ORDINANCE NO. 1871
AN ORDINANCE BY THE CITY OF NORTH RICHLAND HILLS ESTABLISHING
REGULATIONS FOR ITINERANT VENDORS AND SPECIAL SALES FOR NON-PROFIT
ORGANIZATIONS; ESTABLISHING PERMIT FEES; PROVIDING A PENALTY CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS:
SECTION 1.
THAT, an Itinerant Vendor Permit be Obk'lined from the Building Official upon payment of the applicable fee for any person
engaged in a temporary business within the Corporate Limits of the City of North Richland Hills, except for home
occupations.
SECTION 2.
THA T, a Special Sales Pennit be Obk'lined from the Building Official without payment of any fee for any Church, public or
semi-public school, or non-profit organization engaged in a temporary sale at a public or semi-public location and where no
itinerant vendors will be engaged in a temporary business.
SECTION 3.
THAT, a Special Sales Pennit be obk'lined from the Building Official upon payment of the applicable fee for any Church,
public or semi-public school, or non-profit organization engaged in a temporary sale at a public or semi-public location and
where itinerant vendors will be engaged in a temporary business.
SECTION 4.
THAT, the references to temporary vendors contained in Table 3, Ordinance No. 1813 is expressly superseded by the tenns
of this ordinance.
SECTION 5.
THA T, the fee structure for Special Sales Pennits and Itinerant Vendor Pennits is proposed as follows:
A. Special Sales Pennit (w/o commercial vendors)
B. Special Sales Pennit (with commercial vendors)
C. Temporary Vendor

SECTION 6.
THA T, The Building Official, or his designee, shall be responsible for the enforcement of this ordinance and shall be
responsible for any inspections necessary to determine compliance with this ordinance.
SECTION 7.
THA T, it shall be unlawful for any person to become engaged in a temporary business, or any non-profit organization to
conduct a special sales within the corporate limits of the City of North Richland Hills unless in confonnance with the
provisions of this ordinance. Any person, finn or corporation who violates, disobeys, omits, neglects, or refuses to comply
with or who resists the enforcement of any of the provisions of this ordimUlce shall be fined not more than two hundred
dolIars for each offense. Each day that a violations is pennitted to exist shall constitute a separate offense.
SECTION 8.
THA T, it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and
phrases of this ordimUlce are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be
declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance,
since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid
or unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 9.
THA T, this ordinance shall be in full force and effect from and after its passage.
