MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF
ADJUSTMENT OF THE CITY OF NORTH RICHlAND HillS, TEXAS
DECEMBER 17, 1996 - 7:30 p.m.

The meeting was called to order by Chairman Duer at 7:30 p.m.

CONSIDERATION OF MINUTES OF NOVEMBER 21, 1996
Mr. Cypert made a motion to approve the minutes of November 21, 1996, as
presented. The motion was seconded by Mr. Young. The motion carried 5 - o.
Chairman Duer stated that State law requires four affirmative votes for a
variance to pass, regardless of the number of members in attendance. He
stated the board consists of five voting members and all five members would
have to vote unanimously in order for a motion to carry. Chairman Duer also
stated the sound system was not working and asked each speaker to talk loud
enough for the minutes to be taken in the absense for an electronic recorder.

REQUEST OF GARY AND SONJA STARNES TO VARY FROM THE BRICK
COLUMN REQUIREMENT ON A WROUGHT IRON FENCE. (LOCATED AT
7500 DOUGLAS LANE)

Chairman Duer opened the public hearing and asked any proponents of this
request to come forward.
Mr. Gary Starnes, 7500 Douglas Lane, represented his request. He explained
that they were replacing a barbed wire fence and since all of his surrounding
neighbors have wrought iron fences without columns they were requesting same.
He explained this would keep the neighborhood consistent.
Chairman Duer called for any additional proponents, there being none, Chairman
Duer called for any opponents. There being none, he closed the public hearing.
Mr. Cypert made a motion to approve BA 96-45 as presented.
Mr. Christensen seconded the motion and carried 5 - O.

BA 96-46
REQUEST OF BETTYE AND HARLEY PIERCE TO ALLOW A CARPORT TO
EXTEND BEYOND THE FRONT BUILDING LINE. (LOCATED AT 4904
COLORADO BOULEVARD)
APPROVED
Chairman Duer opened the public hearing and asked for any proponents to
come forward.
Mr. Harley Pierce, 4904 Colorado Blvd., represented his request. He explained
that they were putting a 20 x 20 carport in front of the garage and it would extend
8' past his house. This carport will cover the existing driveway only and will be
22' from the road.
Chairman Duer and Mr. Cypert questioned the applicant about how far from the
side property line the proposed carport would be located. Mr. Pierce said he
wanted to build it five feet from the side property line. Chairman Duer stated a
side yard variance would be required since the zoning requires a minimum of six
feet. No neighbors had been notified of any side yard variance request. Mr.
Pierce stated he would keep it back six feet from his side property line.
Mr. Cypert made a motion to approve BA 96-46 with a 20' maximum
encroachment on the front building line.
Mr. Young seconded the motion and the vote carried 5 - o.

REQUEST OF TOM BA TENHORST TO ALLOW A SIDE YARD BUILDING
LINE ENCROACHMENT FOR A BUILDING ADDITION TO AN EXISTING
STRUCTURE. (LOCATED AT 7291 GLENVIEW DRIVE)

Chairman Duer opened the public hearing and called for any proponents wishing
to speak.
Mr. Tom Batenhorst, 7291 Glenview Drive, represented his request. He
explained that due to anticipated growth within his company he will be expanding
his existing structure. He explained that in 1993 this same board had considered
and approved a building line encroachment on this existing structure. Mr.
Batenhorst presented the board with a small drawing showing his proposed
building layout. He is requesting the side yard variance on the proposed building
so that it will match the existing building. He believes there will be no visual
impact on the street and foresees no problem with the additional required
parking spaces.
Chairman Duer called for any additional proponents. There being none,
Chairman Duer called for any opponents. There being none the public hearing
was closed.
Mr. Schopper made a motion to approve BA 96-47 as presented.
Mr. Christensen seconded the motion and the vote carried 5 - O.

SA 96-41
REQUEST OF NEAL NELSON TO VARY FROM THE PARKING LOT PAVING
REQUIREMENTS. (LOCATED IN THE 6800 BLOCK OF DAVIS BLVD.)

Chairman Duer opened the public hearing and called for any proponents.
Mr. Neal Nelson, 7101 Hazel Place, NRH, represented his request. He
explained that they had been tabled at the previous ZBA meeting and has totally
reconfigured his proposal. Mr. Nelson understands how the citizens living on
Odell Street feel and is willing to work with the Commission to ensure these
residents are appeased.
Mr. Nelson explained that in his new proposal, there will be no access from Odell
Street. The entire length of Odell will be fenced and landscaped. Flex Base 2,
a dust free gravel is proposed instead of asphalt. He explained they plan on
planting Red Tip Photynia's along the sight barring fence on Odell and are open
to any suggestions that will help appease the neighbors on this street.
Chairman Duer explained that he believes in a lot of landscape and encourages
the Nelson's to incorporate alot of "greenery" into this location.
Mr. Christensen stated that the money they would be saving on the asphalt,
should this request be granted, could go towards screening and greenery along
Odell.
Mr. Schopper felt the new configuration was wonderful and applauded the
Nelsons for the time they had apparently put into it.
Chairman Duer called for any additional proponents.
Mrs. Penny Nelson, 7101 Hazel Place, stated that they were anxious to get their
business going. She explained they had invested a lot of time in this project and
were willing to do anything to please the Odell Street residents.
There being no additional proponents, Chairman Duer called for any opponents.
Ms. Ann Autry, 8229 Odell Street, believes the Nelson's should be required to
put up a masonry screening wall along Odell Street. She doesn't want to stand
on her front porch and look at R.V.'s.
The Commission explained that the zoning currently allows this use, and if the
Nelson's hadn't been requesting a variance on the paving requirements, they
could have already moved in and opened.
Mr. Lowell Autry, 8229 Odell Street, believes there is no safety in a chain link
fence and thinks they should use a wooden fence or masonry fence. Mr. Autry
believes they were cheated when this zoning was changed to Industrial in the
past.
Ms. Helen Carpenter spoke on behalf of her mother, Lillian Allen, 8217 Odell
Street, and believes that the gravel will create undue dust and wants them to
asphalt the parking lot.
There being no additional Opponents, Chairman Duer closed the public hearing
and asked Mr. Nelson if he would like to address any of the issues brought out
this evening.
Mr. Nelson explained again that he understands these concerns and would feel
the very same way. He believes a cyclone fence with slats in it would be more
pleasing. He believes a wooden fence or masonry fence would inhibit plant
growth. They would like to put up a 6' cyclone fence with slats and plant Red Tip
Photynia's along Odell Street, but stated that he would do whatever the
Commission so desires.
Ms. Nelson stated that the area is currently pure sand and believes the flex base
2 gravel will actually keep the area from being as dusty. At there current location
in Colleyville, very little dust is generated and this was a detefmining factof in
choosing this type material.
Mr. Pefry made a motion to approve BA 96-41 with the Flex Base 2, dust free
gravel, with a greenbelt along Davis Blvd and Odell Street and an 8' sight baffing
fence with vegetation that will gfow in height.
Mf. Young seconded the motion and it carried 5 - O.
