The priorities range from'l to 3 with 1 being the highest. The intent of our exercise is to recommend to the Council and Staff that the engineering phase of all Priority l'sbegin immediatley unless easement~ etc. have to be obtained. Mr. Richard Albin has assured me the capacity exists to accomplish the engineering as we direct. By no means is this list error proof. Your considerations and recommendations are mandatory. Please consider this list "a firm plan to which we can deviate". The items with question marks will be relooked at this weekend. Please review and be prepared to discuss at the Pre-Council Monday night. Art~~!e VI, Section 1 of the Charter of the City of North Richlàñá Hills provides that "all powers and authority which are expressly or explicitly conferred on or possessed by the City Council..." In order to provide the framework for the execution of these powers and authority the following set of rules shall be in effect upon their adoption by the City Coun- cil and until such times as they are amended or new rules adopted in the manner provided for by these rules. 2. General Rules. 2.1 Meetings to be Public. All meetings of the City Council shall be open to the public (Charter, Article KV~ XVIII, Section 4). 2.2 Quorum. Four members of the City Council shall constitute a quorum, whether or not the Mayor Pro Tern or another Council member is serving as Mayor in his absence. 2.3 Minutes of Meetings. An account of all proceedings of the ~ouncil shall. be k~pt by the City Secretary and shall be entered in a book constituting the official record of the City Council. 2.4 Questions to Contain One Subject. All questions submitted for a vote shall contain only one subject. If two or more points are involved, any member may require a divi- sion, if the question reasonably admits of a division. 2.5 Right of Floor. Any member desiring to speak shall be recognized by the Chairman, and shall confine his remarks to the subject under discussion or to be discussed. No member shall be allowed to speak more than once on anyone subject until every member wishing to speak shall have spoken. Page 1 2.6 city Manager. The City Manager shall attend all City Council meetings unless expres~ly excused. He may make recommendations to the city Coun- _cil~nd~shall have the right to take part in all discussions of the Council, but shall have no vote. 2.7 City Attorney. The City Attorney shall attend all meetings of the City Council unless expressly excused and shall upon request give an opinion, either written or oral, on questions of law. The City Attorney shall act as the City Council's Parliamentarian. 2.8 city secretary. The City Secretary shall attend all meetings of the City Council unless expressly excused, and shall keep the official minutes and perform such other duties as, may be requested by the Council. 2.9 Officers and Employees. Any officer or employee of the City, when requested by the City Manager, shall attend any meeting of the City Council. If requested to do so by the City Manager, they may present information relating to matters before the City Council. 2.10 Rules of Order. ,-.. Roberts Rules of Order Revised shall govern the proceedings of the City Council in all cases unless they are in conflict with these rules. 2.11 Suspension of Rules. Provisions of Section 8 shall not be suspended. Amendment of Rules. These rules may be amended, or new rules adopted by a majority vote of all members of the City Council, provided that the pro- posèd·:ámendments 'or new rules shall have been introduced into the record at a previous meeting of the City Council. 3. Types of Meetings. 3.1 Regular Meetings. 3.2 The City Council shall meet in the Council Chamber of the City Hall on the second and fourth Monday of each month at 7:30 p.m. unless otherwise officially established by the City Council. The call for and conduct of all meetings of the City Council, both regular and special as provided in Section 3.2 hereof shall be in accordance with Article 6252-17, Vernon's Annotated Civil statutes, known as the Texas Open Meeting Act. Special Meetings. Special meetings may be called by the Mayor or any four members of the City Council. The call for a special meeting shall be filed with the City S~cretary in written form, except that announcement of a special meeting, during any regular meeting at which all members are present, shall be sufficient notice of such special meeting. The call for a special meeting shall specify the day and the hour of the special meeting, and shall list the subject or subjects to be considered. Chairman and Duties. 4.1 The Mayor, if present, shall preside as Chairman at all meetings of the Council. In the absence of the Mayor, the Mayor Pro Tern sha~~p~eside. The meetings of the City Council shall be called to order by the Mayor, or in his absence, by the Mayor Pro Tern. In the absence of both Mayor and Mayor Pro Tern, the meeting shall be called to order by the City secretary. 4.3 preservation of Order. The Chairman shall preserve order and decorum, prevent clash of personalities or the impugning of members' motives to occur and confine members in debate to the question under discussion. 4.4 points of Order. The Chairman shall determine all points of order, subject to the right of any member to appeal to the City Council. If any appeal is taken, the question shall be, "Shall the decision of the Chair- man be sustained?" 4.5 Questions to be-stated. The Chairman may call any other member to take his place in the chair, such substitutions not to continue beyond adjournment. Page 4 . . . 5. Order of Business. 5.1 Agenda. The order of business of each meeting shall ~e as contained in the City Council agenda prepared by the City Manager. The agenda shall be-~:~~isting by topic of subjects to be considered by the City Coun- cil, and shall be delivered to members of the City Council each Thursday preceding the Monday evening meeting to which it pertains. 5.2 Consent Agenda. 5.43 In preparing the agenda, the City Manager shall give consideration to the number and degree of complexity of items to be considered by the City Council for the purpose of conserving the Council's time in meetings. Items which are anticipated to be routine and require little or no consideration by the Council shall be desi~- nated by an asterisk, and shall be considered as a part of the "Consent Agenda." Prior to taking up the Consent Agenda, the Mayor shall determine if there are any items thereon which should be removed from the Consent Agenda for discussion. Any Council member may, upon request, remove any item from the Consent Agenda for discussion and individual action. Thereafter, all remaining Consent Agenda items may be acted upon by a single motion approv- ing the Consent Agenda. Council Communications. The City Manager shall provide the City Council with âft a written analysis of and recommendation on ei items to be acted upon by the City Council-at its meetings. fft-~fte-£e~m-er-a-ee~ei~-eemm~iea~feft~ These communications shall be delivered to City Council members each Thursday preceding the Monday meeting at which they will be discussed, unless an emergency condition makes it necessary to deliver the com- munication on a subsequent day. 5.54 Oral Presentations by City Manager. Said person shall make himself available for a conference with the City Manager at the Manager's re- quest at some time prior to said Council meeting. ~i~-~~±e-àee5-fte~ a~~%y-~e-aftyefte-apþeârift~-â~-a-þ~%fe-ftearift~-~ft-re~peft5e-~e-ef~ie~ð% :nð~iee,,:, 5.35.2 At the end of each agenda any person who has not been listed on the agenda as provided under 5.5.1, above, but who desires to speak at a Council meeting will be recognized by the Mayor and allowed a-~eâ~eft- ab±e-~fme to speak provided said person completes a form furnished inquiring as to name, address and topic. 5.5.3 Presentation by citizens shall be limited to a time period of not more than three minutes for each speaker. Any time spent by the citizen in responding to direct questions by City Council members will not be counted against the citizen's time allotment. 5.5.4 These rules shall not apply to anyone appearing at a public hearing in response to official notice. 6. Consideration of Ordinances, Resolutions, and Motions. 6.1 Printed or Typewritten Form. All ordinances and resolutions shall be presented to the City Council only in printed or typewritten form. 6.2 city Attorney to Approve. All ordinances and resolutions shall be approved as to form and legal- i ty (Charter, Article V.I, Section 6) by the City Attorney. 6.3 Ordinances - When Effective. Unless otherwise provided by applicable law, all ordinances, except those prescribing a fine or penalty, shall be effective from and after the date of passage, which may be upon one reading only; any ordinance prescribing a fine or penalty shall be effective from and after the publication thereof, in the officially designated news- paper of the city. Page 6 . . . 6.4 Distribution of Ordinances. The City Secretary shall prepare copies of all proposed ordinances for distribution to all members of the City Council at the meeting at which the ordinance is introduced, or at such earlier time as is exþè·diént. 6.5 Recording of Votes. The vote of each Council member yeas-~ftà-ft~Y5 shall be taken upon the passage of all ordinances and resolutions and entered upon the official record of the City Council. 6.6 Majority Vote Required. Approval of every ordinance, resolution, or motion shall require the affirmative vote 'of a majority of all members of the City Council, except as otherwise provided for in these rules. 6.7 Tie Vote. In the event of a tie vote on any motion the Mayor shall vote to break the tie. 6.8 Voting Required. No member shall be excused from voting except on matters involving the consideration of his own official conduct, or where his finan- cial interests are involved, or unless excused by the City Council for other valld reasons by majority~vote (Ordinance NÙIDber-318, Paragraph 6.8). teftar~ef7-Ar~ie~e-HV~7-See~ieft-i4ï-Para~râþh-~t. 6.9 Order of Precedence of Motions. The following motions shall have priority in the order indicated: 1. Adjourn (when privileged) 2. Take a recess (when privileged) * 3. Raise a question of privilege 4 . Lay on table 5. A motion to reconsider any action of the City Council can be made not later than the next succeeding official þftY5~ea± meeting of the City; _Council. Such a motion can only be' made by a member who voted with the majority. It can be seconded by any member. No question shall be reconsidered twice except by unanimous consent of the City Council, except that action relating to any contract may be recon- sidered at any time before the final execution thereof. The Previous Question. When the previous question is moved and seconded it shall be put as follows: "Shall the main question be now put?" There shall be no further amendment or debate; but pending amendments shall be put in their order before the main question. If the motion for the previous question is lost, the main question remains before the City Council. An affirmative vote of two-thirds of the City Coun- cil shall be required to move the previous question. Withdrawal of Motions. A motion may be withdrawn, or modified by its mover without asking permission until the motion has been stated by the Chairman. If the mover modifies his motion, the seconder may withdraw his second. After the question has been stated,-. the mover shall neithe~ withdraw it nor modify it without the consent of the Council. Amendments to Motions. No motion or proposition of a subject different fro~ that under con- sideration shall be admitted under color of amendment. A motion to amend an amendment shall be in order, but more than one amendment ðfie ameftd to an amendment shall not be in order. Appropriation of Money. Before formal approval by the City Council of motions providing for ' the appropriation of money, information must be presented to the City Council showing the purpose of the appropriation and the account to which it is to be credited. In addition, before finally acting on such an appropriation, the City Council shall obtain a report from the City Manager as to the availability of the appropriation. Upon the written recommendation of the City Manager, the City Council may at any time transfer an unencumbered balance of an appropriation made for the use on one department or division to any other department Ox"- ·<iivision. .... '.' ~~ 7. Creation of Committees, Boards and Commissions. 7.1 City Council Committees. The City Council may, as need arises, authorize the appointment of lIad hoc" Council Committees. Except where otherwise provided by the City Charter, the Mayor shall appoint members of the City Council Com- mittees, subject to the approval of the Council. Any committee so created shall cease to exist upon the accomplishment of the special purpose for which it was created or when abolished by a majority of the City Council. 7.2 Citizen Boards, Commissions and Committees. The City Council may create and establish other committees, boards and commissions to assist in the conduct of the City government with such duties as the City Council may specify, not inconsistent with the City Charter or City Code. Memberships and selection of members shall be as provided by the City Council if not specified by the City Charter. Any committees, boards or commissions so created shall cease to exist upon the accomplishment of the spec- cial purpose for which they were created, or when abolished by a majority vote- of the City Council. ,-..·No committee· so appointed shall have powers other than advisory to the City Councilor the City Manager, except as otherwise provided for in the City Charter. 8. Consideration of Zoning Matters. The City Council shall consider matters referred by the Planning and Zoning Commission only after the following steps have been taken. 8.1 Where the Planning and Zoning Commission recommends approval of a proposed change in the zoning classification of property, the City Secretary shall cause to be published at least fifteen (15) days prior to said City Council consideration, notice of the time and place of such hearing and cases to be heard in an official paper of the City or in a paper of general circulation in ~fte-ef~ie~a%-neW5- ~~þer-ðes~~n~~eà-ðY the City. 8.2 All property owners within 200 feet of the property to be rezoned shall be notified in writing by depositing such notice, properly addressed and posted in the United states mail at least ten (10) days prior to such hearing, stating the time and place of such hear- ing (Article 1011f, T.R.C.S.). ' 8.4 When the Planning and zoning Commission recommends the disapproval of a requested rezoning of property to the city Council, before the City Council can reverse the recommendation of the Planning and zoning Com- mission the City Council must: 1. Set a special hearing. 2. Give notice as provided in Sections 8.1 and 8.2 of these Rules of Procedures. 9. Cumulative Clause. 9.1 These city Council Rules of Procedure shall be cumulative of all other city Council Rules of procedure of the City of North Richland Hills relating to the subject matter hereof, except where ordinances or other rules are, or parts thereof are, in conflict with the pro- visions of these rules, in which event such rules or parts of rules so conflicting are hereby express1y.-..repealed. 10. Hitt, 3824 Diamond Loch East, appeared before the Council. Mr. Hitt stated his property backed up to Dawn Drive. Mr. Hitt stat.~d, _J:h~!; ~!J.e.1!, he moved into his home there was already a drive from his home to Dawn Drive. Mr. Hitt stated he was the only resident of Diamon9 Loch on the west side of Dawn Drive that had an existing drive. Mr. Hitt stated he would be the only one on the west side to be assessed. Mr. Bitt asked if the statement on the curb cut meant a new cut or an existing cut. Mayor Faram stated it would include both, a new or existing curb cut. Mr. Hitt stated he did not believe that additional curbing and guttering at the rear of his property would improve the value of his property. Mr. Hitt stated he did believe that if his access to Dawn Drive was cut off it would depreciate his property. August 9, 1982 Page 4 PUBLIC HEARING DAWN DRIVE STREE'.L .-~D DRAINAGE ASSESSMENTS . . . Mayor Faram asked Mr. Hitt if he would agree with the necessity for improving the street. Mr. Hitt stated he believed there was a drainage problem and the street could stand improvement; however, the street was not access to his property. .,.... Mrs. Billie Harrington, 3812 Dawn Drive, appeared before the Council. Mrs. Harrington stated that she had lived on Dawn Drive for thirty years, even before there was a North Richland Hills. Mrs. Harrington stated that at that time, Dawn Drive was -- only a dirt road. Mrs. Harrington stated the drainage on the street drained into a culvert that drained into the creek, and when Diamond Loch was built the culvert was closed until there was no drainage whatsoever. Mrs. Harrington stated she did not feel that pavement or curbing would improve the value of her property to the amount that was being assessed. Mrs. Harrington stated that she felt the City of North Richland Hills created the situation and it was the City's place to take care of it. Mayor Faram advised Mrs. Harrington she was North Richland Hills. Mrs. Harrington stated there were no drainage problems until Diamond Loch was built and the culvert was closed. Mrs. Harrington stated that a six-inch curb on one side and an eight-inch curb on the other side would cause Dawn Drive to become'a ditch. Mr. Albin advised Mrs. Harrington there would be underground drainage and it would drain into Fossil Creek. Coups¿:i±Jna1!___D~YiJ2 asked Mrs. Harrington if she thought the water was coming from Diamond Loch. Mrs. Harrington stated she thought the water was coming off the hill from Rufe Snow. Councilman Davis asked Mrs. Harrington if the water was coming from the east side. Mrs. Harrington' stated yes, it was like a creek in her yard when it rained. Councilman Davis stated that the city was making an effort to eliminate the problem. Mrs. Harrington stated she would not benefit from the improvements. Mayor Faram asked Mrs. Harrington if she was registering a protest. Mrs. Harrington replied yes. Mrs. Bradshaw stated she felt there would be an advantage to having the curbing on Dawn Drive, but 'she would not benefit from the drainage. Mrs. Bradshaw s~~ted that the water drains onto her property from the back east of her. Mrs. Bradshaw stated that after a hard rain it is ankle deep from fence line to fence line. Mrs. Bradshaw stated her driveway washes across the street and has had to be put back several times. Mrs. Bradshaw stated she would like to see the drainage start east of her. May.or Faram asked if the land behind her was undeveloped and at a higher elevation. Mrs. Bradshaw stated it was. Mayor Faram stated when something is to be developed, the developer is required to see that the drainage flows to a recognized drainage course. Mayor Faram stated the proposed drainage improvements are designed to handle the water should development take place. Mrs. Bradshaw stated there was no streets or access to the property behind her. Mayor Faram stated the city could not afford to get into the development business. ' Mrs. Bradshaw asked what could be done about the water that drains onto her property. Mayor Faram asked Mr. Albin to look at the area in question. Mr. John Levan, 6301 Onyx, appeared before the Council. Mr. Levan stated that the water draining onto Mrs. Bradshaw had no where to drain but onto his property. Mr. Levan stated he has helped replace Mrs. Bradshaw's driveway three times this year. Mr. Albin asked Mr. Levan if he thought the curb and gutter would help Mrs. Bradshaw's problem. · Mr. Levan stated no, the water drains from the hill behind Mrs. Bradshaw'·s house. COUNCILMAN J. C. HUBBARD NOW PRESENT. Mr. Arthur Bowdoin, 6412 Harmonson, appeared before the Council. 11&')0.. Mr. Bowdoin stated he owned two pieces of property on the east side of Dawn Drive and had a lot of water that drained across his property. Mr. Bowdoin stated 'if a drain was placed in Onyx it would not catch all of" the water. h Mr. Bowdoin stated that he felt the people on the east side who were being assessed would not benefit from the improvements. Mr. Bowdoin stated the way he saw it, the assessment was in three parts: curb, gutter, and drainage. Mr. Bowdoin stated the drainage project was bein'g done .to correct the problem in Diamond Loch and Onyx Drive. Mr. Bowdoin stated the flooding problem should be corrected, but in a simpler and less costly manner. Mr. Bowdoin stated as for the repaving of Dawn Drive, the street was resurfaced approximately one year ago and was still in good shape. Mr. Bowdoin stated a six-inch curb on one side of the street and an eight-inch on the other side would cause Dawn Drive to be used as a diverter. 4IÞ Mr. Bowdoin stated he felt some of the property owners being assessed would benefit, but some would not. Mr. Bowdoin stated he felt the problem should be corrected by the city. Mayor Faram read the following ~aragraph in a letter received from Mr. Bowdoin: "It is requested that the assessment rate for this property be changed to the zoning category of Residential (rear) in lie~óf.':-- the- non~residential or underdeveloped proper'ty rate as set forth by the city." Mayor Faram advised Mr. Bowdoin the rate had been changed to the residential rate. Mr. Kenneth Zielinski, 3804 Dawn Drive, appeared before the Council. Mr. Zielinski stated he felt the improvements' would not improve his property value. Mr. Zielinski stated that water stood in his drive when it rained. Mr. Zielinski stated he was registering a protest. Mrs. Cynthia Bowdoin, 6412 Harmonson, appeared before the Council. 4IÞ Mrs. Bowdoin asked why the property owners in Diamond Loch who did not have drives were not being assessed. August 9, 1982 Page 7 Mayor Faram stated the values would not increase for the ones who had drives. Mayor Faram stated the property owners would be required to sign a covenant stating if a curb cut was made they would have to pay the full assessment. Mrs. Bowdoin stated that if the people in Diamonch Loch did not have to pay the assessment because it would not be' of benefit ......- to them, then wny did ,the property owners on the east side of Dawn Drive have to pay if they were not going to benefit. Councilman Kenna stated that since the Council had reduced the assessment a minimum of forty percent, it should take care of the cost for the drainage on the east side of Dawn Drive. Marilyn Zielinski, 3804 Dawn Drive, appeared before "the Council. Ms. Zielinski stated that it seemed if the people who owned the Diamond Loch property were not being assessed because they would not benefit from it, and if it would not benefit the people on Dawn Drive, then why was the city spending money. Mrs. Dorothy Short appeare~ before the Council. Mrs. Short stated she did not live on Dawn Drive but was trying to buy property on the corner of Dawn Drive and Harmonson. Mrs. Short stated that if the water was kept back up on the hill it would ·not flood Diamond Loch or Dawn Drive. Mr. Earl Gleim, 6233 Onyx Drive North, appeared before the Council. Mr. Gleim stated that he agreed with everything that had been said tonight. Mr. Gleim stated there was a fourteen foot easémerit Déhíñd~im that the city mowed occasionally. Proposed for 1982-83 are two additional patrolmen, one additional dispatcher, one reference librarian position, a part-time library page, the next increment of the paramedics service program, $25,000 for an outside management analysis study of staffing work procedures and' scheduling in the street and utility maintenance division. . In the event additional funds are required to fully maximize the results of the study, a $200,000 contingence allocation is proposed which would require future City Council action for its use. In addition, the budget also includes the sale of 4.5 million dollars in general obligation which will permit subs!;éintia1 acceleration in the city Capital Improvement ~rogram. The ~õvè--=raii- b·ud~rt contains $5,752,760 in general fund expenditures and $5',253,583 in utility fund expenditures. We recommend the public hearing date of August 23, 1982. Bids having been advertised for as required by the Charter of the City of North Richland Hills, Texas, and the bid of Austin Road Company having found to be the lowest and best bid for the construction of said improvements, the work of con- structing said improvements and contract therefor is hereby awarded to Austin Road Company at and for the prices stated in the proposal of said company and as reported and recommended by the City's Engineers, which said report and recommendation is on file with the city, the Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of 'North Richland Hills, Texas, and to impress the corporate seal of the City thereon, the said contract embracing, among other things, the prices for the work. VI. To provide for the payment of the indebtedness incurred by the City of North Richland Hills, Texas, by said contract, there is hereby appropriated out of available funds and current revenues of the City, an amount sufficient to pay said indebtedness so incurred. VII. The cost of said improvements as herein defined shall be paid for as follows, to wit: (a) On Dawn Drive, from Onyx Drive North to Glenview Drive, in the City of North Richland Hills, Texas, the property abutting on that portion of the street to be improved and the real and true owners thereof shall pay for these improvements at the rate set forth below per foot for property fronting on said street which in no way exceeds nine-tenths (9/l0th) of the estimated cost of the improvements in addition to curbs and gutters'. v , . . . (b) The City of North Richland Hills shall pay all of the remainder of the cost of said improvements after deducting the amounts herein specified to be paid by the abutting properties and the real and true owners thereof as set out above in Subsection (a). The amounts payable by the abutting properties and the real and true owners thereof shall be assessed against such properties and shall constitute a first and prior lien upon such properties and a personal liability of the real and true owners thereof, and shall be payable as follows, to wit: When the improvements are completed and accepted by the City on a particular unit, the sums assessed against property abutting upon such completed and accepted unit shall be and become payable in five (5) equal installments, due respectively on or before thirty (30) days, one (1), two (2), three (3), and four (4) years from the date of such completion and acceptance, and the assessments against the property abutting upon the remaining units shall be and become due and payable in such install- ments after the date of the completion and acceptance of such respective unit. The entire amount assessed against the particular parcels of property shall bear interest from the date of the such completion and acceptance of the improvements on the unit upon which the particular property abuts at the rate of nine (9%) percent per annum, payable annually except as to interest on the first installment, which shall be due and payable on the date said installment matures, provided that any owner shall have the right to pay any and all such installments at any t~me before maturity by paying principal, with interest accrued to the date of payment, and further provided if default be made in the payment of any installment promptly as the same matures, then at the option of the City of North Richland Hills or its assigns, the entire amount of the assessment upon which default is made shall be and become immediately due and payable; but it is specifically provided that no assessment shall in any case be made against any property or any owner thereof in excess of the special benefits to prop- erty in the enhanced value thereof by means of said improvements in the unit upon which the particular property abuts, as ascertained at the hearing provided by law in force in the City, nor shall any assessments be made in any case until after notice and hear- ing as provided by law. Said assessments against the respective lots and parcels of property and owners thereof shall be evidenced by certificates of special assessment which shall be executed in the name of .the City of North Richland Hills, provided, however, that the City of North Richland Hills retains the right to authorize payment of the sums assessed against property abutting upon such completed and accepted unit in a period of not more than four (4) years in equal, regular installments of not less than Ten Dollars ($10.00) each, the first of such installments to become due and payable not more than thirty (30) days after the completion and acceptance by the City of the particular unit, provided further, that such method of payments shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills, a lawful, valid and binding note and mechanic's and material- man's contract upon forms supplied by the City granting a mechanic's lien upon and conveying the said abutting property in trust to secure the payment by said owner or onwers according to the terms thereof of the sums assessed against such property. VIII. The assessments against the respective lots and parcels of property and the owners thereof may be evidenced by certificates of special assessment, which shall be executed in the name of the City by the Mayor of said City, and the City secretary shall attest the same and impress the corporate seal of the City thereon, and which may have attached thereto coupons in evidence of the several installments, which the assessment is payable, which certificates shall be issued to the City of North Richland Hills, shall recite the terms and time of payment, the amount of the assessment, the description of the property, and the name of the owners, as far as known, and shall contain such other recitals as may be pertinent thereto, and shall further recite substantially that all proceedings with reference to the making of such improvements have been regularly had in compliance with law, and that pre- requisites to the fixing of the assessment lien against the property described in said certificates and the personal liability of the owners thereof, have been regu- larly had, done and performed, and such recitals shall be prima facie evidence of the matters so recited, and no further proof thereof shall be required in any court, and the certificates shall provide substantially that if default be made in the pay- ment of any installment promptly as the same matures, then, at the option of the City of North Richland Hills, or its assigns, the entire amount of the assessment shall be and become immediately due and payable, together with reasonable attorneys' fees and costs of collection, if incurred, all of which, as well as the principal and interest on the assessment, shall be a first and prior lien against the property, superior to all other liens and claims except state, County, School District and City ad valorem taxes. No error or mistake in naming any owner or in describing any property or any other matter or thing, shall invalidate any assessment or any certificate issued in eviqence thereof, and the omission of improvements on any particular unit or in, front of any property exempt by law from the lien of special assessment for street improvements shall not invalidate any assessment levied. The certificates referred to need not contain recitals in exactly the words above pro- vided for, but the substance thereof shall suffice, and they may contain other addi- tional recitals pertinent thereto. IX. The city Engineer of the City of North Richland Hills, Texas be and is hereby ordered and directed to file with the City Council estimates of the cost of such improvements in each unit. X. The City Secretary is directed to prepare, sign and file with the County Clerk of Tarrant County, Texas, a notice in accordance with the provisions of Article 1220a of Vernon's Texas Civil statutes and amendments thereto. . \., . . . Calculations are also enclosed which show the basis of the assessment computations. Assessments are computed based on Resolution 79-28 for curb and gutter, paving and drainage. Commerical rates are based on 100% of curb and gutter costs per front foot and 40% of paving and drainage costs per front foot. Commercial rates are applied to all property zoned other than residential and to all vacant, undeveloped property regardless of zoning. Residential front rates are based on 60% of curb and gutter costs and 25% of paving and drainage costs. Side yard residential rates are 2/3 of residential front rates,' and rear yard rates are 1/2 of residential front rates. Units 1 through 15 along the west side of Dawn Drive, as shown on the attached map, all have assessments based on the Residential (rear) rate for 811 curb and 24" gutter along with paving and drainage. Units 16, 23 and 25 receive commercial assessment rates since these pieces of property are all undeveloped. Units 17 through 22 are assessed based on the Residential (front) rate for 611 curb and 18" gutter along with paving and drainage. I am owner of the property described as "South 76 feet, Tract 3, Mahaly Lynch Survey. .1 I think the project of paving Dawn Drive is a worthy project, but that it should be paid for by those who use it the most. . Regarding the pavin~: there are six residences fronting on Dawn between On;cx North and Glenview Drive, including mine, yet this portion of Dawn is heavily travelled, since. vvith Billie Faye and Broadway it makes a direct connection between Grapevine Highway (or Belknap) and Glenview Drive, and is the only direct connection except Denton Highway and Rufe Snow in this part of the city. By careful checking, at quarter-hour periods, at early morning, midday, and even at night, I calculate that 1, 500 to 2, 000 cars or more, pass my house daily. I suggest that we pay for the cUl"'b and gutters, and the city pay for the street. Reg~arding the drainage: the property on the east side of Dawn Drive is at a higher level than that on the west side 01 the street, and a good deal of the property, includirlg lTIlne, is at a higher elevation than the street. Theretore, drainage in the street wOllld be of no beIlefit to the east side of the street. Water flow 5 through my yard, ankle deepI fence line to fence line, during and after a hard rain, and this has happened several times this year already. The water COInes from Harmonson and beyond, and from as far away as the trailer court - at least a quarter mile or more, a diagonal flow. e THs water has been diverted from Onyx North by the developer(s) of the property on Onyx North, causing the water to flow through my lot, and the lots just north of mine onto Dawn Drive.. It is some at this water that is flowing into the Diamond Loch area. · e Page Two t · It is my sllggcstion that either the drainage be tal(en care of east of our properties, that is, behind them, or that we on the east side of the street \v}¡o cannot benetit tram drainage in the street, not be assessed for drainage. I have hearà Mr. Bowdoitl whose property runs from Harmonson 600 feet to the property lacing on Onyx North and is just behind mine. say that he would be acceptable to drainage on his property. The City Council, from ,the evidence, finds that the assessments herein levied should be made and levied against the respective parcels of property abutt- ing upon the said portions of streets, avenues and public places and against the owners of such property, and that such assessments and charges are right and proper and are substantially in proportion to the benefits to the respective parcels of property by means of the i~rovements in the unit for which such assessments are levied, and establish substantial justice and equality and uniformity between the respective owners of the respective properties, and between all parties concerned, considering the benefits received and burdens imposed, and further finds that in each case the abutting property asse~sed is specially benefited and enhances value to the said property by means of the said improvements in the unit upon which the particular property abuts and for which assessment is levied and charge made, in a sum in excess of the said assessment and charge made against the same by this ordi- nance, and further finds that the apportionment of the cost of the improvements is in accordance with the law in force in this City, and the proceedings of the City heretofore had with reference to said improvements, and is in all respects valid and regular. III. There shall be, and is hereby, levied and assessed against the parcels of property hereinbelow mentioned, and against the real and true owners thereof (whether such owners be correctly named herein or not), the sums of money itemized below opposite the description of the respective parcels of property and the several amounts assessed against the same, and the owners thereof, as far as such owners are known, being as follows: (See attached charts.) IV. Where more than one person, firm or corporation owns an interest in any property above described, each said person, firm or corporation shall be personally liable only for its, his or her pro rata of the total assessment against such prop- erty in proportion as its, his or her respective interest bears to the total owner- ship of such property, and its, his or her respective interest in such property may be released from the assessment lien upon payment of such proportionate sum. . . . . v. The several sums above mentioned and assessed against the said parcels of property, and the owners thereof, and interest thereon at the rate of nine (9) per- cent (9%) per annum, together with reasonable attorneys" fees and costs of collector, if incurred, are hereby declared to be and are made a lien upon the respective parcels of property against which the same are assessed, and a personal liability and charge against the real and true owners of such property, whether such owners be correctly named herein or not, and the said liens shall be and constitute the first enforce- able lien and claim against the property on which such assessments are levied, and shall be a first and paramount lien thereon, superior to all other liens and claims, except state, County, School District, City and ad valorem taxes. The sums so assessed against the abutting property and the owners· thereof shall be and become due and payable as follows, to wit: in five (5) equal install- ments, due respectively on 'or before thirty (30) days, one (1), two (2), three (3), and four (4) years from the date of completion and acceptance of the improvements in the respective unit, and the assessments against the property abutting upon the remaining units shall be and become due and payable in such installments after the date of the completion and acceptance of such respective units, and shall bear interest from said date at the rate of nine (9) percent per annum, payable annually with each installment, except as to the first installment, which shall be due and payable at the maturity thereof, so that upon the completion and acceptance of the improvements in a particular unit, assessments against the property abutting upon such completed and accepted unit shall be and become due and payable in such installments, and with interest from the date of such completion and acceptance. Provided, however, that any owner shall have the right to pay the entire assessment, or any installment there- of, before maturity by payment of principal and accrued interest, and provided further that if default shall be made in the payment of any installment of principal or inter- est promptly as the same matures, then the entire amount of the assessment upon which such default is made shall, at the option of said City of North Richland Hills, or its assigns, be and become immediately due and payable, and shall be collectable, together with reasonable attorneys' fees and costs of collection incurred. Provided, however, that the City of North Richland Hills retains the right to authorize payment of the sums assessed against property ~utting upon such completed and accepted unit over a period of not more than four years in equal regular installments of not less than $10.00 each, the first of such installments to become due and payable not more than thirty (30) days after the completion and acceptance by the City of the particular unit, and provided further that such method of payment shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills a lawful, valid and binding note and mechanic's and materialman's contract upon forms supplied by the City of North Richland Hills granting a mechanic's lien upon and con- veying the said abutting property in trust to secure the payment of said owner or owners according to the terms thereof of the sums assessed against such property. VI. If default shall be made in the payment of any assessment, collection thereof shall be enforced either by the sale of the property.by the City of North Richland Hills as near as possible in the manne~ provided for the sale of property for the nonpayment of ad valorem taxes, or, at the option of the City of North Richland Hills, or its assigns, payment of said sums shall be enforced by suit in any court of competent jurisdiction, or as provided in any mechanic's or material- man's contract as aforesaid, and said City shall exercise all of its lawful powers to aid in the enforcement and collection of said assessments. VII. The total amount assessed against the respective parcels of abutting prop- erty, and the owners thereof, is in accordance with the proceedings of the City relat- ing to said improvements and assessments therefor, and is less than the proportion of the cost allowed and permitted by the law in force in the City. VIII. Although the aforementioned charges have been fixed, levied and assessed in the respective amounts hereinabove stated, the City Council does hereby reserve unto itself the right to reduce the aforementioned assessments by allowing' credits to cer- tain property owners where curb and/or gutter or paving presently exists. Notwithstanding the City Council has herein reserved the right to issue credits as hereinabove provided, it shall not be required to issue such credits, and will not do 'so, if same would result in any inequity and/or unjust discrimination. The principal amount of each of the several assessment certificates to be issued the City of North Richland Hills, Texas, as hereinafter provided, shall be fixed and determined by deducting from the amount of any assessment hereinabove levied such amount or amounts, if any, as may hereafter be allowed by the City Coun- cil as a credit against the respective assessments. IX. For the purpose of evidencing the several sums assessed against the respec- tive parcels of abutting property and the owners thereof, and the time and terms of payment, and to aid in the enforcement and collection thereof, assignable certifi- cates in the principal amount of the respective assessments less the amount of any respective credit allowed thereon, shall be issued by the City of North Richland Hills, Texas, upon completion and acceptance by the City of the improvements in each unit of improvement as the work in such unit is completed and accepted, which certificates shall be executed by the Mayor in the name of the City and attested by the City Sec- retary, with the corporate seal of the City impressed thereon, and shall be payable to the City of North Richland Hills, or its assigns, and shall declare the said amounts, time and terms of payment, rate of interest, and the date of completion and acceptance of the improvements abutting upon such property for which the certificate . is issued, and shall contain the name of the owner or owners, if known, description of the property by lot and block number, or front feet thereof, or such other descrip- tion as may otherwise identify ~he same; and if the said property shall be owned by an estate, then the description of same as so owned shall be sufficient and no error or mistake in describing any property, or in giving the name of ,the owner, shall invali- date or in anywise impair such certificate, or the assessments levied. The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectable, with reasonable attorneys' fees and costs of collection, if incurred, and shall provide substantially that the amounts evidenced thereby shall be paid to the City Secretary of the City of North Richland Hills, Texas, who shall issue his receipt therefor, which shall be evidence of such payment on any demand for the same, and the City Secretary shall deposit the sums so received in a separate fund, and when any payment shall be made to the City the city Secretary, upon such certificate shall, upon presentation to him of the certificate by the holder thereof, endorse said payment thereon. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Sec- retary the amount paid upon presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Secretary's warrant for making such payment. Such payments by the Secretary shall be receipted for by the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorneys' fees, if incur- red, have been paid in full. . Said certificate shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law, and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners there- of have been performed, and such recitals shall be prima facie evidence of all the matters recited in such certificates, and no further proof thereof shall be required in any court. Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, which coupons may be payable to the City of North Richland Hills, or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. Said certificates shall further recite that the City of North Richland Hills, Texas, shall exercise all of its lawful powers, when requested to do so, to aid in the enforcement and collection thereof, and may contain recitals substantially in accordance with the above and other additional recitals pertinent or appropriate thereto; and it shall not be necessary that the recitals be in the exact form above set forth, but the substance thereof shall be sufficient. The fact that such improve- ments may be omitted on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessment upon other premises. . x. Full power to make and levy assessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof, is, in accordance with the law in force in this City, vested in the city. XI. All assessments -levied are a personal liability and charge against the real and true owners of the premises described, notwithstanding such owners may not be named, or may be incorrectly named. XII. The assessments so levied are for the improvements in the particular unit upon which the property described abuts, and the assessments for the improvements in any unit are in nowise affected by the improvements or assessments in any other unit and in making assessments and in holding said hearing, the amounts assessed for improve- ments in anyone unit have been in nowise connected with the improvements or the assess- ments therefor in any other unit. XIII. The assessments levied are made and levied under and by virtue of the terms, powers, and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the state of Texas, known as Chapter 106 of the Acts of said Sessión and now shown as Article 110Sb of Vernon's Texas Civil statutes. XIV. The City Secretary is hereby directed to engross and enroll this Ordinance by copying the caption of same in the Minutes Book of the City Council of North Richland Hills, Texas, and by filing the complete Ordinance in the appropriate Ordinance Records of said City. xv. SECTION 2: The powers and duties of the Director shall include superv~s~on of the development of a disaster services plan for the City of North Richland Hills, and the recommendation for adoption by the City Council of any and all mutual aid plans and agreements which are deemed essential for the implementation of such disaster services plan. The powers of the Director shall include the authority to declare a state of emergency, but such action may be subject to confirmation by the City Council at its next meeting. The duties of the Director shall also include the causing of a survey of the availability of existing personnel, equipment, supplies and services which could be used during an emergency, as provided for herein, as well as a con- tinuing study of the need for amendments and improvements in the disaster services plan. SECTION 3: The duties and responsibilities of the Civil Preparedness Direc- tor shall include the following: (a) The control and direction of the actual operation or training of the disaster services organization of the City of North Richland Hills. (b) The determination of all questions of authority and responsibility that may arise within the disaster services organization of the City of North Richland Hills. ~ . (c) The maintenance of necessary liaison with other municipal, district, state, county, regional, Federal or other disaster services organizations. (d) The marshaling, after declaration of an emergency as provided for above, of all necessary personnel, equipment or supplies from any department of the City of North Richland Hills to aid in the carrying out of the disaster services plan. (e) The issuance of all necessary proclamations as to the existence of an emergency and the immediate operational effectiveness of the disaster services plan. (f) The issuance of reasonable rules, regulations or directives which are necessary for the protection of life and property in the City of North Richland Hills. (g) The supervision of the drafting and execution of mutual aid agree- ments, in cooperation with the representatives of state and of other local political subdivisions of the state, and the drafting and execution, if deemed desirable, of an agreement with the county in which said City is located and with other municipalities within the county, for the county-wide coordination of disaster services efforts. (h) The supervision of and final authorization for the procurement of all necessary supplies and equipment, including acceptance of private contributions. (i) The authorizing 6f agreements, after approval of the City Attorney, for the use of private property for public shelter and other purposes. . SECTION 4: The operational disaster services organization of the City of North Richland Hills shall consist of the officers and employees of the City of North Richland Hills so designated by the Director in the disaster services plan, as well as all organized volunteer disaster relief associations or groups. The functions ,and duties of this organization šhall be distributed among such officers and employees in accordance with the terms of the disaster services plan. Such plan shall set forth the form of the organization, establish and designate divisions and functions, assign tasks, duties, and powers, and designate officers and employees to carry out the pro- visions of this Ordinance. Insofar as possible, the form of organization, titles, and terminology shall conform to the recommendations of the state Disaster Emergency Services Council of the" state of Texas and of the Federal government. SECTION 5: Any unauthorized person who shall operate a siren or other device so as to simulate a warning signal, or the termination of a warning, shall be deemed guilty of a violation of this Ordinance and shall be subject to the penalties imposed by this Ordinance. SECTION 6: At all times when the orders, rules, and regulations made and promulgated pursuant to this Ordinance shall be in effect, they shall supersede and override all existing ordinances, orders, rules, and regulations insofar as the latter may be inconsistent therewith. SECTION 7: This Ordinance shall not be construed so as to conflict with any state or Federal statute or with any military or naval order, rule or regulation. . -2- . . . ,. . SECTION 9: No person shall have the right to expend any public funds of the City in carrying out any disaster services activity authorized by this Ordinance without prior approval by the City Council, nor shall any person have any right to bind the City by contract, agreement or otherwise without prior and specific approval of the City Council. SECTION 10: It shall be unlawful for any person willfully to obstruct, hinder, or delay any member of the disaster services organization in the enforcement of any rule or regulation issued pursuant to this Ordinance, or to do any act forbidden by any rule or regulation issued pursuant to the authority contained in this Ordinance. It shall likewise be unlawful for any person to wear, carry or display any emblem, insignia or any other means of identification as a member of the disaster services organization of the City of North Richland Hills, unless authority so to do has been granted to such person by the proper officials. Convictions for violations of the provisions of this Ordinance -shall be punishable by·fine. SECTION 11: If any portion of this Ordinance shall, for any reason, be declared invalid, such invalidity shall not affect the remaining provisions hereof. SECTION 12: The immediate passage of this Ordinance is deemed essential to the public health, safety and welfare and it shall take effect immediately upon passage. LINE, CITY MANAGER RE: DRAINAGE IMPROVEMENTS PLANNING AND CONSTRUCTION DATE: MARCH 18, 1982 . Based on personal observation and your comments to me over my first month as City Manager, it is apparent that one of the most critical problems that is of concern to the Mayor and City Council is storm drainage. You have indicated your desire to take immediate action with City forces on needed maintenance work; to expedite construction work by Contractors to correct the most critical problems, within available financial resources; and to develop a long range plan for drainage improvements by developers and the City to guide future actions. Accor- dingly, our consulting engineers and Public Works Director have assisted in preparing this report to give a current status report on ongoing storm drainage control activities, along with my recommendations concerning a study to ascertain needed long range improvements, for your consideration. A. MAINTENANCE OPERATIONS BY CITY FORCES At the Council meeting of January 25th, the Council authorized the Public Works Department to proceed with drainage channel maintenance improvements to provide immediate relief in several areas of town. That authorization included an allocation of $60,000 to be taken from General Fund surplus. Maintenance work is already underway in two separate areas. 1. STONYBROOKE - AMUNDSON - GLEN ANN AREA, (Walker Branch Channel). We are cleaning approximately 3000 feet of channel, most of which lies outside a dedicated easement. In these undedicated areas there 1s no well defined channel and therein lies one of our major problems. Weather permitting, this project should be completed by April 15th. . We are cleaning approximately 2,500 feet of channel, all of which lies within an undeveloped area where no easements are dedicated. We also anticipate completion of this project in April. 3. Beginning with the 1982-83 budget, I anticipate requesting Council approval to include a new budget item for drainage channel maintenance, at a level of at least $25,000 annually to provide an on-going maintenance program. Such a program, combined with major capital expenditures and developer initi- ated improvements, should help bring our drainage system in line with future needs. Clearly, this process will be slow in developing and will take several years to complete. A compre- hensive drainage study will be an essential element of the total program. Only after completion of this study will we have the ability to design drainage projects that conform to a City-wide Master Plan. In the absence of a drainage study, we can only design projects on an individual basis without the complete knowledge of how that project will affect the downstream drainage pattern. B. DRAINAGE IMPROVEMENTS BY DEVELOPERS . 1. Booth Calloway Hospital. Developers of this proposed hospital site between Booth Calloway Road and the North Hills Mall will be required to provide channel improvements on Calloway Branch from Booth Calloway Road to near Grapevine Highway as required by Subdivision Ordinance. This construction will help lower the flood plain in this area and reduce the effects of backwater flooding upstream. Every effort will be made to expedite this project through the permitting and platting process, which normally takes about six months or more for this type of development. ~. ~ 2. Holiday North Channel improvements and site clearing for development of multi-family dwellings. A multi-barrel 100- year culvert will be constructed on Calloway Branch at Terry Drive providing access to the site. Channel construction in thi s vi ci ni ty from the TESCO right-of-way to Fi el d Stone Drive will be performed to handle a lOO-year storm throughout this section. We anticipate work to begin on the drainage improve- ments within the next two months with a completion date around Februa ry, 1983. 3. The Walker1s Branch Addition consisting of site clearing and channel improvements on the Walker1s Branch from Grapevine Highway to Emerald Hills Way, will provide channel capacity for a lOO-year discharge. Multi-family dwellings are proposed for this site. We would also anticipate work on this project to begin within the next two months and be complete before the end of 1982. . .1 C. ENGINEERING WORK FOR DRAINAGE CONSTRUCTION PROJECTS BY KNOWLTON-ENGlISH- FLOWERS, INC., OUR CONSULTING ENGINEERS, IN PROGRESS ON THE FOLLOWING PROJECTS: . 1. Morgan Meadows Drainage Improvements a. Construction Plans and Specifications are complete for an earthen channel along the west line of the Morgan Meadows . Addition from Chapman Drive to Hightower Drive. Ease- ments from the following property owners are required: a.I. Joan and Leroy Jar1 a.2. Jerry and Shirley Winters a.3. Richard and Berniece Morman . After the easements are acquired, construction can be completed in approximately 60 days at an estimated con- struction cost of $70,000. Funds have not been allocated for this project, but can probably be made available. b. Construction planning ;s underway for the proposed concrete lined channel between Little Ranch Road and Meadow Creek Road from Chapman Drive to Hightower Drive. Permission to enter the privately owned property is presently being obtained for performing field surveys. Also, aerial photographic contour maps are being prepared for the area. Easements for construction will be required from at least twelve property owners. Completion of this planning will take at least two months. The estimated construction cost, for which funds are available, is $673,000. Dependent on response from the property owners concerning easements, construction could begin as early as July, 1982: and be complete by early 1983. 2. Dawn Drive and Harmonson Road Drainage Study Field survey data is presently being obtained for this project. The purpose of these improvements is primarily to relieve local experienced flooding in the Diamond Loch Addition along Dawn Drive. Neither construction cost estimates nor a schedule are available at this time. 3. Mackey Creek Channel Improvements Construction should begin within the next month for concrete channel liner improvements on Mackey Creek between Jerrell Street and Onyx Drive North. This is our Seventh Year Commun- ity Development Block Grant Program Project for low to moderate income neighborhoods funded entirely by H.U.D. through the Tarrant County Planning Department. The estimated construction cost is $82,000. Funding for the Eighth Year project is expected to be available next year for continuation of channel liner extensions upstream on Mackey Creek. If funding from the C.D.B.G. program is discontinued, completion of this project will require funding from other sources. . , . . . 4. Rufe Snow Drive Paving and Drainage Improvements a. Phase I - Construction 'is underway for improvements between I.H. 820 and the St. Louis Southwestern Railroad. The cost of underground storm drainage within the Rufe Snow right-of-way total s approximately $97,000. Off-site \ storm drainage costs in Lewis Drive, Buenos Aires and Trinidad Drive total approximately $425,000. Although this project will somewhat incre~se discharge into the Calloway Branch Channel, it will relieve local flooding problems west of Holiday Lane and also on Jannetta and Lola Drive. Construction should be complete in September, 1982. 5. b. Phase II - Presently under design, this project also consists of paving and underground storm drainage improve- ments which will alleviate local flooding problems along Rufe Snow primarily between Watauga Road and Chapman Drive. Discharge from this drainage system will be westward into Watauga within the Big Fossil Creek Watershed. Estimated storm drainage costs for this Phase total $68,000. We anticipate beginning construction in August, with an estimated completion in May, 1983. Booth Calloway Paving and Drainage Improvements This project is almost complete. It includes a new IOO-year design culvert on the Calloway Branch Channel along with some concrete channel liner and rock rubble riprap for erosion protection. Also, underground storm drainage was constructed in Booth Calloway Road to help alleviate local flooding. Estimated storm drainage and culvert costs for this project will total $272,000. 6. Jerrie Joe and Eldorado Paving and Drainage Improvements The construction plans and specifications are almost complete for this project. This project is designed primarily to alleviate local flooding problems in the Walker Branch watershed. Estimated constructipn cost is $70,000. We anticipate 60 days to complete construction. Glenview Drive Paving and Drainage Improvements The right-of-way is presently being cleared for construction of box culvert extensions at Calloway Branch and Glenview Drive and for underground storm drainage and street widening. Channel improvements between Glenview and Booth Calloway will also be performed. Our consultants have engineered the utility adjustments needed to clear the right-of-way, and the State Highway Department will handle the paving and drainage construc- tion contract, which should be completed by the spring of 1983. If further channel improvements on Calloway Branch in Richland Hills are constructed, the potential for flooding between Glenview and Grapevine Highway along Calloway Branch will be virtually eliminated. 7. .... D. PROPOSED FUTURE DRAINAGE PROGRAM . While the above listing of current activities is impressive, the City Council has indicated a desire to further improve the City's capacity to handle this program assuring that drainage problems are s~l,ved on an objectively detennined, priority basis and that a plan be developed to assure that all components of the overall drainage system are coordinated. Such a plan will evolve in two phases; data gathering to identify the problems; and engineering work to design the facilities needed to solve them. The plan will include proposals and cost estimates for eliminating such trouble spots as in Richland Oaks, a major source of concern. Phase 1 - Data Gathering a. City-wide Topographic Mapping Before drainage areas can be accurately delineated and local flooding problems isolated, 2-foot contour topographic maps should be developed for our City. We would strongly recommend that an aerial' photographic mapping company be engaged immedi- ately to prepare this mapping. Estimated cost of this mapping would be about $30,000 and would take about 4 months to complete. Much of this cost can be recovered from Developers Who will purchase these maps from the City for preparation of their development plans. b. Flood Plain Delineation . We are actively soliciting the aid of the Corps of Engineers in preparing an updated and more accurate flood plain study of the major creeks in our City. Preliminary reaction to the Mayor's letter requesting assistance of the Corps indicates that there-is a good chance that the Corps cån assist in- portions of the study involving the Calloway and Walker Branchs. Phase 2 - Comprehensive Drainage Master Plan We would further recommend that our Engineering Consultants be authorized to work with the Corps in developing a more detailed and comprehensive City-wide drainage master plan. This study would outline proposed bridge, culvert, channel and storm drainage con- struction improvements along with cost estimates of such improvements required to minimize the potential for flooding in our City. Such a plan is vital for properly prioritizing specific projects and allocating funding. If the Corps is unable to help with this study, within a reasonable time frame, then our Consultants have agreed to perform the entire study for $100,000. To the extent the Corps is able to assist, the cost of the work to be done by the consulting engineers will be reduced. RESOLUTION NUMBER WHEREAS, the Tarrant Appraisal District is responsible for providing ad valorem tax appraisal services for all governmental units in Tarrant County, and WHEREAS, Tarrant Appraisal District has to date, been unable to provide these services on a timely and reliable basis, and WHEREAS, there is considerable reason for concern about the level of expenditures proposed in the 1982-83 Tarrant Appraisal District budget, and WHEREAS, the City of North Richland Hills acknowledges the overwhelming task facing the Tarrant Appraisal District but believes that services by Tarrant Appraisal District must be improved and governmental spending at all levels must be minimized; NOW, THEREFORE, be it resolved by the City of North Richland Hills that all of the officers and employees of Tarrant Appraisal District be urged to redouble their efforts toward providing adequate services, and . BE IT FURTHER RESOLVED that such officers and employees extend every pos- sible effort to avoid unnecessary frills and expenses in the delivery of said services.
