ORDINANCE NO. 2896
AN ORDINANCE ABANDONING AND CLOSING A PORTION OF
CARDINAL LANE AND AUTHORIZING AN AGREEMENT FOR STREET
RIGHT OF WAY AND SIDEWALK EASEMENT AND THE CONVEYANCE OF
A PART OF SUCH ABANDONED RIGHT OF WAY TO AN ADJACENT
OWNER.
WHEREAS, there is no longer a requirement for a public street on that portion of
Cardinal Lane described on Exhibit "A" hereto and the city desires to
convey a portion of such abandoned street described on Exhibit "B" hereto
to the adjacent owner in exchange for other right of way conveyed to the
city; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
SECTION 1. THAT the portion of Cardinal Lane described on Exhibit "A" hereto is
hereby abandoned and closed effective December 1, 2006.
SECTION 2. The city manager is hereby authorized to execute an Agreement for
acquisition of street right of way and sidewalk easement and conveyance
of quit claim deed of the property described on Exhibit "B" hereto to Green
Scaping Properties, L.P.
PASSED AND APPROVED on this 14th day of August, 2006.

AGREEMENT FOR
STREET RIGHT OF WAY CONVEYANCE AND SIDEWALK EASEMENT

COUNTY OF TARRANT §
The parties to this agreement are Green Scaping Properties, L.P. ("Green Scaping")
joined herein by Frost National Bank (Frost) as lienholder of a lien on property to be conveyed
by Green Scaping and the City of North Richland Hills, Texas ("City"). The purpose of this
agreement is to document the terms and conditions of an agreement whereby Green Scaping will
convey and Frost will release its lien on a 3,644 square foot parcel of property adjacent to
Simmons Drive for use as a public right of way and City will abandon and close a portion of a
street known as Cardinal Lane and convey 19,008 square feet of its interest in said closed street
by quit claim deed to Green Scaping.
WITNESSETH
For and in consideration of the mutual undertakings herein set forth, the parties hereto
agree as follows:
1. City agrees to abandon, close and convey to Green Scaping by quit claim deed all
that portion of Cardinal Lane located in Tarrant County, Texas described by metes and bounds in
Exhibit A hereto.
2. Green Scaping agrees to convey to City by general warranty deed and Frost
agrees to execute a release of lien on all that property located in Tarrant County, Texas described
by metes and bounds on Exhibit B hereto.
3. Green Scaping agrees to convey to City a sidewalk easement described by metes
and bounds on Exhibit C and Exhibit D hereto.

easterly right-of-way line of Simmons Drive;
