3. The invocation was given by Councilman Hubbard.
4. Councilman Hubbard moved, seconded by Councilman Ramsey,
to approve the minutes of the June 28, 1982 Council meeting
Motion carried 5-0.
5. Mayor Faram on behalf of the Council presented Mrs. Wanda Calvert
with a Five Year Certificate and Service Pin.
Mayor Faram advised he would depart from the agenda at this
time and asked Mr. Line to introduce an old-new Public Works
Director.
Mr. Line introduced Mr. Gene Riddle, Public Works/Utility Director.
Mr. Line stated he felt the city was fortunate to have someone with
the experience and capability as that of Mr. Riddle's.

Mayor Faram on behalf of the Council, welcomed Mr. Riddle
back to the City.
6. Councilman Hubbard moved, seconded by Councilman Ramsey,
to appoint Reverend Ray Fulenwider to the Cable TV Advisory
Committee to replace Dr. Hal Brooks.
Motion carried 5-0.
7. Mayor Faram stated the Planning and Zoning Commission had
recommended approval. All engineer's comments had been
met and a covenant for future improvements of Davis Blvd.
Councilman Hubbard moved, seconded by Councilman Ramsey,
to approve PS 81-65.
Motion carried 5-0.
8. Mayor Faram stated the Planning and Zoning Commission had
recommended approval. All engineer's comments had-
been met and additional easements for TESCO and Southwestern
Bell had been added to the plat.
Councilman Hubbard moved, seconded by Councilman Ramsey,
to approve PS 82-14.
Motion carried 5-0.
9. Mayor Faram stated the Planning and Zoning Commission had
recommended approval.
Mr. Line stated that he had been made aware of a problem.
that might exist concerning the property that might involve
flooding of the adjacent property. Mr. Line stated the staff
would like to have a couple of weeks to work with the people
involved. Mr. Line stated he had discussed this with
Mr. Barfield and it would not cause any problems for him if
the request was postponed until the regular Council meeting.
Councilman Hubbard moved, seconded by Councilman Davis,
to postpone this request until the meeting of July 26, 1982.

Councilwoman Hinkle moved, seconded by Counci1.man Fisher,
to approve PS 82-17.
Motion carried 5-0.
11. City Attorney McEntire stated he had met with Texas
Electric and this ordinance was primarily a procedure
problem as a result of Judge Jones· ruling in December 1981.
Mr. McEntire stated the problem was how the fuel adjustment
was computed.
Councilman Davis moved, seconded by Councilman Ramsey,
to approve Ordinance No. 963.
Motion carried 5-0.

City Attorney t~cEntire stated time was needed to study
this request and asked the Council to suspend the request.
Mr. Mc~ntire stated the date should be June 29, 1982 and
not June 24, 1982.

Councilman Hubbard moved, seconded by Councilwoman Hinkle,
to approve Resolution No. 82-19, with the date changed
to June 29, 1982.
Motion carried 5-0.
13. Councilman Mubbard moved, seconded by Councilman Ramsey,
to approve partial payment, Estimate #8, to Austin Road
Company in the amount of $30,548.35, funds appropriated
from Bond Fund5.
Councilman Davis asked for a status report on the request
for an extension of time. Councilman Davis asked if the
motion needsto be amended to include the extension of time.
Mr. Line stated the recommendation was not for approval
of the extension of time, only approval of the request for
payment. Mr. Line stated a recommendation would be
submitted at a later date on the request of the contractor
for an extension of time.
Councilman Davis asked if a completion date had been given.
Mr. Albin stated no, but the contractor seemed to be on schedule.

Mayor Faram stated he would have to call this discussion
out of order because the consideration was for the payment.
The extension of time request would be discussed at a later
date.
Motion to approved carried 5-0.
14. Mr. Line stated bids were taken last Wednesday, July 7th, and
the staff did not have time to analyze the bids and get a
recommendation prepared by the time the agenda went out
Thursday. Mr. Line stated the recommendation was to award
the contract to the low bidder, Southwestern Electric in
the amount of $33,430.80, which was $4,262.86 under the
next low bid and substantially lower than the Engineer
estimated. Mr. Line stated this was a badly needed improvement
and the staff did not want to delay the award of the contract.
Councilman Hubbard moved, seconded by Councilman Ramsey,
to award the bid to Southwestern Electric in the amount
of $33,430, work to begin 60 days after receipt of equipment.
Mayor Faram stated there was some variation in the dates,
September 15, 1982, to January 1, 1983. Mayor Faram asked
Mr. Horvath if he had made contact with the companies.
Mr. Horvath stated he had contacted Southwestern Electric
and had received a letter from Sharrock Electric, second lowest
bidder, indicating that they may be able to get the equipment
quicker than Southwestern. Mr. Horvath stated Southwestern
had advised him they could get the poles in six to eight weeks,
the same as Sharrock. Mr. Horvath stated that when the contract
is prepared, he would get a firm date from Southwestern Electric.
Mayor Faram asked if there could be an assurance before the
awarding of the contract that they would be within fifteen days
of each other.
Mr. Horvath stated yes, if not the staff would bring it back
to the Council before awarding the contract.
Councilman Fisher asked if this signalization would break up
the traffic flow between Main and Emerald Hills.
Mr. Horvath stated he felt it would break up the traffic flow.
Motion to approve carried 5-0.

Subject: Tarrant County Water Supply Project
Raw Wat€r Rate Settlement

On Friday, June 25) 1982, the Texas Water Commission accepted a joint motion
from all contracting parties to the Tarrant County Water Control and Improve-
ment District Number One supporting a settlement on the raw water rates charged
by the District. This significant action represents a milestone in the Au-
thority's efforis to secure a fair and equitable rate for raw water purchased
from the District. In order for th~Water Commission to approve the settlement,
certain official action was required by the District's Contracting Parties
(Fort Worth, Arlington, Mansfield and the Trinity River Authority) within an
extremely short time-frame.
Throughout the past twenty fqur months, the Authority·s Management has com-
municated and coordinated closely with your City Manager to keep him abreast
of the position and action being taken by the Authority representing you as a
Customer of the TRA Water Supply System. We have furnished information to your
Staff as information was available, but it was not until the last two weeks
that the Authority could state with conviction that the settlement being pro-
posed was advantageous to the Authority's Customers. In order for TRA to per-
serve our Customers· interest in the proposed set~lement, it was necessary for
the TRA Board of Directors to take official action agreeing with the proposed
settlement on June 23, 1982. This action was taken to perserve your interest
in what we conclude is an excellent opportunity to reduce future raw water
costs for your City.
The Trinity River Authority Board of Directors voted unanimously to participate
in the settlement but specifically requested that TRA Management advise the
governing bodies of our five (5) Customer Cities of the action taken. This
letter is written to request an opportunity to present to your City Council the
details supporting the Authority's decision to be a party to the rate settle-

PROBLEM BETWEEN RAILROAD AND WATAUGA DRIVE
Enclosed are copies of' recent correspondence with the City Council and
Cecil Forester regarding the referenced problem. The existing drainage
problem is a serious one and future paving construction on Rufe Snow
could make the problem potentially worse. This situation is complicated
by the sensitive inter-city politics associated with this project, as
described in the attached correspondence.
Before we can complete the construction plans for this section we need
a definite directive from the City regarding this rnatter. We would
suggest that'a Council work session be held to discuss this problem.
We are prepared to meet wi th you and' if necessa ry wi th the Counci 1 at
your earliest convenience.

response to Know1ton-English-Flowers letter dated June 14, 1982,
offer the following comments:
The Engineer's seal has been affixed to the final plat.
The metes and bounds description has been corrected.
The proposed 6-inch stub-out to serve Block 4 has been re-
located within the Irish Drive right-of-way.
The proposed 6-inch water line now shows to be looped to
the existing 8-inch lirie in Mockingbird Lane.
The "future" 8-inch sanitary sewer line along the west line
of Lot 1, Block 3 has been_changed to show the proposed
extension to Mockingbird Lane and will be constructed along
with the other proposed sewer facilities.
6. & 7. Please refer to our response to these items which
appear in. our letter to the Planning and Zoning Commission
dated January 15, 1982.
If there should be any further questions regarding this plat,
please do not hesitate to call.

We have reviewed the referenced materials for this subdivision and offer
the following' comments:
1. The final plat should be affixed with a Surveyor's seal of registration
rather than Engineer's seal.

2. A part of the bearing call in the north line of Block 3 is missing
in the metes and bounds description on the plat.
3. We would suggest that the proposed 6-inch water line stub-out to serve
Block 4 be located within the Irish Drive right-af-way to give City
personnel better access to the water meter when ~lock 4 develops.
4. We would further suggest that the proposed 6-inch water line along
the north TESCO right-af-way, which is shown to terminate at Irish
Drive~ be looped around the east end of Lot 2, Block 3, and tied into
the existing 8-inch line in Mockingbird Lane to provide better service
to the area and avoid a deadend 6-inch line.
5. You may wish to require the Developer to construct at this time the
"future" a-inch sanitary sewer main along the west line of Lot 1, Block
3, to Mockingbird Lane which will be required for future service to
Block 2~ to avoid possible future disruption of Lot 1 access to Davis
Blvd. created by construction of the 8-inch sanitary sewer.
6. We would refer you to our letter dated November 6, 1981, Irish Meadows
Addition, Lot 2, Block 8, PS 81-61, regarding our comments concerning
existing water line pro rata and TESCO permits.
7. We would also refer you to our comments ~ letter dated December 11, 1981,
Redgate Addition, Lot 1, Block 3, regarding Developer Covenant require-
ments for participation in future improvements on Davis Blvd.

2. In accordance with our recommendations in Item 1 of our
November 6, 1981 letter~ the Developer has submitted a
revised preliminary' plan for your consideration which
includes property north and south of his original sub-
mittal as well. We assume that this plan covers all of
Mr. Shafipour's holdings in this immediate area, however,
the ownership of Tract 17 south and contiguous with Block 4
has not been shown on the preliminary plat.
3. Pro rata for the existing 8-inch waterline in Davis Blvd.,
as noted in Item 2 of our November 6 letter, should also
include frontage in Mockingbird Lane, along Block 2 as well.
We would estimate pro rata ùt $5.50 per linear foot for a
length of 379.14 feet along Lot 1, Block 3, and 633.75 feet
along Block 2.
4. The Developer has not shown on the preliminary plan how he
proposes to provide water service to Block 4, nor has he
shown fire hydrant coverage for this block nor fire protection
for 810ck 2.
5. As noted in Item 3 of our November 6 letter, evidence of
written permission from TESCO for the proposed sanitary
sewer easement across the TESCO right-of-way should be
provided to the City.

6. Additional utility easements as required should be shown
on the preliminary plat for Block 4. The Developer should
contact the utility cOìllpanies for their requireìnents.
7. The Developer should be req~ired to signa covenant running
with the land agreeing to participate in future paving and
drainage improvements along Davis Blvd. in accordance with
the City's assessment policy. This would include frontage
on Lot 1, Block 3 and also along Block 2.
8. Written pennission from the Highway Dept. should be obtained
for any construction by the Developer in the Davis Blvd.
right-of-way.
9. We would note that although the Subdivision Ordinance re-
quires that these cOlnrnercial lots be served by a minimum .
8-inch sanitary sewer line, but the collectQrs which the
Developer is proposing to tie into are only 6-inch lines.
We would suggest that the Developer ba required to demonstrate
that these 6-inch lines have sufficient capacity to handle the
anticipated wastewater flow generated by these cormnercial lots.
If such required capacity is not available in the existing
6-inch collector lines, then the Developer may be required to
extend his sewer service lines to the nearest 8-inch collector
either across Davis Blvd. or down to Emerald Hills Way.

2. The developer should be required to pay his pro rata share of the

AN ORDINANCE REVISING THE FUEL ADJUSTMENT CLAUSE OF TEXAS ELECTRIC
SERVICE COMPANY IN THE CITY OF NORTH RICHLAND HILLS, TEXAS, PROVIDING
FOR AN EFFECTIVE DATE FOR SUCH FUEL ADJUSTMENT CLAUSE RATE SCHEDULE,
AND PROVIDING CONDITIONS UNDER WHICH SUCH FUEL ADJUSTMENT CLAUSE RATE
SCHEDULE MAY BE CHANGED, MODIFIED, AMENDED OR WITHDRAWN.
WHEREAS, on December 4, 1981, the District Court of Travis County, Texas,
200th Judicial District, entered a final judgment in favor of various cities and
cooperatives served by Texas Electric Service Company (nTESCO") and adverse to
TESCO, a copy of which is attached hereto as Exhibit A and incorporated herein
for all purposes; and
WHEREAS, the District Court in said judgment ruled (1) that TESCO rate-
payers had been overcharged approximately $30 million as a result of a preferential
sale of electricity by TESCO to TP&L and that a remedy was required for TESCO rate-
payers and (2) that the fuel adjustment clause used by TESCO and authorized by the
Public utility Commission of Texas does not meet the requirements of law; and
WHEREAS, the city hereby agrees not to seek any further remedy with regard
to the Martin Lake trartsaction found in violation of Section 4l(c) (1) of PURA, but in
all other respects, the City finds that the judgment and all included findings and
conclusions of the District Court shall be complied with in all regards, and said
judgment is hereby adopted and approved; and

WHEREAS, TESCO did, on December 9, 1981, file a proposed fuel cost factor
tariff for service within the City of North Richland Hills, Texas ("City") to become
effective January 13, 1982, the operation of which was denied; 'and
WHEREAS, the City, having considered the attached proposed modified fuel
adjustment clause and procedure for approval of payments to affiliates finds that
the modified fuel adjustment clause and procedure for approval of payment of affili-
ates should be approved and const~ued in accordance with the attached final judgment
of the District Court;
NOW, THEREFORE, be it ordained by the City Council of the City of North
Richland Hills, Texas:
SECTION 1: That the fuel adjustment clause rate schedule of Texas Electric
Service Company is hereby amended in accordance with Ex;hibit liB", attached hereto and
incorporated herein for all purposes. Such fuel adjustment clause is the one under
which TESCO shall be authorized to collect charges from its customers for the sale
of electric power and energy within the corporate limits of the City until such time
as said fuel adjustment clause rate schedule Inay be changed, modified, amended, or
withdrawn, with the approval of the City Council.
SECTION 2: Such fuel adjustment clause rate schedule, as same may be modi-
fied or amended, shall be effective from and after final passage of this ordinance
and shall apply to all power and energy used by each customer after the final passage
of this ordinance.

SECTION 3: That the action of the City Council of the City of North Richland
Hills enacting this ordinance constitutes, on the date of its final passage, a final
determination of the fuel adjustment clause rate of Texas Electric Service Company
within the City of North Richland Hills in accordance with Section 43(e) of the Public
Utility Regulatory Act.
SECTION 4: That the final judgment of the District Court of Travis County, 4IÞ
Texas, 200th Judicial District, attached hereto as Exhibit "A" is hereby approved and
adopted except to the extent that the City has agreed not to seek any further remedy
with regard to the Martin Lake transaction found in violation of Section 4l(c) (1) of
the Public Utility Regulatory Act by said judgment. The attached modified fuel adjust-
ment clause and procedure for approval of payments to affiliates shall be construed in
accordance with said final judgment.
SECTION 5: Nothing in this ordinance shall be construed now or hereafter as
limiting or modifying, in any manner, the right or power of the City under the law to
regulate the rates and charges of Texas Electric Service Company.
SECTION 6: The rule providing for the reading of an ordinance of three
separate days is hereby suspended and this ordinance shall become effective as provided
by the Charter of the City of North Richland Hills.
PASSED AND APPROVED at the regular meeting of the City Council of the City
of North Richland.Hills, Texas, this 12th day of July, 1982.

Enclosed is one copy of Contractor's Partial Pay Estimate No.8, dated
July 6, 1982, made payable to Austin Road Company in the amount of
$32,295.49, for materials furnished and work performed on the referenced
project as of June 30, 1982.
The quantities and condition of the project have been verified on-site
by your representative, Floyd McCallum, as indicated by signature on the
estimate, and we have checked the item extensions and additions.
We recommend that this payment in amount of $32,295.49, be made to
Austin Road Co. at P.O. Box 2285, Fort Worth, Texas 76113.
Please note that this estimate also includes a request for partial payment
of emergency extra work ordered for the Chapman Drive culvert widening~
as required to help alleviate flooding, in the amount of $2~693.45.
Along with a copy of this letter, the Contractor is being furnished a
blank estimate form for preparing next month's estimate.

RUFE SNOW DRIVE PAVING & DRAINAGE
IMPROVEMENTS, PHASE I
Enclosed is a copy of a letter from the Contraçtor for the referenced
project, Austin Road, requesting an extension in contract completion time
due to the recent inclement weather and other problems beyond their control.
The Contractor has asked for an extension of 30 calendar days for a total
completion time bf 385 days and a scheduled completion date of
October 31~ 1982. We would note that a previous extension of 40 calendar
days has already been granted for change orders throughout the course of
this project.
We concur that the Contractor is entitled to some amount of extension for
the reasons cited, but we do not have sped fi c document.ation for the
stated amount of 30 days. It is therefore our recommendation that the
Contractor be requested to furnish a chronoligical listing of days already
lost- to date with cause noted, and in the future, be required to submit
daily logs of their activity to the City Inspector~ Mr. Floyd McCallum,
for the remainder of the project duration~ fully documenting all construction
activity associated with the work on Rufe Snow Drive and noting any and all
reasons for delays and lost time. Based on this information~ the amount
of extension can then be determined.
Meanwhile~ we would strongly urge the Contractor to make every effort to
complete this project in a timely manner since proposed business and
commercial development along this arterial are being delayed and potential
tax revenue could also be lost~ to say ~othing of the continued inconvenience
to the general public.

Gentlemen:
As you may know we have experienced some delays on the above project
which we feel are abnormal. First, we have had rainfall far above
normal including a record fourteen inches in the month of May. Second,
we have been delayed by the slow response of various utilities in
relocating their facilities. The telephone company continues to delay
certain item of work.
It is requested that the contract time on this project be extended
thirty calendar days.

The bids from Shàrrock Electric and Southwestern Electric are both well below our
engineer's estimate of $40,867.25, with Southwestern the apparent low bidder. The

. difference in bids is·$4,262,86; the bid by Sharrock some 13 percent. higher than
that of Southwestern Electric. However, Sharrock Electric has quoted a shorter
period for completion of the project.
