MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICH LAND HillS, TEXAS
SEPTEMBER 21, 1995 - 7:30 p.m.
The meeting was called to order by Chairman Tom Duer at 7:30 p.m.

Mr. Bellomy made the motion to approve the minutes as presented. The motion was
seconded by Mr. Young. The motion carried 3-0, with Dr. Duer, Mr. Skinner, and Mr.
Ch ristensen abstai n i ng.
Chairman Duer stated that the State law requires four affirmative votes for a variance request
to pass, regardless of the number of members in attendance. He stated the Board consists of
5 voting members and 2 alternate members.
Request of Mella Irvin to allow a fence to encroach the front building line on Lots 17R and
18R, Block 2, Stonybrooke South Addition. (Located at 8406 Ruthette Drive)

Chairman Duer opened the Public Hearing and called for those wishing to speak to come
forward at this time.
Ms. Mella Irvin, 8406 Ruthette Drive, came forward to speak. She stated she owns two lots,
one with a house. She stated the city stopped work on her fence because it is too close to
th e street.
Chairman Duer asked if she understands the concept of building lines.
She stated no.
Mr. Skinner asked if she is putting up the fence herself.
Ms. Irvin stated she is getting help from a friend from work.
Mr. Skinner asked if the rear yard was fenced.
Ms. Irvin stated yes.
Mr. Skinner stated all fences must be located on building lines.

Chairman Duer stated the lot is on a cui de sac, and the building line follows the curvature
of the lot. He asked where sidewalks are placed in relation to the property line.
Mr. Husband stated the edge closest to the house is usually placed on the property line.
Ms. Irvin stated there is no sidewalk in front of her property.
Chairman Duer asked how far away the posts are from the property line.
Ms. I rvi n stated about twenty feet.
There was general discussion regarding the fence location.
Mr. Christensen asked how far the posts are from the building line.
Mr. Husband stated approximately 20-22 feet in front of the building line.
Mr. Skinner stated he has obtained a copy of the ordinance as it relates to structures and
building lines.
Chairman Duer stated the Board tries to keep their decisions in accordance to what is
considered the norm in a neighborhood. He asked if it was acceptable to place the fence
ten-feet beh i nd the property line.
Mr. Husband stated that property lines are usually located about 10-feet from the face of the
curb.
Chairman Duer stated he could agree to ten feet from the property line, which would give
the applicant a 15-foot encroachment of the building line.
Mr. Skinner made a motion to postpone this request until the end of the meeting so Ms.
Irving could speak with Mr. Pence to discuss exactly what the regulations regarding fences
state. The motion was seconded by Mr. Schopper.
Chairman Duer stated that Mr. Cypert is now in attendance at the meeting.
2. BA 95-32
Request of Bob Frank to vary from the side building line requirements on Lot 12, Block 4,
Meadow Lakes North Addition. (Located at 6020 Iron Horse Drive)
Chairman Duer opened the Public Hearing and called for those wishing to speak to come
forward at this time.
Mr. Bob Frank, 3732 Fenton Avenue, Fort Worth, came forward to speak. He stated they
want to construct a wider house to take advantage of the golf course view. He stated the
owner intends to construct a front swing garage.
There being no one else wishing to speak, Chairman Duer closed the Public Hearing.
Mr. Schopper made the motion to approve BA 95-32. The motion was seconded by
Mr.Bellomy. The motion carried 5-0.

HEARING CONTINUED
Request of Trent Atkinson to allow a fence to be constructed beyond the 25-foot side
building line on Lot 12R, Block 1, Coventry Place Estates. (Located at 7301 Coventry Circle)
Chairman Duer opened the Public Hearing and called for those wishing to speak to come
forward at this time.
Mr. Trent Atkinson, 7301 Coventry Circle, came forward to speak. He stated he wants to
move the fence 15-feet into the side yard. He stated the neighbors have no problem with the
fence being moved.
Chairman Duer asked where the driveway at the house to the west is located.
Mr. Atkinson stated it is on the side closest to his house. He stated the proposed location of
the fence would not interfere with his neighbor backing into the street.
There was general discussion regarding the proposed location of the fence.
Chairman Duer stated that the current ordinance only requires a 20-foot setback on corner
lots. He stated this lot has a 25-foot side setback. He stated his concerns are the visibility in
the street for the cars backing out of the driveway and ch i Id safety.
Mr. Young asked what the distance is between the property line and the curb.
Mr. Husband stated about 9.5-feet.
Chairman Duer stated he could support an encroachment of 10-feet beyond the existing
building line.
There being no one else wishing to speak, Chairman Duer closed the Public Hearing.
Chairman Duer made the motion to approve BA 95-33, subject to the fence being located
10-feet beyond the existing side building line. The motion was seconded by Mr. Young.
The motion carried 5-0.
Request of Mella Irvin to allow a fence to encroach the front building line on Lots 17R and

Mr. Skinner asked if Ms. Irvin understands the reasoning for building lines.
Ms. Irvin stated yes. She stated she would like to move the fence back ten feet from the
property line.
Chairman Duer stated she will have to move the existing posts back to that location if this
case is approved.
Mr. Cypert stated that city staff is always willing to come out and help the citizens, and they
can come out and help measure the property line if necessary.
Mr. Schopper stated that the property line is generally ten feet behind the curb.
There being no one else wishing to speak, Chairman Duer closed the Public Hearing.
Mr. Schopper made the motion to approve SA 95-30 subject to the fence being set back 20-
feet behind the curb, following the curvature of the lot. The motion was seconded by Mr.
Skinner. The motion carried 5-0.
