MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
JULY 25, 1991 - 7:30 P. M.

CONSIDERATION OF THE MINUTES
OF JULY 11, 1991
Ms. Marin made the motion to approve
the minutes as written. This motion
was seconded by Mr. Bowen and the
motion carried 5-0.

POSTPONED 6/27/91
Request of Jerry C. Moore to rezone
Lots 23, 24, & portions of Lots 25 &
26, Block 1, W.E. Odell Addition, from
their present classification of R-3
Single Family Residential to C-1
Commercial. This property is located
at the northwest corner of Davis
Boulevard and Odell Street.
Chairman Brock stated this case was
tabled at the June 27th meeting in
order for the Commission to study that
area.
Mr. Bowen stated the Commission has
reviewed this case, they talked about
it in the sector meeting. He said he
has two comments, one-he does not know
why they would want to add more
commercial C-1 along this corridor.
He said there is already a lot along
there that is empty. Mr. Bowen also
stated that even if this is considered
a redevelopment area, he is not a

proponent of piece meal development.
He said if we are going to look at it,
lets look at the entire area.
Chairman Brock stated that the
residents have stated their concerns
about spot zoning and the Commission
hates to set that tone.
Ms. Marin said if they had a specific
use now for the property, the
Commission might consider it, but if
they approve C-1, it would be leaving
it wide open for a lot of things.
Mark Hannon, Engineer, came forward to
represent the applicant in his
request. He said he understands what
the Commission's concerns are and the
applicant would agree to Local Retail
which would satisfy some of the
concerns.
Chairman Brock said some day this may
be a redevelopment area, but right now
it would be speculative zoning.
Mr. Hannon stated that the owner of
the property is present and would like
to speak.
Mr. Bob Allen, owner of the property,
came forward. He stated he purchased
this property from his parents in
1954. He said the lots are 60 feet
wide and 240 feet deep and he has had
it on the market for sale for
residential, but no one is going to
buy this property and put a modern day
home on those lots. Mr. Allen said
the property to the south, on the
southwest corner, is already zoned
retail; the property on the southeast
corner is under the Grandfather's Act
and there is a business there; the
property directly east of it has been
purchased by a church and then turned
back and is still zoned R-3, and the
property below that on Davis is zoned
commercial. Mr. Allen said it is

such a busy street that it would be
perfect for some type of business.
Mr. Allen stated he is 64 years old
and will retire next year and he does
not reside there anymore. He said the
only hopes he has to sell that
property is for either retail or
commercial property.
Mr. Allen said the problem he had with
his neighbor was about a
misunderstanding about an easement.
He said the city has a 5 foot easement
on his property and a 5 foot easement
on the other people's property. Mr.
Allen said he had some fruit trees and
pecan trees there and he let the whole
area grow up for a place for the
animals and birds. He said he thinks
the neighbors are afraid the city will
come in and take 10 feet off their
property, but it is not that way. He
said there is 5 feet on both sides of
the property. Mr. Allen said there
was a problem in the city not owning
the easement and they came out and cut
down some of his fruit trees and
pecan trees.
Chairman Brock stated there is a lot
of commercial already along Davis
Boulevard and someday Mr. Allen's
property might be retail, but the
neighbors do not know what would go in
there. He said if you came to the
Commission and said he was going to
put a doctor's office there, the
residents would feel more at ease
knowing what would go in there, but
just to ask for a blanket C-1, a lot
of things could go in there.
Mr. Allen said the applicant, Mr.
Moore, plans to put something on it in
3 or 4 years. He said you have all
this commercial property that they are
just sitting on and not doing anything
with it, but here is a developer who
plans to do something with the
property.

Chairman Brock said if he had a
specific use for it, they would
consider, but there is no buffer to
the north and the neighbors are
concerned.
Mr. Allen said the city has an
ordinance that requires the business
to put up a barrier fence type
protection.
Mr. Hannon said his client, the
applicant, requests this be tabled so
they can work with the adjacent
property owners to negotiate on some
uses that would be satisfactory to
them and him and deed restrict the
property which would protect them
rather than leave it open for anything
to happen years from now.
Floyd Amos came forward. He said he
lives within 200 feet of the property.
He said he has his house up for sale.
He said he agrees with everything the
Commission has said tonight. Mr. Amos
said he would like to see a plat of
the whole area, he would like to see
what the Commission's intensions are
for the whole area. He said if they
rezone one block at a time, it is
going to hurt his house, and he will
be in asking for commercial for his
property. Mr. Amos said he would like
to see the Commission do what they
said they would do, get an overall
look at the area and plan the area
where it will coordinate. He said if
they just zone one block, it could end
up being a beer joint or a 7-11 store.
Mr. Bowen asked Mr. Amos where he
lived.
Mr. Amos said he lives on the corner
of Cross and Cox.
Mr. Bowen said the applicant has
requested this be tabled to allow him
to get with the neighbors to try to

work something out that would be
agreeable to both parties.

Mr. Bowen made the motion to table
PZ 91-16. This motion was seconded by
Mr. Moody and the motion carried 5-0.
Mr. Bowen suggested they look at an
office district there.

PS 91-15
Discussion of a reV1Slon to the Master
Thoroughfare Plan regarding down
grading Douglas Lane from a C2U to a
R2U (Residential Street).
Chairman Brock stated the Commission
has spent a lot of time on this and
looked at some developments coming
into this area.
Mr. Bowen stated that based on the
comments in the workshop, the
Commission has serious doubts about
down grading Douglas to a residential
street, and with those doubts, maybe
they should hold off and leave it as
it is.
Chairman Brock stated that with the
development that is planned for that
area, we may need it in the future.
3.
STAFF REPORT
Mr. LeBaron said he would like to tell
everyone where we are in our
Comprehensive Plan study. He said
they have completed the 4th sector of
the city. He said all the sectors
north of Loop 820 have been discussed
and the next sector meeting will be
August 13th and the sector to be
discussed will be south of Loop 820.
Mr. LeBaron urged the residents in
that area to come to the meeting. He
said the planner, Dan Boutwell, has
done an excellent job and will have a
lot of information to present to the
people at the meeting. Mr. LeBaron
said they hope a lot of people will
come out and see the plan for this
area and maybe we can get some input
