BA 94-02 ~ MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICH LAND HILLS, TEXAS February 17, 1994 - 7:30 p.m. The meeting was called to order by Vice-Chairman Robert Skinner at 7:30 p.m. PRESENT Vice-Chai rman Members Robert Ski n ner Billy Cypert Jim Grant Bill Schopper Perry Christensen Barry LeBaron Steve Pence Clayton Husband Gregory Arrington Steve Ingham Dr. Tom Duer Plan/Insp. Dir Building Official Planner Plans Examiner ABSENT Mr. Cypert made the motion to approve the minutes as presented. The motion was seconded by Mr. Christensen, and the motion carried 4-0, with Mr. Grant abstaining due to absence at the previous meeting. Vice-Chairman Skinner stated law requires four affirmative votes for a variance request to pass. Request of Roger Dennis for a variance from the Zoning Ordinance No. 1874 on Lot 12R, Block 4, Coventry Place Addition, to allow a portable building in a corner side yard. This property is located at 7220 Coventry Circle. Vice-Chairman Skinner opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Roger Dennis, 7220 Coventry Circle, came forward to speak. He stated he wishes to place the portable building at the side of the house. He stated the only place to place the building legally is obstructed by trees. Mr. Cypert asked what type of construction the bu i Id i ng is. Mr. Dennis stated it is a kit building. Mr. Cypert asked how tall the building would be when finished. Mr. Dennis stated seven feet. Mr. Christensen asked if he was planning to place the building inside the building line according to the recent drawing submitted to the City. Mr. Dennis stated yes, but it would still encroach the front setback requirement. Mr. Cypert asked if he preferred the most recent submittal. ZBA Minutes - Page 2 17 February 1994 Mr. Dennis stated yes, it gives him more room for plants. He stated his concern with the first submittal was maintaining drainage on the property as required by the warranty on the house. Vice-Chairman Skinner asked if he was pouring a slab for the building. Mr. Dennis stated no, it would be on a steel foundation. There being no one else wishing to speak, Vice-Chairman Skinner closed the Publ ic Heari ng. Vice-Chairman Skinner asked if there was any correspondence about this case. Mr. Husband stated no. Vice-Chairman Skinner stated he prefers the most recent submittal. Mr. Schopper made the motion to approve BA 94-02. The motion was seconded by Mr. Cypert. Mr. Christensen offered an amendment to the motion to include approving the second proposal of placing the building next to the house. Mr. Schopper accepted the amendment to the motion. Mr. Cypert seconded the amended motion, and the motion carried 5-0. 2. BA 94-03 Request of Martin Schelling for a variance from the Zoning Ordinance No. 1874 on Lot 30, Block 1, Steeple Ridge Addition, to allow a house to be built across the front building line, and to vary from the rear yard open space requirement. This property is located at 8554 Kensington Court. Vice-Chairman Skinner opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Martin Schelling, of Wright Development, 601 W Wall Street, Grapevine, came forward to speak. He stated the house plan before the Board is under contract to sell pending approval of the variance request. He stated the house is 2,280 square feet in size. He stated that houses in Steeple Ridge are averaging 2,600 to 2,800 square feet. Mr. Schelling stated it was very difficult to find a house plan to fit onto the lot. He stated the lot is in a cul-de-sac, and there are no apparent visbility problems with the proposed encroachment. He stated the side yard is very large, and the future owners would use that area as the primary rear yard. He stated they are trying to preserve as many trees as possible on the lot. Vice-Chairman Skinner asked if the trees on the lot was one of the primary reasons for choosing this lot configuration. Mr. Schelling stated yes, they are pushing the house to the north and west as much as possible. He stated the lot rises from the south. Vice-Chairman Skinner asked if the house was single-story. Mr. Schelling stated yes. Vice-Chairman Skinner asked how many square feet of the house would ZBA Minutes - Page 3 1 7 February 1994 encroach the front building line. Mr. Schelling stated that is the garage area. He stated it is approximately 24 square feet. He stated that looking at the house it would be very difficult to tell if the house encroaches. Mr. Pence stated they have estimate 12 square feet in the area that would encroach. Vice-Chairman Skinner asked if there are homes to the north and south of th is lot. Mr. Schelling stated yes, and the houses are occupied. He stated Lot 27 is vacant, and the remainder is occupied. There being no one else wishing to speak, Vice-Chairman Skinner closed the Publ ic Heari ng. Vice-Chairman Skinner asked if there was any correspondence regarding th is case. Mr. Husband stated he received one phone call from a resident wanting to know the specifics of the case. Vice-Chairman Skinner stated the Board will consider the items as one item. Mr. Christensen asked if the proposed house meets the side and rear setbacks. Mr. Husband stated yes. Mr. Grant asked how the lot size compares with others in the area. Mr. Schelling stated a typical interior lot is 80 feet by 120 feet. He stated the lots meet the minimum of the R-2 district. He stated Lot 30 is probably larger than the lot in question. He stated there are 162 lots in the subdivision, and this is the first variance request in the subdivision. Mr. Cypert made the motion to approve BA 94-03 as presented. The motion was seconded by Mr. Christensen, and the motion carried 5-0. CITIZEN COMMENTS Mr. Denny Flanagan, 7200 Crabtree Lane, came forward to speak. He stated he wants to construct a gameroom on the rear of h is house. He stated h is plot plan shows he must bu i Id five feet from the rear property line, but the City says ten feet. He asked why there is a discrepancy between the two. Vice-Chairman Skinner stated city staff interprets the ordinance as it is written. He stated he could speak to Mr. Pence about this situation. ADJOURNMENT There being no further business, the meeting was adjourned.
