CALL TO ORDER The meeting was called to order by Chairman Randy Shiflet at 7:04 p.m. 2. CONSIDERATION OF MINUTES FROM THE APRIL 19, 2007 MEETING. APPROVED Brenda Cole, seconded by Steven Cooper, motioned to approve the minutes of April 19, 2007. The motion carried unanimously (7-0). ZC 2007-06 Public Hearing and Consideration of a Request from Penny Hontz to Approve a Zoning Change from "AG" Agricultural and "R2" Single Family Residential to "R- 1-S" Special Single Family (Located in the 7300 Block of Eden Road -1.31 acres). APPROVED Chairman Shiflet opened the public hearing at 7:07p.m. Penny Hontz, 8636 Stonecrest Trail, North Richland Hills, TX spoke in favor of her request for zoning change from AG and R2 to R 1 S. She stated she wanted to build a pool on her property but the current zoning would not allow it because part of her property is zoned AG. Eric Wilhite stated this zoning is R2 with the property behind them is zoned AG, they were wishing to do improvements on their property. He said that the request meets all the re-zoning requirements and staff recommends approval. Mark Haynes asked about the accessory building on the back of the property and what was it being used for. Eric Wilhite explained it was used for shelter for their livestock. Chairman Shifltet asked if there were any others to speak In favor or against the request? Maxine Shields, 7300 Stonecrest Drive, North Richland Hills, TX came forward stating she was concerned about the drainage issues on the property. She also asked if there would be a street cut through Brookridge Drive to the property in the future. Bill Schopper said he felt it makes sense that this request would not allow a street to be put through because other property to the south would have to participate and dedicate property. Mrs. Shields stated there is quite a bit of this land behind her property and the previous owner had plans to open it up and develop the land but it was not allowed to happen due to zoning. Chairman Shifllet stated never say never. Based on the parcels property owners on all sides would have to request this change. He asked John Pitstick if Hightower was still on the main thoroughfare plan to go through to Eden. John Pitstick stated yes it was. Chairman Shiflet said it does not seem feasible for anyone to put a street through unless several property owners came forward to develop land there. Page2of5 P & Z Minutes 05-03-07 Mrs. Shields stated she currently has very low water pressure now and if they built homes behind them it might affect her pressure. She said the city had been in to address the standing water issues in the past. Chairman Shifllet closed the public hearing at 7: 15 p.m. Mark Haynes seconded by Steven Cooper motioned to approve Zoning Change from "AG" Agricultural and "R2" Single Family Residential to "R-1-S" Special Single Family (Located in the 7300 Block of Eden Road - 1.31 acres). The motion carried unanimously (7-0). 6. RP 2007-04 Public Hearing and Consideration of a Request from Penny Hontz to approve a Replat of Lot 3, Block 1 to Lot 3R, Block 1 Stonecrest Addition (located at 8636 Stonecrest Trail) APPROVED Chairman Shifllet opened the public hearing at 7: 18 Eric Wilhite came forward and was asked to explain the utility easement situation at the property that currently divides the lot. He explained that it would stay there because it has utilities in it unless the property owners wanted to pay the utility company to relocate it. Bill Schopper asked if the 15 ft drainage easement at the south end was pre-existing or new to the property. Eric Wilhite discussed it was to provide opportunity to do drainage improvements in the area and the easement was being dedicated by this plat. Penny Hontz, 8636 Stonecrest Trail, North Richland Hills, TX came forward regarding her request. She asked if her horses would still be able to graze on the utility easement. Eric Wilhite stated yes. Brenda Cole asked if the accessory building was on the 25 ft building line and easement. Eric Wilhite stated he was not sure, but if it was located there he would request to work with Public Works to have it grandfathered or relocate it. Greg VanNeiuwenhuize stated the drainage easement would allow the city to go in there at a later date and install underground pipes on the property still giving Mrs. Hontz surface for livestock. Page 3 of 5 P & Z Minutes 05-03-07 Chairman Shiflet asked if anyone else was wishing to speak for or against? Mrs. Shields stated that their new accessory building was against the fence line and asked if it would be a problem for the other neighbors. Eric Wilhite stated they received a permit for the accessory building and would verify it was installed properly. Chairman Shiflet closed the public hearing at 7:23 p.m. Brenda Cole motioned to approve RP 2007-04 Replat of Lot 3, Block 1 to Lot 3R, Block 1 Stonecrest Addition (located at 8636 Stonecrest Trail), seconded by Mike Benton. The motion carried unanimously (7-0). 7. TR 2007-01 PUBLIC HEARING AND CONSIDERATION OF AMENDING THE ZONING ORDINANCE BY REVISING SECTION 118-671 PROHIBITING THE USE OF WOOD BASED PRODUCTS ON RESIDENTIAL SIDING FOR NEW HOMES; REVISING SECTION 118-715 ALLOWING ADDITIONAL TEMPORARY OUTDOOR EVENTS FOR PROFIT AND NON-PROFIT ENTITIES; ADDING SECTION 118-878 REQUIRING THE USE OF METAL POSTS ON NEW WOOD FENCES APPROVED Chairman Shiflet opened the public hearing at 7:24. John Pitstick came forward and thanked the board for their hard work of the items sent to the commission for potential changes to the zoning ordinance. Mr. Pitstick explained the items requested and to be reviewed with recommendations back to the City Council. These items are consider revising regulations for Temporary Outdoor Events, consider requirement mandating the use of metal posts on wood privacy fences, consider requirement prohibiting the use of wood based products when used on eaves, soffits and non-masonry chimneys, consider requirement mandating visibility restrictions on second story windows for new homes overlooking neighboring residences, consider a requirement mandating elevation articulation on residential buildings, consider requirement mandating LEED )Leadership in Energy and Environmental Design) certification (Green Buildings) for new construction. Mr. Pitstick said the Planning and Zoning committee had worked at 3 different work sessions over the past months; the Chairman gave formal presentation to the City Council basically supporting three recommendations. The recommendations were received very favorably with the City Council and is bring brought back tonight for a public hearing. Page 4 of 5 P & Z Minutes 05-03-07 The three sections of the ordinance that are being changed are section 118.671, section 118.715 and 118.878. Brenda Cole stated she remembered the ordinance to state all new wood fences only, not wood fences being replaced. Bill Schopper stated it would not be difficulty for builders installing new fences using all metal posts. His concern was citizens coming in for fences permits to replace damaged or existing fences they would have to replace their entire fence with metal posts. Mark Haynes said he remembered the revision to state all newly constructed wood fences to use metal posts. Greg NanNeiuwnehuize recommended changing the ordinance to state "all new wood fences, with the exception of replacements must use metal or concrete posts as approved the Building OfficiaL" Dan Tresch, 3023 Iron Stone Ct, Arlington, TX asked for clarifications on wood based products on trim work. Brenda Cole, seconded by Bill Schopper moved to approve TR 2007-01 Public Hearing and Consideration of Amending the Zoning Ordinance by revising Section 118-671 Prohibiting the use of wood based products on residential siding for new homes; revising Section 118-715 allowing additional temporary outdoor events for profit and non-profit entities; adding_Section 118-878 requiring the use of metal posts on new wood fences, with the recommendations as read by Mr. VanNeiuwenhuize. The motion was carried unanimously (7-0). 8.
