HomeMy WebLinkAboutPZ 1991-09-12 Minutes MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS SEPTEMBER 12, 1991 - 7:30 P. M. CALL TO ORDER The meeting was called to order by Chairman James Brock at 7:30 P.M. Utilities Building Official P & Z Coordinator ABSENT: Don Collins Wayne Moody CONSIDERATION OF THE MINUTES OF AUGUST 8, 1991 Ms. Marin made the motion to approve the minutes as written. This motion was seconded by Mr. Lueck and the motion carried 4-0 with Brock and Miller abstaining since they were not present at the meeting. 1 . PS 90-39 Consideration of a plan to close certain roads along Bedford-Euless Road as a neighborhood preservation effort. Chairman Brock stated that a lot of time and effort has gone into this; three public hearings were held, several mail-outs were sent to the neighbors in the area asking for their comments and suggestions, but there was no clear cut message from the people as to what should be done. He said there were just as many that did not want anything done as there were those that wanted something done. PS 90-39 DO NOTHING AT THIS TIME Mr. Bowen made the motion to, at this time, do nothing with the area, but if in the future they want to look at it again, they can. This motion was seconded by Mr. Miller and the motion carried 6-0. Page 2 P & Z Minutes September 12, 1991 2. PS 91-13 Request of Gary B. Starnes for Preliminary Plat of Lots 1 & 2, Block 2, Orange Valley Addition, Section 2. This property is located on the east side of Douglas Lane, north of Starnes Road. Owen D. Long, Engineer, came forward to represent Mr. Starnes. He stated he has addressed all the issues in the city engineer's comment letter. Mr. Barfield asked if he planned to final plat both lots. He said if they only final plat lot 1, there would be a gap in the sewer and street improvements. Mr. Long said they had submitted· a preliminary plat for lot 1, but was advised by John Johnston with the city staff that they had to preliminary plat Mr. Starnes entire tract. Mr. Long stated that Mr. Starnes' intention is to only final plat lot 1 at this time. He said Mr. Starnes has his residence on lot 2. Mr. Long said Mr. Starnes would build or sign a covenant for the street for lot 1. He said some day Mr. Starnes may want to divide lot 2, he might want to sell off the south half of lot 2, but at this time, Mr. Starnes only wants to sell off lot 1. Mr. Long said there are some problems with this area. He said where Douglas Lane turns to go west, there is a super elevation there. He said when the area to the north develops, the street there should be pulled down and made a 90 degree intersection there. He said that is why he thinks building a street in front of lot 1 at this time may cause trouble. Mr. Barfield asked what about not building the street, just sign a covenant for the street and sewer and go ahead and final plat both lots 1 & 2. Page 3 P & Z Minutes September 19, 1991 Mr. Long said Mr. Starnes' plan is to final plat only lot 1, but if you want to require in your motion that he final plat both lots, that is up to you. Chairman Brock asked if he plans to rezone lot 2. Mr. Long said he has not discussed the problem of the rezoning with Mr. Starnes. He said the ordinance states that in order to have Agricultural zoning, you must have 2 acres, but you know there are pieces of land allover the city that are AG and are less than 2 acres. He said he did not think Mr. Starnes would object to rezoning lot 2, but it would just be more expense. He said Mr. Starnes would rather just final plat lot 1 at this time. Mr. Long said they know that if Jim Harris buys the property to the north and develops it, he will need this easement on lot 1 to serve his property with sewer. He said there is sewer at the back of this lot 1 that will serve the property to the north. Mr. Bowen asked Mr. LeBaron if Mr. Starnes did rezone lot 2, would he have to plat it then. Mr. LeBaron said he would not, the zoning is a separate issue. Mr. Barfield asked if P & Z goes ahead and approves this with a recommendation to final plat both lots and waives the sewer and street construction at this time and get a covenant for them and maybe waive the zoning or lot 2 at this time, would the city have sufficient tracking information to catch this when he comes in for a building permit or such. Page 4 P & Z Minutes September 12, 1991 Kevin Miller said the city would have. He said they could put sufficient language in the covenant to take care of it. PS 91-13 APPROVED Mr. Barfield made the motion to approve PS 91-13 with the requirement that both lots be final platted and a covenant signed for construction of the sewer and/or street when they become necessary and to waive the zoning requirement for lot 2 at this time. This motion was seconded by Mr. Bowen and the motion carried 6-0. 3. PS 91-16 Request of Ruth Michener for Final Plat of Lots 1 & 2, Block 1, Michener Addition. This property is located on the west side of Douglas Lane, north of Hightower Drive. Mr. Owen D. Long, Engineer, came forward to represent Ms. Michener. He said Ms. Michener hopes to sell off lot 1, she is tired of mowing and trying to keep up this property in lot 1. He said they obtained a percolation test for the property, but they do not know what size structure will be built on lot 1. He said the man said he could design a septic system that would not encroach into the flood plain. Mr. Long said the engineer's letter still refers to the requirement of a concrete channel on this property which P & Z waived on the preliminary plat. He said Ms. Michener does not wish to obligate herself by signing a covenant for that because she feels it would hinder the sale of that property. Ms. Marin made a motion to approve PS 91-16 subject to the engineer's comments. This motion died for lack of a second. Page 5 P & Z Minutes September 12, 1991 PS 91-16 APPROVED Mr. Barfield made the motion to approve PS 91-16 subject to the engineer's comments, but to waive items 5, 6, 7, 8, & 10 of the engineer's letter. This motion was seconded by Mr. Lueck and the motion carried 6-0. 4. PS 91-19 Consideration of proposed Detention/ Retention/Decorative Pond Ordinance. Mr. Kevin Miller made a presentation to P & Z regarding the Detention/ Retention/Decorative Pond Ordinance. There was discussion as to the difference in these and a lake. There was also discussion regarding the requirement of a fence around the pond. Mr. Owen D. Long, Engineer, also spoke. He said he was invited by the city staff, as were other engineers and developers, to assist in this ordinance. He also stated the requirement for a fence around the pond was a major stumbling block to developers. After much discussion, it was the opinion of P & Z that they agree in concept with the ordinance, but that more study should be made and requested information be obtained from other cities regarding detention, retention, and decorative ponds. PS 91-19 TABLED Mr. Barfield made the motion to table PS 91-19 until the next P & Z meeting. This motion was seconded by Mr. Lueck and the motion carried 6-0. 5. STAFF REPORT Mr. LeBaron gave a report regarding the Comprehensive Master Plan. He stated that P & Z plans a couple more workshops and then in the latter part of October they would like to schedule a public hearing to look at all the sectors of the city and the draft of the Master Plan. Page 6 P & Z Minutes September 12, 1991 ADJOURNMENT Don Bowen, Secretary Planning & Zoning Commission Mr. LeBaron also stated that he met with the Consultant, Dan Boutwell, today regarding re-formatting the city's zoning ordinance. He said this was suggested by P & Z back in March. Mr. LeBaron said Mr. Boutwell will have a draft of that in a few weeks. The meeting adjourned at 8:15 P.M.
