BA 95-20 MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HillS, TEXAS July 20, 1995 - 7:30 p.m. The meeting was called to order by Chairman Tom Duer at 7:30 p.m. Mr. Paul Young took the oath of office as a new member of the Zoning Board of Adjustment. PRESENT Chairman Members Dr. Tom Duer Billy Cypert Bill Schopper Jimmy Bellomy Perry Christensen Paul Young Barry LeBaron Gregory Arri ngton Clayton Husband Planning Director Plans Examiner Planner Mr. Cypert made the motion to retain the current officers of Tom Duer, Chairman, and Robert Skinner, Vice-Chairman. The motion was seconded by Mr. Christensen. The motion carried 7-0. Mr. Cypert made the motion to re-appoint Clayton Husband as recording secretary for the Board. The motion was seconded by Mr. Skinner. The motion carried 7-0. Mr. Skinner made the motion to approve the change to the Rules of Procedure that would require officer elections in July rather than January. The motion was seconded by Mr. Bellomy. The motion carried 7-0. Mr. Bellomy made the motion to approve the minutes as presented. The motion was seconded by Mr. Cypert. The motion carried 5-0, with Mr. Christensen and Mr. Young abstaining due to absence at the previous meeting. Chairman Duer stated that the State law requires four affirmative votes for a variance request to pass, regardless of the number of members in attendance. He stated the Board consists of 5 voting members and 2 alternate members. Request of Billie Cross to allow a carport to encroach the front building line by four feet on Lot 26, Block 8, Hillview Addition. This property is located at 6804 Briley Drive. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at th is time. Mr. Odell Cross, 6804 Briley Drive, came forward to speak. He stated one side of the garage has a utility room built into it and a car will not fit into that side of the garage. He stated he wants to construct a carport to protect the cars. Mr. Skinner asked what was in the garage. ZSA MLnutes - Page 2 · 20 July 1995 Mr. Cross stated a utility room was constructed some time ago. He stated the room has a washer and dryer with some shelving and a closet. Mr. Skinner asked of what materials the carport would be constructed. Mr. Cross stated the carport would be steel construction with ornamental iron posts. He stated they will eventually build a wrought iron fence from the drive to the front door. Mr. Skinner asked if there are any other carports on the block. Mr. Cross stated he does not remember any on that street, but there are some on other streets in the area. He stated a petition in support of the request was submitted at the time of application. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Bellomy made the motion to approve BA 95-20 as requested. The motion was seconded by Mr. Schopper. The motion carried 5-0. 2. BA 95-21 Request of Susan Ayers to vary from the side yard setback requirements on Lot 25, Block 11, Meadow Lakes Addition, to allow side building lines of six feet on each side. This property is located at 4712 Greenway Court. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Ms. Susan Ayers, 6651 Watauga Road, came forward to speak. She stated Mr. Ben Gardner will be representing her in this request. Mr. Bennet Gardner, 6651 Watauga Road, came forward to speak. He stated the lot is 70- feet wide and backs up to the driving range. He stated they would like to maximize the width of the house since the garage will be similar to others in the neighborhood. Mr. Gardner presented a working floor plan of the house. Mr. LeBaron stated that staff received a letter in opposition, but the objection was later withdrawn. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Schopper made the motion to approve BA 95-21 as requested. The motion was seconded by Mr. Bellomy. The motion carried 5-0. 3. BA 95-22 Request of Chick-Fil-A to allow a canopy sign to extend two feet above the top of the canopy on Lot 6, Block 4, Tapp Addition. This property is located at 5131 Rufe Snow Drive. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. John Dancer, IMC Construction, contractor for Chick-Fil-A, came forward to speak. He stated the sign designed on the awning extends above the top of the canopy. He stated the sign is designed into the canopy. He presented pictures of the same type of canopy to the Board. He stated the canopy has been built at other stores in Texas. Mr. Christensen asked if the canopy extended above the roof. ZSA Minutes - Page 3 20 July 1995 Mr. Dancer stated no. He stated the canopy is internally lit. He stated the canopy will replace the wall sign on this portion of the building. Chairman Duer asked if they would be before the Board if the canopy did not have a Chick- Fil-A sign on it. Mr. LeBaron stated no. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Christensen made the motion to approve BA 95-22. The motion was seconded by Mr. Skinner. The motion carried 5-0. 4. BA 95-23 Request of Richard Rhodes to vary from the minimum commercial parking requirements on Lot 1, Block 1, Smithfield Storage Addition. This property is located at 7510 Smithfield Road. Chairman Duer stated this item has been withdrawn by the applicant. 5. BA 95-24 Request of James Scibek to allow a garage enclosure without providing the required covered parking on Lot 9, Block 8, Stonybrooke Addition. This property is located at 7104 Stonybrooke Drive. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at th is time. Mr. James Scibek, 7104 Stonybrooke Drive, came forward to speak. He stated the garage was enclosed into a bedroom several years ago. He stated he is refinancing his house, and he was told by the mortgage company to get a permit for the enclosure. He stated a permit cannot be issued unless covered parking is constructed. Mr. Scibek stated that the lender would accept an official variance from the city. Chairman Duer stated the Board is always concerned about the appearance of a neighborhood when garages are enclosed. Mr. Skinner asked what was behind the garage doors. Mr. Scibek stated there is a bedroom with a closet. He stated the walls have been paneled. Mr. Skinner asked where the hot water heater was located. Mr. Scibek stated it is in a closet in that bedroom where it was originally built in. Mr. Skinner asked if additional electric outlets were added to the room. Mr. Scibek stated yes. Chairman Duer asked if there are provisions that a city inspector can go out an see if the enclosure was built according to code. Mr. LeBaron stated without removing the sheetrock, it is difficult to determine the types of wiring and the location and number of framing members. Mr. Christensen asked if there is a required number of electrical outlets a room should have. Mr. Cypert asked if an inspector could do a visual inspection and check to see if the outlets were wired correctly. ZSA Mjnutes - Page 4 20 July 1995 Mr. Christensen asked if a ceiling fan was installed. Mr. Scibek stated yes. Chairman Duer asked who did the conversion. Mr. Scibek stated himself and his father-in-law. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Skinner asked Mr. Husband if he knew the garage was enclosed when Mr. Scibek appl ied for the variance. Mr. Husband stated no. Mr. Schopper stated he has no problem with the enclosure but he would have a problem with the applicant coming back later to ask for a carport. Chairman Duer there are no carports in the area. Mr. Scibek stated that the hardware for the garage doors are in the attic and can be rei nstalled if the house ever sells. Mr. Skinner made the motion to approve BA 95-24 for the garage enclosure, the city shall send out an inspector for a visual inspection of the enclosure, and the variance from covered parking not be approved. Chairman Duer stated that approving the variance will exempt this property from covered parking. He stated denying the variance will require him to construct covered parking right now. Mr. LeBaron stated the reason the appl icant is here is because he does not have covered parki ng. Mr. Skinner withdrew his previous motion and made the motion to approve BA 95-24 for the garage enclosure, and the city shall send out an inspector for a visual inspection of the enclosure. The motion was seconded by Mr. Christensen. The motion carried 4-1, with Chairman Duer, Mr. Skinner, Mr. Cypert, and Mr. Bellomy voting for, and Mr. Schopper voting against. 6. BA 95-25 Request of Summit National Bank to allow an addition to the building to encroach the side building line by 14-feet on Lot 2R, Block 4, University Plaza Addition. This property is located at 1530 Weyland Drive. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Bob Frank, 3732 Fenton Avenue, Fort Worth, came forward to speak. He stated he is the contractor for Summit National Bank. He stated he is seeking a variance to allow a commercial drive-through window to encroach the building line. He stated there is not a commercial window at the facility. Chairman Duer asked where the commercial lane would be located. Mr. Frank stated on the west side of the building, between the building and Weyland Drive. ZSA M";nutes - Page 5 20 July 1995 Chairman Duer asked how persons will drive into the bank. Mr. Frank stated a lane will be added from the existing parking lot. He stated they will have to add additional parking spaces. He stated the canopy will match the existing canopies in appearance. Mr. Christensen asked if a building permit has been applied for. Mr. Frank stated no. Mr. Skinner asked why the expansion could not be done in the other direction. Mr. Frank stated the north side of the building is only 12-feet wide, which is not wide enough to put in a window and drive through. Mr. Skinner asked where the main bank building is. Mr. Frank stated it is in the Nowlin Building. Chairman Duer asked if there is any construction proposed for the vacant property. Mr. Frank stated the bank has an option on the property but no plans for any new building. Mr. Schopper asked what will happen to the oak trees located next to the drive lanes. Mr. Frank stated they will lose up to two trees. Mr. Schopper asked if the trees could be moved. Mr. Frank stated the owner of the building has a tree mover, so the trees could be moved. Mr. Bellomy asked where the entrance to the window would be located. Mr. Frank stated there would be an extension from the existing lanes around the building. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Skinner asked if the building would be 21-feet from the street. Mr. Frank stated yes. Mr. Husband stated there is also a 10-foot water line easement along the property at that location. Mr. Schopper made the motion to approve BA 95-25, with the requirement that any trees removed for the construction are relocated on the property. The motion was seconded by Mr. Skinner. The motion carried 5-0. CITIZEN COMMENTS Mr. Skinner asked for an update on BA 94-19 and Mr. Voyles at the next meeting.
