HomeMy WebLinkAboutPZ 1990-09-13 Minutes . MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS SEPTEMBER 13, 1990 - 7:30 P. M. CALL TO ORDER The meeting was called to order by Chairman Mark Wood at 7:35 P.M. ROLL CALL PRESENT: Chairman Vice Chairman Secretary Members Dir. Community Dev. Asst. Director p/W P & Z Coordinator Mark Wood James Brock David Barfield Don Bowen Ron Lueck Don Collins Pat Marin Barry LeBaron John Johnston Wanda Calvert ABSENT: George Angle CONSIDERATION OF THE MINUTES OF AUGUST 23, 1990 Mr. Brock made the motion to approve the minutes as written. This motion was seconded by Mr. Barfield and the motion carried 5-0 with Mr. Collins and Ms. Marin abstaining since they were not present at the meeting. . ELECTION OF OFFICERS Chairman Wood stated the Rules and Procedures for the Planning and Zoning Commission states the election of officers will be held in January and this will be postponed until that time. DATES OF PENDING MEETINGS Chairman Wood stated the October 11th Planning and Zoning meeting will have to be changed to Monday night, October 15th due to the reception for Boards and Commissions being held on the 11th of October. . Chairman Wood stated that due to the fact that Thanksgiving and Christmas falls either on or near the Planning and Zoning Commission meetings, the November 22nd and December 27th meetings will be cancelled. He said if an emergency arises, they can schedule a special meeting. ~ " Page 2 P & Z Minutes September 13, 1990 . 1. PS 90-20 Request of Gary B. Starnes and James M. Starnes for revised Preliminary Plat of Orange Valley Addition. This property is located at the northeast corner of Starnes Road and Douglas Lane. PS 90-20 APPROVED/STIPULATION Mr. Barfield made the motion to approve PS 90-20 subject to the Engineer's comments. This motion was seconded by Mr. Bowen and the motion carried 7-0. 2. PS 90-21 TABLED 8/23/90 Request of Gary B. Starnes and James M. Starnes for Final Plat of Orange Valley Addition. This property is located at the northeast corner of Starnes Road and Douglas Lane. PS 90-21 APPROVED/STIPULATION Mr. Brock made the motion to approve subject to the engineer's comments. This motion was seconded by Mr. Bowen and the motion carried 7-0. . Mr. Barfield said he would like to request a letter be sent to the City Council conveying the P & Z's thoughts regarding an easement on the 6 acre tract and the breachment for the dam, if necessary. 3. PS 90-22 Request of James R. Harris with Shady Oaks Development Corporation for Final Plat of Shady Oaks Addition. This property is located west of Davis Boulevard and north of North Tarrant Parkway. PS 90-22 APPROVED/STIPULATIONS Mr. Bowen made the motion to approve PS 90-22 subject to the engineer's comments with the exception of numbers 17 and 18 and with the addition that the sewer stub-out be extended to the north city limit line. PZ 90-09 TABLED 4/12/90 Public Hearing for request of Arnold & Doris Pair to rezone part of Tract 1, Brentwood Estates, from its present classification of AG Agriculture to LR Local Retail. This property is located west of Davis Boulevard and north of Shady Grove Road. Owen D. Long, Engineer representing Mr. and Mrs. Pair, came forward. He requested to continue this hearing at a later date when they have the problems worked out. He said they will come back as soon as they can. PZ 90-09 TABLED 9/13/90 Mr. Barfield made the motion to table PZ 90-09. This motion was seconded by Mr. Lueck and the motion to table carried 7-0. 5. PZ 90-13 Public Hearing for request of R. K. Nair & Pedro Ramirez to rezone Lots 11, 12, 13, & 14, Block 8, Richland Heights Addition, from their present classification of R-2 Single Family to 0-1 Office District. This property is located on the southeast corner of Rogan Drive and Booth Calloway Road. . Chairman Wood opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Ramesh K. Nair, 7505 Glenview Drive, came forward. He stated that Booth Calloway Road is getting busier and busier. He said he wants to use this property as a doctor's office. Mr. Nair said they would make the office building look like residential. He said it would be single story like a house. Chairman Wood called for those wishing to speak in opposition to this request to please come forward. . ~ j ~ Page 4 P & Z Minutes September 13, 1990 " . Janie Hernandez, 7801 Rogan Drive, came forward. She stated she has lived there for 20 years. She said they have problem with traffic in the neighborhood now. Ms. Hernandez said they have already had an accident which injured her grandchild. She said she would like to keep this area residential. Don VanDever, 4309 Ashmore Drive, came forward. He said he had lived there for 12 years. He said it is a neat neighborhood. He said according to the tax roll, he has a $100,000 investment there. Mr. VanDever said these neighbors maintain their homes very well. He said they have to continually come down here and defend to keep this property residential. He said he thinks the city feels the same way because they built a park for them in the area. . Pat Marrs, 4313 Ashmore Drive, came forward. She said she had lived there for 22 years. She said she feels if they allow a doctor's office there, it would be a mistake. Lawrence Vaughn, 4317 Ashmore Drive, came forward. He said this is about the 4th time they have had to come up here. He said majority rules and he has no problem getting a majority. Mr. Vaughn said this spot zoning. Mr. Vaughn said he heard that a real estate person had sent out papers saying that all you have to do is fill out a form and pay $300 and you can get a zoning. Lee Centella, 7812 Rogan, came forward. He said he lived next to the property in question. He said how would you like to live next door to a doctor's office. Mr. Centella said they have a very nice neighborhood. He said both these doctors have offices on Booth Calloway. . ~ j Page 5 P & Z Minut~s September 13, 1990 . Carol Centella, 7812 Rogan Drive, came forward. She said they have lived there for 6 years. She said they have a nice home and they have spent a lot of time on it. Ms. Centella said the neighbors take care of their homes. Ms. Centella said there are plenty of other offices available. Bill Otwell, 4308 Ashmore Drive, came forward. He said he has been a resident of North Richland Hills since 1957 and has lived here since 1965. He said he knew the area real well when he chose to live here. Mr. Otwell said he would like to keep it residential. He said it was turned down in 1984 and in 1987, they had a meeting at the hospital about it. . Nick Massey, 7829 Rogan Drive, came forward. He said this is a distinct community, blocked by roads. He said these constant requests for rezoning is tearing these people apart. Mr. Massey said there is adequate space in the area for doctors already. He said it would make the area unsafe. Robert Gault, 7831 Rogan Drive, came forward. He said the value of the homes would go down if an office were built there. Chairman Wood called for anyone else wishing to speak to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Bowen said this has come up before and the city cannot keep them from requesting a change, but he does not think they should allow any commercial type encroachment into the residential. He said it may go someday, but not now. . ~ " Page 6 P & Z Minutes September 13, 1990 . Chairman Wood stated their deed restrictions most likely would not allow commercial activity. Mr. Bowen said if there was a paper passed around saying you could fill out a form and pay $300 and get a zoning change, he would like to see it. He said you can apply, but that is only a request. Mr. Lueck said if that is all you had to do, there would be no need for him to be sitting up there wasting his time. PZ 90-13 DENIED Mr. Bowen made the motion to deny PZ 90-13. This motion was seconded by Mr. Collins and the motion to deny carried 7-0. 6. PZ 90-14 Public Hearing for request of Keith & Jo Ellen Anderson to rezone a portion of Tract 3D, T.K. Martin Survey, Abstract 1055, from its present classification of AG Agriculture to R-l Single Family. This property is located on the east side of Crane Road south of Amundson Road. . Chairman Wood opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Mrs. Anderson came forward. She said they wish to build a single family dwelling on this property. Chairman Wood called for anyone wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. . PZ 90-14 APPROVED Mr. Lueck made the motion to approve PZ 90-14.
