CALL TO ORDER The meeting was called to order by Chairman Randy Shiflet at 7:02 p.m. 2. APPROVED Bill Schopper, seconded by Mike Benton, motioned to approve the minutes of March 1, 2007. The motion carried unanimously (6-0). Steven Cooper was absent. 6. SUP 2006-07 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM GARRISON MOTOR COMPANY TO APPROVE A SPECIAL USE PERMIT FOR INTERNET AUTO SALES (LOCATED AT 7724 MAPLEWOOD AVE.). APPROVED Chairman Shiflet opened the public hearing at 7:04 p.m. Mr. Larry O'Neal, applicant, Northeast Paint & Body, 7724 Maplewood, spoke in favor of his request. Mr. Wilhite said staff is in support of the SUP request with the following conditions: 1. No outside display or storage of vehicles; 2. The existing metal panel fence be replaced that fronts Maplewood Avenue with an 8 ft. tall masonry screening fence, and 3. That the dumpster be enclosed in masonry screening wall. Mr. Schopper said his main concern is this is an industrial area where all the truck conversions were done. The area has cleaned up tremendously. The property owner keeps the property immaculate. It looks fantastic compared to how it previously looked. I don't want to require too much exterior upgrades. This SUP request is all driven by a State regulation requiring automobile dealerships to post a sign on the front elevation of the building no matter how autos are sold. However the sign isn't desirable in this case because off the street customers are not wanted. Chairman Shiflet said it is a tough situation because the street has been widened since the building was built in the late 1950's/early 1960's. The appearance is a factor. The building is haydite block, with a portion that is metal and then whatever masonry fence that comes in now, which is what staff is recommending. This is an SUP for internet auto sales and it is going to be something that we may have to look at again, but on this particular case, I would rather see all of the metal covered up. There being no other comments, Chairman Shiflet closed the public hearing at 7:25 p.m. Page 2 of 8; 3-15-07 P & Z Minutes Mr. Schopper said staff recommended for the fence but they did not say anything about walls on the elevation and that was built when it was alright to do it that way. Going to brick, I think we would defer to the property owner at some future time when he wants to upgrade the facility and make it look really nice as opposed to holding it hostage at a time when he is just trying to get a sign up. Bill Schopper motioned to approve SUP2006-07 a Request from Garrison Motor Company to Approve a Special Use Permit for Internet Auto Sales (Located at 7724 Maplewood Ave.), without regard to the staff recommendations, seconded by Mike Benton. Chairman Shiflet said we have a motion and second without regard for Item number 1 no outside display or storage? Mr. Schopper said that is part of the ordinance anyway. Chairman Shiflet said the existing metal panel fence be replaced on the north and south end of the structure facing Maplewood with an eight foot masonry screening fence. Dumpster being enclosed in a masonry screening wall. Ms. Cole said she thinks that part of the compromise was instead of a full blown masonry screening wall is to allow the panels and then cover the metal. So that was an attempt at saying instead of doing the full blown masonry, we'll allow the concrete fiber cement siding material. Mr. Schopper said that is telling the applicant to veneer his building. Ms. Cole said just a piece of it. The applicant said he would try to do that. Chairman Shiflet said it is actually a little triangle above where the 8 ft. fence stops and goes up another 6 ft. or so and slopes down. So it is a triangle that would be a portion of that fiber cement siding material. Mr. Bowen said he thinks Mr. Schopper's motion doesn't require that. Mr. Schopper said he is also stipulating that "Item Number 1, No outside display or storage of vehicles" is already part of the ordinance so we don't need to further stipulate that. I respectfully submit Mr. Chairman to call the question. If there is another motion, let's hear it. Mr. Benton asked to clarify Mr. Schopper's motion. Ms. Cole said his motion required no changes. Mr. Benton said in addition to what is already stated. Mr. Schopper said that is right. Chairman Shiflet called the vote for the previous motion. ZC 2006-23 Consideration of a Request from Cary Clarke Homes to Approve a Zoning Change from "AG" Agricultural to "RI-PD" Residentiallnfill - Planned Development (Located in the 9200 Block of Amundson Rd. - 4.339 acres). APPROVED Mr. Cary Clarke of Cary Clarke Homes, applicant, office at 204 No. Dooley St., Grapevine, spoke in favor of his Highland Park project. Eric Wilhite said the request to rezone the property meets established requirements for RI-PD. He gave a brief overview of the project and said staff recommends approval. Chairman Shiflet opened the public hearing at 7:37 p.m. Kent Davis, 6817 Knob Hill Drive and 9284 Huntington Square. His questions are about the drainage analysis and plan for this property. At Huntington Square we have had some issues. Everything drains down Knob Hill. The requirement on the screening walls, particularly that comes to my back yard. How high will the wall be and are there any vegetation requirements? I think it is a great plan I just have these questions. Greg Van Neiuwenhuize said at the present time, since this is the zoning phase, the drainage has not been looked at in depth. We realize that drainage patterns cross the site. That is why the detention pond was chosen to be where it is. The drainage will be accommodated across the site. The exact size, depth, the detention structure, I don't think that has been designed. It has not been submitted to Public Works at the present time. It is looked at more closely and nailed down to exact numbers, sizes, etc. at the time of the Final Plat. Not only will they have to make arrangements for what they are currently receiving offsite, but whatever they are forecasted to receive. It is all undeveloped now and in the future it is projected to go commercial. That is obviously a greater amount of water that this site would be receiving so this site would have to accept that water. Eric Wilhite said the fence is required to be a six foot masonry fence; along here will be a wood stockade fence on metal posts. At this point in time the residential subdivision would just be whatever the individual homeowners put in the backyard or meet the landscape ordinance requirement which right now is 3 trees and one of those has to be in the front. The only required by the RI-PD would be the strip along here with the trees and the vegetation along the masonry screening. Page 4 of 8; 3-15-07 P & Z Minutes Mr. Clarke, the applicant, said his development intends to be a good neighbor and as we get into the engineering portion of this project, then we will certainly look at not creating adverse affects to our neighbors. That is what our engineer has been charged with and he is here this evening as well. We have agreed to have metal posts on the 6 foot wood fence. Also a benefit to the neighbors, although intangible, is that I am not only the developer but also the builder. I can assure them of the quality that the project will be. Ms. Cole asked if the homes would be his usual product seen in other areas. She welcomed Mr. Clarke and said North Richland Hills should be glad to have him in our community doing this RI-PD. Kent Davis asked if a fence would be required to be put up beside the fence that exists there by Huntington Square or will he be required to put up a new screening fence along the subdivision and along the commercial? In Huntington Square, each lot owner owns the fence behind their lot to the alley that is in various stages of disrepair. When we built our building, the last one on the cul-de-sac, the City required us to put up a fence around the whole thing for everybody. And so that will be an issue that needs to be addressed at some point as the Homeowner Association is inactive. Chairman Shiflet closed the public hearing at 7:44 p.m. Brenda Cole motioned to approve ZC 2006-23, seconded by Bill Schopper. The motion carried unanimously (6-0). Steven Cooper was absent. 8. ZC2006-22 Public Hearing and Consideration of a Request from Cary Clarke Homes to Approve a Zoning Change from "AG" Agricultural to "0-1" Office (Located in the 6900 Block of Precinct Line Rd. -1.910 acres). APPROVED Chairman Shiflet said this is the front portion of the property just discussed in case ZC2006-23. Chairman Shiflet opened the public hearing at 7:45 p.m. Applicant Cary Clarke spoke in favor of his request. Our intent is to build and own these office buildings as well. We are in the process of setting up a Limited Partnership to build these four buildings. We think they will be approximately 4,000 sq. ft., residentially styled in nature to be very compatible with the RI-PD portion, the 21 garden homes. Same architect, same architectural flavor and again something that will fit very Page 5 of 8; 3-15-07 P & Z Minutes nicely into the neighborhood. One-story and again heavily landscaped and a property owner's association maintaining the continuity of the landscaping. Eric Wilhite said that staff did review this along concurrently with the RI-PD and recommends approval. We believe that it fits with the comprehensive land use plan shown along this corridor. We have actually received several inquiries along Precinct Line Road where there would be potential for office type developments and so we are in support of going that direction. Anywhere adjacent to the RI-PD or if along the residentially zoned property, they will be required to put up a masonry fence at the time they do site development there. They'd have to meet any district development standards to any adjacent zoning when they come in for their site plan. Chairman Shiflet closed the public hearing at 7:45 p.m. Brenda Cole motioned to approve ZC 2006-22, seconded by Bill Schopper. The motion carried unanimously (6-0). Steven Cooper was absent. 9. ZC 2007 -01 Public Hearing and Consideration of a Request from Clifford Land Company to Approve a Zoning Change from "AG" Agricultural and "1-1" Industrial to "RI-PD" Residentiallnfill - Planned Development (Located in the 8800 Block of Mid-Cities Blvd. - 7.685 acres). APPROVED Cliff Harris, Clifford Land Company, 7952 Davis Blvd, applicant spoke in favor of the request. Eric Wilhite said the request to rezone the property meets established requirements for RI-PD and staff recommends approval. Chairman Shiflet opened the public hearing at 8:05 p.m. Mr. Dennis Lang, 8800 Martin Drive, expressed his concerns regarding the fence that would be erected for the subdivision. The fence will be on the west and south sides of his property. He would like to see the fence be masonry and not wood. He believes the developer should be able to afford masonry. Chairman Shiflet closed the public hearing at 8: 13 p.m. Mark Haynes motioned to approve ZC 2007 -01, seconded by Mike Benton. Ms. Cole asked if on the west side of Brynwyck Lane if there is a fence all the way down that common area? Page 6 of 8; 3-15-07 P & Z Minutes The applicant said the current site plan does not show one; it shows landscaping along that border. We can talk to staff about incorporating something. A masonry fence might not work right there by the road, perhaps landscaping with a wrought iron fence. Mr. Shiflet asked how far is it from Mr. Lang's property line to the front of the new homes which will be across the street on Lots 2, 3,4 and 5? The applicant said it would be about 80 feet. There will be the landscape buffer, the width of the street, and then the front yard set back. There is a builder interested in building the whole subdivision, and he builds a similar product as Cary Clarke Homes. The motion carried unanimously (6-0). Steven Cooper was absent. 10. ZC 2007-04 Public Hearing and Consideration of a Request from Clifford Land Company to Approve a Zoning Change from "AG" Agricultural and "1-1" Industrial to "NS" Neighborhood Services (Located in the 8800 Block of Mid-Cities Blvd. - 2.278 acres). APPROVED Chairman Shiflet said this is between the previously approved item and Mid Cities Boulevard. Since the applicant and staff have already been heard, he opened the public hearing at 8: 16 p.m. Mr. Cliff Harris, applicant, spoke in favor of the request. He said there is not a specific tenant yet for the property. He does have someone looking at it but no actual plan for what will end up there. Eric Wilhite said the staff recommends approval. Chairman Shiflet closed the public hearing at 8: 18 p.m. Bill Schopper motioned to approve ZC 2007-04, seconded by Mike Benton. The motion carried (6-0). Steven Cooper was absent. ZC 2007-12 Public Hearing and Consideration of a Request from Jed Bell to Approve a Zoning Change from "AG" Agricultural to "NS" Neighborhood Services (Located in the 8100 Block of Precinct Line Rd. - 7.3356 acres). WITHDRAWN BY APPLICANT Chairman Shiflet opened the public hearing at 8:16 p.m. He advised that the applicant had made a request to withdraw the application. Mr. Glenn Burch, 8324 Thornridge Dr., came forward to express his opinion that any development of this property would reduce green space. Traffic plans need to be developed as there are 6 to 8 access roads if surrounding properties are developed separately. He also is hopeful that the tree line will stay intact. Chairman Shiflet closed the public hearing at 8:25 p.m. 12. ADJOURNMENT There being no other business, the chairman adjourned the meeting at 8:26 p.m. Chairman Secretary ,/f?
