CAll TO ORDER The meeting was called to order by Chairman Duer at 7:30 p.m. 2. CONSIDERATION OF MINUTES OF JANUARY 16, 1997 APPROVED Mr. Bellomy made the motion to approve the minutes of the January 16, 1997, meeting. Mr. Young seconded the motion and it carried, 4 - O. Chairman Duer stated that State Law requires four affirmative votes for a variance to pass, regardless of the number of members in attendance. He stated the board consists of five voting members and only four members were present, meaning all four members would have to vote unanimously in order for a motion to carry. 1 4. REQUEST OF JULIAN T. PEREZ TO VARY FROM THE MINIMUM FRONT BUILDING LINE REQUIREMENT FOR A CARPORT ADDITION ON LOT 10, BLOCK 22, SNOW HEIGHTS ADDITION (LOCATED AT 6705 CORONA DRIVE) CARRIED OVER FROM 2/20/97 DENIED Chairman Duer opened the public hearing and asked the applicant to come forward. Mr. J.T. Perez, applicant, explained that his primary reason for a carport is to avoid future hail damage to his vehicles. He has spoken with his neighbors and stated that no one has a problem with this carport addition. He has lived in this house for 34 years and plans on making the carport aesthetically pleasing. The dimensions are 18 feet wide by 24 feet long, attached to the front of the house and would be constructed of 26 gauge steel with steel posts in concrete. The proposed carport will extend approximately 21 feet beyond the minimum front building line. Mr. Perez can not use his garage on one side because the laundry room extends into the garage. Chairman Duer called for any additional proponents. There being none Chairman Duer called for any opponents. There being none the public hearing was closed. Chairman Duer made a motion to approve BA 97-04. The motion died for lack of a second. Mr. Perez was informed that his request was denied and informed of his appeal rights. 5. REQUEST OF MARSHALL & LINDA VALENTINO TO VARY FROM THE MINIMUM SIDE BUILDING LINE REQUIREMENT FOR A CARPORT ADDITION ON LOT 22, BLOCK 13, B~IARWOOD ESTATES ADDITION (LOCATED AT 7520 BRENTWOOD COURT) CARRIED OVER FROM 2/20/97 APPROVED Chairman Duer opened the public hearing and asked the applicant to come forward. Mr. Marshall Valentino, applicant, explained that lack of suitable parking for family members required them to park in the street. The Valentino's believe this creates a hardship for the neighbors directly across the street since it partially blocks their driveway and, also creates a hazard for the children playing in the cul-de-sac. Mr. Valentino wanted to build a carport on the side of his house, but 2 it would extend into the required side yard set back. The carport would only be one foot from the side property line. Mr. Valentino stated he did not have a problem putting guttering on three sides of the carport if so desired. Mr. LeBaron informed the Commissioners that a letter from one of the Valentino's neighbors had been received in support of this variance request. Chairman Duer asked for any additional proponents. There being none, Chairman Duer called for any opponents. There being none the public hearing was closed. Mr. Young made the motion to approve BA 97-05. The motion was seconded by Mr. Bellomy and carried 4 - O. 6. REQUEST OF MELANIE COMBS TO VARY FROM THE MINIMUM FRONT BUILDING LINE REQUIREMENT FOR A FENCE ON LOT 1, BLOCK 1, COMBS ADDITION (LOCATED AT 7152 HIGHTOWER DRIVE) CARRIED OVER FROM 2/20/97 APPROVED Chairman Duer opened the public hearing and asked the applicant to come forward. Ms. Melanie Combs, applicant, explained that she wanted to put a fence up in her front yard to keep her kids inside her yard. Additionally she stated that she would most likely put the fence five feet further in than originally anticipated to avoid having it torn down and replaced at the time of Hightower Drive being widened. Ms. Combs submitted pictures of the fence she was intending to build on her property. Mr. Bellomy made the motion to approve BA 97-07. Mr. Schopper seconded the motion and it carried 4 - O. 7. REQUEST OF JIM TRUSTY TO VARY FROM THE OUTSIDE DISPLAY REGULATIONS ON LOT 1A, BLOCK D, RICH LAND OAKS ADDITION (LOCATED AT 4801 STRUMMER DRIVE) APPROVED Chairman Duer opened the public hearing and asked the applicant to come forward. Mr. Jim Trusty, applicant, stated that they want to sell outdoor lawn furniture that is too large to place indoors. He explained that there is a cyclone fence currently 3 around the perimeter of the yard. He is not opposed to placing a privacy fence in place of this cyclone fence. Additionally, Mr. Trusty stated that he has hired a contractor for the required masonry screening fence and the plans are being reviewed at Public Works at this time. Chairman Duer called for any additional proponents. There being none, Chairman Duer called for any opponents. There being none the public hearing was closed. In response to a question, Mr. Trusty stated that 30 days would be a sufficient amount of time for the masonry screening wall to be erected. Mr. Schopper made the motion to approve BA 97-06 subject to the backyard area requested for outdoor display only, and none of the furniture being visible from Bedford-Euless Road or Strummer Drive, and the masonry screening fence being erected in 30 days. Mr. Bellomy seconded the motion and it carried 4 - O. 8. REQUEST OF FIRST NATIONAL BANK OF TEXAS TO VARY FROM THE MINIMUM SIDE BUILDING LINE AS REQUIRED ON PLAT FOR A CANOPY ON LOT 1, BLOCK 17, SNOW HEIGHTS ADDITION (LOCATED AT 6851 N.E. LOOP 820) APPROVED Chairman Duer opened the public hearing and asked the applicant to come forward. Mr. Robert Harrison, Branch Manager for First National Bank of Texas, stated he would answer any questions the commission may have. In response to a question, Mr. Harrison explained that they were requesting a variance so they could add a canopy to cover a drive-up A TM, two commercial lanes and two regular drive-thru lanes. Mr. Harrison is in favor of this request. Mr. Bob Adams, Architect for Bank of Texas, showed a copy of the plans that had been submitted for their building permit. Mr. Adams is in favor of this request. Chairman Duer called for any additional proponents. There being none, Chairman Duer asked for any opponents. There being none, the public hearing was closed. Mr. Schopper made the motion to approve BA 97-08. 4 Mr. Bellomy seconded the motion and it carried. 4 - O. 9. REQUEST OF WILLIAM & LISA HALL TO VARY FROM THE REQUIRED COVERED PARKING SPACE FOR TURNING GARAGE INTO A BEDROOM ON LOT 11, BLOCK 12, RICHLAND HILLS WEST ADDITION (LOCATED AT 6601 ONYX DRIVE) APPROVED Chairman Duer opened the public hearing and asked the applicant to come forward. Mr. Hall, applicant, explained that they had hired a contractor to enclose his garage and stated they were both unaware that a permit was required. The Hall's are expecting their second child and need the additional bedroom for the new baby. Since their home was built in the early 1950's, they only have a single car garage. The Hall's submitted a packet which included a petition from neighbors supporting their request, detailed drawings of the enclosure and pictures of their home and the work that has been done. Additionally, there were pictures of homes along Onyx Drive and surrounding streets with garage enclosures as well. Mr. LeBaron informed the Commissioners that one of the Hall's neighbors had sent in a letter stating their support of this enclosure, and a copy of this letter had been included in the Commissioners packets. Chairman Duer asked for any additional proponents. Ms. Lori Wood, neighbor, was also in the audience and in favor of this request. There being no additional proponents, Chairman Duer asked for any opponents. There being none, the public hearing was closed. Mr. Young made the motion to approve SA 97-09. Mr. Schopper seconded the motion and it carried 4 - O. 10. REQUEST OF ALAN PARKER TO VARY FROM THE MINIMUM FRONT BUILDING LINE AS REQUIRED FOR A GARAGE ON LOT 31, BLOCK 11, MEADOW LAKES ADDITION (LOCATED AT 4709 GREENWAY COURT) APPROVED Chairman Duer opened the public hearing and asked the applicant to come forward. 5 Mr. Bill Fenimore, builder for the applicant represented this request. He explained that because of the lot configuration they were requesting a five foot variance from the front building line. Mr. Fenimore is in favor of this request. Chairman Duer asked for any additional proponents. There being none, Chairman Duer asked for any opponents. There being none, the public hearing was closed. Mr. Young made the motion to approve SA 97-10. The motion was seconded by Mr. Schopper and carried 4 - O. 11. STAFF REPORT There was nothing to report 12. CITIZEN COMMENTS There were none. 13.
