MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF
ADJUSTMENT OF THE CITY OF NORTH RICHlAND HillS, TEXAS
NOVEMBER 20,1997 -7:30 P.M.

CONSIDERATION OF MINUTES OF OCTOBER 16, 1997
APPROVED
Mr. Schopper made the motion to approve the minutes of the October 16, 1997
meeting. Chairman Duer seconded the motion and it carried 5 - o.
Chairman Duer explained that this board consists of five voting members and it
requires four affirmative votes in order for a variance to pass.

SA 97-35
REQUEST OF DERALD EVANS FOR A VARIANCE TO RECONSTRUCT A
CARPORT IN THE REAR BUILDING LINE SETBACK ON LOT 25, BLOCK 19,
RICHLAND HILLS WEST ADDITION. (LOCATED AT 6327 ONYX DRIVE
SOUTH)
APPROVED
Chairman Duer opened the public hearing and asked the applicant to come
forward.
Mr. Derald Evans, applicant, presented this request. Mr. Evans presented
pictures of the carport before it was rebuilt and pictures of the refurbished
carport. He explained this carport was rebuilt in the exact location as the
previous carport and he had spent approximately $250.00 on these repairs. He
replaced the rusted metal posts with new wood posts, which are inset 32" with
concrete, replaced shingles and updated its appearance. Mr. Evans stated he
does plan on rebuilding the house that was originally destroyed by fire.
Responding to a question, Mr. LeBaron stated that there is a 6' side building line
setback that is being encroached upon as well.
Chairman Duer called for any additional proponents. There being none, he
called for any opponents. Being none, the public hearing was closed.
Mr. Cypert stated that if in fact the carport was an existing structure and the
improvements did not exceed 50% of the value of the structure, he didn't believe
the variance could be denied.
Much discussion ensued between the Board members. They voiced concern
over the need for a carport on a lot that has no residential structure.
Mr. Cypert asked the applicant the reason the work was performed prior to a
permit being taken out.
Mr. Evans stated that Code Enforcement found him doing the work without a
permit. He was already setting the new posts when they stopped work. Mr.
Evans stated that construction of a new home at this location should commence
in January of 1998.
Mr. Cypert made the motion to approve BA 97-35.
Mr. Young seconded the motion and it carried 4 - 1. Mr. Schopper was
opposed.

REQUEST OF KELLY BEEBE FOR A VARIANCE FROM THE FRONT
BUILDING LINE SETBACK ON PROPERTY LOCATED ON LOT 49, BLOCK 1,
BRIDLEWOOD ESTATES ADDITION. (LOCATED AT 7713 BRIDLEWOOD
COURT)
APPROVED
Chairman Duer opened the public hearing and asked any proponents to come
forward.
Mr. Kelly Beebe, applicant, presented this request stating that his home is
currently under construction and every home on this street is built at a 20' front
building line. If he is required to conform to the 25' front building line, his house
will look out of place.
Chairman Duer called for additional proponents. Seeing none, he called for any
opponents. Seeing none the public hearing was closed.
Mr. Schopper made the motion to approve BA" 97-38.
Ms. Martin seconded the motion and it carried 5 - O.

REQUEST OF SANDRA L. SUDWISCHER TO ALLOW CONSTRUCTION OF A
CARPORT OVER THE FRONT BUILDING LINE ON LOT 5, KELLY ESTATES
ADDITION. (LOCATED AT 4309 KEN MICHAEL COURT)
APPROVED
Chairman Duer opened the public hearing and asked the applicant to come
forward.
Mr. Terry Battle presented the request for his wife. He stated that they were just
married last week, that they have 3 teenage children and a 1-car garage. They
are simply trying to protect some of their vehicles from the weather. Mr. Battle
explained that this home is approximately 45 years old. The carport will be 25'
from the street
Chairman Duer called for any additional proponents. Being none, he called for
any opponents. Being none, the public hearing was closed.
Ms. Martin made the motion to approve BA 97-39.
Mr. Cypert seconded the motion and it carried 5 - O.

BA 97-40
REQUEST OF PHILLIP HAYNES TO CONSTRUCT A CARPORT OVER THE
FRONT BUILDING LINE ON LOT 8, BLOCK 82, FOSTER VILLAGE
ADDITION. (LOCATED AT 6864 HICKORY HOLLOW LANE)
APPROVED
Chairman Duer opened the public hearing and asked the applicant to come
forward.
Mr. Phillip Haynes, applicant, presented this request. He explained that he had
his home built 10 years ago, very soon after being injured. At that time he had a
handicap-equipped mini-van and the garage was raised for it. However, the
mini-van is not able to handle the weight of his power-chair and they have
recently purchased a modified full-size van. This van will not fit into the garage.
The variance is being requested to allow a carport to be constructed to protect
Mr. Hayes from the weather. He explained that his wheelchair cost $22,000 and
repairs are costly. Mr. Haynes presented the Board members with a brochure
showing the proposed carport. He stated that it is an expensive carport that will
be taken with him should they ever sell this home.
Chairman Duer asked for additional proponents.
Mr. Ty Borgerman, 6861 Hickory Hollow Lane was in favor of this request.
Having no additional proponents, Chairman Duer asked for any opponents.
Being none the public hearing was closed.
Mr. LeBaron stated that 2 letters of opposition had been received.
Responding to a question, Mr. LeBaron stated that while it would be hard to
monitor, a variance could be granted requiring Mr. Haynes to remove the carport
when he sells or moves from the home.
The Board discussed the issue of setting a precedent since no carports currently
exist in this neighborhood; however, Mr. Haynes clearly has presented a
hardship because of his disability.
Mr. Cypert made the motion to approve BA 97-40 subject to the removal of the
carport should the Haynes ever move and/or sell their home.
Mr. Young seconded the motion and it carried 6 - O.
