MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
MAY 9, 1991 - 7:30 P. M.

The meeting was called to order by

ELECTION OF CHAIRMAN
Vice Chairman Brock stated that
Chairman Mark Wood was elected to the
City Council last week and they now
have a vacancy for Chairman of P & Z.
Ms. Marin nominated James Brock for
Chairman. This nomination was
seconded by Mr. Miller.
Mr. Lueck nominated David Barfield for
Chairman.
There was a secret ballot taken and
there were 4 for Brock and 3 for
Barfield.
Since James Brock is now Chairman,
there is a vacancy for a Vice
Chairman.
Mr. Collins nominated David Barfield
for Vice Chairman.
Mr. Bowen made the motion to elect
David Barfield by acclamation. This
motion was seconded by Mr. Collins and
the motion carried 6-0.

Since David Barfield was elected Vice
Chairman, there is a vacancy for
Secretary.
Mr. Collins nominated Don Bowen for
Secretary.
Mr. Lueck seconded the nomination and
the vote was 6-0.
CONSIDERATION OF THE MINUTES
OF APRIL 25, 1991
Ms. Marin made the motion to approve
the minutes as written. This motion
was seconded by Mr. Bowen and the
motion carried 7-0.
1 .
PS 90-32
Request of Ruth Michener for
Preliminary Plat of Lots 1 & 2, Block
1, Michener Addition. This property
is located on the west side of Douglas
Lane, north of Hightower Drive.
Chairman Brock stated that Ms.
Michener wishes to subdivide a 5 acre
tract.
Ruth Michener, 7015 Douglas Lane, came
forward. She said she wants to divide
it and sell it for pasture. She said
there is no way she can build a
drainage ditch; no one else up the
street has done that. Ms. Michener
said the property has been used for
horses; it has a natural water way and
is now in the 100 year flood plain.
Ms. Michener said she cannot afford to
put in the drainage ditch.
Mr. LeBaron said the staff feels this
should not be treated any differently
than any other subdivision and the
drainage channel should be put in,
but it is a small tract and there are
no other concrete channels in the
area.
Mr. Bowen said it would be onerous to
require Ms. Michener to build the
channel which could cost $100,000. He
said he feels she should be allowed to
dedicate it as a drainage easement
through the flood plain.

Chairman Brock asked Ms. Michener if
she would agree to that.
Ms. Michener said she would. She said
she is a widow and it is hard to take
care of this property. She said she
would like to sell it to someone who
has horses.
Chairman Brock asked if she would get
a percolation test run by the Tarrant
County Health Department.
Ms. Michener said she feel the builder
should do that, but she would if the
plat is approved.
Mr. LeBaron said the city policy does
not allow lateral lines in the flood
plain area.
Ms. Michener said she understands, she
knows where the flood plain is.
PS 90-32
APPROVED
Mr. Barfield made the motion to
approve PS 90-32 subject to the
Engineer's comments save and except
that we not require the concrete
channel; that we require the owner
dedicate all of the flood area as a
drainage easement; and the plat not be
accepted until a percolation test is
done to verify that a sufficient
structure can be built so that all the
lateral lines are out of the flood
plain. This motion was seconded by
Mr. Lueck.
Mr. Doug Long, Engineer for Ms.
Michener, came forward. He asked if
Mr. Barfield meant the final plat
would not be accepted until the
percolation test was done. This is
the preliminary plat.
Mr. Barfield said that was correct,
that he should have said the final
plat.
The motion carried 7-0.

PS 91-07
Request of Tecnol, Inc. for Replat of
Lots SR & 6R, Block 1, NRH Industrial
Park Addition. This property is
located on Industrial Park Boulevard,
east of Rufe Snow Drive.
Mr. LeBaron stated that Tecnol was
needing to expand and they have
purchased additional property and are
platting it into one lot.
Max Reeves with Tecnol, came forward.
He said they have a 12 plus acre tract
known as lot SR and have recently
purchased a S plus acre tract from RTC
and requests it be removed from lot 6R
and added to lot SR. Mr. Reeves said
they plan to expand the present
facility and also have future plans to
some day build another facility on the
new property.
Mr. Reeves stated he has no problems
with the Engineer's comments.
PS 91-07
APPROVED
Mr. Bowen made the motion to approve
PS 91-07 subject to the Engineer's
comments and the stipulation that a
signature line be added on the plat
for RTC to sign. This motion was
seconded by Mr. Miller and the motion
carried 7-0.

PZ 91-10
Public Hearing for request of the City
of North Richland Hills to rezone 38
lots in Diamond Loch Addition from
their present classification of R-S-D
Duplex to R-l Single Family
Residential.
Mr. LeBaron stated that a large part
of Diamond Loch Addition is currently
zoned duplex and has been for
approximately 20 years, but could only
find one duplex built there; the
others were build single family. He
said there are 2 problems; the duplex
zoning classification "R-S-D" no
longer exists; we only have R-4-SD
duplex which has different
requirements.

Mr. LeBaron said we need to change the
zoning to R-1 like the rest of Diamond
Loch. He said if you rezone to R-1,
what do you do with the duplexes; do
you change them to R-4.
Chairman Brock asked the audience how
many were present who have duplexes in
the are. There were two.
Chairman Brock opened the Public
Hearing and called for those wishing
to speak in favor of changing the
zoning to R-l to please come forward.
There being no one, the Chairman
called for those wishing to speak in
opposition to changing the zoning to
please come forward.
Bill Frey, CPA from Fort Worth, came
forward to represent Mr. & Mrs. Eddie
Hamer who live in Belgium. He said
they bought the property at 4400
Diamond Loch approximately 15 years
ago when their daughter was an
exchange student here. Mr. Frey said
it is a duplex and he keeps it in
tip-top shape. He said they purchased
it as an investment and he requests to
be grandfathered so it could continue
as a duplex.
Clarice Conrad, 6432 Diamond Loch
Court, came forward. She said she has
had the property ever since the
addition started. She said her deed
restrictions states that only 8 lots,
lots 9 through 16, Block 7, would be
zoned 2 family.
Mr. Bowen said that is not what the
zoning map shows.
Ms. Marin said it probably meant that
many lots in that Block would be
duplex.

Ms. Conrad said her's was lot 9, Block
7. She said they built on it and
planned later to build a granny house
in the back since it was a large lot.
Chairman Brock stated that putting a
house behind a house would not be a
duplex; it would not be a common wall.
Mr. LeBaron said that was correct.
Ms. Conrad said it says on her deed
restrictions "Two Family" zoning; it
does not say it has to be a duplex.
Mr. Bowen asked if Ms. Conrad's was a
duplex.
Ms. Conrad said it was a single family
house, but she does not want the
zoning changed. She says there are
three two-family dwellings on that
street. She said lots 11 & 12 are
duplexes and lot 13 has a garage
apartment in the back.
Ms. Conrad said she has her deed
restrictions and if anything has been
changed, she has not been notified.
Ms. Conrad said she wants to be able
to build a house in the back for her
parents or convert her house into two
family.
Mr. Bowen said he did not think the
granny house would be legal.
Mr. LeBaron said that is correct.
Mr. Bowen said he was not sure about
the garage apartment.
Mr. LeBaron said that could possibly
be considered for duplex zoning.
Chairman Brock called for anyone else
wishing to speak in opposition to the
change to please come forward.

There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Mr. Barfield said he would like to
know which are duplexes and which are
single family.
Ms. Conrad said lots 11 & 12 are
duplexes and lot 13 has the garage
apartment.
Mr. Barfield said he feels this should
be surveyed on the ground and he
requests it be tabled to allow the
staff time to go out and check this.
Mr. LeBaron said he had three staff
people go out and drive down the
streets surveying, he has had 6 or 7
surveys made, and they could only
visualize one and the garage
apartment. Mr. LeBaron said he feels
the people did not know the property
was zoned for duplexes.
Ms. Marin said she feels that if they
bought it knowing it was duplex
zoning, they have every right to keep
that zoning, but if they have a single
family house built in duplex zoning,
it would be non-conforming and that is
what we need to change.
Mr. Bowen asked if you have a single
family house built on a duplex lot and
it burns down, could they build a
single family house back.
Mr. LeBaron said they could build
either single family or duplex.
Mr. Lueck said he feels they should
protect the ones that built the
duplexes.
Mr. Barfield asked if you could
stipulate that in the zoning.

Mr. LeBaron said that would not be the
proper thing to do.
Mr. Barfield said to protect these
three people, the Commission would
have to leave those lots out.
Mr. Lueck said he felt they should
protect the property owners in case it
burned down, they could build back
either single family or duplex. He
said he feels buying that property
made them have flexibility.
Mr. LeBaron said he feels it should be
zoned appropriately. He said there
could be problems with neighbors, if a
single family house burned down and
they built a duplex back on the lot.
He said they usually are not aware of
the zoning.
Mr. Lueck said they are aware of it
now, because we sent each of them a
letter.
Mr. Barfield asked if they could zone
it, leaving the duplexes out, and give
them a time span for them to come in
if they had a duplex. He said to send
them a registered letter stating if
they have a duplex, to please let us
know before June 10th City Council
meeting.
Mr. LeBaron said we could send them
all a registered letter stating they
can come to the City Council meeting
June 10th.
PZ 91-10
APPROVED
Mr. Barfield recommended approval of
PZ 91-10, that it be changed to R-1
zoning and that any existing duplexes
that notify the city that they have a
duplex prior to the June 10th City
Council meeting will remain duplex.
Mr. Bowen asked if that would include
the lady's property that did not want
her's changed.

Mr. Barfield said it would.
Mr. Bowen seconded the motion and the
vote was 4-3 with Marin, Lueck, and
Brock voting against. The motion
carried.
4.
PZ 91-11
Public Hearing for request of the Bank
of North Texas to rezone Tract 7,
John's Addition, from its present
classification of C-2 Commercial to
1-2 Industrial. This property is
located on the east side of Davis
Boulevard and south of the railroad.
Mr. LeBaron stated this tract of land
at one time had a cabinet shop in it,
but a cabinet shop is not an allowed
use in C-2 zoning and the building
does not conform to the masonry
requirement for C-2 zoning. He said
the structure is currently vacant and
before it can be used again, it either
needs to be rezoned to 1-2 or the
building be brought up to code and be
used for something other than a
cabinet shop.
Chairman Brock opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
There being no one wishing to speak,
the Chairman called for those wishing
to speak in opposition to this request
to please come forward.
Councilman Scoma came forward. He
stated that he was speaking on behalf
of several neighbors who has property
adjacent to or in the vicinity of the
property being requested for rezoning.
He said he understands the bank needs
to utilize this facility for revenue
purposes and not just let it set
there. Councilman Scoma said he
understands it is non-conforming. He
said they are totally in agreement in
making it where a cabinet shop can be

in that facility. He said they don't
object to the cabinet shop as they
have lived with it for years.
Councilman Scoma said one of the major
concerns is that this Planning and
Zoning Commission and the Council has
done a lot of work looking at the
zoning map of the city and
establishing some areas where
industrial would work. He said they
have at the present time, no
industrial property on the east side
of Davis Boulevard, south of the rail
road tracks except for a piece in
front of the new post office that is
zoned industrial. He said it ties
into the old airport property that is
zoned industrial. Councilman Scoma
said that was intended to be opened up
as a road into some large tracts that
would encourage manufacturing
companies to move here.
Councilman Scoma said one objection
that they have is not only does this
represent industrial zoning, it is
considered to be a commercial area
according to our master plan, but it
is also a small tract of land that
limits the use of this property to
such things as machine shops, plumbing
shops, sheet metal shops, welding
shops that have outdoor storage. He
said this is not compatible with the
residential area; it is not compatible
with what the residents were told when
they bought their property. He said
there is a piece of agricultural
property behind the houses in
Sunnybrook and their concern is if we
approve the industrial zoning carte
blanche that there will be an attempt
in the future to make it industrial
also. Councilman Scoma said he
encourages P & Z tonight as a
homeowner in the area to restrict the
industrial use to only a cabinet shop
or to reject the request for general
industrial use.

B. J. Wilkinson, 6433 Westgate, came
forward. He said Westgate backs up to
this area. He said these houses were
built within this last year and there
are about 30 houses there. He said
all the homeowners were told this
would remain as it is and we are
concerned.
Robert Hightower, 6437 Westgate Drive,
came forward. He said he is close
enough to the cabinet shop to hit it
with a rock. He said he has two small
children. He said when he moved in he
specifically asked what it was zoned
and was told it was commercial. Mr.
Hightower said he didn't have a
problem with that and he would like it
to remain that way.
Keith Smith, 6441 Westgate Drive, came
forward. He said they were told it
was currently commercial and would
probably stay that way. He asked Mr.
LeBaron about what he said about the
bank having a proposed use for the
property.
Mr. LeBaron said their application
said the sale was contingent on getting
the zoning change.
Mr. Smith asked about the same usage.
Mr. Bowen stated that the cabinet shop
was a non-conforming use, it was
already there. He said there is some
question as to where it has been
vacant for 6 months or not.
Mr. LeBaron read what was written on
the application: "Previous use was
inconsistent with zoning. Similar use
will be established if zoning change
can be obtained."
Mr. Lueck asked if a cabinet shop
could go in if the building was
brought up to code.

Mr. LeBaron stated it could not.
Mr. Smith said he has a problem with
changing the zoning to industrial, but
has no objection to the cabinet shop.
He said it opens the gate to allow
businesses that are not favorable and
it will lower the property value of
these houses.
Mr. Barfield asked if he was aware of
the outdoor storage allowed in C-2
zoning. He said you can have 20% of
the lot for outdoor storage in C-2
without changing the zoning. Mr.
Barfield said the cabinet shop would
have to be in Industrial zoning and he
is not sure we, as a Board, are at
liberty to pick and choose in the
Industrial zoning.
Ron Wright came forward. He said his
family has property at 8217 and 8221
Cardinal Lane. He said he feels that
a zoning change would hurt the use of
the property. Mr. Wright said his
family has owned the property for SO
years and do not look forward to it
being used as industrial. He asked
what percent outdoor storage is
allowed in industrial zoning.
Mr. Pence said there is no outdoor
storage in Industrial zoning.
Mr. Wright said he is still opposed to
the industrial zoning.
Jack King, 8301 Cardinal, came
forward. He said he was against this
for all the same reasons. He said he
and his wife took a survey of the
residential area and they were 100% in
opposition to this request and said
they would sign a petition.

Councilman Scoma came forward again.
He said he would like to address Mr.
Barfield's comment in regard to the
restriction of not being allowed to
pick and choose. Councilman Scoma
stated that the staff attorney has
told us that we can, the P & Z can, or
the council can restrict the use of
that property to a cabinet shop, if
that is what we want to do under 1-2.
He said he and the neighbors are not
opposed to the cabinet shop; it was
already there when they moved into the
area. Councilman Scoma said they
would understand if it had to be
rezoned to accommodate that. He said
the concern is now you are opening up,
if you should resolve and the council
approve the 1-2 zoning, you then would
have contiguous property adjacent to
that and it would be inclined to be
zoned industrial and then the whole
area would be industrial and would
allow types of businesses we do not
want, so you can restrict that too
based on Rex McEntire's comments the
other day.
Jeff Walter, 6425 Westgate, came
forward. He thanked Councilman Scoma
for his leadership tonight. Mr.
Walter said he echoes the feelings of
his neighbors tonight, he said he and
his wife are against this rezoning for
the same reasons.
Captain Michael Plan, U.S.A.F.,
address 6409 Amundson, came forward.
He stated he has plans to sell his
home within the next year and if you
open this up to industrial, it would
definitely affect the resale of his
property. He said he has no problem
with what is already there.
Chairman Brock asked for a show of
hands of the ones present who are in
opposition to the rezoning.

There were a number of hands raised.
Chairman Brock asked if there was
anyone who had anything different to
say.
No one else came forward so Chairman
Brock closed the Public Hearing.
Mr. Barfield said he understands the
attorney has discussed with Councilman
Scoma that you can pick and choose in
the menu, but it has been our
direction that you could not. He said
p & Z has had its hands slapped on a
few occasions when we would pick and
choose. Mr. Barfield said he could
not vote for a zone change until we
get a directive from the City Attorney
on this matter. He said he would like
to table this until they get an answer
from the City Attorney.
Mr. Lueck asked Mr. LeBaron if
something has changed that P & Z does
not know about.
Mr. LeBaron said we just have to take
the directive from the City Attorney.
Mr. Bowen asked if we do zone it 1-2
for a cabinet shop and if he wants to
fall to something else, what would he
fall back to, C-2, I-I?
Mr. LeBaron said he could not answer
that.
Mr. Barfield said he felt we should
give the owner of the property a
chance to address these issues.
Chairman Brock said it seems it is the
consensus that if it is not used as a
cabinet shop, it should be left C-2.
Mr. Collins suggested they leave it
C-2 and the owner come back in for a
specific use permit.

Mr. Barfield said we might need to do
that so he will not have to pay more
fees, but he thinks we should give him
the chance to come back and address
the issues. He said the Chairman can
re-open the Public Hearing at that
meeting.
Mr. Bowen said you cannot use a
specific use. He said if you have a
specific use, you have that use plus
all the other uses. He also stated
that specific use for a cabinet shop
is not allowed in C-2.
Mr. Barfield made a motion to table
this request until the next meeting
until the City Attorney has a chance
to direct us if we can pick and choose
items in the industrial zoning and
give the owner a chance to address
this issue. This motion was seconded
by Mr. Bowen. The motion failed by a
vote of 3-4 with Lueck, Marin, Collins
and Miller voting against.
PZ 91-11
DENIED
Mr. Collins made the motion to deny
PZ 91-11. This motion was seconded by
Ms. Marin and the motion carried 4-3
with Brock, Bowen, and Barfield voting
against denial.
Mr. Bowen stated that his vote against
denial was just to allow the requester
to have a say.

PZ 91-12
Public Hearing for request of Oscar
Trevino Jr. with J.L. Steele, Inc. to
rezone Lots 1 & 2, Block 2, Meacham
Addition, from their present
classification of R-2 Single Family
Residential to C-2 Commercial. This
property is located on the west side
of Smithfield Road between Guy Street
and Arthur Drive.
Chairman Brock opened the Public
Hearing and called for anyone wishing
to speak in favor of this request to
please come forward.

Oscar Trevino came forward. He said
his business is presently located at
8208 Northeast Parkway, Suite 123,
North Richland Hills, Texas. He said
the property in question is located at
6504 Smithfield Road. He said it is 2
lots, 200 feet by 100 feet each with
200 feet of frontage on Smithfield
Road. Mr. Trevino stated the property
is bounded on three sides by
thoroughfares. He said the property
to the Northwest and across Smithfield
Road is zoned 1-2 and across Guy
Street is R-5-D Duplex. He said the
area bounded by the St. Louis
Railroad, Smithfield Road and Watauga
Road is going to need to be rezoned
within the next few years.
Mr. Trevino said their intensions, if
they get the zoning, is to renovate
the existing frame house to commercial
standards as required by the city. He
said they would keep the fenced area
as a green belt and use the remainder
for yard area. Mr. Trevino stated
that C-2 does allow up to 20% outside
storage. He said they will obtain the
main access off Smithfield Road. He
said the material to be stored on the
property would be small racks, a 16
foot trailer, and other miscellaneous
items. Mr. Trevino said the property
will also be fenced per city
specifications for C-2 zoning. He
said the noise level will be no more
than at present. He said the company
specializes in the installation of
re-enforcement steel on construction
projects. Mr. Trevino said they have
the re-enforcement steel delivered to
the job site and the delivery of
supplies to the yard will be limited
to a bob-tail truck. He said the
office staff ranges from 5 to 8
people. He said with the continued
growth in the area north of Starnes,
Smithfield Road will have an increase
in traffic.

Mr. Trevino stated that the directors
and officers of this company all live
in North Richland Hills and have an
interest in the quality of life in
this city. He said the corporation
will endeavor to keep the ascetics of
the property as good or better than it
is today. He said he has pictures of
the supplies that will be stored on
the property and also what you can see
from the front, side and back of this
property. Mr. Trevino said you can
look out one side and see Martin
Lumber Company with trucks parked
there and then you have the railroad.
Ray Bates, owner of the property, came
forward. He said the property has
been vacant for approximately 2~
years. He said the initial building
construction was 4 rooms in 1946 and
the house has been added on to. He
said it is only 1 or 2 bedroom house
and would be hard to use it as a
residence without completely
rebuilding it. Mr. Bates stated he
feels this is the best use of the
property.
Chairman Brock called for anyone else
wishing to speak in favor of this
request to please come forward.
There being no one, the Chairman
called for those wishing to speak in
opposition to this request to please
come forward.
Glenn Willis, 7820 Arthur, came
forward. He said he has several
questions that needs answered:
traffic, access to Arthur, his plans
for expansion, guarantee of storage,
there are all types of steel, a lot of
trucks, a lot of noise, hours of
operation, what kind of guarantees do
we have that he will make it ascetic
to the neighborhood.

Mr. Willis stated he and his wife
spend a lot of time in their yard and
they do not want a commercial piece of
property there.
Chairman Brock asked Mr. Trevino what
his hours would be.
Mr. Trevino stated he and the Vice
President show up at 5:30 A.M. and the
men will come in to pick things up at
6:30 or 7:00 A.M. and at 5:30 P.M.,
they will all be out of the office.
Mr. Trevino said he would like to have
his main access off Smithfield Road.
He said the steel would be delivered
to the job site and tied there; he
said the delivery there would be in
bob-tail trucks; and as far as
expansion, with less than an acre,
there would not be much expansion. He
said as for as keeping the
neighborhood pretty, the fence line is
covered with brush and weeds are
standing a foot and a half high, and
the house is falling apart now;
nothing is pretty about this piece of
property. Mr. Trevino said he agrees
it is a nice neighborhood, but when
the property next to Watauga Road
sells, and a grocery store shows up
there, there will be noise there.
Mr. Barfield asked where he puts the
steel left over from a job.
Mr. Trevino said they do not purchase
the steel, they just install it. He
said they would have some racks. He
showed the Commission pictures of the
racks.
Mr. Miller asked how close they would
be to the lumber company.
Mr. Trevino said it would be about 80
feet and across Smithfield Road.

Jessie Johnson, 6413 Smithfield Road,
came forward. He said he owns the
property next door to the property in
question. Mr. Johnson stated he does
not really have any objections to what
he plans to do, except he does not
want it to get to looking like 28th
Street.
Doug Van Den Berg, 6337 Smithfield
Road, came forward. He said he
believes it is true that in the
future, the property values will
increase, but he is concerned now. He
said he has a little girl that likes
to play in the yard. Mr. Van Den Berg
asked if they were permanent employees
or temporary employees. He said he
felt an 8 foot fence would be better
than a 6 foot fence.
King Bell, 7829 Arthur Drive, came
forward. He said his property is
adjacent to this property. He said he
is concerned about the noise level and
the fence.
Stephen Grove, 7808 Arthur, came
forward. He said he would like to
know how much more traffic there would
be and if they would have a cat or
fork lift. He said he was concerned
about what would happen 5-10 years
from now.
Chairman Brock called for anyone else

Chairman Brock asked Mr. Trevino to
come back to answer some questions.
Mr. Trevino stated they will restore
the building to commercial code; the
building will need to be gutted, put
in wider doors, electric will have to
be put in PVC, 80% brick is required;

the roof will have to be fixed; there
will be a major renovation.
Mr. Trevino said they have been at the
present location for 2 years and last
year they did 6~ million dollar
business. He said they do not own a
cat loader; they own one pickup, but
may buy another pickup shortly. He
said the wire is in boxes, 48 on a
palet and it is unloaded by hand.
Mr. Trevino said they have 82
employees, but only a few might come
to the office to pick up their check
early and the lead men and foremen
would come to the office. The noise
level-there is a truck company next to
this property and this should not be
any more noisy. He said they might do
a little welding from time to time.
He said there are 18 wheelers going in
and out there now. What happens in 10
years, they are not fortune tellers;
he does not know.
Chairman Brock stated this property
does not meet the one acre requirement
for C-2 zoning.
Mr. Willis came forward. He stated he
is opposed to the 6:30 A.M. He wanted
to know if there would be access to
Arthur. He said he does not want
access to Arthur.
Mr. Bowen stated access to Arthur
would be a platting issue, but they
would remember it. He said he wanted
to stress that they would not be
rezoning to a construction yard, they
would be rezoning to C-2 and that
means everything allowed in C-2.

APPROVED
Mr. Collins made the motion to approve
PZ 91-12. This motion was seconded by
Mr. Lueck and the motion carried 5-2
with Brock and Bowen voting against.

PS 90-30
Discussion of an ordinance to amend
the Subdivision Ordinance #1579
regarding the requirement of masonry
screening walls along major
thoroughfares.
Chairman Brock stated this case is
just for discussion only.
Mr. LeBaron stated this ordinance
would be a very important one for the
city; a significant impact on the
ascetics and on the cost of the
development. He stated the Commission
will hold a Public Hearing at their
next meeting. He said the draft
ordinance has 5 key points:
1. It will apply to all new
subdivisions and all replats.
2. It will apply to any residential
subdivision that is next to a C2U or
greater major thoroughfare.
3. Who is going to maintain it? He
said we are suggesting it be
constructed outside the right of way
on private property and when a plat
comes before you that includes a
masonry screening wall, that a
homeowners association become a part
of the plat. He said the homeowners
association can oversee the
maintenance of the screening wall.
4. The intersection treatment. Mr.
LeBaron said this is so important that
he will have slides to show at the
next meeting.
5. Type of construction. He said
p & Z has stated they do not want just
plain concrete, they want brick or
something that looks like brick.. Mr.
LeBaron said he suggested the
screening wall be at least 6 feet high
and the columns be no higher than 8
feet and spaced 10 feet apart. He
said they need to have a 4 inch
opening at the bottom so they will not
cause a drainage problem. Also, Mr.
LeBaron said they need to address the
issue that someone could want to put
up an 8 foot wood fence behind the 6
foot masonry screening wall.

Chairman Brock stated they would have
a public hearing for public input at
the next P & Z meeting.
Mr. LeBaron stated that the American
Planning Association is sponsoring a
training program for Planning and
Zoning members on June 3rd, on Monday
from 6:30 to 10:00 at White
Settlement. He said if they are
interested in going, let him know.
Mr. LeBaron said that back in March,
P & Z had a joint workshop with the
City Council, Board of Adjustment and
with Dan Boutwell, Planning Resources
Group, regarding updating the Zoning
Ordinance. He said he has finished
step one which is, taking a look at
all the amendments to the Zoning
Ordinance since 1984. He said he has
compiled them in an ordinance which
has been high-lighted. Mr. LeBaron
said they would be receiving a copy
probably next week.
Mr. LeBaron stated that Dan Boutwell
is present to give them a status
report on the work he is doing on the
Comprehensive Plan.
Mr. Boutwell came forward. He said he
has 7 tasks: the mobilization task,
the inventory task, demographics,
objectives, plans, city land use plan,
and the implementation. He said the
mobilization and inventory tasks are
going real well. He said he has the
base mapping done for the 5 sectors of
the city and we need to name these
sectors instead of just calling them
sector 1, 2, etc.
Mr. Boutwell said he has counted the
houses in sector one and has come up
with less units than the census has
listed and he is somewhat concerned
about that.

Mr. Boutwell said he is ready to get
with Mr. LeBaron and set up a
worksession and start on Sector 1;
then Sector 2 will follow in about 2
weeks. He said there would be an
overlap.
Mr. LeBaron said they need to discuss
at the next workshop how we are going
to get input from the citizens of that
sector and how we make them aware of
what is going on.
