I. Consider revising regulations for Temporary Outdoor Events II. Consider a requirement mandating the use of metal posts on wood privacy fences. III. Consider a requirement that would prohibit the use of wood based products when used on eaves, soffits, and non-masonry chimneys. IV. Consider a requirement that would mandate visibility restrictions on second story windows for new homes overlooking neighboring residences. V. Consider a requirement that would mandate elevation articulation on residential buildings. VI. Consider a requirement that would mandate LEED (Leadership in Energy and Environmental Design) certification (Green Buildings) for new construction. All of the above items have been discussed at the February 1, 2007, March 1, 2007 and March 15, 2007 Planning & Zoning Commission work sessions. Staff has surveyed area cities and reviewed these potential changes. Following is a breakdown of each item with recommendations to City Council. Temporary Outdoor Events As a result of recent changes in the Sign Ordinance, the Planning & Zoning Commission supports a zoning ordinance revision to the Temporary Uses and Buildings section to make additions to: 1. Allow up to six special sales events per site for business uses on sites containing 200,000 square feet of buildings; or greater than 5 acres in area within the Freeway District for a maximum of 10 days each with a minimum of 30 days between events. 2.Allow up to four non-profit events per year for each separate non-profit agency. For-profit business properties can allow the use of their property for non-profit sponsored fundraising as long as no more than four non-profit events occur on their property per year. 3.Allow one non-profit sponsored carnival per site per year to be counted as one of the four annual non-profit events allowed for each non-profit agency for a maximum of three consecutive days. II. Requiring metal posts on wood privacy fences The Planning and Zoning Commission believes it is in order to recommend to the City Council an ordinance that would require the use of metal posts on all NEW wood privacy fences within the City of North Richland Hills. The Commission believes that extending a metal post requirement to minor replacement of existing fences would introduce undue code enforcement problems and recommends exempting the requirement on replacement of existing fences. III. Prohibiting the use of wood based products on eaves, soffits, and non- masonry chimneys The Planning & Zoning Commission supports an ordinance revision that would prohibit the use of wood based products on all siding materials for new homes. IV. Requiring visibility restrictions on second story residential windows overlooking neighboring residences. The Planning & Zoning Commission does not support a general requirement for second story visibility restrictions, but would recommend that visibility restrictions on residential structures be considered on a one-on-one basis under a planned development ordinance. V. Requiring Elevation Articulation on Residential Buildings The Planning & Zoning Commission does not support a requirement for side or rear elevation articulation on residential buildings within North Richland Hills. VI. Requiring “Green Buildings” for new construction The Planning & Zoning Commission believes that many of the LEED nuances are being incorporated in adopted building and energy conservation codes and does not recommend adopting LEED certification or “green buildings” as a requirement for building construction within the city at this time. The building and energy codes are continuously updated by the International Code Council, and as new practices and standards evolve and continue to be accepted by the building community, the code development process will move to include them. The Commission would recommend that the City of North Richland Hills should encourage “green buildings” by providing educational materials on LEED-certified buildings within all city offices dealing with developers and builders. INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. IR 2007-043 Date: March 26, 2007 Subject: Update on the Art in Public Spaces Program and Discussion of Proposed Signal Art Program Update on Art in Public Spaces Program Under City Council Goal #5, “Preserve Positive City Image” one of the objectives is to “Enhance the Public Art Program”. With the latest installation of the urban mural at Ace Park, the City has in its’ collection 15 pieces of public art, 14 of which are original commissioned pieces. This does not include the mission façade included in the architectural design of Dr. Pillow Park or the prehistoric structures at Norich Park. In as much as possible, it is the intent of the Internal Public Art Committee to include public art in the architectural design of new parks and facilities. For example, the public art feature at the future Library Park Plaza may not necessarily be a separate stand alone piece but instead be built into the architectural theme of the park, as was the façade at Dr. Pillow Park. Another public art site has been selected along South Boulevard 26 for an original commissioned piece. The piece will be commissioned later this year and will compliment the Boulevard 26 theme and the new intersections. Staff is currently working with TxDOT for approval to place the future art work within one of the medians. Proposed Signal Art Program To further enhance our public art program, the Internal Public Art Committee is recommending that the City implement a new and unique public art initiative, “Signal Art”. The program will commission artists to design and implement original artwork for traffic signal boxes throughout the City. Initially, as budget allows, we would like to commission artwork for approximately 10 signal boxes. The location of the boxes will be located at various places throughout the City with an emphasis on pedestrian access or highly visible areas. We have selected signal boxes on South Boulevard 26, Rufe Snow Drive, Holiday Lane, Mid-Cities Blvd. and Davis Blvd. The purpose of this program is to integrate the traffic signal boxes into the surrounding physical landscape and to beautify public spaces. The artists will be encouraged to ISSUED BY THE CITY MANAGER NORTH RICHLAND HILLS, TEXAS draw upon North Richland Hills’ historic and cultural references or specific physical characteristics for the site for inspiration. The objective is to assign one box per artist, but in some cases a single artist may be commissioned to design/paint up to two boxes. Historic photographs converted into a print design graphic and applied to the signal box with a pressure-activated adhesive material called “Controltac” will also be considered as artwork where appropriate. Artists will be paid approximately $500 - $750 and will be selected on the quality of their portfolio and concept sketch of the selected signal box. Specific guidelines will apply to ensure quality, professionalism, and appropriate themes and images. Advertising, partisan politics, religious art and sexual content will not be permitted. Business sponsorships will also be considered should a business want a Signal Art box near or around their specific place of business. The City will maintain artistic control of the boxes including selection of the artist(s) and all Signal Art guidelines will apply. The Internal Public Art Committee will select all the artists for the program with final approval from the City Manager. The Internal Public Art Committee is excited to introduce this new public art initiative which supports City Council goals, beautifies public spaces, promotes a healthy vibrant atmosphere, encourages artistic expression and inspires a sense of civic pride. Staff will present a PowerPoint presentation on the proposed program and will be available to answer any questions. Staff is seeking concurrence on initiating the Signal Art Program. Respectfully Submitted, Vickie Loftice Director of Parks and Recreation INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. IR 2007-044 Date: March 26, 2007 Subject: State Legislative Update th Attached is the first NRH Legislative Update for the 80 Regular Session of the Texas Legislature. Although this report is up-to-date through early March, it does not have all the bills that were filed the last several days before the filing deadline of March 9. In four days, legislators filed nearly 2,300 bills. I have not been able to sort through all the city related bills that were filed at the last minute, but the next legislative update presented to Council will contain those bills. Since the session started, there have been 6,089 bills filed which breaks the previous record set in 1999 when 5,908 bills were filed. Although the deadline has passed, additional bills can be filed if lawmakers can persuade their colleagues to suspend the rules on a bill-by-bill basis. It is anticipated that over the next several weeks bills will see significant movement. Most bills have been assigned to committee, many bills have been scheduled for hearing in committee, and several bills have already been passed by the House and are ready to be referred to the Senate. Please keep in mind that City positions on bills could change throughout the session depending on changes and amendments to each bill as they move through the process. On Monday night I will highlight several of the bills that I believe are of particular interest to Council. Please do not hesitate to notify me if you have any questions on a particular bill. The contract does not include an extension provision. We wanted to discuss with Council how we might proceed with obtaining a new contract either with Allied or with another company. Either way we need to begin this process very soon. We have a couple of options on how to move forward.We can negotiate with Allied Waste for a new solid waste contract or we can issue a Request for Proposal (RFP) to seek vendors for this service. If council concurs to issue an RFP, staff would develop a timeline and list of criteria we believe should be included in the RFP. We would bring this to Council at a future worksession to get Council feedback and suggestions as well as talk about the specifics of going out for bid. The bid specifications and contract allow for the contract to be extended for an additional one year term if it remains beneficial to the City. At the March 28, 2005 meeting, Council awarded the contract to Active Impressions (2005-012) to supply various types of shirts for a two year term. T-Shirts and golf shirts are used by various departments as part of their uniform and by the Parks and Recreation Department for the various sport leagues and special events. Departments order these shirts as they are required throughout the year. Active Impressions has stated they will extend the current contract an additional year with the same percent off the retail catalog prices. The contract pricing is 45 percent off the manufacture retail catalog price. This type of contract gives the City the ability to choose any item from the vendor catalog and not be limited to specific types, colors or brands. Miscellaneous services such as silk screening, embroidery and creating the artwork that may be required are included as part of the contract. Active Impressions has been awarded this contract the last seven (7) years and has provided excellent service, orders are delivered by the requested date and they are a very knowledgeable and easy company to work with. As part of the legal requirements for the planned issuance of Certificates of Obligation, the City Council must authorize the City Secretary to publish by April 8, 2007 a notice in a newspaper of general circulation of the intent of the City to issue Certificates of Obligation in an amount not to exceed $1,285,000 (see attached project list). Of this total issuance, $700,000 will be issued for improvements at NRH0, and $585,000 will 2 be issued for fire and public works replacement equipment. Sale1,285,000$ CITY OF NORTH RICHLAND HILLS Department: Human Resources Council Meeting Date: 3-26-2007 Presented by: Patrick Hillis Agenda No. F.3 Subject: GN 2007-023 Approval of the April 2007 Market Adjustment to the Public Safety Plan History On February 24, 2003, Council adopted a resolution (No. 2003-01) recognizing the need to compensate employees at a market competitive level in order to retain and attract quality individuals. As part of this resolution, Council instructed City staff to conduct annual salary surveys to determine market changes. As discussed during this year's budget work session, an analysis of survey data going back to 2003 showed relatively little movement in the market from 2003 to 2005. However, survey data showed significant movement with pay ranges over the last 12 months leading up to the budget work session. This recent market increase can be attributed to improving economic conditions as well as employers' attempts to offset rising health care costs that over the last several years have been passed along to their employees. To maintain the Council's goal of positioning our salary range midpoints at the market average, City Council approved the funds to provide for two adjustments to the salary ranges in FY 06/07. The first adjustment occurred in January 2007. The Public Safety Pay Plan was adjusted 5.42% and the Professional/Administrative and General Services Pay Plans were adjusted 4.51%. Survey Methodology To simplify the budget process, most cities adjust their pay ranges October 1 of each year. To determine additional movement with the market, the Human Resources Department conducted its 2006 benchmark survey in November of last year. The market analysis compared the benchmark positions from our pay plans against similar positions from our ten survey cities. The midpoint averages were used as the basis of comparison. The survey results combined with the Employment Cost Index showed that the City of North Richland Hills Public Safety Pay Plan was 4.83% below the market and the Professional/Administrative and General Services Pay Plans were 2.55% below the market average. Adjustments to the Public Safety Pay Plan are based on the Police Officer survey data. Since North Richland Hills Police Officer and Fire Fighter salaries are identical, the adjustment to the Public Safety Pay Plan is calculated on the higher of the two midpoints, according to the survey data. Implementation As previously approved by Council, due to the differences between the two pay plans, the implementation of the April 2007 market adjustment for the Public Safety Pay Plan will be different than the Professional/Administrative and General Services Pay Plans. All Public Safety employees will remain on step, and their salaries will be adjusted along with the pay ranges. However, the Professional/Administrative and General Services pay ranges will be brought to the market average with no further adjustment to individual employee salaries. Budget The survey data indicates that the market adjustment for the Professional/Administrative and General Services Pay Plans is 2.55%, and is within the budget estimate of 3% approved by Council as part of the FY 06/07 budget. No action from Council is needed to implement this adjustment.As stated above, only Public Safety employee's salaries will be adjusted along with the pay ranges (step plan), and Professional/Administrative and General Services employees (open pay ranges) will not receive an across the board adjustment to individual salaries. As stated above, the survey data for the Public Safety Pay Plan shows that a 4.83% market adjustment will be needed to bring the Public Safety Pay Plan to the market average. This 4.83% proposed adjustment is above the 4% estimate approved by Council in the FY 06/07 budget. Although the 4.83% exceeds the budgeted amount, due to salary savings from vacancies within both departments, sufficient funds are available to provide the necessary costs for the additional .83% difference. Since the City of North Richland Hills has been striving to remain as competitive with the market as possible, we believe it would be highly desirable to implement the additional .83% adjustment to the Public Safety Pay Plan. Recommendation: To approve a 4.83% adjustment to the City's Public Safety Pay Plan effective the first payroll period beginning in April 2007. CITY OF NORTH RICHLAND HILLS Department: Parks and Recreation Council Meeting Date: 3-26-2007 Presented by: Vickie Loftice Agenda No. F.4 Subject: GN 2007-025 Conveyance of .0615 Acres to TxDOT for Construction of Improvements Associated with the "Keep Texas Beautiful" Governor’s Achievement Award - Resolution No. 2007-023 A status update of the Davis Boulevard Streetscape and the “Keep Texas Beautiful” Governor’s Achievement Award Project was provided to Council at the February 26, 2007 meeting. Both projects will introduce streetscape amenities and features designed to enhance the city’s image and promote possible business attractions and private investment along Davis Boulevard. While the City’s consultant, Schrickel Rollins and Associates, is proceeding with the design for the landscape cost sharing portion of the Davis Streetscape project, TxDOT is proceeding with preparing the detailed plans and specifications for the pocket park and bicycle rest area at the corner of Emerald Hills Way and Davis Boulevard. The City owns this corner lot and the proposed improvements will occur within the TxDOT right- of-way along Davis Boulevard and within the limits of the City’s property. TxDOT requires that all TxDOT funded improvements occur within their right-of-way. Therefore, an additional .0615 acres needs to be conveyed to TxDOT for the purpose of constructing the proposed improvements. The deed allows for the following: • Conveyance of .0615 acres for improvements to be constructed by TxDOT • Property will revert to the City if improvements are ever removed • City retains all mineral interests The City Attorney has reviewed and approved the conveyance deed. The North Richland Hills Industrial Development Corporation was established by the City in 1980 for the purpose of encouraging employment and furthering the promotion and development of commercial, industrial and manufacturing enterprises in North Richland Hills. The City appointed seven members to the Corporation’s Board of Directors to manage and perform the duties required by law. From time to time, the Board of Directors has authorized and the City has issued Industrial Development Bonds to provide financial assistance to private-sector entities for the acquisition and construction of industrial and commercial facilities to be in the public interest. The bonds are secured by the property financed and are payable solely from payments received on the underlying mortgage loans. Since 1980 there have been four issues: Sealy Mattress in 1981, Carlisle Corporation in 1983, M & H Realty Co (H & M Foods) in 1985 and Technol, Inc. in 1985. As of September 30, 2006, there was one issue of Industrial Development Bonds outstanding in the name of Carlisle Corporation. This company was named Graham Magnetics. We have been informed that it was acquired by another corporation who assumed its assets and liabilities. While it is no longer in business here, its ID Bonds are being paid. Again the City has no obligation to pay these nor any liability.The original issue amount totaled $4,625,000 with a retirement date of 2013. Over the last several years, the Corporation has been inactive but cannot be dissolved until the retirement of the one outstanding issue. Additionally, the Board of Directors has not needed to meet and the existing members terms of office have expired. The City recently received notification from the State of Texas to submit a non-profit periodic report for the Corporation updating information for the Corporation.Two officers of the Corporation must submit the report. In order to provide updated information to the State Council is being requested to appoint/reappoint members to the Board of Directors. Staff is recommending the appointment of the following individuals to hold office for a term of six years or until successors are appointed as provided in the Corporations’ Bylaws. In the previous agenda item, Council was requested to make appointments to the Industrial Development Corporation. Staff is recommending that the individuals that were appointed to the Industrial Development Corporation also be appointed to the Health Facilities Development Corporation.
