CALL TO ORDER The meeting was called to order by Chairman Randy Shiflett at 6:30 p.m. 2. DISCUSSION ON ROUGH PROPORTIONALITY DETERMINATION Eric Wilhite gave a brief introduction regarding rough proportionality. He explained that this situation frequently comes up where the applicants are cognizant of whether they have to pay for the rough proportional share of public improvements which usually include curb, gutter and street improvements. Not only does the city acquire the right of Page 1 of 6; 09/06/2007 P & Z Minutes way through that process, but also takes the opportunity to take their share of what it would take to complete the infrastructure. This matter comes up frequently with the applicants and explaining the process will give the commission more insight as to what takes place during Development Review Committee. He explained it's a somewhat complicated and significant issue when developers come in to purchase property and find out they are going to be responsible for their share of the public improvements. Caroline Waggoner, Civil Engineer, gave a presentation on rough proportionality determination. She explained that rough proportionality is a mechanism by which the City assures that new developments adequately and fairly participate in the dedication and construction of public improvements necessitated by or attributable to that development. It basically comes down to what is that developments fair share. The City of North Richland Hills passed Rough Proportionality Ordinance in June 2006. The passage of that ordinance was a result of a Texas Supreme Court case involving the city of Flower Mound in 2004 and a subsequent update to the Texas Local Government Code in 2005. The City of North Richland Hills is on the leading edge amongst other local municipalities with the first local appeal in June 2007. Rough Proportionality applies to public infrastructure: utilities, streets, drainage and dedication of land. These determinations are done on an individual basis as they come in and do not require "mathematical exactitude". Mrs. Waggoner explained the different categories in more detail completing the presentation with explaining the appeal process and reviewed individual cases in North Richland Hills. Greg VanNeiuwenhuize explained that impact fees give us the ability to reduce the developer's cost so he is only paying for his impact and at the same time the city gets the appropriate drainage needed for that subdivision. He also explained Caroline's example of supply and demand regarding streets varies but is generally accepted as fair to the developer. Chairman Shiflet asked Mrs. Waggoner if she knew what other cities were doing regarding this issue? She stated she has been calling other cities at random and perhaps they are not feeling the push to move forward at this time. Chairman Shiflet asked when are the impact fee calculations reviewed? John Pitstick explained that they are reviewed twice a year. Chairman Shiflet commended the Public Works Department on their job explaining Rough Proportionality and all the work they have done. Page 2 of 6; 09/06/2007 P & Z Minutes 4. CONSIDERATION OF MINUTES FROM THE AUGUST 2, 2007 MEETING APPROVED Don Bowen, seconded by Bill Schopper, motioned to approve the minutes of August 2,2007. The motion carried unanimously (6-0). Mark Haynes was absent. 5. RP 2006-14 Consideration of a Request from Jon Westrom of Westrom & Walling Developers to Approve a Replat of Lot 11A, Block 6 into Lots 11R1-11R23, Block 6, Crestwood Estates Addition, (Located in the 8200 Block of Starnes Road-3.673 acres). Barry Walling of Westrom and Walling Developers, 1105 Brown Trail, Bedford, TX came forward with a request to replat the subdivision behind the former Winn Dixie grocery store with 18 lots cutting in a private street for single family units. Eric Wilhite explained that this property was recently reviewed by P & Z and rezoned for RI-PD Residential Infill - Planned Development. He explained that it conforms to previously approved RI- PO as it relates to the lot configurations and some of the common open space that the HOA will have. Mike Benton asked if there would be trees and rod iron fencing along the subdivision? Eric Wilhite stated that there would be vegetation maintained and masonry screening fencing would be installed by the subdivision and are secured by the construction plan and conformed to the RI-PD. They meet all the subdivision rules and regulations and staff recommends approval. Mike Benton asked if the trees along the back would be saved? Eric Wilhite stated that several things had to be changed based on City Council review to get a mutual access back to the alley that serves the back portion. Some of the trees that staff had wanted to save due to the requirement placed on the developer to get final approval. APPROVED Steve Cooper, seconded by Don Bowen motioned to approve RP 2006-14. RP 2007-08 Consideration of a Request from John Blacker of Kimley-Horn & Associates, Inc. to Approve a Replat of Lot AR, Block 6 and Tract 2B1A, Abstract 146 into Lot 4R, Block 6, Crestwood Estates Addition, Gateway Church, (Located in the 7500 Block of Davis Boulevard-1 0.60 acres Anna Carrillo, Civil Engineer of Kimley-Horn and Associates, Inc., 2767 Autumn Breeze, Grand Prairie, TX came forward representing Gateway Church, requesting to replat 3 tracts of land into one single lot. She noted that there is no public improvements at this time. Don Bowen asked if the northern portion of this property is in flood plain? Eric Wilhite said yes it was. He stated the property is zoned C-1 and they are requesting to replat the land for the use of a satellite campus of Gateway Church located in Southlake. This campus will primarily be geared towards youth. Staff has reviewed and it meets all the subdivision rules and regulations and recommends approval. APPROVED Bill Schopper, seconded by Mike Benton motioned to approve RP 2007-08. The motion as carried unanimously (6-0). Mark Haynes was absent. 7. FP 2007-10 Consideration of a Request from Jim Makens to Approve a Final Plat of Lot 4, Block 1, Gibson Addition, (Located in the 8700 Block of Precinct Line Road-1.12 acres) Brian Toley, 3231 Harwood Drive, Bedford, TX, came forward representing the property owner Jim Makens requesting a final plat of the Gibson Addition. This is the last tract in the development. He explained that is was not platted with other properties is because they were uncertain what they were going to have in the end Eric Wilhite came forward stating this was all previously platted and has mutual access dedicated to get to the back lot where the hair salon is located. The Development Review Committee has reviewed this plat and it meets all the subdivision rules and regulations and staff recommends approval. APPROVED Mike Benton motioned to approve FP2007 -10, seconded by Kelly Gent. The motion was carried unanimously (6-0). Mark Haynes was absent. Page 4 of 6; 09/06/2007 P & Z Minutes Chairman Shiflet asked Public Works if this development would be able to obtain a TX DOT permit for driveway? Caroline Waggoner stated no, she did not think they would be able to. She noted in staff report that there is an existing shared access that the convenience store and hair salon use that this property also has access to. A second proposed access point would not meet the spacing criteria, she does not believe TX DOT would grant a second access point. 8. DISCUSSION OF UPDATED COMPREHENSIVE PLAN John Pitstick presented the proposed Comprehensive Plan, Strategic Area Map and Thoroughfare Plan that take into account the recommendations from the Loop 820 Corridor Study and identifies areas for Mixed Use Zoning around our two future commuter rail station areas. Mr. Pitstick explained the proposed commuter rail station is going from southwest Fort Worth to the north end of DFW Airport which The T plans to have in operation by the year 2012. The City of North Richland Hills will have two proposed station sites in its path. He stated several staff and council members have served on the technical committees to determine the most cost effective way to transport people through this corridor. He said we are hopeful that the next Legislative session will be favorable to increase the sales tax to create a county wide election to help pay for regional rail for this area. He explained that the Council of Governments has a grant program which awards cities with Mixed Use Developments funding for planning and land banking money to develop future rail stations. In order to qualify for these grants you must have a Mixed Use Development on the Comprehensive Plan and Mixed Use Ordinance in place. He explained that over the next few months there are plans for city staff to hire professional consultants that are familiar with transit oriented developments and form based zoning to help develop separate zoning districts to accommodate the proposed changes. Mr. Pitstick said that on September 20, 2007 the committee will review changes the Comprehensive Plan. October 4, 2007 we would like to hold a Public Hearing to invite input on proposed Comprehensive Plan use changes and on October 18, 2007 have recommendations to present to the City Council for the November 12, 2007 meeting to adopt the map changes. Chairman Shiflet asked if there would be enough room between Smithfield Road and Davis Blvd. to accommodate the rail system to make the stops? Page 5 of 6; 09/06/2007 P & Z Minutes Mr. Pitstick stated that 600 feet is adequate for the rail station stops which would allow several commuter trains to make the stop. General discussion on Mixed Use buildings such is being done in The Venue at Hometown took place. Staff described how the mix of land uses typically separated could be successfully done and combined in the same structure.
