MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICH LAND HILLS, TEXAS
October 20, 1994 - 7:30 p.m.
The meeting was called to order by Chairman Tom Duer at 7:35 p.m.

ABSENT
Mr. Skinner made the motion to approve the minutes as presented. The motion was
seconded by Mr. Cypert. The motion carried 4-0, with Mr. Christensen abstaining due to
absence at the previous meeti ng.
Chairman Duer stated that the State law requires four affirmative votes for a variance request
to pass, regardless of the number of members in attendance. He stated the Board consists of
5 voting members and 2 alternate members.
Request of Sylvia Gregory to vary from the single family parking requirements on Lot 15R,
Block 4, Briarwood Estates, to allow the garage to be enclosed without providing covered
parking. This property is located at 7105 Briardale Drive.
Chairman Duer opened the Public Hearing and called for those wishing to speak to come
forward at this time.
Ms. Sylvia Gregory, 7105 Briardale Drive, came forward to speak. She stated they have
lived in the house since 1977. She stated the garage was converted into a playroom, and
now she wishes to convert it into a nursery for her grandchild.
Mr. Cypert asked if they were the ones who originally enclosed the garage.
Ms. Gregory stated yes.
Chairman Duer asked when they converted the garage.
Ms. Gregory stated 1977.
Mr. Christensen asked if a building permit was ever issued for the work.
Ms. Gregory stated she did not know. He husband did the work.
There being no one else wishing to speak, Chairman Duer closed the Public Hearing.

Mr. Christensen asked if Ms. Gregory was going to change the way the house looked on the
front.
Ms. Gregory stated no.
Mr. Christensen made the motion to approve BA 94-25 subject to keeping the garage door at
it exists. The motion was seconded by Mr. Schopper. The motion carried 5-0.
2. BA 94-26
Request of Bryan Crum to vary from the masonry requirement on Lot 11, Block 2, Briarwood
Estates, to allow the addition of the house to be constructed of siding. This property is
located at 7117 Sweetbriar Court.
Chairman Duer opened the Public Hearing and called for those wishing to speak to come
forward at this time.
Mr. Bryan Crum, 7117 Sweetbriar Court, came forward to speak. He stated he is making an
addition to the rear of the house. He presented a drawing of the addition to the Board. He
stated the house is old and he cannot match the brick. He stated other houses have used
siding.
Mr. Christensen asked what type of siding he will use.
Mr. Crum stated a masonite siding to match the existing siding.
Mr. Skinner asked if the addition is single story.
Mr. Crum stated yes.
Mr. Christensen asked what the addition will be used for.
Mr. Crum stated a gameroom, living space and office.
Chairman Duer asked if Mr. Crum if he will be doing the work himself.
Mr. Crum stated he will hire a contractor.
Mr. Skinner asked if the addition will be visible to the street.
Mr. Crum stated no.
Mr. Christensen asked if the fireplace if fully brick.
Mr. Crum stated yes.
There being no one else wishing to speak, Chairman Duer closed the Public Hearing.
Mr. Cypert stated this area was originally allowed to brick 75% of the entire structure.
Mr. Christensen asked if a building permit has been applied for.
Mr. LeBaron stated yes.
Mr. Cypert made the motion to approve BA 94-26. The motion was seconded by Mr.
Skinner. The motion carried 5-0.

3. BA 94-27
Request of Bill Fenimore to vary from the side building line requirement on Lot 34, Block
11, Meadow Lakes Addition, to allow side building lines of six feet on each side. This
property is located at 4721 Greenway Court.
Chairman Duer opened the Public Hearing and called for those wishing to speak to come
forward at th is time.
Mr. john Spicer, 7725 Tamarron Court, came forward to speak. He stated they are
requesting a variance from the six foot and ten foot side building line requirements. He
stated the reason for the large side yard was to accommodate access to the rear yard, to
faci I itate garage entry, and to encourage larger lots. Mr. Spicer stated the lot backs up to the
golf course. He stated that the typical garage entry in the area have a front garage with a side
entry. He stated the side building line requirements only affected plats submitted after
january 1, 1990.
Mr. Bill Fenimore, 6041 Riviera Drive, presented an elevation drawing of the proposed
house.
Mr. Spicer stated the house has appraised for $213,000. He stated this house design is
similar to others in the neighborhood.
Mr. Christensen asked if there was a contract for this house.
Mr. Spicer stated it is a speculative house.
Mr. Fenimore stated narrow lots make it difficult to construct rear entry garages.
Chairman Duer asked if the master bedroom is on the south side of the house.
Mr. Fenimore stated yes.
Chairman Duer stated the Board was looking at how cutting four feet off the house would
affect the floor plan.
Mr. Fenimore stated most of the houses on Skylark Circle fall under the six foot sideyards.
Mr. Mitchell Baxter, 6050 Riviera Drive, came forward to speak. He stated he supports the
request. He stated he owns the lot next door.
There being no one else wishing to speak, Chairman Duer closed the Public Hearing.
Mr. Cypert stated he would favor centering the house in lot rather than offsetting it to meet
the requirement.
Mr. Cypert made the motion to approve BA 94-27. The motion was seconded by Mr.
Christensen. The motion carried 5-0.
4. BA 94-28
Request of Gerald White to vary from the satellite dish receiver requirement on Lot 1 R,
Block 4, Industrial Park Addition, to allow a second receiver to be installed on the property.
This property is located at 5559 Rufe Snow Drive.
Chairman Duer stated no is here to represent this request. He stated the Board has heard
cases without anyone present before.
Mr. Skinner made the motion to postpone this case until the November meeting and to
inform the appl icant of the reason for the postponement.

Mr. Schopper if the request could stand on its merit the Board should consider it.
Chairman Duer stated if the Board denies it, the applicant's only recourse is district court.
He stated he would like to ask questions of the applicant.
The motion was seconded by Mr. Christensen. The motion carried 4-0, with Mr. Schopper
abstai n i ng.
