HomeMy WebLinkAboutZBA 1996-06-20 Minutes , MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHlAND HillS, TEXAS JUNE 20, 1996 - 7:30 p.m. 1. CALL TO ORDER The meeting was called to order by Chairman Tom Duer at 7:30 p.m. 2. ROLL CALL PRESENT Chairman ZBA Members Dr. Tom Duer Billy Cypert Paul Young Jimmy Bellomy Perry Christensen ABSENT None CITY STAFF Planning Director Plans Examiner Barry LeBaron Gregory Arrington 3. CONSIDERATION OF MINUTES OF MAY 16, 1996 Mr. Bellomy made the motion to approve the minutes of the May 16, 1996 meeting as presented. The motion was seconded by Mr. Young. The motion carried 3-0, with Mr. Cypert and Mr. Christensen abstaining. Chairman Duer stated that the State law requires four affirmative votes for a variance request to pass, regardless of the number of members in attendance. He stated the Board consists of 5 voting members and 2 alternate members. ZBA Minutes - Page 2 20 June 1996 4. BA 96-23 REQUEST OF HENRI ECKHARDT TO ALLOW A CARPORT TO ENCROACH THE SIDE BUILDING LINE ON LOT R9A, BLOCK 34, HOLIDAY WEST ADDITION. (LOCATED AT 5732 WESTCHASE DRIVE) APPROVED Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Henri Eckhardt, 5732 Westchase Drive, came forward to speak. He presented a letter from his neighbor in support of the request. He stated he is seeking a variance to allow a carport in the back yard to encroach the side building line. Mr. Eckhardt stated the carport would be about one foot from the side fence. He stated the lot is very small and has several trees and a storage building in the rear. Chairman Duer asked if most of the carports in the area are in the rear yard. Mr. Eckhardt stated yes. Chairman Duer read into the record a letter from Norita Sabito, 5730 Westchase Drive, in support of the request. Mr. Christensen asked how the water will run off the carport. Mr. Eckhardt stated a gutter will be installed and the water will run off into the yard. Mr. Christensen asked if there is concrete where the carport would be located. Mr. Eckhardt stated yes. Staff advised that Mr. Eckhardt has applied for a building permit. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Cypert made the motion to approve SA 96-23 as requested. The motion was seconded by Mr. Young. The motion carried 5-0. Mr. Christensen asked if staff would take care of any drainage requirements. Staff advised that they will address this issue at the time of permitting. ZBA Minutes - Page 3 20 June 1996 5. BA 96-24 REQUEST OF KATHY KIRKHAM TO ALLOW A PORCH COVER TO ENCROACH THE FRONT BUILDING LINE ON LOT 11, BLOCK 3, WOODLAND OAKS ADDITION. (LOCATED AT 6804 NOB HILL DRIVE) APPROVED Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Ms. Kathy Kirkham, 6804 Nob Hill Drive, came forward to speak. She stated they intend to extend the hip and ridge of the roof to extend the porch. She stated the columns of the cover would encroach the building line. Ms. Kirkham stated there is some room to work with since the lot has a curved building line. She stated the extension would enhance the value of the property. She stated she has spoken with some of her neighbors. She presented a letter from Sam Morrow, 6813 Nob Hill Drive, in support of the request. Chairman Duer asked what type of columns would be used. Ms. Kirkham stated the columns would be fluted aluminum. She stated she wants the cover to look like it was built when the house was constructed. She presented a copy of the plans from the contractor. Mr. Christensen asked if the columns would be placed on the existing patio. Ms. Kirkham stated the columns would have their own footings. Mr. David Barfield, 6821 Nob Hill Drive, came forward to speak. He stated his support for the request. He stated his concern over the number of cars on the street due to the day care Ms. Kirkham operates in her house. Mr. Bob Seago, 6801 Nob Hill Court, came forward to speak. He stated his opposition to the request. He stated the porch extension would make the house look too large for the lot and too close to the street. Mr. Christensen stated that if aesthetics is the concern, the homeowners association can address that if they have to approve all additions. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Bellomy made the motion to approve SA 96-24 subject to a seven foot encroachment.
