MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
JUNE 21, 1990 - 7:30 P. M.
CALL TO ORDER
The meeting was called to order by
Chairman Tom Duer at 7:32 P.M.

CONSIDERATION OF THE MINUTES
OF MAY 17, 1990
Mr. Skinner made the motion to approve
the minutes as written. This motion
was seconded by Mr. Hubbard and the
motion carried 3-0 with Mr. Lawson
abstaining since he was not present at
the meeting.

Request of Classic Concepts Custom
Homes to vary from the Zoning
Ordinance #1080 on Lot 4, Block 4,
Sunnybrook Addition, to allow house to
be 5 feet beyond the side building
line. This property is located at the
southeast corner of Westgate Drive and
Southgate Drive.
Chairman Duer opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Bob Kohsmann with Classic Concepts
Custom Homes came forward. He stated
he is building in Sunnybrook Addition;
he has 10 lots. He said he built the
house across the street from this lot
and some people want to buy one like
it on this lot. Mr. Kohsmann said he
did not realize the setback was
different on this lot from the one

across the street until he had the
plans drawn up. He said it is a large
house over 2,500 square feet and the
garage will be open to the Southgate
side.
Mr. Kohsmann submitted a letter from
the property owner across the street
stating he had no objection to this
variance. Mr. Kohsmann stated that
Classic Concepts owns the lots
adjoining this lot. He said he had
checked and the visual effect is
non-existent.

Chairman Duer explained to Mr.
Kohsmann that there are only 4 Board
members present tonight and it takes 4
affirmative votes to approve a
variance. He said if Mr. Kohsmann
wanted to, they could postpone this
request until there are 5 members
present.
Mr. Kohsmann stated he would rather
have it heard tonight.
Mr. Skinner asked how large the house
would be.
Mr. Kohsmann said it would be 2,540
square feet.
Mr. Skinner asked what the address
would be.
Mr. Kohsmann said it would be 6444
Westgate Drive. He said he had to do
a little revising to get the house to
fit on the lot with the 5 foot
variance.
Chairman Duer stated the plat must
have been done before the plans for
Cardinal Lane.
Mr. Kohsmann said Lot 1, Block 5 is
unbuildable.

Mrs. Calvert stated that is because it
is located in the flood plain.
Chairman Duer said Lot 1, Block 6, is
a corner lot and it does not show a
side building line.
Mr. Skinner asked Mr. Kohsmann if he
plans to build a fence.
Mr. Kohsmann said they do not usually
put up fences, but he would if
necessary.
Mr. Skinner stated the fence would
have to be built on the original 25
foot building line.
Mr. Hubbard asked Mr. Kohsmann if he
said he owns the house next to this
lot.

Mr. Kohsmann said he does; he owns 10
lots in the subdivision.
Mr. Hubbard asked Mr. Kohsmann if he
would write the purchasers of this
house a letter stating about the fence
and send the city a copy of it for our
files.
Mr. Kohsmann said he would.
Chairman Duer called for those wishing
to speak in opposition to this request
to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Chairman Duer asked if there had been
any correspondence received.
Mrs. Calvert stated there had been
none.

Mr. Hubbard stated he would feel
better if they requested a letter
regarding the fence.

ADJOURNMENT

Mr. Hubbard made the motion to approve
BA 90-08 as requested with a
stipulation that the applicant write a
letter to the buyers of the property
stating the fence would have to be on
the 25 foot building line and a copy
sent to Wanda Calvert at the city.
This motion was seconded by Mr.
Skinner and the motion carried 4-0.
The meeting adjourned at 7:55 P.M.
