ZONING CASE ZC 2006-23
AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH
RICHLAND HILLS; AMENDING THE ZONING MAP OF THE CITY OF NORTH
RICHLAND HILLS, TEXAS, AND BY REZONING A 4.339 ACRE TRACT OF
PROPERTY AND MODIFYING AN RI-PD SITE PLAN TO ELIMINATE
REQUIREMENTS PREVIOUSLY APPROVED; ESTABLISHING A PENALTY;
PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent
to real property owners within 200 feet of the property herein described at
least 10 days before such hearing; and,
WHEREAS, notice of a public hearing before the City Council was published in a
newspaper of general circulation in the City at least 15 days before such
hearing; and,
WHEREAS, public hearings to zone the property herein described were held before
both the Planning and Zoning Commission and the City Council, and the
Planning and Zoning Commission has heretofore made a
recommendation concerning the zone change; and,
WHEREAS, the City Council is of the opinion that the zone change herein effectuated
furthers the purpose of zoning as set forth in the Comprehensive Zoning
Ordinance and is in the best interest of the citizens of the City of North
Richland Hills; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
Section 1: THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance
and the zoning map of the City of North Richland Hills are hereby
amended by rezoning a 4.339 acre tract of land located in the City of
North Richland Hills, Tarrant County, Texas, more particularly described in
Exhibit A by approving the site plan attached hereto as Exhibit B without
the following stipulation: The existing fence shall be modified by replacing
wood portions with a masonry product.
Section 2: Any person, firm or corporation violating any provision of the
Comprehensive Zoning Ordinance as amended hereby shall be deemed
guilty of a misdemeanor and upon final conviction thereof fined in an
amount not to exceed Two Thousand Dollars ($2,000.00). Each day any
such violation shall be allowed to continue shall constitute a separate
violation and punishable hereunder.

Section 3: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clauses of this ordinance
as an alternative method of publication provided by law.
Section 4: This ordinance shall be in full force and effect immediately after passage.
AND IT IS SO ORDAINED.

County Clerk's File No. D206375778, Deed Records, Tarrant County, Texas and also being a portion of thai
tract of land desaibed in deed to MaIIhevt Delusque, at aJ and recorded in County Clerk's File No.
D206068257, Deed Recarda, Tarrant County. Texas, said 4.339 acre tract being more particularly described
by metes and boU1ds as follows:
BEGINNING at a 1/2 inch capped steel rod found in the south right~f-way line of Amundson Road (8
Wliab6e width right4-way);
THENCE SOO°05'2O'W, along the W8$t line of Nob Hill North, an addition to the City of North Ríchland Hills,
Tarrant County. Texas according to the plat reoorded in Volume 388-197, Page 52, Plat Records, Tarrant
County, Texas a distance of 207.48 feet to a 1/2 inch steel rod fOIJnd;
THENCE SOQ'>00'24"E, continuing along the west line of said Nob Hill North, a distance of 208.55 feet to a
112 inch steel rod found for the southwest comer of said Nab Hill ~orth;
THENCE N89"59'STE, along the south line of saíd Neb Hill North, a distance of 139.17 feet to a point;
THENCE s00001'03"E, leaving the south line of said Neb Hill North, a distance of 276.86 feet to a point in
the soutn line of said Delusque tract:
THENCE N89"55'2TW, along the south line of saíd Delusque traà. a distance of 358.98 feet to a 318 inen
steel rod found:
