ZONING CASE ZC 2006-09
AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH
RICHLAND HILLS; AMENDING THE ZONING MAP OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, AND REZONING A 1.700 ACRE
TRACT OF PROPERTY FROM AG (AGRICULTURE) TO RI-PD
(RESIDENTIAL INFILL-PLANNED DEVELOPMENT) ZONING;
ESTABLISHING A PENALTY; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent
to real property owners within 200 feet of the property herein described at
least 10 days before such hearing; and,
WHEREAS, notice of a public hearing before the City Council was published in a
newspaper of general circulation in the City at least 15 days before such
hearing; and,
WHEREAS, public hearings to zone the property herein described were held before
both the Planning and Zoning Commission and the City Council, and the
Planning and Zoning Commission has heretofore made a
recommendation concerning the zone change; and,
WHEREAS, the City Council is of the opinion that the zone change herein effectuated
furthers the purpose of zoning as set forth in the Comprehensive Zoning
Ordinance and is in the best interest of the citizens of the City of North
Richland Hills; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
Section 1 : THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance
and the zoning map of the City of North Richland Hills are hereby
amended by rezoning a 1.700 acre tract of land located in the City of
North Richland Hills, Tarrant County, Texas, more particularly described in
Exhibit A from AG (Agriculture) to RI-PD (Residential Infi/I-Planned
Development) zoning and approving the attached site plan.
Section 2: Any person, firm or corporation violating any provision of the
Comprehensive Zoning Ordinance as amended hereby shall be deemed
guilty of a misdemeanor and upon final conviction thereof fined in an
amount not to exceed Two Thousand Dollars ($2,000.00). Each day any
such violation shall be allowed to continue shall constitute a separate
violation and punishable hereunder.

Section 3: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clauses of this ordinance
as an alternative method of publication provided by law.
Section 4: This ordinance shall be in full force and effect immediately after passage,
AND IT IS SO ORDAINED.

Deed Records, Tarrant County, Texas; Together With a portion of
Amundson Drive vacated by City Ordinance, and being described as
one (1) tract by metes and bounds as follows:
BEGINNING at a 1/2" iron pin found for the southeast corner of that portion of Lot
3 described in a deed to Billy Holcombe, Jr. and Karen Holcombe, recorded in
Volume 10788, Page 1643, Deed Records, Tarrant County, Texas, said pin also
being the northeast corner of a portion of Lot 3 described in a deed to Tommy
Hicks and Bonnie Hicks, Volume 7914, Page 81, Deed Records, Tarrant County,
Texas;
THENCE WEST a distance of a 129.51 feet to a 1/2" iron pin set with cap
marked, "AREA SURVEYING" in the east line of Lot 2, for the southwest corner
of said Holcombe tract and for the northwest corner of said Hicks tract;
THENCE South 00 degree 47 minutes 30 seconds East a distance of 153.73 feet
to the north line of Main Street and to the southeast corner of Lot 2;
THENCE North 88 degrees 55 minutes 43 seconds West a distance of 250.22
feet along the north line of Main Street to a 1/2" iron pin found for the southwest
corner of Lot 2;
THENCE North 00 degree 25 minutes 06 seconds East at 106.69 feet passing
the northwest corner of Lot 2 and the southeast line of Amundson Drive, in all, a
total distance of 115.61 feet to a 1/2" iron pin set with cap marked, "AREA
SURVEYING";
THENCE North 56 degrees 26 minutes 19 seconds East a distance of 241.56
feet along the northwesterly line of Amundson Drive as vacated by said City
Ordinance, to a 1/2" iron pin set with cap marked, "AREA SURVEYING" for the
beginning of a curve, concave to the northwest, having a radius of 2,304.62 feet,
and a long chord which bears 227.82 feet, North 51 degrees 25 minutes 09
seconds East;
THENCE Northeasterly, continuing along said northwesterly line of Amundson
Drive as vacated by said City Ordinance, a distance of 227.91 feet to a 1/2" iron
pin set with cap marked, "AREA SURVEYING";
