MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
OCTOBER 18, 1990 - 7:30 P. M.
CALL TO ORDER
The meeting was called to order by
Chairman Tom Duer at 7:30 P.M.

CONSIDERATION OF THE MINUTES
OF AUGUST 16, 1990
Mr. Ingham made the motion to approve
the minutes as written. This motion
was seconded by Mr. Skinner and the
motion carried 4-0 with Mr. Cypert
abstaining since he was not present at
the meeting.
CONSIDERATION OF THE MINUTES
OF SEPTEMBER 20, 1990
Mr. Ingham made the motion to approve
the minutes as written. This motion
was seconded by Mr. Cypert and the
motion carried 2-0 with Duer, Skinner,
and Kemp abstaining since they were
not present at the meeting.

POSTPONED 9/20/90
WITHDRAWN
Request of John N. Hudson to vary from
the Zoning Ordinance #1080 on Lot 7,
Block 5, Emerald Hills Addition, to be
allowed to build a carport and walkway
cover beyond the front building line.
This property is located at 7924
Donegal Lane.

This case was withdrawn after the
applicant complied with Ordinance
#1080 and the variance request fee was
refunded.

Request of Ozz Yazell for Charles
Quick to vary from the Zoning
Ordinance #1080 on Lot 26, Block 4,
Briarwood Estates, to be allowed to
close in his 2-car garage without
providing covered parking as required
in Ordinance #1080. This property is
located at 7112 Post Oak Drive.
Chairman Duer opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Ozz Yazell, 5613 Cork Lane, came
forward. He stated he is the son of
Charles Quick, owner of the property
in question. Mr. Yazell stated that
his sister had to move back home and
they are in need of more room. He
said she was having to sleep in the
living room now.

Mr. Skinner asked what the
approximate distance between the back
of the property and the edge of his
2-car garage.
Mr. Yazell said it was 15 feet with a
6 foot utility building on it. He
said there is a very steep incline.
He said the city told him that for a
2-car covered parking, it would have
to be 18 feet by 18 feet. Mr. Yazell
stated there would be plenty of
parking on the drive way and also they
live on a corner lot.
Chairman Duer said they would need a
good emergency brake on the cars due
to the incline.
Mr. Yazell stated this would be
professionally built and it would be
permanent. He said they have a Grand
Mother who will probably be joining
them in a few years.

Chairman Duer asked Mr. Yazell if he
was aware that even if he is granted
this request, there can not be a
separate cooking area. He said no two
family dwellings are allowed in this
area.
Mr. Yazell said he realizes that. He
said it would only be a room and a
little storage.
Mr. Kemp asked how far it was from the
curb to the garage door.
Mr. Yazell said after the city's 9~
feet and the 20 foot building line,
there is 6 feet 6 inches to the garage
door. He said with it all, there is
forty feet to the curb and there are a
lot of trees.

Mr. Skinner said, looking at the
drawing at the back bedroom, could you
extend another bedroom? He asked if
there are trees there?
Mr. Yazell said there are trees all in
the front where they could not get to
the back for a drive way for covered
parking, and as far as putting another
bedroom back there, the cost would be
prohibitive; they just could not
afford it.
Chairman Duer asked about building a
2-car garage in the back.
Mr. Yazell said there would not be a
way to get to it.

Chairman Duer said you have 9 feet of
access plus the utility easements and
you can pour concrete over an
easement. He said you have 15 feet on
the east side of the house where you
could put a driveway and then a garage
in the back. Chairman Duer said there
would be enough area for a 23 by 17
foot garage. He said the cost would
be less for the shell garage than for
a bedroom.

Chairman Duer asked how many live
there.
Mr. Yazell said his Mother and Father,
his brother and sister and now another
sister.
Chairman Duer said the reason for the
requirement for covered parking is so
the streets do not become parking
lots.
Mr. Yazell said they have a very large
driveway that will hold 4 cars.
Mr. Ingham asked if Mr. Quick built
the house originally.

Mr. Yazell said no, they purchased the
house 2 years ago. He said it was
large enough at that time, but there
are problems, the family stands by
each other. He said they lost their
Grand Father a few years ago and at
some time in the near future, the
Grand Mother will come to live with
them. Mr. Yazell said they plan to
stay in North Richland Hills.
Chairman Duer asked if he knows of any
houses in this area with the garage
enclosed.
Mr. Yazell said he was not aware of
any, but he has not gone up and down
the street looking. He said he works
for a general contractor and they plan
to do the work. Mr. Yazell said it
will not look like a garage
conversion.

Charles Quick, owner of the property,
came forward. He stated that, as his
son has said, they are family and when
they have problems, you do turn to the
family. He said there are a few
garage conversions on the side streets
in the area, but they have been done
very decoratively. Mr. Quick said he
knows his son will do the same.

Mr. Quick said he would appreciate the
Board's consideration in this matter.
Chairman Duer called for anyone
wishing to speak in opposition to this
request to please come forward.
There being no one, the Chairman
closed the Public Hearing.
Chairman Duer stated there had been no
correspondence.
Chairman Duer explained that in order
to approve a request, there has to be
4 affirmative votes to approve a
request.
Mr. Kemp stated that it does appear
they have a hardship due to the family
situation.

Chairman Duer said yes, and also there
is some hardship due to the structure
of the property. He said if they put
in a carport, it would be the tallest
carport in North Richland Hills.
Chairman Duer said they need to try to
keep the integrity of the
neighborhood. He said he would like
to have them look at putting up a
small carport for at least one car to
have some covered area, if possible,
to the side or rear.

Mr. Quick said that is financially
impossible and also the property
drains to the back yard and there is a
drainage problem there. He said his
daughter is paying for this. Mr.
Quick said he is an independent sales
representative and has lost 2 lines.
He said he has been unemployed for
approximately 6 months, but said we
will take care of her and at some time
his Mother-in-Law will need to be
taken care of. Mr. Quick said he and
his wife agreed when they got married
that if either of their parents were
left alone, they would take care of
them. He said they had to sell a

5,000 square foot house on Riviera
that was built primarily for them.
Mr. Quick said there is no way he
could financially build the car port
you asked about. He said it would
be so expensive to try to fix the
drainage to keep it off the patio
and out of the den.
Mr. Quick explained how it would not
be possible to fit the car port in the
back yard.

APPROVED
Mr. Kemp made the motion to approve
BA 90-17. This motion was seconded by
Mr. Ingham and the motion carried 4-1
with Mr. Skinner voting against the
request.

Chairman Duer said you do realize you
have to get permits and build this to
the letter of the law. He said in
case you decide you want to build
covered parking out in the front, you
would have to come back to this Board
for another variance request.
Mr. Yazell said he realizes that. He
said it would look like part of the
house.
ELECTION OF OFFICERS
Mr. Cypert made the motion that Dr.
Duer be chosen as Chairman. This
motion was seconded by Mr. Cypert and
the motion carried 4-0 with Dr. Duer
abstaining from voting.
The Board decided they did not need a
secretary.
ADJOURNMENT
The meeting adjourned at 7:55 P.M.
