BA 95-26 MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICH lAND HillS, TEXAS AUGUST 17, 1995 - 7:30 p.m. The meeting was called to order by Acting Chairman Bill Schopper at 7:30 p.m. PRESENT Acting Chairman Members Bill Schopper Billy Cypert Paul Young Jimmy Bellomy Barry LeBaron Steve Pence Gregory Arrington Clayton Husband Dr. Tom Duer Robert Skinner Perry Ch ristensen Planning Director Building Official Plans Examiner Planner ABSENT Mr. Cypert made the motion to approve the minutes as presented. The motion was seconded by Mr. Young. The motion carried 4-0. Acting Chairman Schopper stated that the State law requires four affirmative votes for a variance request to pass, regardless of the number of members in attendance. He stated the Board consists of 5 voting members and 2 alternate members. Request of Joyce Auerbach to allow a carport to encroach the 25-foot front building line on Lot 3, Block 15, Richland Hills West Addition. This property is located at 3609 Venice Drive. Acting Chairman Schopper opened the Public Hearing and called for those wishing to speak to come forward at this time. Ms. Joyce Auerbach, 3609 Venice Drive, came forward to speak. She stated the carport will not be metal or have a flat roof. She stated it wi II be constructed to look I ike it is part of the original structure. She stated her next door neighbor has submitted a letter in support of the request. She requested that the Board approve the request. There being no one else wishing to speak, Acting Chairman Schopper closed the Public Heari ng. Mr. Cypert asked how far the carport would encroach the front building line. Mr. LeBaron stated they went to verify the measurements this afternoon. He stated the portion of the garage is set back about nine feet behind the front building line. He stated the carport would encroach approximately eleven feet over the building line. Mr. Cypert made the motion to approve BA 95-26 as requested. The motion was seconded by Mr. Bellomy. BA 95-27 Request of Deborah Tribble to allow a carport to encroach the side and rear building lines on Lot 52, Block 4, Fossil Creek Trails Addition. This property is located at 6033 Riviera Drive. Acting Chairman Schopper opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Arthur Tribble, 6033 Riviera Drive, came forward to speak. He stated the carport would be located at the northeast corner of the lot. He stated a creek is behind the house. He stated there are no houses to the rear. Mr. Tribble stated there are five other similar carports on the street. He stated the lots are not very deep, and it is difficult to make the turn into a rear entry garage. There being no one else wishing to speak, Acting Chairman Schopper closed the Public Heari ng. Mr. Young asked if the carport location would allow enough room to pull into the garage. Mr. Tribble stated yes. Mr. Cypert asked if the carport would encroach into the flood plain. Mr. LeBaron stated he does not think so because the lot is quite higher than the creek level. Mr. Cypert made the motion to approve BA 95-27 as requested. The motion was seconded by Mr. Bellomy. The motion carried 4-0. 3. BA 95-28 Request of Bill Norman to vary from the side building line requirement on Lot 26, Block 11, Meadow Lakes Addition. (Located at 4708 Greenway Court) Acting Chairman Schopper opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Bill Fenimore, 6041 Riviera Drive, came forward to speak. He stated they are requesting six-foot side yards to take advantage of the golf course view. He stated the house will have a front swing driveway. He stated this lot is not 70-feet wide. There being no one else wishing to speak, Acting Chairman Schopper closed the Public Heari ng. Mr. Bellomy made the motion to approve BA 95-28. The motion was seconded by Mr. Young. The motion carried 4-0. 4. BA 95-29 Request of Ricky Brown to vary from the side building line requirement on Lot 11, Block 4, Meadow Lakes North Addition. (Located at 6024 Iron Horse Drive) Acting Chairman Schopper opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Brent Barrett, the owner of the lot, came forward to speak. He stated the lot abuts the golf course and they want to take advantage of the view. There being no one else wishing to speak, Acting Chairman Schopper closed the Public Heari ng. Mr. Cypert made the motion to approve BA 95-29. The motion was seconded by Mr. Bellomy. BA 95-30 Request of Mella Irvin to allow a fence to encroach the front building line on Lots 17R and 18R, Block 2, Stonybrooke South Addition. (Located at 8406 Ruthette Drive) Acting Chairman Schopper opened the Public Hearing and called for those wishing to speak to come forward at th is time. Acting Chairman Schopper stated it appears that the applicant is not in attendance. He asked if the Board could consider the case without the applicant present. Mr. LeBaron stated the Board is fully entitled to act on the case; however, the Board has customarily tabled the item to give the applicant a chance to respond. Acting Chairman Schopper stated there are persons who wish to speak against the request, but may not be able to attend the next meeting. Mr. Husband stated the Board could hold the public hearing to hear the testimony, then table the hearing until the next meeting. He stated the speakers comments would be recorded in the minutes as official testimony of the case. Mr. Cypert stated he would probably vote to table the item in fairness to the applicant. Mr. Young stated he agreed with Mr. Cypert's comments. Mr. Bellomy stated the Board should consider the case tonight. Ms. Christie Frick, 8402 Ruthette Drive, came forward to speak. She stated the fence wi II block the view of her house from the entrance to the cui de sac. She requested that the Board disapprove the fence. Mr. Erasto Siller, 8409 Ruthette Drive, came forward to speak. He stated his opposition to the req uest. Mr. Cypert made the motion to table BA 95-30 until the next regular scheduled meeting of the Board, and that the public hearing remain open until that time. The motion was seconded by Mr. Young. The motion carried 3-1, with Mr. Bellomy, Mr. Young, and Mr. Cypert voting for, and Mr. Schopper voting against. 6. BA 95-31 Request of Summit National Bank to vary from the sign location and spacing requirements on Lot 2R, Block 4, University Plaza Addition. (Located at 9001 Airport Freeway) Acting Chairman Schopper opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Bob Frank, 3732 Fenton Avenue, Fort Worth, came forward to speak. He stated the bank wishes to place a sign on the property. He stated they have 64-feet of frontage and want to construct a 128-square foot sign. He stated there is an existing sign on the property which dictated the need for the variance request. Acting Chairman Schopper asked if the property will be platted. Mr. Frank stated they would agree to plat the property. He stated he has spoken with Mr. LeBaron. There being no one else wishing to speak, Acting Chairman Schopper closed the Public Hearing. ZSA Miputes - Page 4 .. 17 Âugust 1995 Mr. Young asked where the sign would be located.
