role as the council was suppose to follow. Mr. Line stated
he proposed the salary ranges be established for these
reasons.
Councilman Kenna moved, seconded by Councilman Hubbard, to
establish the salary range as presented by the City Manager.

councilman Davis asked if there were any projections as to how
long the salary ranges would be effective.
Mr. Line stated he anticipated that these ranges would be
effective as long as the organization remained basically as
it was, unless the market changed drastically. Mr· Line
stated that if one of these positions took on a great deal
more or less responsibility, then the range would be changed
or provided that the ranges were adjusted to meet the cost of
living requirements as the Civil service type positions were
adjusted.
councilman Kenna asked if it was anticipated applying the
cost of living each year at budget time and raising by the
amount that Civil service did.
Mr. Line stated yes, he thought it was essential that it be
done because if the cost of living adjustments were not
applied to the non-classified personnel as they were to the
classified, then it would be a matter of time before the
classified employees would be making more than the supervisors.
Motion to approve carried 7-0.

Mr. McEntire stated he recommended the council refer this item
to him and the staff for study. Mr~ McEntire stated he would
have a resolution at the next council meeting suspending the
rate request.

councilman Kenna moved, seconded by councilwoman Hinkle, to
suspend action on this item and refer it to the city Attorney
and staff for study.
Motion carried 7-0.
19.
Mr. LeO Wehkamp, construction supervisor for Grandy's,
appeared before the council.
Mr. Wehkamp stated Grandy's was basically a country-fried
chicken restaurant. Mr. Wehkamp stated they proposed to
build a new restaurant in the front of the new outlet mall
located on Rufe Snow Drive. Mr. wehkamp stated they made
application to the city and was denied a curb-cut on Rufe
snow.

Mr. Wehkamp stated his request was for a curb-cut approximately
120 feet north of the main entrance to the shopping center.
Mr. Wehkamp stated the shopping center had granted them per-
mission to enter the mall from the rear. Mr. Wehkamp stated
the only other way to get into their site would be through
Rufe Snow. Mr. Wehkamp stated the major objection was the
traffic basically coming out of t~eir site and wanting to
turn left and the other major objection would be people
coming north and wanting to turn left into the establishment.
Mr. Wehkamp stated his proposal to eliminate this problem
would be to put a median down the center of Rufe Snow just
north of Lewis Drive, which was the entrance to the shopping
center.
Mayor Faram stated he had discussed this with the Staff earlier
in the day and it was his impression it was not the major objec-
tion. The objection was the street design was for a pull-out
lane for right turning traffic and it was designed so there
would be three curb-cuts to the whole area. An additional
curb-cut at this ìocation would be objectionable because it
would do away with getting the right turn traffic off the main
thoroughfare. Mayor Faram stated the main objection was that
there was a turn-out lane into the right going south. Mayor
Faram stated the staff had a problem as the street was designed
for only three openings.
Mayor Faram asked Mr. Wehkamp if Grandy's owned the property.
Mr. Wehkamp stated no.
Mayor Fararn asked if there was another access without the
curb-cut.
Mr. Wehkamp stated yes, from the rear, but that was not
acceptable to Grandy's.
Mayor Faram stated he felt the curb-cut would do away with the
total street design.
Councilman Ramsey asked Mr. Wehkamp if they had a restaurant
located in Hurst.
Mr. Wehkamp stated yes.
Councilman Ramsey stated the restaurant in Hurst did not have a
curb-cut in front and was similar to the one proposed for Rufe
Snow.
~IT. Wehkamp stated there was one curb-cut at the leaving side
of the restaurant located in Hurst.

Councilman Ramsey stated the design of the proposed restaurant
showed that to enter from the rear would not be inconvenient
for people to drive into the shopping center and go around.
Mr. Wehkamp stated their research showed the majority would
come off the street.
Councilman Davis asked if there would be a signal light at
Lewis Drive and Rufe Snow.
Mr. Horvath replied yes.
Councilman Davis stated he felt that with the curb-cut it
would discourage people to go through the light where
there would be controlled ·traffic.
Mayor Faram stated the Staff had recommended this request
be disapproved and he would add his recommendation for
disapproval of the request.
Councilman Kenna moved, seconded by Councilman Ramsey, to
disapprove the request of Grandy's for the curb-cut on
Rufe Snow Drive.
Motion carried 7-0.

Delbert Stembridge, Consulting Engineer,
came forward to represent Lartnec, Inc.
Mr. Stembridge said Lartnec owns the 5
lots left by the Factory Outlet Mallon
Rufe Snow Drive.
Mr. Stembridge said TESCO had requested
some additional easements which he did not
wànt to give. He said he felt they
probably were not needed s6 he called TESCO
and the owner of the property and they said
he could leave them off and if they needed
them, they could get them at a later date.
Mr. Tucker stated our" ordinance states we
are to contact the utility companies to
see if any easements are needed and if so
it is best to get them on the plat before
it is recorded,.

Mr. Stembridge said TESCO stated he could
leave them off because they might never
need them.

street with a cul-de-sac. He said. they
would have a 30 ft. wide street, lighted,
with concrete curb and gutter, and drainage
as required by city specifications. Mr.
Owens sa id it is proposed .that the sani tary
sewer will be installed by extending the
existing service line located at the north-
west corner of the tract in Watauga Road,
and water will be served from a line adjacent
to the property on the west side of County
Road #3004 (Smithfield Road).
Mr. Owens said the homes will be totàl
electric with underground electric and

and curve data do agree. We are sending a'print

3. The replat has been fully executed and notarized.
4. The area of the two replat lots has been added to

We have reviewed the referenced materials for this subdivision and offer
the following comments:
1. The distance of 140.0 feet on the south line of Lot 4R does not
agree with the 150.0 foot distance shown on the original plat.
This should be checked and corrected if necessary.
2. The curve data for the 56.44 foot arc does not agree with the
curve data shown on the original plat. This should also be checked
and corrected if necessary.
3. The replat should be fully executed and notarized before approval.
4. We would request that the area of the two replat lots be shown
on the plat.
5. Utility companies should be notified of the replat in accordance
with standard City procedures.
Should you have any questions concerning the review of this subdivision,
please do not hesitate to call.

Chuck Owens, 6129 Abbott Ave, an Associate
of Charles Owen Company, came forward. He
passed out preliminary drawings of the
layout of the land.
Mr. Owens stated they were requesting this
zoning change from Local Retail to duplexes.
He said they plan dual ownership of the
duplexes, highly restricted owner-occupied
subdivision.
Mr. Owens said the site will have 10 units
with a total value of over $1,000,000· the
homes will front on a 220 ft. long city
street with a cul-de-sac. He said they
would have a 30 ft. wide street, lighted,
with concrete curb and gutter, and drainage
as required by city specifications. Mr.
Owens said it is proposed that the sanitary
sewer will be installed by extending the
existing service line located at the north-
west corner of the tract inWatauga Road,
and water will be served from a line adjacent
to the property on the v/est side of County
Road #3004 (Smithfield Road).
Mr. Owens said the homes will be total
electric with underground electric and
telephone service lines. He said power

will be served from existing overhead
power lines running along the south and
west property lines to limit any require-
ments for additional power poles. He
said these homes will have rear-entry
driveways extending from a concrete paved
access way on the south and west which
will be built to city specifications with
the homes on the north entering onto
Watauga Road. Mr. Owens said all the
homes will be 100% brick and have an
architecturally appealing exterior design
of like quality to ones in these pictures.
He showed the Commission several photos.
Mr. Owens sa id ·the exterior styl es wi 11
vary and an emphasis will be placed on
decorative characteristics such as shutters,
columns, railings, etc. and the homes will
be completed with landscaping and fences
before occupancy. Mr. Owens said each
homeowner will be required to sign a
restrictive covenant governing the care and
maintenance of the property and these
covenants will be strictly enforced.

Mr. Owens said they feel this development .
will be an aesthetically appealing asset to
the community and will bring in residents
employed by commercial and industrial firms
in the area.
The Chairman opened the Public Hearing and

H. L. Rupert, 6220 Price Drive, came
forward. He said the east side of his
property backs up to this property.
Mr. Rupert asked how large these duplexes
would be.
Mr. Owens stated they would be 2000 to
2400 sq. ft., which would be 1000 to 1200
sq. ft. for each unit.
Mr. Rupert asked if there would remain the
10 ft. easement on the west side of the
property.

After reviewing the information contained in the Real Log Homes
Brochure supplied by Pat Hughes there are several modes of con-
struction in this type of home that will exceed requirements of the
uniform building code for residential construction.

Because of the construction characteristics that follow I have no
question as to the fire safety involved in this type of home.
1.
Even as untreated yellow pine the logs have a flame spread
rating of 124 or less. (Class C). This flame spread can be
reduced to .even greater protection by a spray application that
is available throughout the United States and is' also certifiable.
The walls, both interior and exterior which are one in the same
can actually be protected to a Class B flame spread which is what
the interior of a place of assembly is required to be in the City
of North Richland Hills.
2. The assembly of these walls in the way they interlock to each
other and at joints give the entire structure monolithic qualities.
Also, the average thickness of the logs being 8.3 inches compares
to the fire resistance of two hour fire walls which under the
uniform building code a residence is not even required to have a
one hour exterior wall.
3. Another unique quality found in th.is type of construction is that
the walls are solid and all of the electrical wiring runs along
and behind base boards. This situation eliminates any and all
concealed spaces in the walls such as you find in ordinary
construction that act as a flue in a chimney and can produce
drafts for a fire.

BACKGROUND:
Financing of Phase II of the.Rufe Snow Drive project, as well as
other critical storm drainage and street improvement needs, will require the sale
of previously authorized general ob~igation bonds. September 13, 1982 has been
determined to be an appropriate date, and $4,500,000 is the amount that best meets
the City's financial needs and long range fiscal planning ·requirements.
The attached financial projection indicates that this 1982 sale and
a 1985 sale of the remaining $1,500,000 ih authorized bonds can be accommodated
with no increase in the current'debt levy of $.22 per $100 valuation.

A proposed Capital Improvement Program will be presented to the
City Council at its regulàr budget planning. workshop on July 23rd to give the
Council an opportunity to evaluate the City's capital improvement needs in an
orderly, comprehensive manner and to establish priorities for utilizing the bond
sale proceeds to the maximum advantage.

BACKGROUND: With the res~&~ation of our Deputy Tax Assessor/Collector, Lou Spiegel
asked the Civil Service Commission on June 17th to recommend to the Council the
approval of an Account Clerk positio~. The vacated Deputy Tax Assessor/Collector
positiôn will not be filled.
Lou's case in support of this new position was based u~on the reduced
duties·of our Tax Office (because of the Tarrant Appraisal District) and an
increasing work1oad~in the Finance Department. She suggested that the Account
Clerk would be able to handle the Tax office duties previouslX performed by the
Deputx Tax Assessor/Collector on a part-time basis and the remaining time assist
. Claudette Smyth. In essence, Lou was asking for a full-time person to fill two
·part-time positions. The Com~ission agreed and voted unanimously to recommend
the Account Clerk position and that the position be placed in ~aygrade 5. No
additional funding is required.

Black Hawk Cable Communications Company has offered to present to the

City of North Richland Hills, on loan, the video equipment from its public access
studio located at Watauga Road and Rufe Snow Drive and to build a studio in the Library.
If·this offer is accepted, the Library Department will need a 20-hour per week staff
member to coordinàte the expansion' of the ·service·s of Citicable 36. A job description
for this position is attached. The personnel costs are computed at Pay Grade 5
@ $5.90'per hour for 20 hours for 11 weeks "(July 19 thr\l September 30,1982). The
'studio will need additional special wiring and supplies to begin operations. The
amounts are shown below. Funds are included in the proposed 1982-83 Budget to contin\).e
this program.

Per previous discussions, CBS/Black Hawk is ready to relocate its North
Richland Hills Studio and related equipment to the North Richland Hills
City Library.

CBS/Black Hawk will provide the following:
* All costs related to the construction of the control room, with
a window and doors leading into Room 100 (control room).
* Maintenance and repair of .all equipment.
* Administration of the Public "Access Programming according to
adopted rules and wishes of the City and the Cable Advisory
Committee.
* When the demand becomes too great, CBS/Black Hawk will reopen an
office in North Richland Hills and take back all of the èquipment
at the library in order to provide services from the new location.
It is my understanding that the City of North Richland Hills will provide
the following:
* Approximately 10' x 14' space in the library for construction of
the control room. (Actual size to be determined in the design
phase.)
* Access to the studio facilities by CBS/Black· Hawk Personnel.
* Permission to CBS/Black Hawk to close the office now being used
for studio purposes which is located at Watauga-Smithfield Road.

This is a status report of the referenced project which we have pre-
pared to acquaj~t you with the history and recent events associated .
with this drainage system. Attached is a schematic layout of the
project, which was prepared by Gordon Swiftt showing a graphic repre-
sentation of èó~t participation in the storm drain improvements by
Clark Brothers, N.E. Construction (Hamm and Sandlin)~ and the City
of North Richland Hills.

The construction plans for the Holiday West Addition~ Section III,
were approved by the City Council in 1979 and these plans included
stonn drainage in Trinidad. Drive, Guadalajara Drive a.nd Buenos Aires
Drive which was designed to serve only the Holiday West Addition with
minimal provision for future off-site drainage requirements. Con-
struction of this system, which was designed by Gordon Swift for N.E.
Construction Co., was delayed, we understandt because of financial
problems by the developers. .

Subsequently, we were a~s;gned the design of Rufe Snow Drive paving
and drainage improvements. Our drainage study revealed that in order
to discharge the storm water runoff generated on Rufe Snow Drive, in
accordance with City criteria,' an extension of the storm drain lines
westward from Santa Dom;nga Drive in Trinidad and Buenos Aires to Rufe
Snow would be required. Additionally, oversizing of the Holiday West
lines would be required to provide extra capacity for the Rufe Snow
runoff. Extra capacity for the Clark Brothers Industrial Park system
north of Trinidad Drive had already been provided by Gordon Swift in
the original Holiday West design.
The City Council agreed to pay for the storm drain extensions in
Trinidad and Buenos Aires west of Santa Dominga Drive and for the
oversizing east of Santa Dominga Drive in Trinidad, Guadalajara and
Buenos Aires. Contracts were let for construction of this system
by Clark Brothers) N.E. Construction and the City with Gordon Swift
handling the project administration for both Clark Brothers and N.E.
Construction) and with our firm performing the project administration

Staff Salary Ranges
DEPARTMENT: City Manager and Civil Service
BACKGROUND: It is proposed that the City Council establish salary ran~es for
appointed positions of the City of North Richland Hills, similar to the salary
plan for Civil Service employees implemented last year. This will give the Council
control over maximum allowable salaries, while giving the City Manager the
opportunity to reward outstanding performance. . Recruitment to fill vacant positions
will be greatly simplified, and employees wilf be given incentives to· perform
at thè level needed to enable financial advancement. Financial expectations will
be clear to the emp~oyees since" they will know the limits of allowable salaries
within their job classifications.
The basis for the proposed salary ranges is outlined in the
· attached memorandum.

The attached salary schedule was developed on the basis of:
1. salary comparisons for like positions in Hurst, Haltom
City, Bedford and Euless;

2. the Police Chief and Public Works Director position
ranges tentatively approved by the City Council in
April; and
3. internal salary relationships taking into consideration
the degree of responsibility, size of organization and
number supervised, qualifications and ability, and using
the Police Chief and Public Works Director position salary
as a base.
No adjustments of staff salaries for performance/merit will be made until the
1982-83 budget year. The attached schedule does not include the cost of living
recommendations made by the Civil Service Commission.

Gentlemen:
On June 24, 1982, our company filed a Statement of Intent (Attachment
No.1) to change the rates charged for gas service in North Rich1and Hills.
The new rates will result in an estimated annual revenue increase for Lone
Star of $323,042 in North Richland Hills.
The proposed increase in annual revenues is intended to allow Lone
Star Gas Company the recovery of its expenses and also to provide Lone
Star with the opportunity to earn a fair and reasonable rate of return
upon its investment. in the Fort Worth Distribution System. This return,
of course, goes to pay the people whose monies are invested in the system.
The revenues, expenses and investment on which our filing is based
have been measured as of December.31, 1981; this is the end of the test
year. The proposed rate is based upon sales volumes (use per customer)
measured as of that same date.
Attachment No. 2 is a summary of the Fort Worth Distribution System's
revenue requirement which is supported by documents recently filed with the
city. The revenue required to operate this system, as with most other busi-
nesses, equals the wholesale cost of the product plus operating expenses,
federal income tax and a return on investment sufficient to make it worth-
while to stay in business.
Lone Star's last rate increase here was based upon a test year ending
December 31, 1979. The current proposal has been based upon a test year
ended December 31, 1981. During this two-year period of operation, rev-
enues have become inadequate to cover operating expenses and still allow
a reasonable return. Even though these expenses have continued to rise,
Lone Star Gas Company still has one of the lowest average gas costs and
operating costs per customer among the major gas utilities. With this

proposed increase, Lone Star will be able to continue to provide its cus-
tomers with an excellent quality of service at the lowest possible cost.
Among the documents filed with the Statement of Intent is a bond form
which is provided so that you may be aware of the proposed bond amount and
the surety company to be used. Should the City not take action ~efore 90
days from the proposed effective date, as specified in the Statement of
Intent, the Public Utility Regulatory Act provides for the implementation
of the proposed rate under such a bond.
The rate application which Lone Star has filed with your city, as well
as the other 16 cities in the Fort Worth Distribution System, recognizes
that the investment made in a metropolitan area such as the Fort Worth
Distribution System is for equal penefit to all customers within that
system. In 1979 the Texas Railroad Commission recognized this by estab-
lishing uniform rates for residential and commercial customers in the
entire Fort Worth Distribution System.
By coordinating your evaluation efforts with the other 16 cities in
the Fort Worth Distribution System, you can help protect our customers'
interests by avoiding costly duplication of effortt which would keep the
regulatory expense (including consulting fees) as low as possible, and
would retain uniform rates throughout this system.
Let me assure you that as your company representative for Lone Star
Gas Company I stand ready to assist in every possible way as you evaluate
this proposal. A Bill Comparison and Rate Application Profile which high-

(Lone Star), a public utility under Article 6050 et. seq. V.A.C.S. and Article
l446c V.A.C.S. (Supp. 1976) and files this its Statement of Intent to Change
Residential and Commercial Rates in the City of North Richland Hills, Texas,
under the provisions of Section 43(a) of Article l446c V.A.C.S. (Supp. 1976)
ånd Article 6050 et. seq. V.A.C.S.
I.
Lone Star proposes to change its rates, and the details of the pro-
posed changes in rates are as follows:
1. Name of Utility - Lone Star Gas Company
2. Description of Area Affected - City of North Richland Hills, Texas

A. The following rates are the maximum applicable to residential and
commercial consumers per meter per month or for any part of a month
for which gas service is available at the same location. Summer rates
shall be applicable between the meter reading dates in May and October.

B. Gas Cost Adjustment:
Each monthly bill at the above rates shall be adjusted for gas cost as
follows:
(1) The city gate rate increase or decrease applicable to current
billing month residential and commercial sales shall be esti-
mated to the nearest $0.0001 per Mcf based upon:
(a) A volume factor of 1.0251 determined in establishing the
above rates for the distribution system as the ratio of
adjusted purchased volumes divided by adjusted sales volumes.
(b) The city gate rate estimated to be applicable to vol-
umes purchased during the current calendar month, ex-
pressed to the nearest $0.0001 per Mcf (shown below
as "Re").
(c) The base city gate rate of $3.1847 per Mcf.

(2) Correction of the estimated adjustment determined by Item 3B (1)
above shall be included as part of the adjustment for the second
following billing month. The correcting factor (shown below as
"C") shall be expressed to the nearest $0.0001 per Mcf based upon:
(a) The corrected adjustment amount based upon the actual city
gate rate, less
(b) The estimated adjustment amount billed under Item 3B (1)
above, divided by
(c) Distribution system residential and commercial sales Mcf
recorded on the Company's books during the prior year for
the month that the correction is included as part of the
adjustment.
(3) The adjustment determined by Item 3B (1) and Item 3B (2) above shall
be multiplied by a tax factor of 1.06135 to include street and alley
rental and state occupation tax due to increasing Company revenues
under this gas cost adjustment provision.
In summary, the gas cost adjustment (GCA) shall be determined to the near-
est $0.0001 per Mcf by Item 3B (1), Item 3B (2), and Item 3B (3) as follows:

C. Tax Adjustment:
The tax adjustment shall be an amount equivalent to the proportionate part
of any new tax, or increased tax, or any other governmental imposition,
rental, fee or charge (except state, county, city and special district ad
valorem taxes and taxes on net income) levied, assessed or imposed subsequent
to January 1, 1982, upon or allocable to the Company's distribution opera-
tions, by any new or amended law, ordinance or contract.
D. Rate Case Expense:
Rate case expense is not included in the calculation of proposed rates. If
rate case expense is incurred in this current case, it is the intention of
Lone Star Gas Company- to· recover the current and any unrecovered prior rate
case expense through a surcharge designed fora six-month nominal recovery
period., The surcharge. per Mef would be calculated by dividing the rate case
expense to be recovered by one-half of the adjusted annual sales volume to
residential and co~ercial customers. If there is no current rate case expense,
the Company will forego recovery of any unamortized prior rate case expense.
When a surcharge is applicable, monthly status reports will be provided to
account fQr the collections.

Current Annual Revenue from Residential and Commercial Customers (Test Year
ended 12 31 81) of $2,458,367 and Estimated Annual Revenue under the proposed
rates of $2,781,409.
