SUP 2006-05
PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM T-MOBILE
TO APPROVE A SPECIAL USE PERMIT FOR THE ADDITION OF A 10 FOOT
EXTENSION TO AN EXISTING MONOPOLE (LOCATED AT 7510
SMITHFIELD RD.).

Chairman Shiflet opened the public hearing at 7:05 p.m.
Tito Fuentes, 7668 Warren Parkway, Frisco, TX, 75034, representing the applicant T-
Mobile, spoke in favor of the Special Use Permit. The permit is needed in to add a 10
foot extension to the existing tower in order to provide better coverage for T -Mobile's
cellular telephone customers to the existing monopole.
Eric Wilhite said the original SUP for the location was granted in 1996. At that time, the
SUP approved limited the overall height of the antenna to 100 feet By coming in and
adding an additional 10 feet to the monopole, the actual ending maximum height, will
end up being 110 feet up to the top of the antennae. Staff did advise the applicant
because of this they would have to apply for a new SUP so that now the maximum
height will be 113 feet. The Land Use Table does permit cellular tower locations or
single cell towers like this to be a maximum of 130 feet high with an SUP. So in the
future, this existing antenna could go up higher. So it is within the Commission's
authority to limit the height at 113 feet or to prohibit future height change requests. This
request meets all the requirements of the city's ordinances and staff recommends
approval.
There were no others to speak in favor of the request or against the request.
Steven Cooper asked the applicant if they add to these poles in 10 foot sections?
Mr. Fuentes said T-Mobile is adding 10 feet to the pole and then the way the arrays join
onto the pole, there is going to be about 2 or 3 feet above the pole where the antenna
extends. We are adding a 10 feet section and we need a bit of separation between the
antenna arrays.
Mr. Cooper said one of the things he was thinking about is if you need to add 2 or 3
more feet to it, that we could go ahead and do that at this time, but it sounds that there
would be no benefit to you.
Mr. Fuentes said taller is better, and his engineers would be saying yes. T-Mobile could
work with the city to go ahead and extend the pole up to 130 feet at this time.
Mr. Cooper said he is not suggesting that, he just wanted clarification.

Mr. Fuentes said this will provide better coverage for the area, and in-home, in-building
coverage.
Chairman Shiflet asked if there were other providers on this tower?
Mr. Fuentes said yes. There are other providers located on this pole, and this is to
provide better coverage for T-Mobile. We are co-locating with the providers that are
already there. It is the give and take that is in this industry.
Chairman Shiflet closed the public hearing at 7: 15 p.m.
Don Bowen motioned to approve SUP2006-05, a Request from T -Mobile to
approve a Special Use Permit for the addition of a 10 foot extension to an existing
monopole (Located at 7510 Smithfield Rd.) for a maximum overall height of 113
feet, seconded by Mark Haynes. The motion carried unanimously (7 -0).

PP 2006-09
CONSIDERATION OF A REQUEST FROM JOSE SALES TO APPROVE A
PRELIMINARY PLAT OF LOT 1, BLOCK 20, BRIARWOOD ESTATES
(LOCATED IN THE 6900 BLOCK OF SMITHFIELD RD. - 0.985 ACRES).
APPROVED
Ms. Sales was present in support of the request.
Mr. Xavier Chapa, 1425 W. Pioneer Pkwy., Ste. 129, Arlington, representing the
applicant, spoke in favor of this request. His is a professional engineer and registered
professional land surveyor. He said the Sales' bought the property with the intention of
building their home on this tract of land and that is why they request approval of the
preliminary plat. There is one thing that I need to disclose. When I started investigating
the adjoining tracts, I discovered that the city had purchased a tract of land immediately
adjacent to the front of this tract, which in reality, was not adjacent to this tract. The city
had purchased what they thought was the portion along the front of the Sales' tract.
When the Sales' purchased this tract, they actually got title to the original rectangular
tract, and the city's tract was described in the wrong abstract and survey. So by
applying for this plat, the Commission would have to determine if it is not a violation of
city policy to plat a tract that might have a cloud on it. I am personally not an attorney
but I feel like the city is claiming a portion of the land that they own and in some
situations this might result as a cloud on the deed.
Mr. Schopper said it looks like the applicant is dedicating the right-of-way to the city by
plat anyway, so it is going right back to the city.

Mr. Chapa said it is not a problem for the applicant to dedicate the right-of-way to the
city, but my concern is that if it is satisfactory to the city for them to do this, then they are
in favor of dedicating the right-of-way. I have not ever run into this situation before.
Chairman Shiflet said that is where the street either tapers down or widens from two
lanes to four lanes.
Mr. Chapa said yes that is the beginning of the curving portion.
Eric Wilhite said that this is a preliminary plat and the Commission will soon see a final
plat on the same tract for this 0.9 acre parcel. Staff has talked to the City Attorney
regarding this parcel. He said that by the mere fact that we are bringing the preliminary
plat and final plats forward for approval through the platting process, the city does not
take issue to the way that the right-of-way will be deeded to the city. The city's engineer
has determined that this subdivision will be responsible for improvement cost for the
construction of a four foot sidewalk within the Smithfield Road right-of-way when
construction of the residence occurs. The Development Review Committee has
reviewed the plat and it does meet the requirements of the Zoning and Subdivision
Ordinance. Staff recommends approval.
Brenda Cole motioned to approve PP 2006-09, seconded by Mike Benton. The
motion carried unanimously (7-0).

PP 2007-01
PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM FROM CARY
CLARKE HOMES TO APPROVE A PRELIMINARY PLAT OF LOTS 1-12, BLOCK
1; LOTS 1-9, BLOCK 2; LOTS 1-6, BLOCK 3; LOT 1, BLOCK 4; LOTS 1-4,
BLOCK 5, HIGHLAND PARK (LOCATED IN THE 9200 BLOCK OF AMUNDSON
RD. - 6.248 ACRES).
APPROVED
Mr. Cary Clarke, applicant, spoke in favor of his request.
Eric Wilhite said the request meets all required criteria and is consistent with the
approved RI-PD site plan. Staff recommends approval.
Don Bowen motioned to approve PP 2007-01, seconded by Brenda Cole. The
motion carried unanimously (7-0).
