CALL TO ORDER The meeting was called to order by the Chairman, Mark Wood, at 7:30 P. M. ROLL CALL PRESENT: Chairman Vice Chairman Members Mark Wood James Brock Don Bowen Ron Lueck Don Collins Pat Marin Dir. Economic Dev./ Planning Asst. Dir. Public Works Bob Miller John Johnston ABSENT: David Barfield George Angle . CONSIDERATION OF THE MINUTES OF MARCH 22, 1990 Mr. Brock made the motion to approve the minutes as written. This motion was seconded by Ms. Marin and the motion carried 4-0 with Lueck and Collins abstaining since they were not present at the meeting. 1 . PS 89-30 Request of Cent ex Real Estate Corp. for final plat of Lots 22, 23, & 24, Block 4, Ember Oaks Addition. PS 89-30 APPROVED Mr. Collins made the motion to approve PS 89-30 subject to the Engineer's comments and recommend City Staff send a letter to E-Systems regarding the drainage as recommended. This motion was seconded by Mr. Lueck and the motion carried 6-0. 2. PS 90-01 Public Hearing for consideration of reV1Sl0ns to the Thoroughfare Plan, Ordinance #1538. . Chairman Wood opened the Public Hearing to consider several revisions to the Thoroughfare Plan. Page 2 P & Z Minutes April 12, 1990 . Chairman Wood said the Planning and Zoning Commission had been spending a lot of time the last 6 to 8 months reviewing this and now have it ready for consideration to send to the City Council. He stated there are 12 changes to be considereð: 1. Redesignating Shady Grove Road from a C4U to C2U (60 foot R.O.W.). 2. The addition of North Tarrant Parkway on the map. He said it is currently not shown. Chairman Wood said it is the road the county is constructing in the northern area of the city running east and west. 3. The addition of a portion of the proposed Precinct Line Road as a M6D size road. . 4. The re-designation of Wilson Road from P6D to C4U. 5. The extension of Douglas Lane as a C2U along its current route northward to Bursey ROàd. 6. The removal of John Autrey Road west of Aubrey Lane since there is a house there. Chairman Wood stated it could not be extended westward as is currently shown on the Thoroughfare Map. 7. The removal of Newman Drive from Harwood Road south to Grapevine Highway. Chairman Wood stated this portion of the street does not exist. 8. Changing Glenview Drive from an M5U to a M4U width. . 9. Changing the R.O.W. requirement for Grapevine Highway (Highway 26) from 120 feet to 130 feet for future expansion. Chairman Wood stated that the State Highway Department has requested this. Page 3 P & Z Minutes April 12, 1990 . 10. Eliminating the un-named C4U road between Wilson Road and Shady Grove Road from the Thoroughfare Plan. 11. Adding a C4U un-named road down by the hospital and North Hills Mall from Booth Calloway Road to Grapevine Highway. 12. Legend added to the map showing Geometric Street Design Standards. Chairman Wood called for anyone wishing to speak for or against the revisions to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PS 90-01 APPROVED Mr. Brock made the motion to approve PS 90-01, the amendments as suggested. This motion was seconded by Mr. Bowen and the motion carried 6-0. . Chairman Wood stated he has a conflict of interest in this next case, PS 90-05, and will step down and Vice Chairman Brock will take over. 3. PS 90-05 Request of B.H. & L. Joint Venture for preliminary plat of Shady Oaks Addition. Vice Chairman Brock asked if there was any comments or questions regarding this case. There were none. PS 90-05 APPROVED Ms. Marin made the motion to approve PS 90-05 subject to the Engineer's comments and a 60 foot R.O.W. being established on Shady Grove Road. This motion was seconded by Mr. Collins and the motion carried 5-0. . Doug Long asked if he could speak. ~ Page 4 P & Z Minutes April 12, 1990 . Vice Chairman Brock asked him to come forward. Mr. Long, Engineer for the project, said that in the review letter, item #9, the staff made a comment recommending a collector through the property. He asked if this is a requirement. Vice Chairman Brock said that was not part of the requirement. Chairman Wood returned to the Chair. 4. PZ 90-01 Public Hearing for consideration of revisions to Zoning Ordinance #1080. . Chairman Wood stated this is a Public Hearing for revisions to the Zoning Ordinance. He said the staff and P & Z have spent a lot of time over the past year working on revisions, clarifications, up-date, and clean-ups to the current Zoning Ordinance. Chairman Wood stated they went through each zoning category, line by line. He said they asked themselves about the format, was it clear as possible, were things in the right area, etc. He said they have had work sessions with citizens, property owners, with people from all segments of the area. Chairman Wood stated they had received a lot of input from citizens, builders, developers, and owners. Chairman Wood opened the Public Hearing and called for anyone wishing to speak to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 90-01 APPROVED Ms. Marin made the motion to approve the changes as presented and pass them on to the City Council for consideration. This motion was seconded by Mr. Brock and the motion carried 6-0. . ~ Page 5 P & Z Minutes April 12, 1990 . 5. PZ 90-06 Public Hearing for request of James R. Harris Company to rezone part of Tract 1, Brentwood Estates, from its present classification of AG Agriculture to R-2 Single Family. This property is located west of Davis Boulevard, north of Shady Grove Road and south of the northern boundary of North Richland Hills. Chairman Wood opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Dick Perkins, Engineer, came forward to represent James R. Harris Company. He stated they had already submitted a preliminary plat on this property to the city. He said this would be a single family development for R-2 zoning. Mr. Perkins stated there had previously been a plat on the property to the west of this property submitted several years ago. He said they have made some adjustments to street alignments to accommodate this tract of land also. Mr. Perkins stated it would be a 163 lot development. He said it wraps around the large elevated storage tank and the access to the property will be off Shady Grove Road. Chairman Wood called for anyone else wishing to speak in favor of this request to please come forward. There being no one, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. . PZ 90-06 APPROVED Mr. Bowen made the motion to approve PZ 90-06. This motion was seconded by Ms. Marin and the motion carried 6-0. ~ Page 6 p & Z Minutes April 12, 1990 . 6. PZ 90-07 Public Hearing for request of Sandlin-Barfield Joint Venture to rezone part of Tract 7A4, S. Richardson Survey, Abstract 1266, from its present classification of AG Agriculture to R-1 Single Family. This property is located on the east side of Davis Boulevard just east of the entrance of Thornbridge Addition. Chairman Wood opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Chairman Wood stated they previously platted this property a few meetings ago. He said this property involved trading a sliver of property in one lot for a sliver out of another lot. He stated this is just to clean up the property. . Doug Long, Engineer for Sandlin and Barfield, came forward. He stated this is a 3,000 square foot piece. Chairman Wood called for anyone else wishing to speak in favor of this request to please come forward. There being no one, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 90-07 APPROVED Mr. Lueck made the motion to approve PZ 90-07. This motion was seconded by Mr. Brock and the motion carried 6-0. . Page 7 P & Z Minutes April 12, 1990 . 7 . PZ 90-08 Public Hearing for request of Crestview Estates Joint Venture, John Barfield Trustee, to rezone part of Tract 1, Brentwood Estates, from its present classification of AG Agriculture to C-1 Commercial. This property is located at the northwest corner of Davis Boulevard and Shady Grove Road. Chairman Wood opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Doug Long came forward. He said he represents Mr. Barfield and others in this request. He said this is a part of the old Brentwood Estates, Tract 1, which is south and east of the water tower. Mr. Long stated this property fronts on Shady Grove Road and Davis Boulevard. He said they are trying to get the corner of F.M. 1938 (Davis Boulevard) zoned commercial. Chairman Woód asked if they had any plans for this property at this time. Mr. Long stated they have no prospects at this time. He said they have had some people looking and talking, but none at this time. Chairman Wood called for anyone else wishing to speak in favor of this request to please come forward. There being no one, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. . PZ 90-08 APPROVED Mr. Collins made the motion to approve PZ 90-08. This motion was seconded by Mr. Bowen and the motion carried 6-0. 1 Page 8 P & Z Minutes April 12, 1990 . 8. PZ 90-09 Public Hearing for request of Arnold & Doris Pair to rezone part of Tract 1, Brentwood Estates, from its present classification of AG Agriculture to LR Local Retail. This property is located west of Davis Boulevard and north of Shady Grove Road. Chairman Wood called Mr. Pair to come forward. Chairman Wood stated that technically you have to have 50 feet road frontage and this property does not. . Doug Long came forward. He stated that Mr. Pair has access use of the property. He said he has a 30 foot easement and R.O.W. access which has a 50 foot R.O.W. on Davis Boulevard. Mr. Long said Mr. Pair does not own this land, but he has ingress-egress to it. Mr. Miller read from the Zoning Ordinance, Section 12.4.1 (b) "Minimum frontage: Every parcel of land within this district shall have at least fifty (50) feet in frontage on a public street." Mr. Long said you can not deprive a man the use of his property. He said he does have the document that allows him to use that strip. Chairman Wood said he was going to say they could not hear this request and would refund his money, but P & Z will hear it and let it stand on it's own merits. Mr. Long stated this came up several years ago when Mark Hannon was on the Board. He said it was agreed that if you have ingress-egress to a public street, it would be okay. . Mr. Miller stated he would talk to the City Attorney. 1 Page 9 p & Z Minutes April 12, 1990 . Mr. Long stated this property is adjacent to the R-2 zoned property just heard and the C-l to the south that was just approved. He said Local Retail is a transitional zoning between residential and commercial. Mr. Long stated that Mr. Pair is willing to have a 50 foot building set back from the residential property. Chairman Wood opened the Public Hearing and called for anyone else wishing to speak in favor of this request to please come forward. Chairman Wood asked why does he need the zoning; what does he plan to do with the property. . Mr. Long stated that Mr. Pair does not have a specific use at this time, but would like to market his property. He said Mr. Pair does have his present electrician office in his home on the property and has some storage in a building behind his home at this time. Mr. Long said if you zone it to a non-conforming use, he would have 5 years to continue that use, and he would agree to that. Chairman Wood said he does not have a view from Davis Boulevard because of the Animal Clinic. Mr. Long stated the Animal Clinic is a pie-shaped property and there is view from Davis. He said they think the property would be good for a day care use. He said they would not have to have major frontage exposure. Chairman Wood stated if granted Local Retail as requested, it would be zoned for any use in the Local Retail district. . Mr. Long asked if it could be zoned Local Retail subject to a site plan submittal prior to a building permit being issued. 1 Page 10 p & Z Minutes April 12, 1990 . Chairman Wood stated that granting Local Retail would allow some uses the Commission would really not want next to a residential subdivision. Mr. Long asked if the Commission would state which ones they did not want and let Mr. Pair agree not to allow them in there. Chairman Wood stated they can not zone and limit the use. Mr. Long stated some people would not want to have to get the zoning themselves. He said Mr. Pair would rather go ahead and get the property zoned to Local Retail. . Mr. Bowen stated he questions the legality of being able to live there after it would be zoned Local Retail. He said this city does not have cumulative zoning. Mr. Long stated he looked through the Ordinance and could not find where it said, in an existing non-conforming use, which he is, he could not stay there if zoned commercial. Chairman Wood called for anyone wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Chairman Wood stated that tieing it to a site plan would be better, but would require tabling this request and having a work session with Mr. Pair. Mr. Miller stated that Local Retail does not allow for a Planned Development. . Mr. Long pointed out that a site plan is required for Local Retail zoning and he will provide one later. ~ Page 11 P & Z Minutes April 12, 1990 . Mr. Miller said Mr. Long says he will present a site plan later and requests you zone it to Local Retail with the site plan to come later. Chairman Wood said they can not approve this and send it to council without having a Public Hearing on the site plan. Mr. Long said he requests P & Z approve the Local Retail zoning with the stipulation that a Public Hearing on a site plan must be approved prior to issuing a building permit. Chairman Wood stated that would put a big burden on the City Staff to keep up with that. . Mr. Long said he could bring them a "white washed" site plan, but they have no idea what they plan to do with the property, but if that is what the P & Z wants, we request it be tabled until they can bring in a site plan. Chairman Wood stated that a "white washed" site plan is not what P & Z wants, but we had rather you wait until you have something to bring to us. Mr. Miller stated that the City Manager requires us not to bring anything to council unless it is complete, and this is not complete. Mr. Lueck asked Mr. & Mrs. Pair if not having this zoning would hinder the marketing of their property. He said it could be sold subject to getting the zoning. . Mr. Pair said they have the water tower beside them, the Animal Clinic in front of them, and commercial around them and for residential, it would be hard to market. Page 12 P & Z Minutes April 12, 1990 . . PZ 90-09 TABLED ADJOURNMENT ~~~~ Secretary Planning & Zoning Commission . ~ Mr. Lueck said he was not suggesting they market it for residential. Mr. Long said he could draw up a site plan for a day care or something and Mr. Pair could market it based on the site plan. Mr. Miller said you could have the site plan where it could be used as a day care or an office building. Ms. Marin said she feels there are still too many questions to just zone it Local Retail without a site plan or any answers. She said she feels they could be limiting him with Local Retail zoning. Mr. Lueck said he does not feel that technically they can approve it without a site plan. Mr. Long asked that the case be tabled. Mr. Bowen made the motion to table PZ 90-09 as requested. This motion was seconded by Mr. Lueck and the motion carried 6-0. The meeting adjourned at 8:20 P. M. Chai Commission
