BA 94-12 MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS May 19, 1994 - 7:30 p.m. The meeting was called to order by Chairman Tom Duer at 7:30 p.m. PRESENT Chairman Members Dr. Tom Duer Billy Cypert Bill Schopper Perry Christensen Jim Grant Robert Skinner Barry LeBaron Clayton Husband Gregory Arri ngton Steve Ingham Dir Plan/lnsp Planner Plans Examiner ABSENT Mr. Cypert made the motion to approve the minutes as presented. The motion was seconded by Mr. Cypert, and the motion carried 6-0. Chairman Duer stated that the State law requires four affirmative votes for a variance request to pass, regardless of the number of members in attendance. He stated the Board consists of 5 voting members and 2 alternate members. Request of Ken Miller for a variance from the Zoning Ordinance No. 1874 on Lot 9, Block 9, Oak Hills Addition, to allow a fence to encroach the side building line. This property is located at 9301 Weeping Willow Drive. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Ken Miller, 9301 Weeping Willow, came forward to speak. He stated he wishes to construct his fence 10 feet beyond the building line on the north side of the lot. He stated he has spoken with h is neighbor and he has no objection. Chairman Duer asked if the fence would be a stockade fence. Mr. Miller stated yes. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. LeBaron asked if Mr. Miller meant 15 feet from the curb or property line. Mr. Miller stated from the property line. Chairman Duer asked how far away from the curb the property line sits. Mr. LeBaron stated it is usually 9.5 feet. Chairman Duer stated that would place the fence about 25 feet from the back of curb. Mr. Cypert made the motion to approve BA 94-12 as requested. The motion was seconded by Mr. Christensen, and the motion carried 5-0. ZBA Minutes - Page 2 19 May 1994 2. BA94-13 Request of Donald Rea for a variance from the Zoning Ordinance No. 1874 on Lot 7, Block 1, Briarwood Estates, to vary from the masonry requirement. Th is property is located at 7116 Sweetbriar Court. Chairman Duer opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Donald Rea, 7116 Sweetbriar Court, came forward to speak. He stated the neighbors do not object to the use of siding. He stated the house is painted brick. He stated there is one house on the block with siding on one side. Mr. Rea stated the area with the siding will be behind the fence. He stated since the house is painted brick, they did not want the extra expense of putting brick on the addition and having to paint it to match the existing house. Chairman Duer asked how large the house was. Mr. Rea stated 1,500 square feet living area. He stated they are doubling the size. Mr. LeBaron stated an issue came up during the workshop about a variance from the 20% rear yard requirement. He stated the addition would leave the rear yard 135 square feet short of the requirement. Mr. Rea stated the plot plan he submitted was inaccurate. He stated there is an additional 10 feet that is not shown. Mr. Christensen asked what type of siding was proposed. Mr. Rea stated 4-inch masonite. Mr. Schopper asked why the city would have a masonry requirement and also allow the brick to painted. Mr. LeBaron stated the city does not regulate whether the brick can be painted. Mr. Rea stated their brick is painted because there was a fire in the house before they bought it. There being no one else wishing to speak, Chairman Duer closed the Public Hearing. Mr. Schopper stated that since the brick is already painted, there is no need for the Board to require the addition to be bricked. Chairman Duer stated that the second story would be exempt from that requirement anyway. Mr. Schopper made the motion to approve BA 94-13.
