BA 95-03 MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICH LAND HillS, TEXAS February 16, 1995 - 7:30 p.m. The meeting was called to order by Chairman Tom Duer at 7:30 p.m. PRESENT Chairman Members Dr. Tom Duer Billy Cypert Bill Schopper Robert Skinner Perry Christensen Barry LeBaron Clayton Husband Gregory Arri ngton Randy Shiflet Jim Grant Planning Director Planner Plans Exam i ner Asst. City Manager ABSENT Mr. Skinner made the motion to approve the minutes as presented. The motion was seconded by Mr. Cypert. The motion carried 4-0, with Mr. Christensen abstaining due to absence at the previous meeting. Chairman Duer stated that the State law requires four affirmative votes for a variance request to pass, regardless of the number of members in attendance. He stated the Board consists of 5 voting members and 2 alternate members. Request of Maplewood Baptist Church to vary from the off-premise advertising requirement on Lot 12, Block 12, Richland Terrace Addition, to allow a pole sign on Davis Boulevard. This property is located at 5013 Davis Boulevard. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Tony Coburn, pastor of Maplewood Baptist Church, came forward to speak. He stated the church is on Maplewood Avenue. He stated the owner of a new business on Davis Boulevard has offered to place a directional sign on their sign indicating an additional entrance to the church. He stated the church and the business have parking lots adjacent to each other. He stated the sign will also have a reader board. Mr. Coburn stated the business will pay for the sign and maintain the sign. He stated the sign is a gift to the church. Chairman Duer asked if there was a fence between the properties at one time. Mr. Coburn stated yes. He stated the sign will give the church more visibility. He stated the church is used by many community groups, including being used as a voting site. Chairman Duer asked if the business has checked with the city to see if they have enough frontage to allow an additional sign. Mr. LeBaron stated the existing sign does meet the requirements of the city. He stated by adding the church sign, the signs will exceed the allowable square footage by one foot. Chairman Duer asked if the business has put in writing their intention to maintain the sign. · ZBA .Min'-ltes - Page 2 16 February 1995 Mr. Coburn stated yes. There being no one else wishing to speak, Chairman Duer closed the public hearing. Mr. Schopper made the motion to approve BA 95-03 as requested. The motion was seconded by Mr. Cypert. The motion carried 5-0. 2. BA 95-04 Request of Bill Fenimore to vary from the side building line requirement on Lot 33, Block 11, Meadow Lakes Addition, to allow side yards of six feet on each side. This property is located at 4717 Greenway Court. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Bill Fenimore, 6041 Riviera Drive, came forward to speak. He stated he is seeking a variance from the side building lines to allow six foot side yards. He stated the lots are very narrow and the extra four feet would make the lot more usable. Mr. Fenimore stated he intends to construct his home on this lot. He presented a proposed house plan for the property. He stated he intends to build a front-swing garage. There was general discussion regarding the proposed house. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Cypert made the motion to approve BA 95-04 as requested. The motion was seconded by Mr. Christensen. The motion carried 5-0. 3. BA 95-05 Request of Mitchell Baxter to vary from the side building line requirement Lot 32, Block 11, Meadow Lakes Addition, to allow side yards of six feet on each side. This property is located at 4713 Greenway Court. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. BA 95-06 Request of Ted Gray to allow a carport and porch cover to encroach the front building line on Lot 9, Block 5, Emerald Hills Addition. This property is located at 8000 Donegal Lane. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at th is time. Mr. Ted Gray, 8000 Donegal Lane, came forward to speak. He stated he would like to place an awning on his front porch and a carport on his driveway. ...ZBA Min'-ltes - Page 3 16 February 1995 Chairman Duer asked if the garage has been converted into a room. Mr. Gray stated no. He stated there is a carport several doors down. Mr. Skinner asked when Mr. Gray bought the house. Mr. Gray stated in November 1994. Mr. Christensen asked Mr. Gray to explain the problem around the front porch area. Mr. Gray stated that the water from the roof drains onto the flower bed and front porch area. He stated he would like to cover the front porch area and add tile to the porch. Mr. Skinner asked if Mr. Gray had submitted any plans for the porch cover. Mr. Gray stated he has shown the cover on the site plan. Mr. Christensen asked what type of roof the cover would have. Mr. G ray stated a metal roof. Mr. Ch ristensen asked where the water wou Id go. Mr. Gray stated the cover and the carport would have rain gutters. There was general discussion regarding the porch cover. Chairman Duer asked if only the porch cover is approved, would the cover be unsightly. Mr. Gray stated he did not think so. Mr. Cypert asked if the existi ng carport was perm itted. Mr. LeBaron stated no. Mr. Schopper stated the Board required a carport to be removed on Emerald Hills Way. He stated a perm it was not issued for that carport. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Christensen asked if any correspondence was received regarding this case. Mr. Husband stated no. Mr. Christensen asked if there is a ban on carports in the city. Mr. Husband stated no, that most people build carports at the rear or side of the house. He stated they cannot construct a carport over the front building line without approval from the Board of Adjustment. Mr. Cypert stated this area does not have many carports, and he would not like to see a proliferation of them in an area without them. Chairman Duer made the motion to approve BA 95-06 subject to the following: to allow the porch cover to extend five feet beyond the front building line, and to allow the porch cover to extend to the end of the house across the driveway if desired by the applicant.
