HomeMy WebLinkAboutZBA 1991-07-18 Minutes MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS JULY 18, 1991 - 7:30 P. M. CALL TO ORDER The meeting was called to order by Chairman Torn Duer at 7:31 P.M. ROLL CALL PRESENT: Chairman Members Alt. Member Dir. Community Dev. Building Official P & Z Coordinator Tom Duer Billy Cypert Jeff Bunting Robert Skinner Jim Kemp Richard Lawson Barry LeBaron Steve Pence Wanda Calvert ABSENT: Steve Ingham Since all regular members are present, Alternate Member, Richard Lawson, will not vote. CONSIDERATION OF THE MINUTES OF JUNE 20, 1991 Mr. Kemp made the motion to approve the minutes as written. This motion was seconded by Mr. Skinner and the motion carried 4-0 with Mr. Cypert abstaining since he was not present at the meeting. 1 . BA 91-09 Request of William & Elaine McCallion to vary from Zoning Ordinance #1080, Section 24.11.2 (a) on Tract 1B16, S. Richardson Survey, Abstract 1266, to be allowed to construct a swimming pool in their side yard. This property is located at 7401 Continental Trail. Chairman Duer opened the Public Hearing and called for those wishing to speak in favor of this request to please corne forward. Mr. McCallion came forward. He stated there is no other place that he can put the pool due to septic tanks, lateral lines and flood plain. He said the only safe place to put it Page 2 Z B A Minutes July 18, 1991 would be on the west side of the house. Chairman Duer asked if he had such a drop off in the back of the house that he could not put it there. Mr. McCallion said that was correct. Mr. Skinner asked how far it was to the drop off. Mr. McCallion said it was approximately 100 feet, but that is in pasture now. He said they don't have a 100 foot back yard, they have a 20 foot back yard and the rest is in pasture and they have lateral lines there. Mr. Skinner asked where the septic tank or tanks and lateral lines are located. Mr. McCallion showed the Board where they were located. He also showed where his property severly drops off. Chairman Duer asked when was the last time it flooded there. Mr. McCallion said it was last year. He said they actually had fish in their pasture. Mr. Bunting asked what kind of fence he has around the property. Mr. McCallion said they have chain link fencing. Mr. Bunting asked if chain link fencing is good enough to enclose a pool. Mr. Pence said it has to be 6 feet high. Page 3 Z B A Minutes July 18, 1991 Mr. Kemp asked if the chain link fence is around the side yard. Mr. McCallion said it is around the side yard, also. Mr. Skinner asked Mr. McCallion if he had read the requirements in the ordinance for having a pool in the side yard. Mr. McCallion said all he knows, it is not allowed. He said that is why they have asked for a variance. Mr. McCallion said they have a professional pool builder to build the pool and feel that he knows the ordinance; his permit was turned down. Chairman Duer said if they ever continue Valley Drive and put in curbs, the property line would be approximately 10 feet from the curb. Mr. McCallion said the pool would be 7 feet from the fence. Mr. Skinner asked how far the fence had to be from the curb on a corner lot. Mr. Pence said it would depend on how the house behind it faced. Mr. McCallion said his fence is 4 feet inside the property line. He said they had just had the property surveyed and the fence is 4 feet off the property line. Chairman Duer asked how far off Continental Trail does his house set. Mr. McCallion said the house sets back approximately 75 feet. Chairman Duer called for anyone else wishing to speak in favor of this request to please come forward. Page 4 Z B A Minutes July 18, 1991 There being no one, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, Chairman Duer closed the Public Hearing. Chairman Duer explained that it takes 4 affirmative votes of the Board to approve a variance request. Chairman Duer said we had a call from a neighbor, Graham Baker, 7417 Continental Trail, who stated he has no objections to this variance request. Mr. Bunting asked when the road is planned to go through. Mr. LeBaron stated it probably would be when the property to the north is developed. Mr. Bunting asked if this road could be considered a cul de sac. Chairman Duer said it is not a cuI de sac, it is just a dead end street at this time. Chairman Duer said the edge of the pool would be 21 feet from the edge of the road if the road is ever built. Mr. Bunting made the motion to approve BA 91-09 as requested. This motion was seconded by Mr. Cypert, but the motion failed by a vote of 3-2 with Bunting, Cypert, and Duer voting for and Skinner and Kemp voting against. Mr. Skinner made the motion to deny BA 91-09. This motion was seconded by Mr. Kemp. The vote was 2-3 with Skinner and Kemp voting for denial and Bunting, Cypert and Duer voting against denial. Page 5 Z B A Minutes July 18, 1991 Chairman Duer stated the variance request has been denied since they could not get 4 affirmative votes.
