MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
FEBRUARY 15, 1990 - 7:30 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Tom Duer, at 7:32 P.M.

Since all regular members are present,
Alternate Member, Jim Kemp, will not
vote.

CONSIDERATION OF THE MINUTES
OF JANUARY 18, 1990
Mr. Hubbard made the motion to approve
the minutes as written. This motion
was seconded by Mr. Skinner and the
motion carried 4-0 with Mr. Bunting
abstaining since he was not present at
the meeting.

BA 90-01
Request of J. Marc Hesse, Attorney for
Hilltop Apartments, to vary from the
Zoning Ordinance #1080 on Lot 1, Block
2, Tapp Addition, to allow building to
be built 3 feet beyond the building
line parallel to Industrial Park
Boulevard. This property is located
on Industrial Park Boulevard, west of
Rufe Snow Drive.
Chairman Duer opened the Public
Hearing and called for those wishing
to speak in favor of this request to
come forward.

Marc Hesse, Attorney, came forward.
He stated his client acquired this
property in December and when the
survey was done, they found a 3 foot
encroachment to the building line.

Mr. Hesse stated that these apartments
have been in existence since 1984, and
as new owners, they felt they needed
this variance.
Chairman Duer called for anyone
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
BA 90-01
APPROVED
Mr. Cypert made the motion to approve
BA 90-01 as requested. This motion
was seconded by Mr. Hubbard and the
motion carried 5-0.

Bob Williams stated he came to work
for the City in 1984 and this project
was already completed. He stated he
did not know when the project started
or how the error happened.
Chairman Duer recognized two Richland
High School Students, Angie Carpenter
and Sheri Stanislaw, who came as a
class project to observe this Board.
Chairman Duer explained the duties of
the Zoning Board of Adjustment. He
also stated that after the Board acts,
the only recourse for the applicant is
the Courts.
The girls asked if it offended the
Board when they are taken to court.
Chairman Duer stated it did not.
Mr. Kemp stated that lots of their
cases are from people who do not get
building permits.

Mr. Skinner explained that the Board
consists of residents of North
Richland Hills appointed by the City
Council. He stated their main purpose
is to interpret the Zoning Ordinance.

The students asked if the Board got
paid for their services.
Mr. Skinner stated they get no money.
