Presentation of Boulevard 26 Intersection Design Concepts
The Boulevard 26 Oversight Committee met on Thursday, October 19 to review
concept designs for intersection improvements at Boulevard 26 and Rufe Snow and
Boulevard 26 and Glenview Drive as provided by Schrickel, Rollins and Associates.
Four basic options were presented to the Oversight Committee including A, B1, B2 and
C.
David Whitson and Scott Turnage represent the City on the Boulevard 26 Oversight
Committee. Mr. Whitson will be presenting the recommended streetscape design
concepts at the work session as North Richland Hills' senior representative on the
Boulevard 26 Oversight Committee.

It was a unanimous decision to proceed with Option B2 which includes improvements
to both intersections for full landscaping, signs and signal improvements, 2 inch
asphalt overlay and striped crosswalks and a painted oval as a base bid. (Drawings of
both options are included in the attachment for the action item on this agenda.) It was
also unanimously decided that should funding be available, an add alternate bid will be
considered for selecting Option C which includes the addition of colored and stamped
concrete in the crosswalks. The current budget for this project includes approximately
$800,000 for construction costs. Schrickel, Rollins and Associates has estimated that
that construction costs could be between $50,000 and $200,000 over budget
depending on which design option is ultimately constructed. These costs would be
shared equally by both cities.
It is anticipated that these Boulevard 26 intersection improvements could go to bid by
April or May. All costs will be shared equally by both cities and each City Council will
have to approve final construction bids.

NRH20 2006 End of Season Report
Staff has prepared NRH20's 2006 End of Season report and is submitting it for
Council's review. The report summarizes park attendance, financial performance,
marketing efforts, group sales, staffing, park operations and surveys.
Highlights from the report include:
· Best revenue year - Over $3.9 million
· Second best attendance season - 260,869
· Highest season pass totals - 10,848 passes sold
· Highest group exclusive revenue - Over $165,000
· Third best food and beverage revenue - Over $410,000
· Fifth best locker and gift shop combined revenue - Over $165,000
· North Richland Hills residents account for over 22 percent of park's attendance

names collected by the park, in addition to a water bill insert sent to North Richland Hills
residents. The park offered guests the best volume discount at a flat rate of $65.00 for
non-resident season passes.
Marketing, Advertising and Promotions Recap
Due to increased competition in the Dallas/Fort Worth area, NRH20 continued to focus
its marketing strategy on Tarrant County. The focus of the 2006 season's advertising
campaign was to further publicize NRH20 Family Water Park as the place for summer
family fun, convey the scope of the facility (show how the park differs in size from
competing smaller facilities) and publicize the offers with the park's two promotional
partners, Sonic and Dr Pepper.

Channel 5 featured NRH20 on June 1st to help promote NRH20'S birthday celebration,
During multiple broadcasts, a flyover clip of the park was shown and the news anchors
discussed the park's birthday party event. In addition, WB 33 promoted NRH20'S
birthday celebration during Victoria Snee's weekly "Around the Town" segment.
Natasha Curry with FOX 4 Good Day visited the park on the morning of June 16th to
highlight the park's newest attraction, the Tadpole Swimming Hole. She conducted an
interview to learn more about the attraction and also mentioned the park's Dive-in Movie
Series.
On June 16th, Channel 5 also promoted the kick-off of NRH20'S Dive-in Movie Series
with a flyover of the park showing aerial shots of the wave pool while discussing the
upcoming Dive-in Movie series. The Dive-in Movie Series was also featured on WB 33's
"Around the Town" segment.
Print Media Coveraae - Publicitv
Throughout the summer, the Fort Worth Star- Telegram and Dallas Morning News
featured NRH20 in numerous articles and listings. Dive-In movies were regularly
mentioned in the Dallas Morning News Guide and the Fort Worth Star-Telegram Star
Time. The movies were highlighted in the Star- Telegram's After Hours, Best Bets, Picks
of the Week and Star Time listings on multiple occasions. At the beginning of the
summer, NRH20 was mentioned in two articles featuring area waterparks including a
Star- Telegram article that ran in late May with photos and generic information about the
park and a Dallas Morning News "Waterpark Roundup" story on June 1 st. The Star-
Telegram also featured multiple park events throughout the summer in their Life & Arts
and Northeast sections including the Ribbon Cutting, Birthday Celebration, SpongeBob
squarepants visit and Keeping Kids Safe Day. Other local family publications including
Fort Worth Child, Positive Parenting and local newspapers featured many of NRH20'S
events in their fami\y ca\endars.

Print Advertisina
NRH20 continued to focus its newspaper advertising on park events. The Dive-In Movie
Series was advertised through seven large ads that ran in the Fort Worth Star- Telegram
Northeast section promoting each week's movie. In addition, Star- Telegram ads were
run to promote various events that occurred at the park this season. NRH20 also ran
advertisements promoting birthdays and season passes in Tarrant County family
publications including Fort Worth Child and Positive Parenting.
Website
The park is continuing to see an increase in guests and potential visitors utilizing the
NRH20 website. In 2006, the site was used to promote special events, discounts and
promotions. NRH20 continued to offer online ticket purchasing through the park's
website. Without any advertising, 6,205 online purchases were generated throughout
the season in comparison to 2005, when the site generated 4,669 online purchases. For
the first time, NRH20 sold season passes online during the 2006 season. Without any
promotion or advertising, the park sold 997 season passes through the website.
E-mail
E-mail hasbecomeanimportantcomponentofNRH20.smarketingstrategy.ln 2006, e-
mails were used to promote special events, communicate time sensitive information to
guests and offer special coupons and promotions throughout the season. NRH20 has
compiled an e-mail distribution list of over 14,000 addresses including season pass
holders, past NRH20 guests and potential guests who have participated in NRH20
contests and promotions.
Radio and Television Advertisements
NRH20 chose to partner with Comcast Cable this season in order to efficiently target
our Tarrant County market. The stations chosen were specifically selected based on
survey data given to the park that specified which stations matched up with mothers and
children who frequent waterparks. The programming, during which NRH20
advertisements aired, was geared towards children and mothers. Stations included
Nickelodeon, Cartoon Network, Animal Planet, TV Land, ABC Family, HGTV, Style,
TBS, Lifetime and TLC. The park also advertised on NBC 5 during the morning news in
the month of July.
NRH20 ran advertisements on three radio stations that were chosen based on listeners
fitting the park's target market. The radio stations NRH20 partnered with during the
2006 season included KSCS 96.3, KL TY 94.9 and Radio Disney 620. In addition to
advertisements, these stations provided additional promotional exposure through on site
radio remotes and van stops. As a part of these added value promotions, NRH20
received additional coverage through announcements leading up to the events and
remote broadcasts.

. Season Pass Promotions
The 2006 season kicked-off with a holiday season pass sale that began November 28,
2005 and continued through December 23, 2005. Prior to the start of the campaign, a
direct mail piece was sent to the previous year's season pass holders and a database of
names that were compiled through the park's website. Additionally, the sale was
promoted through water bill inserts sent to North Richland Hills residents. An
advertisement was also included in the North Richland Hills Parks and Recreation
"Discover Magazine" mailed to 24,000 households in the city. The holiday season pass
promotion included a $5 off discount, special incentives and a souvenir bottle good for
$1 refills all summer long.
N RH20 also held a spring season pass special prior to the May 13th opening of the
park. The promotion was directed at Northeast Tarrant County residents, with the offer
being announced via flyers to the Birdville Independent School District and water bill
inserts sent to North Richland Hills residents.
Brochure
The 2006 general park brochure showcased the Dive-In Movie schedule, a host of
special events, the 2006 operating schedule, information about birthday parties and
admission prices. A "fun" map was included showing the locations of the attractions and
amenities. Roughly 100,000 brochures were distributed during the 2006 season to park
guests and targeted locations throughout the Metroplex.

Promotions
During the 2006 season, NRH20 launched a cross-promotion with Tarrant County Sonic
Drive-ins. Beginning opening day and continuing through the end of June, seventy
Sonic Drive-ins across Tarrant County partnered with NRH20 to distribute $4 off
coupons to all customers at each location. In addition, the northeast Tarrant County
stores displayed POP materials that featured Frogstein's Splashatory and the coupon
offer.
Throughout the second half of the season, Dr Pepper included a $4 off Monday -
Thursday discount coupon on the side of cans that were distributed throughout Dallas
and Fort Worth. The special offer was printed on 2.4 million cans.
For the 2006 season, Cook Children's Urgent Care Center and NRH20 teamed up
again for a cross promotion designed to drive traffic to both Cook Children's and
NRH20. Cook Children's distributed NRH20 materials at local family events that they
sponsored. In exchange, Cook Children's visited the park to distribute water safety
materials.

Donations
NRH20 donates daily admission tickets to several hundred organizations per year, in
exchange for promotional advertising at school carnivals, charity events and
fund raisers. In 2006, over 600 organizations, including more than 35 Birdville
Independent School District schools, North Richland Hills' churches and North Richland
Hills' businesses, benefited from NRH20's dedication to serving the community.
Approximately 1 ,200 tickets were awarded to these worthy organizations.
Special Events
Special events continued to play an integral role during the 2006 season. These events
are important to the park as they help gain additional publicity, encourage new guests to
visit the park, give season pass holders more reasons to attend the park on multiple
occasions and enhance the overall family-friendly character of NRH20.
On June 1, 2006 from 2 p.m. to 4 p.m., NRH20 celebrated its 12th season of operation.
To commemorate the day the park first opened on June 1, 1995, NRH20 hosted a
birthday party for its guests. Birthday celebration activities and decorations were set up
in the pavilion and entertainment included clowns, free popcorn, carnival games, hula
hoop contests and face painting. To make the birthday even more appealing, NRH20
reduced its ticket pricing for the day to $12. The event was a huge success with park
guests.
June 7th was "An iPod an Hour" Giveaway Day. Well over 2,000 entries were collected
as guests entered a drawing in hopes of winning one of ten iPod nanos that were given
away throughout the day. The iPods were supplied to the park courtesy of Comcast
Cable.
Still popular with our guests, Sponge Bob SquarePants and his buddy Patrick made a
guest appearance at NRH20 on Saturday, June 10th. For five hours, our favorite sea
dwellers posed for photos with hundreds of park guests.
In preparation for NRH20'S first Dive-in Movie of the season, Madagascar, the park held
Animal Adventure Days. The Fort Worth Zoo drew a great crowd when their outreach
program visited the park on June 14th with animals of all kinds including a penguin, baby
alligator and more! The week continued with a visit from Animal Planet and Crikey the
Crocodile who made a five hour appearance at the park on June 15th.
The park held its third annual Health and Safety Day on June 22nd. Hundreds of guests
were able to learn about health and safety topics thanks to the many different groups
involved, including the Tarrant County SAFEKIDS Coalition, North Hills Hospital, NRH
D.A.R.E. Officer Debra Taylor and other health and safety businesses in NRH.
Dive-In Movies continued to playa major role in the park's success throughout the 2006
season. The movies were sponsored by Radio Disney, and were shown every Friday
night beginning June 16th and ending July 28th. The movies for the 2006 season were

Churches, as expected, represented a large percentage of group business due to a pre-
season marketing campaign to area youth groups and church groups. Municipal day
camps also demonstrated a large number of group attendance and will continue to do
so based on NRH20's pricing and safety policies. For a third year in row, there was also
an increase in family and birthday attendance. NRH20 was an ideal site for these
groups who not only rented one of the many picnic areas but stayed for the duration of
the day. The park will continue to see growth in this population category. Another
increase was in the area of corporate groups that historically spend more per capita
than other attendance categories.
The online reservation option that was added in 2004 continued to provide another
popular outlet for groups to register for this season. This option could be accessed
through the park's website and linked to a registration form to be filled out and sent
directly to the Group Sales Representative. This service, utilized by 182 groups, allowed
group leaders to register and request reserved seating and catering 24 hours a day. An
email or phone call was used to confirm these reservations by the group sale's staff
once the form was received.

Groue Pricina
The group reservation pricing structure enabled guests to receive varying discounts
based on group attendance. The Basic Group Rate was offered to those group guests
who did not make a reservation prior to arrival. The Registered Group Rate was offered
to groups depending on quantity purchased. The price ranged from $11.50 per person
to $15.50 per person depending on attendance. A vast majority of the department's
revenue is generated by these daily ticket sales.
Groue Seatina Facilities
The Forest Picnic Areas, the Splashatory Picnic Areas and the Group Pavilion rentals
remained a popular choice for groups and organizations who wanted to provide
reserved seating for their guests. Nearly 300 registered groups "took advantage of this
offer and generated an additional $13,893 in revenues. The Forest Picnic and
Splashatory Picnic areas accommodated small groups (25-30 per site) in a shaded
area. While the park's existing pavilion seated 275 people, NRH20 added two additional
covered pavilions this season, seating approximately 250 guests each. These areas are
generally reserved for large groups and catered events.
Exclusive Park Rentals
The revenue from Exclusive Park Rentals saw a substantial increase again in 2006.
Revenue increased by almost $70,957 or 71 % over the 2005 season. This includes
tickets and hourly rental fees. Twenty-eight various schools, churches and corporate
businesses took advantage of this exclusive offer to rent the water park for "after hours"
events this season.

. size lockers: standard or family. Standard locker rentals cost $4,00 plus a $1.00
refundable deposit, while family locker rentals cost $6.00 plus a $1.00 refundable
deposit. Locker rentals generated over $62,300 in revenue for the park; this was a 7%
increase from the 2005 season. The addition of renting lockers at the Front Gate during
the tickets sales process assisted with the revenue increase.

Park Operations
During the summer of 2006, the Operations Department of NRH20 saw many
advancements and improvements occur that raised public awareness of the park and
enhanced the beauty of our park so our guests could further enjoy our facilities.
One of the major park enhancements done to improve the quality of our guests
experience was the replacement of the wooden waterslide tower staircases. Aside from
increasing the overall safety of the towers, the new staircases were very pleasing to the
eye and aided in increased guest satisfaction.
Also this summer, NRH20 staff continued to incorporate park wide operational
readiness drills. These drills are designed to test the emergency system of the facility as
a whole. An emergency scenario takes place at a designated area while the park is
open and the entire management staff responds accordingly. These drills greatly
enhance the response time of management staff and the park received many
compliments from the guests regarding how seriously NRH20 takes it's safety training.
The lifeguards for NRH20 again had a very exciting, safe and fun filled summer. This
year 200 lifeguards were trained in CPR, first aid and lifeguarding skills. NRH20
continues to be proactive in its training approaches. Again this year, lifeguards were
required to perform inservice daily, covering such topics and exercises as infant and
child CPR to the more extensive full blown drowning scenarios where the lifeguards
have to perform such extra duties as crowd control and assisting the park EMTs.
Lifeguards were also audited daily and made to perform backboarding and other
lifeguard skills while the park was open, letting the guests know that NRH20 takes its
lifeguards skills very seriously. Also, this year the park continued mannequin testing and
the 5 minute rule. The mannequin tests were conducted by placing a mannequin in the
water without the lifeguard's knowledge and timing how long it took to recognize and
save the mannequin. The 5 minute rule requires the lifeguard staff to make a significant
change in posture every 5 minutes in order to keep them alert and concentrating. In
addition, in order to aid in our ongoing quest to provide well-trained lifeguards for the
safety of our guests, we added three new lifeguard instructors to our ranks.

. Team Peñormance and Benefits
The seasonal team members, a vastly important section of the team, continue to be
pivotal in the success of NRH20. Although there are several contributing factors to the
success of the park, the most noteworthy are the seasonal team members. The 400
plus seasonal team members encountered many more guests than did any supervisory
personnel and this presents NRH20 with many opportunities to either exceed the
guests' expectations or not reach that level. That is why the seasonal team is so
important. This season our exceptional team members were provided with discounts to
area attractions, complimentary admission to NRH20, a private showing of the movie
"Pirates of the Caribbean: Dead Man'S' Chest" and other special events throughout the
summer. To cap off a great season, all team members still on board were invited to an
end of the season party at NRH20 that was held in our new pavilion area. A great time
was had by all and we hope to see our team members return for the 2007 season.
Survey Results
.
Survey results for the 2006 Season remain very positive. The surveys are not only a
good tool to find out how the guest feels about the park, but also how long the guest
stayed, how many people were in their party, where the guest was from and other
helpful information. The surveys are administered by park staff, specifically the
Elements of Fun and are recorded in a database for analysis. The park conducts over
500 surveys each season. Below is the survey question followed by the average
answers. The scale runs from 1.0 to 5.0, with 5.0 being the highest possible rating.
How many hours did yOU stay today? - 4.9
The length of stay decreased to 4.9 hours from 6.2 hours. With the increase in season
pass sales a shorter length of stay is expected as season pass holders tend to visit
more frequently, but for a shorter period of time. A longer length of stay is positive since
the longer people are in the park the better time they are having and the more
opportunity there is that the guest will spend money. As more attractions and activities
are added to the park and with an increase in attendance, length of stay will increase.
How many people came with you? - 4.6
This number dropped from the 2005 season, which was 5.9. This number is greatly
affected by the person interviewed and whether he/she visited the park with a large
group.
How would yOU rate NRH20's attractions and facilities? - 4.5
The ratings of the attractions and facilities increased very slightly (.031) from the 2005
Season. As park attendance increases, historically attendance based survey questions
drop slightly, however this season did not show this trend.

. How would you rate NRH20's guest service and courtesy? - 4.5
This rating slightly decreased from the 2005 season which was 4.6. With a high number
of guests in the park this season, coupled with a hot summer, this rating decrease was
expected, but not welcome.
How would yOU rate NRH~O's Quality of concessions? - 4.2
Our rating in the area of concessions increased from the 2005 season which was 3.9.
One of the newer programs introduced during the 2005 Season, "Family Feast
Thursday" was revamped for the 2006 Season to ease some of the congestion seen at
the concession building with last season caused some longer than usual lines.
What radio station do yOU listen to?
For the tenth season in a row, KISS 106.1 FM was ranked number one by the guests of
the park with over 16%. The second most popular station was KDGE 102.1 finishing
with 9.81 %. In fourth and fifth place was KPLX 99.5 with 8.17% and KBFB 97.9 with
5. 72% respectively.
How did yOU find out about NRH20?
"Friend/family" was the number one followed by "Live nearby". This strong word of
mouth is reflective of the overall high quality of the entertainment service provided.
Television was third with radio, brochure, drive by, newspaper, internet, water bill and
billboards following.

NRH20 Strategic Plan Implementation Update
At the September 26, 2005 meeting, City Council adopted the Strategic Plan update for
NRH20 Family Waterpark. On November 14, 2005, staff presented an implementation
timeline to address action items identified in the plan. Chris Swartz, NRH20's Park
Manager, will present an updated timeline including the recommended 2007 pricing
which is attached.
Staff is requesting concurrence from the Mayor and Council on the 2007 NRH20

V Subject: Discuss Upcoming State and Federal Legislative Programs
The 80th Legislature for the State of Texas convenes on Tuesday, January 9,2007 with
pre-filing of legislation beginning on November 13, 2006. The session will run for 140
days, ending on Monday, May 28.
As in the past, we will use guiding principles to determine positions on city related
issues we expect will come forward during the legislative session. The guiding
principles are:
· Local control
· A predictable and sufficient level of revenue
· Opposition to unfunded mandates, and
· Quality of life
.
The purpose of this report is to seek input from Council regarding the priorities for the
City's 2007 State legislative program. Attached is a page from the 2005 Legislative
Program to give you an idea of the information I'm seeking. Please let me know of any
areas you have been made aware of that we need to monitor this coming year. Input
from Directors is also being sought. The plan is to present the 2007 State Legislative
Program at the December 11 , 2006 meeting for Council approval.
The 11 oth Federal legislative session begins on Wednesday, January 3, 2007, We will
use the same guiding principles for the Federal program as we do the State. We are
seeking input from Council regarding the priorities for the City's 2007 Federal
Legislative Program. Please let me know of any areas you have been made aware of
that we need to monitor at the Federal level. As with the State program, we are also
seeking input from Directors. The 2007 Federal Legislative Program will be presented
at the December 11, 2006 meeting for Council approval.

A.1 Discuss Items from Reaular City Council Meetina
Agenda Item F.1 - Attorney Staples advised of a typographical error in Section 5 of the
ordinance. Second sentence should end after "entire perimeter of the tract" and the
words "General limitation" at the end of the sentence are to be deleted.
A.2 IR 2006-105 Northeast Transcortation Services End Of The Year Recort
.
Council requested at the August 28, 2006 Council Work Session to be provided with a
fiscal year end report on the NETS Transportation Service. Mr. Cunningham presented
a PowerPoint presentation providing an overview of service information on the NETS
program, a ridership report for fiscal year 2006 and a ridership comparison between
fiscal years 2005 and 2006. Present in the audience and available to answer Council
questions were Nancy Amos, Senior Vice President of the Fort Worth Transportation
Authority (The T), and Carla Forman, The T. NETS provides on demand transportation
to seniors and disabled residents within the member cities service area. The service is
administered by contract with The T and is operated by the Red Cross. North Richland
Hills generated 4,856 trips in 2006 and was the second highest behind the City of
Bedford. Council was advised that in August 2006 the NETS Board agreed to a one-
year extension of the cooperative agreement with The T and the Red Cross. Future
considerations are the development of a vehicle replacement program and evaluation of
ridership needs with possible expansion of services. In response to a request from
Mayor Trevino, Mr. Cunningham also discussed how the NETS Service began and how
Congresswoman Kay Granger was instrumental in re-securing federal funding for the
program.
A.3 IR 2006-113 Imclementation of Buralar Alarm Permit Ordinance
Police Chief Perdue presented a PowerPoint presentation highlighting a proposed
burglar alarm permit ordinance. Last May, the Council concurred with a suggestion
brought forward by the Police Chief to implement a burglar alarm permit ordinance and
directed the Chief to proceed with drafting an ordinance for further consideration. Chief
Perdue highlighted provisions of the draft ordinance. The draft ordinance establishes
standards alarms must meet to be accepted by the City, allows for a seven day
acclimation period, requires a permit for each location, including apartment units, and
requires the alarm provider to make two attempts to reach permit holder before
summoning police. The ordinance provides for a permit fee of $50 for residential and
commercial, a $10 senior citizen rate and service fees after the first three false alarms.
Management of the program can be done with the hiring of additional personnel or with
contracting with an outside company that specializes in administering burglar alarm
permit programs. Chief Perdue recommended obtaining an outside company to
administer the program. Plans are to bring the ordinance back for approval at the
November council meeting. Council discussed the draft ordinance and questioned the
number of repetitious alarms received and fees charged by other cities. Chief Perdue

discussed the fees charged by other cities and advised the Council that he would
provide them with a copy of the fees charged by other cities. The Council was advised
that the fees in the draft ordinance were suggested fees and could be modified as
Council desired. The consensus of the Council was for Chief to bring the ordinance
back for action. The Council was asked to submit any suggested modifications to the
ordinance to the City Manager's office.
A.4 IR 2006-114 Red Liaht Enforcement
.
Police Chief Perdue advised that in Maya recommendation was brought forward for the
implementation of a Red Light Enforcement Program. Council concurred with Staffs
recommendation and directed the drafting of a proposed ordinance for consideration.
Chief Perdue presented a PowerPoint presentation of the program that included video
clips of violations that were recorded by the system. An engineering study was
conducted at the high accident locations in North Richland Hills. A temporary camera
was set up and the intersections were filmed for a total of eight hours. Violations filmed
ranged from 6 vehicles at Smithfield Road at Mid-Cities Boulevard to 426 vehicles at
Rufe Snow Drive at Mid Cities and 976 vehicles at Rufe Snow Drive at Loop 820. The
system will detect violations and take pictures of any vehicle before the intersection and
in the intersection. In addition, a twelve second video of the violation is taken and
stored for later use. The offense is a civil violation, a civil fine is mailed to the registered
owner of the vehicle, there are no criminal penalties, and any enforcement action does
not impact an individual's drivers license. Most jurisdictions are charging $75 for the
first occurrence. An appeal process is available. The program operates at no cost or
risk to the City. The primary purpose of the program is to reduce the number of
accidents and save lives. The funds derived from the program will be earmarked
exclusively for law enforcement and traffic control improvements that might otherwise
not be done. Councilman Sapp suggested that the revenue dedication not be made a
part of the ordinance, but be set up similar to the resolution addressing the oil and gas
revenues received by the City. After discussion, the consensus of the Council was to
leave the revenue dedication in the ordinance and for the ordinance to be brought back
for consideration at the November council meeting. Mayor Trevino asked that Council
be provided with a CD of the presentation.
A.5 IR 2006-115 Richland Tennis Center Proarams and Operations
Ms. Charlotte Wylie, Richland Tennis Center Manager, presented a PowerPoint
presentation highlighting operations and programs at the Tennis Center. The Center
opened in January 1997 and is a partnership between the City and Birdville
Independent School District. BISD provided a long-term land lease and the City funded
the construction costs through the % cent sales tax and a Texas Parks and Wildlife
Grant. A Joint Use Facility Agreement with BISD provides the Richland High School
Tennis Team with eight courts during the school year. The 16-court facility includes a
Pro-Shop and a sunken championship court. Programs can be divided into three areas

- lesson programs, recreational leagues and junior team tennis and camps for junior.
During the past year, there were 887 private lessons, 803 group lessons with 4,688
participants, and 551 drills to over 4,800 participants. Fiscal year 2005-2006 revenues
were the second best in ten years - $311,284. There were no questions from Council.

CITIZENS PRESENTATION
Mayor Trevino recognized John Roseman, Troop 179, who is working on his citizenship
and community badge.
Mr. David Cole, 9139 Boulevard 26, Suite 540-141, expressed thanks to the City
Council, City Staff and Park and Recreation Board for adding Tipps Canine Hollow to
Northfield Park. Mr. Cole commended the Parks and Recreation Department for the
excellent job they did in designing and building the dog park. Mr. Cole commented that
the usage of the park has declined in the last few weeks due to the park being unlighted
and the shorter days and that with a few strategically placed lights the park would
remain useable year round. Mr. Cole commented that he hoped that Council would
support any future proposals from the Park and Recreation Department to add lighting
to their budget.
Mayor Trevino asked Mr. Cole's opinion if it would be sufficient lighting to add can lights
in the trees. Mr. Cole advised he would be happy to talk with the Parks Department as
they design the lighting. Mr. Cole felt that it would be most beneficial to light the areas
where the people gather. Mr. Cole did not feel it necessary to light all the way into the
trees.
Mrs. Laverne O'Steen, 8429 Emerald Circle, advised she has asked for nothing and
complained about nothing. Mrs. O'Steen spoke on the requirement of the City Charter
for a permit to be issued before the construction of a facility like Emerald Lakes. Mrs.
O'Steen commented there were a lot of problems with the facility - huge cracking,
broken rails. Mrs. O'Steen advised she had talked to the representatives of the
Emerald Lakes Homeowners Association and that they have not made any plans to
determine what is causing the problems. Mrs. O'Steen advised the Association has not
made any plans to obtain professional engineers to conduct a study to determine the
problem, how to fix the problem and to obtain an accurate cost for the repairs. Mrs.

O'Steen stated it needs prompt and immediate attention and its time the passing of the
buck is stopped.
Mayor Trevino questioned what Mrs. O'Steen meant by the time the passing of the buck
is stopped. Mrs. O'Steen refused to further comment.
Mayor Trevino asked Attorney Staples to respond to Mrs. O'Steen. Mr. Staples advised
the responsibility for the repair of the Emerald Lakes wall is that of Mrs. O'Steen's
homeowners association. It would not be lawful for the City to pay the cost of those
repairs. Public funds cannot be expended for private purposes and no matter how
many times Mrs. O'Steen appears before the Council, the Council has no lawful way to
grant Mrs. O'Steen's request for public funds to meet private obligation. Mrs. O'Steen is
in error in her continued assertion that the City has acted improperly concerning
permits. All proper permits were issued.
Mr. Tom Lombard, 7216 Crabtree Lane, advised that in addition to serving on the North
Richland Hills Parks and Recreation Board he also serves on the Birdville Independent
School District's Bond Study Committee and urged viewers at home to vote for the bond
package on the November ballot. Mr. Lombard advised that one of the items in the
package is to build a replacement campus at Richland High School. Mr. Lombard
began commenting on the need for the replacement campus.
Mayor Trevino advised Mr. Lombard that political statements are not to be made during
Citizens Presentation.
Ms. Jane Birkes, 8300 Euclid Avenue, advised that while she sympathized with Mrs.
O'Steen on her issues with the developer and her problems with the wall, she agreed
with the City Attorney that public funds are not to be used to fix Mrs. O'Steen's private
issues. Ms. Birkes advised she would like to know how much money the City has spent
each time Mrs. O'Steen has appeared before the Council. Ms. Birkes commented that
with the City Attorney, the Public Works Department, the City Manager, the City Council
and the Assistant City Managers responding to Mrs. O'Steens's presentations, she felt
that City funds were being used to address her issues. Ms. Birkes advised she would
also like to know that if it is a safety issue, as Mrs. O'Steen keeps addressing the fact,
whether Code Enforcement should force the issue to have her fix the problem. Ms.
Birkes requested that her questions be addressed.

Mr. Mike Curtis, Public Works Director, presented the item. Staff has made several
requests during the past few years to TxDOT to lower .the speed limit along Davis
Boulevard from the northern city limit line to Smithfield Road. Until now, TxDOT has
denied all requests. After the City's most recent request, TxDOT will allow the section
currently marked 55 miles per hour (beginning approximately at Hightower Drive to the
North Richland Hills/Keller city limit line) to be lowered to 50 miles per hour. All other
sections along Davis Boulevard will remain the same. Staff will continue to make
requests to TxDOT for the 40 mile per hour speed limit to be extended further north.
The ordinance also reflects TxDOT's new method of identifying the locations of speed
zones. The identification process of the speed zone limits is different from the
"stationing" process previously used. The ordinance therefore indicates changes along
the entire length of Davis Boulevard because of the new way TxDOT is defining speed
zone limits. However, the only section where the speed limit will be lowered is the
section that was 55 miles per hour.
Councilman Welch questioned why TxDOT did not want to reduce the speed zone as
requested by the City.
Mr. Curtis advised that TxDOT has indicated that it does not warrant change.

and to fulfill several goals established by the City Council, including neighborhood
preservation, enhanced community aesthetics and image, stimulation of economic
vitality and a general reduction in the amount of trash and debris within the City. The

ordinance 1) makes it a misdemeanor for the "person in charge" and/or the property
owner of a premise to fail to abate a violation; 2) requires all property owners and
contractors to pick up their trash prior to mowing; 3) requires all property owners and
contractors to trim grass or weeds that grow to a height of more than ten inches within
three feet of the perimeter of their property; and 4) eliminates the current set fees
associated with mowing and cleaning a property as set forth in Appendix A of the Fee
Schedule and allows the code officer to charge the property owner the actual costs of
such mowing/cleaning charged by the contractor.

Ms. Vickie Lottice, Director of Parks and Recreation, presented the item. Item is to
consider the award of bid for the construction of the 2007 Mat Racer Slide addition at
the Water Park. The attraction is a four-lane mat racer slide that will face Boulevard 26
and be located adjacent to the Green Extreme sharing the same tower for structural
support. Staff is recommending acceptance of the Base Bid and Alternate 1, which is
the Shade Canopy on top of the slide. The lowest overall bidder was Workman
Commercial Construction Services, L TD in the amount of $797,281. The bid is $67,281
greater than the available construction budget of $730,000. Because Workman
Commercial's bid is the lowest responsible bid and the City desires to complete the
project for the 2007 season, Staff has worked with the consultants, WhiteWater and
Workman Commercial representatives to determine what could be modified without
sacrificing public safety, entertainment value, aesthetics and operational expectations.
As a result, the next agenda item is to consider a deduct change order in the amount of
$33,000 to bring the contract closer to budget. The deduct change order will leave a
budget deficit of approximately $35,000. A budget amendment to cover this deficit is
being recommended with the source of funds from the Aquatic Park Expansion
Reserve. Agenda Item No. F.3 addresses the Change Order and the budget
amendment.

Splashatory attraction. Over the course of the construction of the Splashatory

2006/2007 CIP Budget items that will be funded with certificates of obligation or general
obligation bonds. The bond sale is scheduled for the Spring of 2007. Some of the
approved projects will require funding prior to the sale, such as the Aquatic Park Mat
Racer approved earlier in the agenda. Staff is recommending approval of a resolution
that will allow the City to reimburse any expenditures with proceeds from the planned
2007 bond sale. The total to be reimbursed with 2007 bond proceeds will not exceed
the $4,364,000 budgeted for 'the projects. Any interim funding required will be
appropriated from existing reserves and will be repaid upon receipt of bond proceeds.

Council may recall that the replat of Brentwood Estates Addition, Block 5, Lots 1 and 2
was approved on October 23, 2005. This subdivision is located just west of Chase
Bank and the Chili's Restaurant located on Davis Boulevard and between North Tarrant
Parkway and Shady Grove Road.
During the time of the approval it was the intent of staff to require the developer to
construct one-half of the improvements required along Shady Grove Road. It has since
been discovered that one-half of the road cannot feasibly be constructed because of
right-of-way limitations on the opposite side of the road and grading requirements due to
the road needing to be lowered. Staff believes that a better option now would be to
accept the developer's share of the Shady Grove improvements and allow the project to
be constructed as a City Capital Improvement Program (CIP) project in the future, after
the City has acquired the necessary right-of-way.

The developer is therefore requesting that he be allowed to pay the city $275,000 (his
share of the road improvements adjacent to his property) and that the city construct this
section of the road in the future.

CITY-DEVELOPER AGREEMENT
This agreement is made by and between the City of North Richland Hil1s, Texas (UCity")
a Texas municipality acting by and through its duly authorized City Manager and Richland
Retail, L.P. (UDeveloperH) a Texas Limited Partnership acting by and through its General
Partner, Jasmine Investments~ LLCs for the purpose of documenting their agreement for
construction by Developer of 1,300 Linear Feet of Shady Grove Road as a condition of
development of property known as Brentwood Estates Addition, Block 5, Lots 1, 2R-1 , 2R-2 and
2R-3 an addition to the City of North Richland Hills, Tarrant County, Texas with City
participation in the cost of such road.
WITNESSETH

For and in consideration of the mutual undertakings herein set forth, the parties agree as
follows:
1. City agrees to reconstruct to City standards and specifications a 1,300 linear foot section
of Shady Grove Road (the US tree t") from the Summit Bank drive approach located
approximately 300 feet West of Davis Bou1evard to the West property line of Lot I,. Block 5,
Brentwood Estates Addition to the City of North Richland HiUs, Tarrant County, Texas as such
Lot is shown on the approved at the August 9, 1999 City Council meeting of the City of North
Richland Hills. Such Street is classified as a Minor Collector street on City's Master
Thoroughfare Plan and shall be constructed in accordance with such plan with curb and gutter to
a width of 40 feet as measured from face of curb. Such construction shall commence at such
time as City acquires right of way on the opposite side of such road from Developer's property.
Such Street is an infrastructure improvement required for development of the property being
platted by Developer.

2. The City's licensed professional engineer has determined that Developer's roughly
proportionate share of the cost of such infrastructure improvement is $275,000.
3. Developer agrees to pay City $275,000 within thirty (30) days of the approval of this
Developer Agreement.
4. Developer agrees to construct the public improvements and the access drive between Lot
1 and 2R-3 prior to the development of either lot.
5. It is further agreed that no permits will be granted for the construction of improvements
unless and until the expiration of thirty (30) days of the approval of this Developer Agreement
without a court challenge to any provision of this Developer Agreement.

Subject: PU 2006-060 Authorization to Extend Wrecker Services Contract with AA
Wrecker Service Resolution No.2006-099
The contract for wrecker services was originally awarded in November, 2002 to AA
Wrecker Service for three (3) years with two (2) successive one-year extensions by
mutual agreement of both parties. At the November 14, 2005 meeting, Council
extended the wrecker services contract to AA Wrecker Service for one year. This
contract extension included an increase in fees from previous years. The contract
includes tow truck services and vehicle storage facilities as well as the following
responsibilities:
.
· Furnish all equipment , material, labor and personnel in an efficient and timely
manner for tow truck services on a 24 hour, 7 days a week, 365 days a year
basis.
· Responsible for handling police ordered tows (non-consent tows) and tows
where the person in charge of the vehicle makes no selection of a tow truck
operator; responsible for all tows requested for city-owned vehicles.
· Provide a storage facility for vehicles pursuant to the requirements of the
contract.
· Provide, at contractor's expense, for the disposal of unclaimed vehicles.
· Maintain specified insurance in force for the duration of the contract.
· Contractor shall not exceed charges for towing and storage as contained in
contractor's proposal and contract, or charge any additional fees for service
whether listed or not.
· Contractor agrees to pay City of North Richland Hills for contract administration
the equivalent of six percent (6%) of gross revenues resulting from all city
directed pulls.
The specifications and contract allow for an additional one-year extension if it is in the
best interest of the City. As mentioned above, the contract that was extended in 2005
included an increase in fees from previous years, but for this extension request, AA
Wrecker Service has not requested an increase. Attached is a spreadsheet with the
fees that were approved in 2005. The impound and notification fees are state mandated
and the increase in these fees were a result of an increase by the state.
AA Wrecker Service's overall performance has been excellent with regards to response
time for Police Department requested tow calls and the professional conduct of the tow
service drivers. In review of the service provided by AA Wrecker Service it is believed
that their performance has proven to be an asset for the City of North Richland Hills and
it is recommended that a one-year extension be approved.

Subject: GN 2006-102 Consideration to Authorize the City Manager to Execute a Site
Access Agreement with the City of Fort Worth - Resolution No. 2006-097
City staff was recently approached by representatives from the City of Fort Worth with a
request to provide a small location for the placement of an air monitor. The City of Fort
Worth operates a number of air monitors in Tarrant County for the Texas Commission
on Environmental Quality (TCEQ). The modeling system they use indicated that a
location was needed in the southern portion of the City of North Richland Hills, south of
Loop 820. After meeting with the representatives it was determined that one of the
most suited spots was in the rear yard area of Fire Station No.2 located at 4001 Rufe
Snow Drive. This spot is out of the way of all of the City's operations and not obvious to
the general public.
The City of Fort Worth's request is to utilize an 8 feet x 8 feet area where they will fence
and place one of their air monitoring systems. The specific location is subject to
approval by the City. All expenses for the project will be the responsibility of the City of
Fort Worth. This location is accessed and monitored by a Fort Worth representative
every day of the year.
The attached agreement gives access, rights and privileges, as well as liability, to the
City of Fort Worth. The agreement can be terminated by the City of North Richland Hills
with a one hundred twenty (120) written notice.
Recommendation:

SECTION 1. That the City Manager is hereby authorized to execute a Site Access

This SITE ACCESS AGREEMENT is entered into by and between the City of North
Richland Hills, Texas, hereinafter called uGRANTOR," and the City of Fort Worth, a
home-rule municipality located within Tarrant County, Texas, acting through Libby Watson,
its duly authorized Assistant City Manager C"GRANTEE").
WHEREAS, the City of Fort Worth operates a number of Air Monitors in Tarrant County
for the Texas Commission on Environmental Quality (TCEQ):
WHEREAS, TCEQ is looking to expand the existing air monitoring network in Tarrant
County;

WHEREAS, it is desirable to secure an additional location for the Air Monitors located in
the City of North Richland Hills; and
NOW, THEREFORE, in consideration of the mutual promises and agreements contained
herein, and other good and valuable consideration, the receipt and adequacy of which
are hereby acknowledged, the parties hereto agree as follows:
1. The GRANTOR does hereby grant and convey upon GRANTEE access to,
across, and upon the following described property of the GRANTOR, for the
,purposes set out below.
2. The property that is the subject of this access agreement is located at 4001 Rufe
Snow Drive (Fire Station No.2), North Richland Hills, Texas.
3. The purposes for which GRANTEE shall have access to, across, and upon the
subject property are:
A. The construction, repair, maintenance, and sampling of the air monitors~
B. The taking of samples as may be determined by GRANTEE to be
necessary;
C. The inspection of the air monitors; and
D.
Other actions deemed necessary by GRANTEE related to the
investigation of the air monitors.

GRANTEE shall secure each air monitor at the location within a chain link
enclosure of an approximate size of 8' (feet) by 8" (feet), exact location requires
approval of GRANTOR.
5. GRANTEE shall be responsible for all costs associated with the construction
operation and maintenance of all equipment and fencing installed by GRANTEE.
Construction subject to all codes and required permitting by GRANTEE.
6. The GRANTOR retains, reserves, and shall continue to enjoy the use of the
surface of such property for any and all purposes which do not interfere with or
prevent the use of the property by GRANTEE for the purposes herein described.
7. GRANTOR may terminate this Agreement upon one hundred and twenty (120)
days written notice to the GRANTEE, with or without cause, and at no penalty or
expense to the GRANTOR.
8. The access, rights, and privileges granted herein are exclusive, and the
GRANTOR covenants that it will not convey conflicting rights within the area
covered by this grant.

The access, rights, and priviieges herein granted shall commence upon
execution of this agreement by both parties and shall remain in effect until the
completion of the assessment activities.
GRANTOR shall in no way be responsible for the housing, security,
maintenance, or operation of the air monitors.
Pursuant to law, GRANTEE shall be responsible for all work-related deaths,
injuries or diseases of its agents and employees, and for property damage,
personal injury or death caused by City employees or agents, relating to work
provided pursuant to this agreement.

This instrument contains the entire agreement between the parties relating to the
rights herein granted and the obligations herein assumed. Any oral
representations or modifications concerning this instrument shall be of no force
and effect excepting a subsequent modification in writing, signed by the party to
be charged.
14. It is expressly understood and agreed that, in the execution of this agreement,
neither of the parties waives, nor shall be deemed hereby to waive, any immunity
or defense that would otherwise be available to it against claims arising in the
exercise of governmental powers and functions. By entering into this agreement
the parties do not intend to create any obligations, expressed or implied, other
than those set forth herein and this agreement shall not create any rights in
parties not signatories hereto.

PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM KEVIN NUGEN
TO APPROVE A ZONING CHANGE FROM "R-3" RESIDENTIAL TO "CS"
COMMERCIAL SERVICES (LOCATED IN THE 8300 BLOCK OF WOODS LN. - 0.481

Applicant Kevin Nugen, 1505 Denise Court, Keller, presented his request to approve
this zoning change. Mr. Nugen requests this zoning change to accommodate his
intention to purchase this property from its current owner and build an office building.
The applicant did provide a conceptual drawing for the Commission to see. The
conceptual drawing depicted a residential-style office building with a masonry screening
wall at the west boundary abutting the current residential zoned property. Paved
parking was depicted as well as access to and from the building off of Woods Lane. Mr.
Nugen did not want to purchase the property unless the property is zoned to
accommodate his plans.
Eric Wilhite presented ZC 2006-14. Mr. Wilhite stated that this is a zoning change
request consistent with the surrounding land uses and properties. This request is
located in the 8300 Block of Woods Lane and is 0.481 acres. It has been reviewed,
meets all the technical requirements, and Staff recommends approval.
Chairman Shiflet opened the Public Hearing.
Mr. Benton asked the applicant what type of offices would operate at the location.
Mr. Nugen stated that he is an electrical contractor and plans to have an office for his
business at the location, but would not have any type of outside storage or shop
operations. It would be only his office operation. There might be several other offices in
the same building.
Ms. Myrna Moffet of 8308 Woods Lane asked if the planned zoning would allow for any
type of storage facility.
Mr. Wilhite answered that the zoning requested would not allow for any type of storage
facility.
As there were no others wishing to speak, the Chairman closed the Public Hearing and
called for a motion.
Bill Schopper, seconded by Steven Cooper, motioned to approve ZC 2006-14.
The motion carried unanimously (6-0). Brenda Cole was absent.

James to Approve a Special Use Permit to deviate from the 850/0 masonry requirements
for residential structures (Located at 8920 Rumfield Road - being Lot 1, Block 1, James
Addition) Ordinance No. 2913
Summary of Request: The applicant is requesting approval of a Special Use Permit
(SUP) for an exemption to the residential masonry requirement of 85% per wall
elevation. Section 118-673 "Unusual construction" of the zoning ordinance provides for
such a variance to the masonry requirement through the SUP process.
The applicant is constructing a new single family residence at 8920 Rumfield Rd. The
home is custom and is of ranch-style architecture. The attached photos are of the home
and the east elevation that does not meet the 85% masonry.
The applicant's approved building permit plans indicated that the elevation would be of
masonry and therefore meet the city's masonry percentage requirements. During one of
the inspections of the structure, it was discovered that the elevations had not been
constructed as the approved building permit plans had indicated. The builder and the
applicant had, without knowledge or approval of the Building Inspections Department,
altered the elevations during construction. After being notified by staff of the situation,
the applicant and the home builder discussed what needed to be done, and the options
available in order to possibly not go back and redo the elevation with masonry. The
SUP is an option that will allow them to proceed with their desired plan if the Council
approves.
If the SUP is not granted, the applicant would be required to redo the elevation as
indicated on the approved building permit plans.

PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM BRIAN JAMES
TO APPROVE A SPECIAL USE PERMIT TO DEVIATE FROM THE 85% MASONRY
REQUIREMENT FOR RESIDENTIAL STRUCTURES. (LOCATED IN THE 8900
BLOCK OF RUMFIELD ROAD)

Brian James, 8120 Rumfield Road, applicant, presented his request to approve the
deviation from the 85% masonry requirement for residential structures. Mr. James said
that the deviation was completely unintentional. The plan for the home was to construct
it with a rustic design. As construction progressed, the upper floor siding was changed
to add red cedar as a design improvement.

Gary Gardner, 3106 Oakview, Hurst, is the builder of the home. He said has been a
builder for over 20 years. He primarily deals with single story homes, and it was an
oversight on his part that the red cedar was added to this home. He takes complete
responsibility for his oversight. He said the cost difference in using the red cedar
instead of masonry is only around $300, and the red cedar was not used to save
money, but for a design enhancement. He has received many compliments on the
home, and no negative comments.
Eric Wilhite presented SUP 2006-03. The applicant, Mr. James, is constructing a new
single family residence at 8920 Rumfield Road. The home is custom and of ranch-style
architecture. The east elevation of the home does not meet the 850/0 masonry
requirement. The approved building permit plans indicated that the east elevation
would be of masonry. During an inspection of the structure, it was discovered that the
elevation had not been constructed as approved in the building permit. The builder and
the applicant had, without knowledge or approval of the building inspections
department, altered the elevations during construction. Staff advised the applicant and
home builder of the situation, and the options available to correct the oversight in order
to possibly not have to go back and reconstruct the east elevation with masonry.
The applicant's request of approval of Special Use Permit for an exemption to the
residential masonry requirement of 85% per wall elevation could be granted under the
Section 118-673 "Unusual Construction" of the Zoning Ordinance. If the SUP is not
granted, the applicant would be required to replace the east elevation red cedar with
masonry.
Chairman Shiflet opened the Public Hearing.
Mr. Benton asked if Mr. Gardner has built other homes in North Richland Hills.
Mr. Gardner stated he also built a home on Sayers.

Mr. Benton asked Eric Wilhite to explain the Special Use Permit and how approval of
this SUP might set precedence regarding granting exceptions to the masonry
requirement for residential homes. Mr. Wilhite said SUPs are considered on a case by
case basis and that approval of this SUP would not set a precedence.
Mr. Schopper asked Mr. Gardner what the approximate cost would be to change the red
cedar to masonry. Mr. Gardner said that due to the design of the plan, it was not a
simple process and would require framing, mechanical and electrical work to make the
change as well as the masonry work. The approximate cost to the applicant would be
around $15,000.
Mr. Schopper asked if the red cedar would require extra maintenance.
Mr. Gardner said the red cedar would need to be stained again every three to five
years to maintain its new appearance.
As there were no others wishing to speak, the Chairman closed the Public Hearing and
called for a motion.
Mike Benton, seconded by Don Bowen, motioned to approve SUP 2006-03. The
motion carried unanimously (6-0). Brenda Cole was absent.

Background: This ordinance amendment revises the Table of Permitted Uses in the
Zoning Ordinance, creates new definitions, repeals sections dealing with Conditional
Special Use Permits and Site Plans within 200 feet of residential properties, and creates
a requirement for administrative site plan approval.

Reviews and discussions of these changes have occurred before the Planning & Zoning
Commission on July 6, 2006; September 7, 2006 and October 5, 2006 at work session
meetings with a formal public hearing being conducted on October 19, 2006. A City
Council work session was also held on September 11, 2006 to receive input before the
final Ordinance was prepared and given to the P&Z Commission for final review and
recommendation. It was the consensus of the City Council to proceed with these
changes.
These proposed changes are an effort to clarify permitted uses and make the permitted
use table more understandable. There are six basic changes to the proposed zoning
text revisions. Following is a summary of the proposed changes.
(1) Elimination of the Conditional Special Use Permits (CS) - The current table of
permitted land uses has several designations that are listed as CS which stands for
Conditional Special Use Permit and allows a permitted use unless the request falls
within 200 feet of residential property or is located within a residential zoning district.
Proposed changes include the elimination of Section 118-204 and all the CS
designations in Section 118-631 Table of Permitted Uses. The new table (which has all
previous CS designations removed) shows all land uses to be either allowed by right
(P), allowed under a special use permit (S) or not allowed at all (blank). This change
will simplify the permitted use table and allow for staff and the general public to clearly
be able to determine permitted uses without having to determine distances from certain
properties and eliminate potential errors in reading the table for all parties.
(2) Providing for Administrative Site Plan Approval by Staff - Our current zoning
ordinance requires commercial site plans that fall within 200 feet of residential property
to be presented to the Planning & Zoning Commission and City Council for an
administrative review. These are not zoning cases and do not require a public hearing
or notification. Site plans are required to be approved by staff and meet all regulations.
This change includes eliminating Sections 118-242, 118-354, 118-393, 118-423 and a

small section in 118-631 also. The new administrative site plan Section 118-242
requires approval from the Development Review Committee and re-submittal of a site
plans if construction has not commenced within 12 months of the its original approval
date.
(3) Specifying Outdoor Commercial Uses to allow and encourage Outdoor
Entertainment Uses - Changes to the Outdoor Commercial zoning district includes
elimination of some uses and the addition of other land uses to encourage more
entertainment related uses. Automobile and manufacturing uses have been removed
and new uses such as miniature golf course, health studios and recreation centers,
swim and tennis clubs, restaurants and cafeterias, garden centers and feed stores have
been added to this district. Uses currently allowed that will not change include bowling
lanes, golf courses, movie theatres, country clubs, roller or ice skating rinks and farmers
markets. This change should encourage more entertainment related uses within our
current entertainment area that includes NRH20 and the Mountasia facility.
(4) Specifying a minimum of 5 acres for Automobile and Truck Dealerships - This
proposed change requires that automobile and truck dealerships with new and used
vehicles that have outdoor display and sales have a minimum of 5 acres to operate.
Some of the smaller auto lots typically do not have stability and often change owners on
a more frequent basis. This proposed change in combination with the requirement for a
special use permit will aid in encouraging and requiring attractive and vibrant
dealerships that will be in the community for a longer period and provide increased land
use and business stability.
(5) Clarifying allowed uses with Alcohol Sales - The State has passed regulations
on alcohol sales that were adopted by the City in 2003 but have not been reflected in
the Table of Permitted Uses. This change modifies the use table to reflect the State
Law requirements. Specifically, an establishment which derives more than 75% of its
revenue from alcoholic beverages is only allowed by a special use permit in the C-2, HC
and OC zoning districts and must conform to alcoholic beverage sales regulations under
Section 118-711. All other alcohol sales are regulated as part of the primary use. For
instance, on premise alcohol sales as part of a restaurant, grocery store, convenience
store or super store are regulated as listed in the table of permitted uses under each
use.
(6) Adding New and Unlisted land Uses (Section 118-1) - Changes include the
addition of new land uses including Pet Day Care and Accessory Off-Site Parking Lots;
new definitions for Wedding Chapel and Weight Loss Center; eliminating Finishing
Store and revising the definition for Special personal service shop.
These amendments are many and can seem somewhat complex. Accordingly, much
time has been spent in their research for and explanation to the members of the
Planning and Zoning Commission. The Commission has reviewed the amendments

more then four times during work sessions as well as conducting a formal public
hearing. They where also presented to City Council in a work session format.
Many of the changes to the table of permitted uses are a direct response to a desire by
the City to be increasingly selective in the approval of specific types of land uses, their
general and particular location, and their physical relationships to both existing and
future adjacent land uses. As is to be expected, new types of land uses have been and
will always be requested by developers and these amendments include several such
new land use types. Modification of the administrative site plan provisions are intended
to shorten the overall review time spent by developer's without sacrificing quality of
design or compliance with City development standards.
The Planning and Zoning Commission and staff believes these amendments will both
strengthen and expand the City Council's ability, through land planning and land use
controls, to meet several key community goals and objectives including enhancing
economic vitality and furthering private investment, the conservation of both commercial
and residential neighborhoods, and the overall protection of land use values throughout
our Community.

The Planning & Zoning Commission held a public hearing on the proposed changes to
the zoning ordinance on Thursday, October 19, 2006 and recommended 6-0 to
approve Ordinance No. 2910.

eliminate conflicting provisions and eliminate conflicts with state law; and
WHEREAS, the City Council has determined that the amendment to the North
Richland Hills Code of Ordinance herein made is in the best interest of the
health, safety and general welfare of the citizens of the City of North
Richland Hills, Texas; and
WHEREAS, notice has been published of the time and place of a public hearing held
before the City Council concerning the changes herein made, which public
hearing has been duly held; and,
WHEREAS, the City Council has determined that the amendment to the
Comprehensive Zoning Ordinance herein made is in the best interest of
the health, safety and general welfare of the citizens of the City of North
Richland Hills;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF NORTH
RICHlAND HillS, TEXAS:
Section 1. THAT Sec. 118-1 of the North Richland Hills Code of Ordinances hereby
amended by adding thereto the following definitions:
"Pet Day Care means an indoor facility dedicated to sheltering and caring for the
basic needs of household animals, but not including medical assistance,
breeding, grooming, outdoor runs, or overnight boarding.
Wedding Chapel means a building set aside for the use of conducting a
ceremony in which a representative of the state and family and friends come
together to witness the joining together of two individuals in marriage. This
facility can also be used for receptions and celebrations associated with a
marriage ceremony.
Weight Loss Center means a facility that provides equipment, counsel, and
nutritional supplements intended to help individuals in their attempt to lose
weight. It does not include surgical equipment designed to reduce weight."
Section 2. THAT Sec. 118-1 of the North Richland Hills Code of Ordinances is
hereby amended by amending the definition of Special Personal Service Shop to read
as follows:
"Special Personal Service Shop means an establishment where the primary use
of the building or lease space includes any of or any combination of the following:
psychic readers, tattoo parlo~s, body or piercing parlors, the sale of cigarette
papers, bongs, or other smoking accessories. This definition shall not include
massage therapy or acupuncture clinics, cigar or cigarette shops, or permanent
cosmetics as part of a beauty salon."
Section 3. THAT Section 118-242 of the North Richland Hills Code of Ordinances be
amended to read as follows;
"Sec. 118-242 Administrative Site Plan Approval.
(a) No development or construction of any structure or occupancy of any land
shall occur unless a site plan is first submitted and has been approved by the
Development Review Committee (defined in Section 110-5 of the Code of
Ordinances). A site plan must be submitted prior to or concurrently with building
permit construction plans. The site plan must be approved prior to issuance of
any building permit for development. No building or site shall be occupied unless'
all construction, development and operations conform to the site plan approved
under this section. Failure to comply with the approved site plan may result in
non-issuance or revocation of an occupancy permit. Site plan approval shall not
.
be required for property zoned for single family dwelling purposes or any
accessory uses incidental thereto.
(b) If construction of a site with an approved site plan has not commenced within
12 months of the date of final approval of the site plan, the site plan shall be
deemed to have expired, and a review and re-approval of the approved site plan
by the DRC shall be required before construction commenc,es on the project.
Said review and approval shall be evaluated according to the standards of Article
III, taking into account changes in the surroundings and in applicable ordinances
which have occurred subsequent to the prior approval of the site plan.
(c) The enforcement officer may approve minor modifications of a site plan
approved under this section if such modifications are necessitated by final
architectural and engineering design and do not materially change the circulation
and building location on the site.
Section 4. Sections 118-204, 118-354, 118-393 and 118-423 of the North Richland
Hills Code of Ordinances are hereby repealed.
Section 5. THAT Sec. 118-631 of the North Richland Hills Code of Ordinances is
hereby amended by adopting by reference the table attached to this ordinance and by
amending such section to read as follows:
.
"Sec. 118-631. Table of permitted uses
The following table presents the zoning district classifications and the permitted
uses within those classifications. Uses are listed in accordance with permitted
uses (P), used permitted by a special use permit (S), and prohibited uses (blank).
Note: Procedures and conditions requiring a special use permit are contained in
section 118-201 et seq."
Section 6. This ordinance shall be deemed an amendment to the North Richland Hills
Comprehensive Plan as well as to the specific code sections.
Section 7. Penalty.
Any person, firm or corporation violating any provision of this ordinance shall be
deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount
not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be
allowed to continue shall constitute a separate violation and punishable hereunder.
Section 8. Severability.
.
It is hereby declared to be the intention of the City Council that the phrases,
clauses, sentences, paragraphs and section of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,

sentences, paragraphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
Section 9. Publication.
The City Secretary of the City of North Richland Hills is hereby directed to publish
the caption and penalty of this ordinance in the official City newspaper.

Backaround:
Staff has worked closely with the Boulevard 26 Oversight Committee and Schrickel,
Rollins and Associates to bring the conceptual design of the Boulevard 26 Corridor into
a realistic and practical design in preparation for construction. Four basic options were
presented to the Oversight Committee on Thursday, October 19, 2006 including A, B 1 ,
B2 and C.

It was a unanimous decision to proceed with Option B2 which includes improvements to
both intersections for full landscaping, signs and signal improvements, 2 inch asphalt
overlay and striped crosswalks and a painted oval as a base bid. It was also
unanimously decided that should funding be available, an add alternate bid will be
considered for selecting Option C which includes the addition of colored and stamped
concrete in the crosswalks. Both the B2 and C design concept drawings are attached.
The current budget for this project includes approximately $800,000 for construction
costs. Schrickel, Rollins and Associates has estimated that construction costs could be
between $50,000 and $200,000 over budget depending on which design option is
ultimately constructed. These costs would be shared by both cities.
Staff has prepared a joint resolution that 1) establishes Concept B2 as the primary
streetscape design for intersection improvements for the Boulevard 26 Corridor, with a
possible option for Concept C if funding is available, 2) Encourages Staff and City
Council to pursue acceptance of the new design concepts by the Texas Department of
Transportation (TXDOT) because this is a state highway, 3) encourages the Fort Worth
District of the Texas Department of Transportation to approve and assist the Cities in
the timely implementation of this project, and (4) Encourages the completion of design
and bidding of Boulevard 26 intersection improvements as soon as possible
This resolution will be presented to the City of North Richland Hills on Monday,
November 13th and to the City of Richland Hills on Tuesday, November 14th for
approval. The approval of this resolution supports joint acceptance of new design
concepts and will allow the engineering consultants and staff to proceed to get TXDOT
approval and proceed with final design. It is anticipated that these Boulevard 26
intersection improvements could go to bid by April or May. All costs will be shared
equally by both cities and each City Council will approve final construction bids.

A JOINT RESOLUTION OF THE CITY COUNCilS OF THE CITIES OF
RICH lAND HillS AND NORTH RICH lAND HillS, TEXAS ENDORSING

WHEREAS, the City Councils of Richland Hills and North Richland Hills have entered
into an interlocal agreement to jointly promote the planning and
implementation of measures for the revitalization of the Boulevard 26 area
south of Loop 820 which is a mutual concern and which effected roadway
corridors are located within both cities; and
WHEREAS, the City Councils of Richland Hills and North Richland Hills have adopted
specific branding and design efforts for the new "twentysix" area and have
renamed the previous Grapevine Highway within the city limits of each city
to "Boulevard 26" and are firmly committed to supporting new streetscape
design standards and elements for Boulevard 26 south of Loop 820; and
WHEREAS, the City Councils of Richland Hills and North Richland Hills have
established an Oversight Committee composed of two (2)
Councilmembers from each city and one (1) business person to identify
. and recommend efforts to revitalize the Boulevard 26 area and the
Oversight Committee has given a unanimous recommendation for
designing and constructing specific intersection improvements for the
intersections of Rufe Snow and Boulevard 26 and Glenview and
Boulevard 26; and
WHEREAS, the City Councils of Richland Hills and North Richland Hills firmly believe
that public dollars spent on specific streetscape designs at key
intersections within the Boulevard 26 corridor will encourage and stimulate
private investment of similar efforts throughout the Boulevard 26 corridor
to assist in the revitalization of the entire area; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCilS OF THE CITIES OF RICHlAND HillS
AND NORTH RICHlAND HillS, TEXAS:
Section 1: The specific design Concept B2 as included in the attached exhibits is
hereby established as the primary streetscape design for intersection
improvements for the Boulevard 26 corridor. However, should additional
funding be available atter bids are received, then an add alternate
(Concept C) will be considered for stamped and colored concrete
crosswalks.

Section 2: City Council members and City Staff from each city are encouraged to
meet with Texas Department of Transportation (TXDOT) officials to
pursue acceptance of the new design concepts for Boulevard 26 by
TXDOT.
Section 3: That the Fort Worth District of the Texas Department of Transportation is
strongly encouraged to approve this unique streetscape design and assist
the Cities' in its timely implementation.

Subject: GN 2006-105 Amending the Interlocal Agreement between the Cities of North
Richland Hills and Keller for Animal Cremation Services - Resolution No. 2006-100
The Animal Adoption and Rescue Center has historically assisted several different
entities with their crematory needs. In the past, we have assisted the City of Haltom
City, City of Watauga, City of Bedford and the City of Richland Hills with communal
cremations. We currently have agreements in place with the City of Southlake and
Keller to provide cremation services for their deceased animals. However, throughout
the years, the agreements that were entered into with these cities for crematory
services were not consistent and varied from city to city. The fees were not
standardized and some agreements were verbal, while others were approved by City
Council through interlocal agreements. It is the Neighborhood Services Department's
desire to ensure all municipalities that request our services are charged the same fee
for crematory services and all service relationships are approved through an interlocal
agreement.
Staff surveyed other comparable cities to assess their current fee rates for providing
crematory service to other municipalities. The rates varied from $15 - $75 per animal.
The rate being recommended by staff is $30 per animal.
We currently have an interlocal agreement with the City of Keller, which was approved
in January of 2002. The fees are $30 per euthanized animal and $20 for dead animals
picked up off the street. Staff is recommending a change to the current interlocal
agreement to charge a flat rate of $30 per animal (whether euthanized or found dead on
the street) which is the same as was approved by the City Council for the City of
Southlake just a few weeks ago. The City Manager for the City of Keller is aware of the
proposed change in fee and has already signed the revised interlocal agreement which
is for Council consideration.
It is our desire to provide crematory services to all municipalities in a fair and equitable
manner by ensuring that all fees are consistent. Staff has chosen a roughly middle
range rate for such services ($30 per animal) as gathered from a survey of comparable
cities that also provide crematory services. This amendment will, if approved, ensure
that the City of Southlake and the City of Keller and any future municipalities that
request our services will be charged the same amount. This will also require approval
of an interlocal agreement by the City Council for the provision of such services.

Pursuant to the authority granted in Chapter 791 of the Texas Local Government
Code, this document shall constitute an Interlocal Agreement between the local
government agencies named herein.
INTERLOCAL AGREEMENT
1. The City of 'North Richland Hills is the owner of a Municipal Crematorium for
animals and the City of Keller does not posses such a facility.
2. The City of Keller is in need of a means for disposing of dead animals picked up
off the streets and animals euthanized by Keller Animal Control.
3. The parties have agreed that the North Richland Hills Animal Shelter will cremate
deceased dogs, cats, and other animals weighing less than 150 pounds brought
to the City of North Richland Hills by the animal control department of the City of
Keller for the following consideration: $30 per animal. Animals shall be brought
for cremation as arranged and agreed between staff of both cities.
The City of North Richland Hills will bill the City of Keller for the services
rendered pursuant to this agreement on a quarterly basis and the City of Keller
will remit payment in full to the City of North Richland Hills, c/o Animal Adoption &
Rescue Center, 7200-B Dick Fisher Dr. South, North Richland Hills, Texas 76180
within 30 days from receipt of each bill.

5. This contract shall be for a term of 1 year from the date signed and shall be
automatically renewed for successive one year terms thereafter unless
terminated by one of the parties as herein provided.
6. This contract may be terminated by either party by giving the other party 60 days
written notice to the other.

Enforcement - Ordinance No. 2911
As our roadways become more congested, motorists begin to look for opportunities to
avoid those traffic devices that might cause them to be delayed. Unfortunately, often
these actions result in unsafe measures that can cause accidents. One of the
contributing factors to many accidents throughout the city is motorists failing to stop at
red lights. During 2005, the Police Department responded to 1573 accidents; 462 of
these involved an injury. While the exact number of accidents directly contributed to red
lights is difficult to obtain, we estimate that approximately 5-100k fall into this category.
This results in significant property damage as well as the time necessary to respond
and investigate the accident.
During 2005, Rufe Snow Drive and Davis Blvd. had the highest number of accidents in
the city. Since January, this trend has continued with the top five accident locations
being 5100 Rufe Snow, 5600 Rufe Snow, 6200 Rufe Snow, 8500 Harwood and 5100
Davis Blvd. A recent engineering study was conducted at those and other high-accident
intersections in North Richland Hills. A temporary camera was set up and filmed the
following intersections for a total of eight hours (7-10am, 11-2pm, and 5-7pm).

Many cities across the State have begun installing cameras at selected high-accident
locations in an attempt to reduce the number of accidents. While still a relatively recent
practice, several of the cities have seen reductions as high as 40-50% in related
crashes at these intersections. The system is based on the issuance of a civil fine to the
registered owner of the vehicle. There are no criminal penalties and any enforcement
action does not impact an individual's driver's license.
The cameras are set at specific locations based on the accident data available.
Cameras are placed in conspicuous areas and often have signage accompanying them
to alert the motorist. This helps to serve as an additional deterrent to the damaging
conduct. Once the traffic signal begins to cycle, the camera records any vehicle that is
within a certain distance of the stop line. The camera will continue to take photographs if
the vehicle continues beyond the stop line after the light turns red. If the vehicle stops,
. then nothing is done. The camera only takes a picture from the rear of the vehicle in
· order to capture the license plate. It is assumed that the owner of the vehicle is
responsible for the vehicle and whoever may be operating it at that time.
If a violation is detected by the system, then a digital image is downloaded to a server
where the picture is reviewed by a police officer to verify the violation. If a violation is
confirmed then a citation is sent to the registered owner. The amount being charged by
most jurisdictions is $75.00 for the first occurrence. There are provisions to contest the
violation or file an appeal due to unusual circumstances. The installation, maintenance
and upkeep of the system as well as the mailing of the citation are done on a contract
basis. There are currently several companies in Texas operating this type of system in
various jurisdictions. The costs can be done either on a flat charge or based on a
percentage of the violations. In most cities, any funds derived from this program are
earmarked exclusively for law enforcement and traffic control improvements.
This is not a criminal violation and does not go against the violator's driving record. This
type of violation is in fact a civil violation. To enforce this type violation it would be
necessary to adopt an ordinance to address the violation. The attached ordinance has
been modified from the draft previously provided to give the City Council greater
flexibility in the usage of these funds when evaluated for meeting program expectations
on an annual basis. The Texas Red Light Photo Enforcement Coalition endorses using
revenues for traffic safety for the following reasons:

1. The creation of a traffic safety fund dispels the view that the program is
intended solely as a revenue generator.
2. It will ensure that cities address traffic related issues.
3. It allows "buy-in" from the public for the photo enforcement program by
showing where the money will be used.
4. Money allocated from the program to long-term projects may not be available
when the program matures and achieves its goals.
In addition to the deterrent factor, most of the available systems can be utilized in
accident investigations. The system will retain a short-time period of recording before it
is erased. If an accident occurs at an intersection, often it will be recorded on the
system and can be accessed for the investigation. Also, the system can be connected
to a monitor in Police communications that would allow them to view the intersection
after an accident to better and more rapidly send responding emergency units.
A concern was raised that the timing of the traffic signals "yellow" light would be
modified to enhance revenues. This would never be practiced in our city as we use the
Texas Manual on Uniform Traffic Control Devices to regulate the settings on all traffic
signals within the city. All signals are in compliance with this manual and will remain that
way. Further, all vendors contacted regarding red light cameras strongly suggest to
never alter the timing of signals because variations become problematic for motorists to
establish driving patterns and good safe habits.
Since we have a number of intersections eligible for red light cameras that are located
on a State Highway, a new Municipal Maintenance Agreement (MMA) will be completed
and brought to the City Council for approval. This is being coordinated by the Public
Works Department.

There are numerous benefits to the City of North Richland Hills and its residents
through the use of an automated red light enforcement system.

AN ORDINANCE OF THE CITY OF NORTH RICHlAND HillS,
AMENDING THE NORTH RICH lAND HillS CODE OF ORDINANCES
OF THE CITY OF NORTH RICHlAND HillS, BY AMENDING
CHAPTER 54, TO ADD ARTICLE X. AUTOMATED TRAFFIC SIGNAL
ENFORCEMENT; PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABiliTY CLAUSE; PROVIDING FOR THE IMPOSITION OF
CIVil PENALTIES AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City is a home rule municipality with powers created by its charter, in
addition to those granted by Sec. 542.201 and 542.202, Texas
Transportation Code; and
WHEREAS, the installation of red light cameras and the creation of civil penalties for
running red lights will promote public safety; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF NORTH RICH lAND
HillS, TEXAS:

SECTION 1. That Chapter 54 of the North Richland Hills Code of Ordinances of the
City of North Richland Hills, Texas is hereby amended by adding a new
Article X, which shall read as follows:
"ARTICLE X.
AUTOMATED TRAFFIC SIGNAL ENFORCEMENT
Sec. 54-401.
Definitions.
In this article:
(1) Department shall mean the Police Department of the City of North
Richland Hills, Texas.
(2) Intersection shall mean the place or area where two or more streets
intersect.
(3) Owner shall mean the owner of a motor vehicle as shown on the motor
vehicle registration records of the Texas Department of Transportation or
the analogous department or agency of another state or country.
(4) Photographic Traffic Signal Enforcement System shall mean a system
that:
(a) consists of a camera system installed to work in conjunction with an
electrically operated traffic-control signal; and
.
·
(b) is ·capable of producing at least two recorded images that depicts
the license plate attached to the rear of a motor vehicle that is not
operated in compliance with the instructions of the traffic-control
signal.
(5) Recorded Image means an image recorded by a photographic traffic
monitoring system that depicts the rear of a motor vehicle and is
automatically recorded on a photograph or digital image.
(6) System Location means the approach to an intersection toward which a
photographic traffic monitoring system is directed and in operation.
(7) Traffic Control Signal shall mean a traffic control device that displays
alternating red, amber and green lights that directs traffic when to stop at
or proceed through an intersection.
Sec. 54-402. Imposition of Civil Penalty for Violations.
·
(a) The City Council finds and determines that a vehicle that proceeds into an
intersection when the traffic control signal for that vehicle's direction of travel is
emitting a steady red signal damages the public by endangering motor vehicle
operators and pedestrians alike, by decreasing the efficiency of traffic control and
traffic flow efforts, and by increasing the number of serious accidents to which
public safety agencies must respond at the expense of the taxpayers.
(b) Except as provided in (c) and (d) below, the owner of a motor vehicle is liable for
a civil penalty of seventy-five dollars ($75.00) if the motor vehicle proceeds into
an intersection at a system location when the traffic control signal for that motor
vehicle's direction of travel is emitting a steady red signal.
(c) For a third or subsequent violation committed by the owner of the same motor
vehicle during any 12-month period, the amount of the civil penalty shall be one
hundred fifty dollars ($150.00).
(d) An owner who fails to timely pay the civil penalty shall be subject to a late
payment penalty of twenty-five dollars ($25.00).
Sec. 54-403. Enforcement; procedures.
(a) The Department is responsible for the enforcement and administration of this
article.
·
(b) In order to impose a civil penalty under this article, a notice of violation shall be
mailed to the owner of the motor vehicle liable for the civil penalty not later than
the 30th day after the date the violation is alleged to have occurred to:
·
(1 ) the owner's address as shown on the registration records of the Texas
Department of Transportation; or
(2) if the vehicle is registered in another state or country, the owner's address
as shown on the motor vehicle registration records of the department or
agency of the other state or country analogous to the Texas Department
of Transportation.
(c) A notice of violation issued under this article shall contain the following:
(1 ) a description of the violation alleged;
(2) the date, time, and location of the violation;
(3) a copy of a recorded image of the vehicle involved in the violation;
(4) the amount of the civil penalty to be imposed for the violation;
(5) the date by which the civil penalty must be paid;
(6) a statement that the person named in the notice of violation may pay the
· civil penalty in lieu of appearing at an administrative adjudication hearing;
(7) information that informs the person named in the notice of violations:
(A) of the right to contest the imposition of the civil penalty in an
administrative adjudication;
(8) of the manner and time in which to contest liability is an admission
of liability; and
(C) that failure to pay the civil penalty or to contest liability is an
admission of liability.
(8) a statement that a recorded image is evidence in a proceeding for the
imposition of a civil penalty;
(9) a statement that failure to pay the civil penalty within the time allowed shall
result in the imposition of a late penalty of $25.00;
(10) any other information deemed necessary by the department.
(d) A notice of violation under this article is presumed to have been received on the
10th day after the date the notice of violation is mailed.
·

(e) In lieu of issuing a notice of violation, the Department may mail a warning notice
to the owner.
Sec. 54-404. Administrative adjudication hearing.
(a) A person who receives a notice of violation may contest the imposition of the civil
penalty by requesting in writing an administrative adjudication of the civil
penalty within fifteen (15) days after receipt of the notice of violation.
Upon receipt of a timely request, the Department shall notify the person of
the date and time of the hearing on the administrative adjudication. The
administrative adjudication hearing shall be held before a hearing officer
appointed by the City Manager.
(b) Failure to pay a civil penalty or to contest liability in a timely manner is an
admission of liability in the full amount of the civil penalty assessed in the notice
of violation, and is a waiver of the right to appeal under section 54-404(i).
(c) The civil penalty shall not be assessed if after a hearing, the hearing officer
enters a finding of no liability.
(d) In an administrative adjudication hearing, the issues must be proved at the
hearing by a preponderance of the evidence. The reliability of the photographic
traffic signal enforcement system used to produce the recorded image of the
violation may be attested to in an administrative adjudication hearing by affidavit
of an officer or employee of the City or the entity with which the City contracts to
install or operate the system and who is responsible for inspecting and
maintaining the system. An affidavit of an officer or employee of the City that
alleges a violation based on an inspection of the pertinent recorded image, is
admissible in a proceeding under this article and is evidence of the facts
contained in the affidavit.
(e) A person who is found liable after an administrative adjudication hearing or who
requests an administrative adjudication hearing and thereafter fails to appear at
the time and place of the hearing is liable for administrative hearing costs in the
amount of $25.00 in addition to the amount of the civil penalty assessed for the
violation. A person who is found liable for a civil penalty after an administrative
adjudication hearing shall pay the civil penalty and costs within 10 days of the
hearing.
(f) It shall be an affirmative defense to the imposition of civil liability under this
article, to be proven by a preponderance of the evidence, that:
(1) the traffic-control signal was not in proper position and sufficiently legible
to an ordinarily observant person;
.

(2) the operator of the motor vehicle was acting in compliance with the lawful
order or direction of a police officer;
(3) the operator of the motor vehicle violated the instruction of the traffic-
control signal so as to yield the right-of-way to an immediately
approaching authorized emergency vehicle;
(4) the motor vehicle was being operated as an authorized emergency vehicle
under Chapter 546 of the Texas Transportation Code and that the
operator was acting in compliance with that Chapter;
(5) the motor vehicle was a stolen vehicle and being operated by a person
other than the owner of the vehicle without the effective consent of the
owner;
(6) the license plate depicted in the recorded image of the violation was stolen
and being displayed on a motor vehicle other than the motor vehicle for
which the plate had been issued; or
(7) the presence of ice, snow, unusual amounts of rain or other unusually
hazardous road conditions existed that would make compliance with this
article more dangerous under the circumstances than non-compliance;
(8) the person who received the notice of violation was not the owner of the
motor-vehicle at the time of the violation.
(g) To demonstrate that at the time of the violation the motor vehicle was a stolen
vehicle or the license plate displayed on the motor vehicle was a stolen plate, the
owner must submit proof acceptable to the hearing officer that the theft of the
vehicle or license plate had been timely reported to the appropriate law
enforcement agency.
(h) Notwithstanding anything in this article to the contrary, a person who fails to pay
the amount of a civil penalty or to contest liability in a timely manner is entitled to
an administrative adjudication hearing on the violation if:
(1) the person files an affidavit with the hearing officer stating the date on
which the person received the notice of violation that was mailed to the
person; and
(2) within the same period required by Sec. 54-403(c)(7)(B) for a hearing to
be timely requested but measured from the date the mailed notice was
received as stated in the affidavit filed under Subdivision (1), the person
requests an administrative adjudication hearing.
(i) A person who is found liable after an administrative adjudication hearing may
appeal that finding of civil liability to the Municipal Court by filing a notice of
.
appeal with the clerk of the Municipal Court. A $100 filing fee must accompany
the appeal. The notice of appeal must be filed not later than the 31st day after
the date on which the administrative adjudication hearing officer entered the
fining of civil liability. Unless the person, on or before the filing of the notice of
appeal, posts a bond in the amount of the civil penalty and any late fees, and
appeal does not stay the enforcement of the civil penalty. An appeal shall be
determined by the Municipal Court by trial de novo. The affidavits submitted
under Section 54-404(d) shall be admitted by the municipal judge in the trial de
novo, and the issues must be proved by a preponderance of the evidence. A
person found liable by the Municipal Court shall forfeit the appellate filing fee of
$100.00 in addition to the civil penalty and any other fees due the City.
Sec. 54-405 Order.
(a) The hearing officer at any administrative adjudication hearing under this article
shall issue an order stating:
(1) whether the person charged with the violation is liable for the violation;
and
(2) the amount of any civil penalty, late penalty, and administrative
adjudication cost assessed against the person.
.
(b) The orders issued under subsection (a) may be filed with the office of the hearing
examiner. The hearing examiner shall keep the orders in a separate index and
file. The orders may be recorded using microfilm, microfiche, or data processing
techniques.
Sec. 54-406 Effect of liability; exclusion of civil remedy.
(a) The imposition of a civil penalty under this article is not a criminal conviction for
any purpose.
(b) A civil penalty may not be imposed under this article on the owner of a motor
vehicle if the operator of the vehicle was arrested or was issued a citation and
notice to appear by a peace officer for the same violation of Section 544.007(d)
of the Texas Transportation Code recorded by the photographic traffic signal
enforcement system.
(c) An owner who fails to pay the civil penalty or to timely contest liability for the
penalty is considered to admit liability for the full amount of the civil penalty
stated in the notice of violation mailed to the person.
(d) The City Attorney is authorized to file suit to enforce collection of a civil penalty
imposed under this article.

Sec. 54-407 Traffic Safety Fund.
(a) The penalties and fees collected from the imposition of civil liability under this
article, except for the appellate filing fee paid to the Municipal Court, shall be
deposited in the Traffic Safety Fund account established by the City Council.
(b) Funds from the Traffic Safety Fund may be expended only for the costs of
automated signal enforcement under this article, public traffic or pedestrian
safety programs, traffic enforcement, intersection improvements and other uses
as determined on an annual basis by resolution of the City Council."
SECTION 2. That all provisions of the ordinances of the City of North Richland Hills in
conflict with the provisions of this ordinance be, and the same are hereby,
repealed, and all other provisions of the ordinances of the City of North
Richland Hills not in conflict with the provisions of this ordinance shall
remain in full force and effect.
SECTION 3. That should any sentence, paragraph, subdivision, clause, phrase or
section of this ordinance be adjudged or held to be unconstitutional, illegal
or invalid, the same shall not affect the validity of this ordinance as a
whole, or any part or provision thereof other than the part so decided to be
invalid, illegal or unconstitutional, and shall not affect the validity of the
Code of Ordinances as a whole.
SECTION 4. This Ordinance shall take effect immediately from and after its passage.
SECTION 5. The City Secretary is hereby authorized and directed to cause the
descriptive caption and 54-402 hereof to be published.

Subject: GN 2006-109 Consider Approval of Traffic Safety Fund Memorandum of
Usage - Resolution No. 2006-103
Council consensus at the October 23, 2006 Work Session was for Staff to bring forward
the Policy on Uses of Revenues from the Automated Signal Enforcement Program for
approval.
The policy is intended to establish guidelines governing the usage of funds and defining
the scope of resources for which the Traffic Safety Fund may be utilized. The Fund is
established by City Ordinance and is defined as the gross collections derived from civil
violations in accordance with Article X of Chapter 54 of the Municipal Code.
According to 54-407 of the Municipal Code, "funds from the Traffic Safety Fund may be
expended only for the costs of automated signal enforcement under this article, public
traffic or pedestrian safety programs, traffic enforcement, intersection improvements,
and other uses as determined on an annual basis by resolution of the City Council."

The attached policy is in anticipation of the City receiving revenues from an automated
traffic signal enforcement program (red light camera) over the next several years. It is
important that the City not become reliant on these funds as the program is intended to
have a diminishing revenue stream as it becomes effective. The policy is to be
reviewed on an annual basis to allow for any modifications to the policy and is so stated
in both the policy as well as the accompanying resolution.
The attached resolution adopts the policy on uses of revenues for the funds derived
from this program as discussed at the October 23 Work Session.

A RESOLUTION OF THE CITY COUNCil OF THE CITY OF NORTH
RICH lAND HillS, TEXAS, APPROVING THE POLICY ON USES OF
REVENUES FROM THE AUTOMATED TRAFFIC SIGNAL

WHEREAS, pursuant to Section 54-407 of the Code of Ordinances of the City of North
Richland Hills, Texas funds from the Traffic Safety Fund may be expended only for the
costs of automated signal enforcement, public traffic or pedestrian safety programs,
traffic enforcement, intersection improvements and other uses as determined on an
annual basis by resolution of the City Council pursuant to the Traffic Safety Fund policy
guidelines; and

WHEREAS, the City Council of the City of North Richland Hills, Texas, has been
presented a proposed Policy Guidelines for Use of Traffic Safety Fund (Exhibit "A")
establishing guidelines governing the usage of funds and defining the scope of
resources' for which the Traffic Safety Fund may be utilized, and finds such to be
acceptable and in the best interests of the City of North Richland Hills and its citizens;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF
NORTH RICHlAND HillS, TEXAS:
SECTION 1. That the Memorandum Policy Guidelines for Use of Traffic Safety Fund
attached hereto as Exhibit A is hereby approved.
SECTION2. That the funds from the Traffic Safety Fund may be expended only for the
costs of automated signal enforcement, public traffic or pedestrian safety
programs, traffic enforcement and intersection improvements in
accordance with the Policy Guidelines for Use of Traffic Safety Fund.
SECTION 3. That this resolution shall become effective immediately from and after its
passage.

Policy Guidelines For Use of Traffic Safety Fund
I. Introduction
These policy guidelines are in anticipation of the City receiving revenues from an
Automated Signal Enforcement (red light camera) Program. The guidelines are to
establish the usage of revenues and to define the scope of resources for which the
Traffic Safety Fund may be utilized. The Fund is established by City Ordinance and is
defined as the gross collections derived from civil violations in accordance with Article X
of Chapter 54 of the Municipal Code.
According to 54-407 of the Municipal Code, "funds from the Traffic Safety Fund may be
expended only for the costs of automated signal enforcement under this article, public
traffic or pedestrian safety programs, traffic enforcement, intersection improvements,
and other uses as determined on an annual basis by resolution of the City Council."
II. TVDe of Revenue
.
The City anticipates receiving revenues from the implementation of an Automated
Traffic Signal Enforcement Program. These revenues will come in the form of a civil
penalty assessed for a vehicle proceeding into an intersection against a red light. The
program is intended to increase the safety of the intersections by reducing the number
of related vehicle crashes. As the program matures, it is anticipated that driver behavior
will change resulting in a decline in the number of violations and, thus, the amount of
revenue received. Because of the nature of this revenue, it would seem impractical to
use these revenues for ongoing operations, and instead should lend themselves to
more project or one-time expenses.
III. Uses of Revenues
A. ODerational EXDenditures
· Monthly payment per approach in accordance with the contract with
equipment provider.
· Hourly wages to the Administrative Hearing Officers as appropriately billed.
· Overtime rate to police officers designated to review violations for issuance.
· Other operational expenses as identified that are directly related to the
operation of the photo enforcement program.
B. Traffic Safety EauiDment and Proarams - Police DeDartment

· Traffic safety devices including but not limited to flares, cones, barricades, or
other expendable items utilized by the police department to warn, control,

divert traffic.
· Equipment utilized in police vehicles for officer safety while conducting traffic
enforcement or traffic patrol.
· Speed detection equipment or other equipment used for the purpose of
detecting traffic violators or vehicles that may be operated by persons wanted
for traffic violations.
· Video equipment utilized during traffic enforcement.
· Safety equipment worn by police officers while directing traffic or working
traffic or motor vehicle accidents.
· Computer equipment, software or other equipment utilized in the investigation
of traffic crashes.
· Overtime reimbursement for special programs established strictly for traffic
enforcement programs, Le. speed enforcement, seatbelt campaigns, OWl
enforcement, etc.
· Educational and promotional items for traffic safety education programs.
· Training programs related to traffic safety, traffic management, traffic
investigations, accident reconstruction, etc.
· Other equipment or expenses directly related to the promotion of traffic
safety, traffic enforcement, accident prevention, accident investigation, and
public education traffic safety programs.

C. Traffic Safety EauiDment and Proarams-TransDortation/Other City
DeDartments
· Equipment required for emergency response and emergency traffic
management, or notification of the driving public of a major traffic interruption due
to accident or other unexpected event that requires immediate attention by the
Transportation personnel.
· Construction projects required to eliminate or reduce high priority pedestrian
safety or traffic safety problems, including but not limited to pedestrian walkways,
intersection lighting, crosswalks, etc.
· Video equipment utilized for the management and safe movement of traffic.
· Computer equipment/software or other technology upgrades utilized for the
management and safe movement of traffic.
· Training programs related to traffic safety and traffic management.
· Education materials and promotional items for traffic safety.
· Safety equipment worn by personnel performing traffic engineering or
management functions in the field. (Not construction)
· Safety equipment utilized on vehicles utilized by the Transportation/Traffic
Department in the field.
· Traffic signal, signage, pavement markings or other traffic management
infrastructure upgrades or enhancements designed to improve traffic safety.

IV. Establishment of Traffic Safety Fund
These guidelines for use of revenues from an Automated Traffic Signal Enforcement
Program are intended to assist Council in the proper allocation of these funds. All
revenues obtained from this program will be accounted for in a Special Traffic Safety
Fund as they are received. Appropriations from this fund will be made consistent with
this policy as reviewed and amended on an annual basis by the City Council.

Subject: GN 2006-106 Appointments to Naming Board
The Naming Board was established by Ordinance No. 2517 for the purpose of
submitting recommendations to the City Council for the naming of City facilities, which
includes parks, buildings, streets and other publicly owned facilities. The Board
consists of three council members. Mayor Trevino, Councilwoman Compton and
Councilman Lewis are currently serving on this board. The ordinance provides that the
appointments to the board are to be made annually and that the Mayor, subject to
Council approval, makes the appointments. Mayor Trevino is recommending that
Councilwoman Compton, Councilman Barth and Councilman Turnage be appointed to
the Board.
Recommendation:
To approve the recommendation of the Mayor to appoint Councilwoman Compton,
Councilman Barth and Councilman Turnage to the Naming Board.

Places 1, 5 and the Alternate position on Keep NRH Beautiful Committee are currently
vacant. Mayor Pro Tern Lewis is recommending the appointment of Ms. Teresa Hebert
to the Place 1 position, Ms, Hebert lives in the northern quadrant of the City.
Councilman Whitson is recommending the appointment of Ms. Dianna Madar to the
Place 5 position. Ms, Madar has been serving as the Alternate since June 2006. Mayor
Trevino is recommending the appointment of Ms. Dianne Spradling to the Alternate
position. Ms. Spradling lives in the eastern quadrant of the City.

A resident called to express appreciation for Ed and the assistance he provided when
she ran out of gas. Ed made sure that her car was out of traffic and brought her enough
