ATTENTION CITIZENS OF WATAUGA !!!!
The City Council of the City of Watauga has attempted to recover the "voluntary" one dollar
fee that many of the citizens of Watauga have been paying to the City of North Richland Hills
on their monthly water bill. The City of North Richland Hills has declined to return the one
dollar voluntary fee to the citizens of Watauga. If you are paying the· one dollar fee, please be
advised that this money goes to support the City of North Richland Hills parks and library.
The City Council of the City of Watauga advises that if you are paying this fee, it does not
benefit your City's parks and library. If you wish to support your City's parks and library, pay
only the "subtotal due" amount on your water bill. Send one dollar to Watauga City Hall, 7101
Whitley Road, Watauga, Texas 76148, Attention: Finance Dept. for Parks and Library
donation.

Subject:
Richfield Park Concession Facility - Update
The Richland Youth Association has requested Council to consider
budgeting $15,000 for materials to expand the Richfield Park
Concession Facility. The Council asked the Staff and Parks and
Recreation Board to meet prior to the BUdget Workshop in order to
prepare a recommendation for Council review.
Staff has requested the Richland Youth Association to provide a list
of materials and preliminary plans for Parks and Recreation Board
review. To date this information has not been received. However, if
the information is made available in time, Staff will certainly
endeavor to schedule a special Parks and Recreation Board meeting
prior to the BUdget Workshop.

Attached is a letter from the Comptroller of Public Accounts. The
$77,903. 85 is a result of an audit conducted by our City of all
businesses in North Richland Hills.
This will add an additional $6,500 per month in sales tax revenue.
This amount has been included in your budget figures.
The Budget Coordinator will conduct an annual business sales tax audit
starting in 1992.

I'm writing to you at the request of your Finance Director, Hr. lee Maness.
Mr. Maness asked that J send you information conCerning the July 1991 city
sales tax allocation payment to the City of North Richland Hills.
Mr. Maness sent the Comptroller's Office a list of bus1nesses with1n the city
limits of North Richland Hills that had been re~ortjng the city sales tax to
Hurst, fort Worth, Richland Hills and Watauga.
Upon completion of Our investigation, we have determined that a total of
$",903.85 had been reported to the other cfties in error. These adjustments
are included in the July 1991 sales tax payment to North Richland Hills.
Since this represents tax collectfons for prior rep~rt1n9 periods, th1s should
be considered as a one time payment.

Council had questions on several areas of the ordinance - hours of operation, liability, and number of

levying the fee at this time.

Councilman Welch moved, seconded by Councilman Wood, to let the Council go to budget with a zero
figure at this time and reconsider after the tax rate is set, etc.
Motion carried 7-0.
Mr. Nelson Stoppiello, 7400 Jade Circle, had several questions pertaining to the fee. Mr. Stoppiello
advised the Council that he felt they should hold the budget work session in the City Hall and make it
more convenient for citizens who wanted to attend.

RE: REQUEST FOR APPEAL HEARING _
WOODLAND OAKS ZONING CASE DENIAL
Mr. David Harlow, 9108 Nob Hill spoke for Mr. Radmacher. Mr. Harlow gave the background on this
.equest and asked the City to hold an appeal hearing.
Mr. Harlow was advised the Planning and Zoning Commission had made their recommendation and
Council felt they should support the decision. Council felt it would be an injustice to the property
owner for the City to rezone the property. Council suggested that the homeowners continue to work
with the property owner.

Request of John Rainey for Replat of AgendaNumber~S 91-12
Lot 3R, Block 1, Carston Court Add1t10n.
This property is located at 6628 Carston Court.
Mr. John Rainey has submitted a request to replat two lots in the
Carston Court Addition into a single lot. According to the official
Zoning Map of the City of North Richland Hills, the Carston Court
Addition is zoned R-1 Single Family residential. The R-1 zoning
district requires a minimum of 13,000 square feet per lot. Some of
the lots in the Carston Court Addition are below this minimum
requirement. One of the lots being replatted (the original lot number
four) contains approximately 12,260 SF according to staff
calculations. If approved by the City Council, the replatting of the
two lots will create a single lot having 28,450 square feet. All
concerns have been addressed by the developer and the replat is now
ready for review by the City Council.
The Planning and Zoning Commission approved this replat at their July
11th meeting.
Recommendation:

It is recommended that the City Council approve the recommendation of
the Planning and Zoning Commission.

came forward to represent Mr. Rainey
in his request. He stated that Mr.
Rainey has his house on one lot and he
plans to build a garage, make an
addition or add a guest house on the
additional lot. Mr. Long said he
would use the same drive. He said he
was not sure just when this would be
done, he does not know Mr. Rainey's
time schedule.

June 13, 1991 and have the following comments to offer:

1. A signature block for the Public Works Departmentls approval
will be provided on the cover sheet.

New metes and bounds description will be added to the ownerls
acknowledgement.
3. A 5.01 utility easement will be added to Lot 3-R between

4. After discussion with staff, only the lots and blocks for
adjacent property is required - not ownership.

5. The existing sewer service on old Lot 4 is plugged, but the
Owner does not want it abandoned.
With the new additions proposed on the new combined Lot 3-R, the

and offer the following comments.

He said they do not have a problem
with the Engineer's comments except
for the requirement of a fire hydrant.
Mr. Zimmerman stated that Greg
Dickens, Director of Public Works and
Utilities, made Mr. Davis an offer for
the city to install the fire hydrant
and Mr. Davis bear the expense, but
Mr. Davis does not feel he should have
to pay for a fire hydrant and he wants
to go to the Council and request a
waiver. Mr. Zimmerman said if the
Council does not grant him a waiver,
he feels sure that Mr. Davis would go
along with Mr. Dicken's offer.
Chairman Brock asked if they agree to
all the other Engineer's comments.

Mr. Zimmerman said yes, they had
addressed each one. He said there was
a problem with the existing building
being over the building line, but Mr.
LeBaron said it would be a
non-conforming use and if it was ever

Mr. Bowen stated that a little farther
south of this property on the west
side of Rufe Snow, there is a fire
hydrant that is not a full time
hydrant that might could be converted

less expense. He said he would like
to ask the City Staff to look into the
feasibility of this and see if it
could be made usable and save Mr.
Davis some money.
Mr. Zimmerman said they did not elect
to use this one since it is connected
to the water tank, but they would like
for Mr. Dickens to check into the
feasibility of it.

send it to the Council with the
recommendation that the fire hydrant
be waived and then if they find they
can use the overflow fire hydrant, to
look into that.
Mr. Barfield said yes, if this one can
be used, to let him use it for a
lesser amount of money, and then the
City Council can decide what they want
to do. Mr. Barfield said he would
like to waive it, but he does not want
to create a problem that is going to
be a hazard for the City.

We have reviewed the subject documents submitted to our
office on June 17, 1991 and offer the following comments:
1 .
The engineer should provide a cover sheet for the
submitted documents. The information on the cover
sheet should include: project title; legal property
description; City name; vicinity map; name, address and
telephone numbers of the owner and engineer/surveyor;
project title placed vertically along the right hand
border; and signature block for approval of plans by
the Assistant Director of Public Works or Utilities.
2. The City has recently obtained a Global Positioning
System (GPS) Horizontal Control Survey. This survey
was accomplished to create an accurate base map for the
Geographical Information System. City policy requires
that all new plats be tied by survey to the GPS. This
will allow the City to keep the GIS up-to-date. The
Public Works Department as written descriptions for all
of the GPS Benchmarks located around the City. This
plat should therefore include the Texas State Plane
Coordinates for at least one property. The coordinates
should be determined by a survey tied to the City's
GPS.
3. The metes and bounds description does not appear to
provide adequate closure. The engineer/surveyor should
provide additional information or make the proper
corrections before the next submittal.

4. The surveyor should sign and seal the plat before the
next submittal.
5. The attached easement dedication should be incorporated
into the owner's acknowledgement.
6. The building set back lines should be added to the
plat. It appears the existing building located on Lot
2 encroaches on the building set back line. If this
building does encroach on the building set back line,
the developer should apply to the Zoning Board of
Adjustment for a variance.
7. The current zoning of the property to the south of this
subdivision should be shown on the plat.
8.
The location of existing street lights should be shown
on the utility layout plan. If additional street
lights are required, the developer should coordinate
with TU Electric the layout and design of the street
lights which will serve this property. The cost for
installation will be paid by the developer directly to
TU Electric. The developer should provide the City
with an approved street light layout and a photocopy of
TU Electric's agreement to install the referenced
street lights.

9. The Drainage Study should include an engineer's
certification which states that the study is in
compliance with the latest published requirements and
criteria of the City of North Richland Hills. An
example of the certification is found on page 12 of the
Subdivision Ordinance.
10. The location of the existing water and sewer services
should be shown on the Utility Layout Sheet.
11. The fire hydrant radius of coverage should be shown.
The Design Manual for Public Works/Utilities for the
City of North Richland Hills should be consulted for
the required radius of coverage. The existing fire
hydrant located on Glenview Drive may be used to
provide coverage to this subdivision. Since Rufe Snow
Drive has a M5U designation on the City Master
Thoroughfare Plan, the existing fire hydrant located on
Rufe Snow Drive may not be used to serve this
subdivision.

Thoroughfares.

The Planning and Zoning Commission has been reviewing regulations to
require the construction of masonry screening walls since November
1990. During workshops where these regulations were discussed,
members of the Planning and Zoning Commission expressed concern over
the unsightly appearance of existing wooden fences along many of the
city's major thoroughfares. It was felt that masonry screening walls
would have a much greater life span and produce a higher quality
residential environment than do the wooden fences. Wooden fences
require periodic maintenance to prevent them from becoming unsightly.
Attached is a copy of a proposed ordinance which will amend the
Subdivision Ordinance to require the construction of masonry screening
walls along any subdivision which abuts a major thoroughfare as shown
on the Master Thoroughfare Map. The regulations will be placed in the
Subdivision Ordinance because the regulations will apply to any new
subdivision or a replat of an existing subdivision which abuts a major
thoroughfare. To prevent a hardship on small subdivisions with only a
few lots, the regulation exempts subdivision having less than 400 feet
of frontage along a thoroughfare and without an intersecting street.
A copy of the technical construction details is also attached for your
review. These details will be included in the Design Manual for
Public Works/utilities.
Copies of the proposed masonry screening wall regulations were sent to
area builders and developers along with an invitation to discuss these
regulations wi th the Pla-nning and Zoning Commission. Only one
developer offered comments. He felt that masonry screening walls
should not be mandatory, but determined by what the housing market
demanded. The developer also expressed concerns over the maintenance
provision by a homeowners association or an alternative satisfactory
to the city.
The Planning and Zoning Commission approved this proposed ordinance at
their meeting on June 27, 1991.

It - is recommended that the City Council hold the required public
hearing and consider the recommendation of the Planning and Zoning

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
I.
THAT, ORDINANCE 1579, "THE SUBDIVISION ORDINANCE OF THE CITY
OF NORTH RICHLAND HILLS", SECTION 1-01, Subsection D, be hereby amended to
insert a new Paragraph 7, to hereafter be and read as follows:
7.
Every newly platted subdivision or resubdivision of existing residential lots which
contains at least one street intersection with a C-2-U thoroughfare or larger as
shown on the prevailing Master Thoroughfare Plan or extends for a distance of 400
feet along a C-2-U thoroughfare or larger as shown on the prevailing Master
Thoroughfare Plan shall comply with the screening wall requirements as provided in
this section.
7.1 The developer of any lot located in a newly platted subdivision or
resubdivision of existing residential lots adjacent to a C-2-U thoroughfare or
larger as shown on the prevailing Master Thoroughfare Plan shall be
required to construct a masonry or concrete screening wall along and
adjacent to said thoroughfare.
7.2 The Masonry or concrete screening wall shall be constructed in a manner
consistent with the standards and specifications contained in the Design
Manual for Public Works/Utilities. No masonry or concrete screening wall
or its foundation shall be constructed within the street right-of-way.
Furthermore, any masonry screening wall constructed within the City of
North Richland Hills not required by Section 7.1 of this Ordinance shall be
constructed in a manner consistent with the standards and specifications
contained in the Design Manual for Public Works/Utilities.
7.3 Unless an alternative maintenance plan is determined satisfactory to the
Planning and Zoning Commission, a maintenance agreement between the
City and a Homeowners Association for the continued maintenance of said
screening wall shall be included with the Final Plat submittal.
II.
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City
Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are
severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall
be declared invalid or unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the

same would have been enacted by the City Council without the incorporation in this
ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or
section.

SAVINGS CLAUSE. That Ordinance No. 1579, The Subdivision Ordinance of the City
of North Richland Hills, as amended shall remain in full force and effect, save and except
as amended by this ordinance.
IV.
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its
passage.

MASONRY/CONCRETE SCREENING WALLS
A.
CONSTRUCTION
Masonry or concrete screening walls shall be constructed
according to the following specifications:
1. Concrete foundations shall have a minimum compressive
strenght of 3000 PSI at 28 days. Compresive strength
tests conducted by an independent testing laboratory
shall be submitted to the City staff for confirmation.
All testing costs shall be paid by the developer or his
contractor.
2. Reinforcing steel shall be new billet steel conforming
to the requirements of ASTM A-61S-GR.60.
3. Concrete for peirs shall be place within 8 hours of
drilling pier holes.
4. Brick masonry shall be as approved by the City.
5. Mortar shall be Type "S".
6. Construction shall be in accordance with the
requirements of the "Recommended Practice for
Engineered Brick Masonry" Brick Institute of America.
7. Use #9 Gauge 1-3/4" wide galvanized ladder wire to
extend horizontal in wall panel on every course.
8. The wall shall be a minimum of six feet in height as
measured from the nearest/adjacent sidewalk grade.
Columns may be eight feet in height spaced not to
exceed a ten foot span. No masonry or concrete
screening wall shall exceed eight feet in height unless
the wall is functioning as a retaining wall and is
designed as such.
9. A four (4) inch opening to allow for storm water
drainage shall be provided along the entire length of
each span.
10. Prefabricated screening fences such as "brickcrete" or
"woodcrete" may be substituted for on-site masonry
construction, provided that the finish resembles
typical masonry constructed fences. No ordinary
concrete finishes shall be allowed. However, a
concrete finish consisting of exposed aggregate shall
be allowed.
11. The color of the wall shall be uniform on each side of
a thoroughfare for the entire length between two
intersecting Collector or greater streets. The finish
of the wall shall be consistent on all surfaces.
12. All masonry or concrete screening walls shall be
designed by a Professional Engineer registered in the
state of Texas. Sealed plans shall be submitted to the
City for review.
B. LOCATION
The location of masonry or concrete screening walls shall be
as follows:
1. No masonry or concrete screening wall shall be located
on public right-of-way.
2. Sight triangles shall be provided at street
intersections according to the schedule contained
elsewhere in this Manual.
3. The location and placement of a masonry or conctrete
screening wall shall be coordinated with the Public
Works Department to avoid conflicts with utility and
drainage easements.

decision that will have great
consequences on the city and they
have not wanted to rush into it. He
said letters were sent out to
developers and builders in the
community to get their input.
Chairman Brock opened the Public
Hearing and asked if there was anyone
here who wished to speak regarding
this ordinance.
Jim Harris came forward. He said he
was surprised to see this as a
proposal. He said it is an unusual
requirement. Mr. Harris said they
build them and they build them for
marketing purposes. He said 10 years
ago, you did not have to, but things
change, the market requires it. Mr.
Harris said they also do a lot of
landscaping. Mr. Harris said he has a
problem with a city ordinance which
requires this. He said he sometimes
wonders what the city is getting
itself into. Mr. Harris said
maintenance on walls, landscaping,
etc. is done through Homeowners
Associations. He said no one likes
Homeowners Associations, but you have
to have them to make it work. Mr.
Harris said you could take 100
different developers and 100 lawyers
working with those developers and you
will get 100 different Homeowner
Association structures. He said there
is a clause in this ordinance that
deals with this, paragraph 7.3. He
said it deals with what happens if a

Homeowner's Association does not
function.
Chairman Brock said the Commission has
worked with this part of the ordinance
to try to figure out how to put some
teeth into it.
Mr. Harris said it will get you
involved in writing a lot of legal
documents. He said the way he reads
it, it would have to be reviewed by
the city to see if it is adequate. He
said he does not think that is
something the city should get involved
with. Mr. Harris said he does not
think the city has any legal
responsibility to maintain these
walls, but with this clause in the
ordinance, you would have that
responsibility. He said he thinks
that opens up a big can of worms.
Chairman Brock said the Commission was
trying to come up with something to
take care of cases where the wall
falls down after a few years.
Mr. Harris said he feels you should
have standards for the construction of
those walls. He said he has some
people who just build walls and they
are required to provide a set of plans
for the walls. Mr. Harris said he
would provide his men with a set of
section 1-07-General Construction
Guidelines and they said they do all
that anyway with one exception,
paragraph 8 where you have required a
10 foot span. He said 20 feet is
standard. Mr. Harris said he suggests
a 20 foot span with a pier every 10
feet. He said those columns are
expensive.
Mr. Barfield said they were addressing
the pre-fab walls with an open space.
He said the city is concerned with
drainage. Mr. Barfield said they are
open to look at other designs.

Mr. Harris stated he was doing a
subdivision in Southlake and Southlake
is almost diametrically opposed to
walls. He said they have put in
berms, sprinkler system and
landscaping with a wrought iron fence
in front of the berms. He said it is
going to look better than anything
they have ever done. Mr. Harris said
this ordinance would not allow this.
Mr. LeBaron said they found cities
that had minimum standards for walls
if you planned to build a wall.
Mr. Harris said he agreed with that.
Mr. Harris said he thinks a C4U street
is where they should go, not on a C2U.
He said a C2U is just a collector
street.

Mr. Harris said he is opposed to the
requirement, he is for standards, 10
foot span is too short, and he would
hope they would allow for the use of
wrought iron fencing and landscaping,
which would be more decorative than
just a plain old brick wall. He said
also, to pay attention to the
Homeowners Association situation.
Mr. Lueck said he agrees that
generally, the market place takes care
of the fencing, but how can we
guarantee that the perimeter of the
subdivision will turn out to look
nice.
Chairman Brock said some of the
developers put up fences that are not
up to specs and they fall down.

Mr. Harris said he felt that most of
the time market place and competition
will take care if it, but you need to
have standards. He said he would not
object to landscaping requirements,
but he does not agree with the
requirement for a masonry or concrete
wall.

12. If additional fire hydrants are required to serve this
subdivision the appropriate details for construction
should be included in the plans. Note that the details
included in the Design Manual do not contain any logos
other than that of the City of North Richland Hills.
It is therefore recommended that the details be used in
their entirety.
13. The developer should provide a layout of proposed drive
approaches which will serve this subdivision. The
drive approaches should meet the current criteria
stated in the Design Manual for Public Works/Utilities,
City of North Richland Hills.

Mr. Barfield said he would take the
blame for this ordinance. He said he
has been pushing for this ever since
he has been on this Commission. Mr.
Barfield said if you look at the City
of North Richland Hills, except for a
few exceptions, we have a city where
fences are falling down, fences that
don't blend. He said we have a
hap-hazard mess through our city, and
we talk about the market place
dictating it; that is not good
business. Mr. Barfield said the walls
being build, we have very little
control over them; they can come in
and do just about anything they want
to. Mr. Barfield said he knows
because he is a developer. He said
developers come in and put in walls
and landscaping in their subdivision
and hope they last long enough for him
to sell most of the lots; then the
walls fall down, the landscaping dies
and the sprinkler system goes to pot.
He said thats what we need to stop.
Mr. Barfield said he did not think the
city needs to be in the business of
maintaining walls and landscaping, but
the walls will do several things: they
will control noise from the
thoroughfare to the subdivision; it
will provide security and privacy.
Mr. Barfield said Dallas has had walls
for 30 years; the homes are nice and
the people like them. He said now,
they even go in and tear down the old
houses and build new ones behind the
brick walls. Mr. Barfield said it is
a proven market.

Mr. Barfield said he thinks wrought
iron fences are pretty, but it
requires a continual maintenance, the

paint is always peeling, you have to
repaint it every year. He said he
thinks we should go with what will
work. Mr. Barfield said he would like
to see some flexibility in it, other
engineering concepts, maybe have it on
20 foot centers and walls with

ordinance and recommends it be
approved.

walls, they felt they had to put this

what they have suggested is when a
final plat comes to the Commission,
the developer will provide you with
some alternative maintenance plan
which may include a Homeowners
Association. Mr. LeBaron said they
are concerned that Homeowners
Associations goes by the wayside after
5 or so years and then someone from
the subdivision would come to the city
and ask for the city to take care of
their wall, but the city would have to
remind them they are Supposed to have
a Homeowners Association to take care
of that.

care of. He said they no longer have
a Homeowners Association; they did not
like the way the Homeowners

went to court.

Chairman Brock opened the Public
Hearing and called for those wishing
to speak in favor of this amendment to

Mr. Barfield said since this ordinance
would make such an impact on the
development in the city, he would like
to see this tabled and get some
developers in for discussion.
Chairman Brock said he agrees and
would like a letter to go out to the
developers with a copy of this
ordinance and set a time next month,
probably the last meeting of June, for
this to be heard.
Mr. Lueck suggested they include the
Zoning Board of Adjustment at this
meeting.
Mr. Lueck thanked Mr. LeBaron and the
Staff for all the work that was put
into this.

Discussion of an ordinance to amend
the Subdivision Ordinance #1579
regarding the requirement of masonry
screening walls along major
thoroughfares.
Chairman Brock stated this case is
just for discussion only.

Mr. LeBaron stated this ordinance
would be a very important one for the
city; a significant impact on the
ascetics and on the cost of the
development. He stated the Commission
will hold a Public Hearing at their
next meeting. He said the draft
ordinance has 5 key points:
1. It will apply to all new
subdivisions and all replats.
2. It will apply to any residential
subdivision that is next to a C2U or
greater major thoroughfare.
3. Who is going to maintain it? He
said we are suggesting it be
constructed outside the right of way
on private property and when a plat
comes before you that includes a
masonry screening wall, that a
homeowners association become a part
of the plat. He said the homeowners
association can oversee the
maintenance of the screening wall.
4. The intersection treatment. Mr.
LeBaron said this is so important that
he will have slides to show at the
next meeting.
5. Type of construction. He said
P & Z has stated they do not want just
plain concrete, they want brick or
something that looks like brick. Mr.
LeBaron said he suggested the
screening wall be at least 6 feet high
and the columns be no higher than 8
feet and spaced 10 feet apart. He
said they need to have a 4 inch
opening at the bottom so they will not
cause a drainage problem. Also, Mr.
LeBaron said they need to address the
issue that someone could want to put
up an 8 foot wood fence behind the 6
foot masonry screening wall.

Planning Association is sponsoring a
training program for Planning and

Mr. Boutwell came forward. He said he
has 7 tasks: the mobilization task,
the inventory task, demographics,
objectives, plans, city land use plan,
and the implementation. He said the
mobilization and inventory tasks are
going real well. He said he has the
base mapping done for the 5 sectors of
the city and we need to name these
sectors instead of just calling them
sector 1, 2, etc.
Mr. Boutwell said he has counted the
houses in sector one and has come up
with less units than the census has
listed and he is somewhat concerned
about that.

approve PS 91-06 with the stipulation
that lots 41, 42, and 48 have rear

lots 41, 42, and 48, and that a
masonry sight barring and sound
dampening fence be required along
Harwood Road and designed by a
structural engineer. This motion was
seconded by Mr. Lueck and the motion
carried 7-0.

Chairman Wood stated this is not an
action item, but is an issue the
Commission has been studying for some
time whether to require masonry fences
on new subdivisions being developed in
the city specificly on certain size
roads. He said we need to decide what
size roads and what locations; if we
do require fences, what type of
fences; if masonry, what type of
structural design and be certified by
an engineer. Chairman Wood stated
that Mr. LeBaron has been conducting a
study on what other cities are doing
and what types of fencing they
require.
Mr. LeBaron stated that last fall he
drafted a preliminary ordinance which
would require fences only on a P6D
thoroughfare, but since then P & Z has
requested more study and he gave the
following steps to consider:
1. What type of construction
specifications you feel are important,
such as pour in place concrete,
pre-fab concrete, masonry
construction, height, what color.
2. Where would these masonry walls be
constructed; on the right of way side
of the property line, the private
property side of the line, or would
they want to provide an easement for
this.
3. Who is going to maintain these
screening fences; would they be
maintained by the city, a homeowner's
association or a property owner.
4. How would you apply this
regulation; to all new subdivisions,
all existing undeveloped lots; would
it be a prerequsite to obtaining a
building permit or should it be done
when putting in water and sewer.

Chairman Wood stated the first thing
they need to decide is where it needs
to go-what size street.
Mr. Barfield said he felt the first
thing they need to talk about is the
design of the fence, whether sight
barring or sound dampening.
Mr. Lueck said to tie it to a traffic
count on the street.
Mr. Brock asked wouldn't any masonry
fence be sound dampening.
Mr. Barfield said it would not be if
it had wrought iron on top of it. He
said you need to consider the decibel
rating.
Chairman Wood said he felt the fences
are needed on collector streets or
above.
Mr. Lueck asked about the cost per
foot to build this type of fence.
Chairman Wood said they had been given
an estimate of $50 per foot for a 6
foot high fence.

subdivisions where fences are falling
down and decaying.
Chairman Wood said this is a whole
different situation.
Mr. Barfield said the city did this
with sidewalks.
Mr. Pence said if the subdivision is
less than one fourth developed, they
have to put in sidewalks.

which subdivisions, and what size
streets to require them on. Chairman
Wood said they need to decide whether
to require it or not, or if you build
it, here's the standards, but if you
say you don't have to build it, sooner
or later, someone, probably the
homeowner, with build a fence there.
Will we require him to build one
according to these standards. He said
each homeowner with have a different
idea of what should be there and how
it should be built and there might be
gaps in the fence.

have some sort of masonry screening
fences along public thoroughfares and
collector streets. He said it does a
tremendous job of sound control in the
subdivision. Mr. Barfield said he
would like to see this requirement for
subdivisions on collector streets of 4
lanes or greater. He said the fences
usually last about as long as it takes
to sell the last lot. He said we need
to have more control on what kind of
fences are built and how they are
built. Mr. Barfield said he felt the
Commission needs to spend considerable
time on this subject, we need to
really study it, maybe continue this
Public Hearing, so we can come up with
a good ordinance on this.

the thoroughfare map to see what size
street to require this on. He said we
have some very detailed construction
standards entered into this ordinance.

Authorization to Purchase Fuel on the Spot Market Basis

For several years Council authorized Staff and City Manager to
purchase gasoline and diesel fuel on a "spot market" basis. Last
year Purchasing solicited formal bids to determine if buying on the
"spot market" was the most beneficial way to approach these
purchases.
When the bids were analyzed, it was determined the "spot market"
method was the most advantageous way to purchase gasoline and
diesel fuel · This method involves obtaining 3 bids over the
telephone and buying from the lowest bidder.
Recommendation: It is recommended Council authorize Staff and Ci ty
Manager to purchase gas and diesel fuel on a "spot market" basis.

In 1988 the City entered into a three year lease-purchase of
a 1988 Chevrolet Celebrity. The lease will terminate on
AUgust 3, 1991.
The Director of Management Services car is due to be replaced this
year · Instead of buying a new car, we can buyout the lease on the
1988 Celebrity for $5,709. This would result in a cost savings for
the city.
Recommendation: Staff recommends Council approve the buyout of
the lease on the 1988 Celebrity in the amount of $5,709.
