CALL TO ORDER The meeting was called to order by Chairman Tom Duer at 7:30 P.M. ROLL CALL PRESENT: Chairman Members Alt. Member Dir. Community Dev. Code Enforcement P & Z Coordinator Tom Duer Robert Skinner Jim Kemp Steve Ingham Barry LeBaron Paula Cline Wanda Calvert ABSENT: Billy Cypert Jeff Bunting Richard Lawson Since there are absentees, Alternate Member Steve Ingham will vote. . CONSIDERATION OF THE MINUTES OF NOVEMBER 15, 1990 Mr. Kemp made the motion to approve the minutes as written. This motion was seconded by Chairman Duer and the motion carried 2-0 with Mr. Skinner and Mr. Ingham abstaining since they were not present at the meeting. 1 . BA 90-18 Request of R. E. Wright to vary from the Zoning Ordinance #1080 on Lot 9, Block 9, Woodcrest Addition, to be allowed to have a TV Satellite Disc Receiver on the top of his house instead of in the rear yard behind a 6 foot fence of wood or masonry construction as required in Section 14.10.2 of the Zoning Ordinance #1080. This property is located at 4836 Wedgeview Drive. Chairman Duer opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Bob Wright, 4836 Wedgeview Drive, came forward. He stated the reason he needs the variance is there is no other place to put the antenna. He ~ ~ Page 2 Z B A Minutes December 20, 1990 . said there are too many trees in his back yard and his neighbor's yard also. Mr. Wright showed pictures of his home and others in the city who have TV Receivers. He said there are Ham antennas, TV antennas on towers, and TV Satellite Disc Receivers. Mr. Wright stated he was not complaining about them. Chairman Duer asked Mr. Wright when he put up his TV Satellite Disc. Mr. Wright said three or four months ago. Chairman Duer asked if he got a permit. . Mr. Wright said he did not. He said he put the antenna up himself. He said it is a 7~ foot unit. He said he wanted one as small as he could get since he had to have it on the roof. Mr. Wright said he would prefer to have a 12 foot dish in the back yard, but it would not work. Leroy Coffman, 4828 Wedgeview Drive, came forward. He said he thinks that if the Board grants this variance, that he (Mr. Coffman) should be allowed to have a Disc Receiver on his house also. Mr. Coffman said he lives two doors down from Mr. Wright. He said he does not object to this variance but feels he should be allowed to have one too. Mr. Wright said he contacted several of the cities around and some had ordinances allowing them to be 35 to 38 feet high. He said his problem is too many trees. Chairman Duer asked when this ordinance was adopted. . Mr. LeBaron stated it was May, 1987. r'" 1 Page 3 Z B A Minutes December 20, 1990 . Chairman Duer called for anyone else wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one, the Chairman closed the Public Hearing. Mr. Skinner asked Mr. Wright if he applied for a permit and was turned down. Mr. Wright said he never applied for a permit. He said he was told he was in violation so he came down and applied for a variance. . Mr. Skinner said, if granted the variance, Mr. Wright would get a permit. Mr. Wright said he would. Mr. Ingham said he had a fear that if the Board grants this request, they would have an abundance of people wanting them. Mr. Wright said he had done research on the Satellite Disc Receivers. He said they should be unobstructed. He said he cut a hole in the roof and attached it to the ceiling joist. He said it is 3 or 4 feet from the peak of the roof. Mr. Wright said it should be on the ground, in concrete, on a 25 to 30 foot pole. . Chairman Duer explained that it takes 4 affirmative votes to approve a variance and since there are only 4 members present, if one votes in opposition, the request would not pass. He asked Mr. Wright if he would like them to postpone the request until the January meeting in hopes the Board would have 5 members present. ~ ~ Page 4 Z B A Minutes December 20, 1990 . Mr. Wright said he would like to wait. BA 90-18 POSTPONED Mr. Ingham made the motion to postpone BA 90-18 until the January meeting. This motion was seconded by Mr. Kemp and the motion carried 4-0. Mr. Wright stated that the Federal Government said cities can not deny citizens antennas. Chairman Duer said the city is not denying you the right to have a Receiver. He said maybe the ordinance needs to be revised and up dated. He said to talk to the City Councilor at a Town Hall meeting. 2. BA 90-20 Request of Craig & Vie Ferrara to vary from the Zoning Ordinance #1080 on Lot 16, Block 23, Kingswood Estates, to be allowed to build a house beyond the side building line on the south to allow enough room on the north side to put a driveway. This property is located at 7501 Acts Court. . Chairman Duer opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Craig Ferrara came forward. He said this is a corner lot and he purchased it for his home. He said the houses across the street have access to Starnes Road. Mr. Ferrara said he needs to bring the house 4 or 5 feet to the south so he can put a driveway on the north side. He said his property is about 10 feet higher than the street. Mr. Ferrara said he has only 6 feet on the north side. He said if he does not get this variance, he could only build a house 42 feet wide and the stipulation is for at least an 1800 square foot house. . Mr. Skinner asked if he brings the drive way down the side, how far would it be from the neighbor. ~ 1 Page 5 Z B A Minutes December 20, 1990 . Mr. Ferrara said the concrete drive would go to the property line. He said there would be 12 feet between the houses now. Mr. Skinner asked if there would be an incline on the driveway. Mr. Ferrara said there would be about a 6 foot rise. He showed pictures of the area. He said that the Public Works Department said they messed up on the houses across the street; they said they are not supposed to allow them on collector streets. Mr. Ferrara said he will reverse the house plans to have the driveway on the north side. He said he plans to build a 2300 square foot house. . Chairman Duer called for anyone else wishing to speak in favor of this request to please come forward. There being no one, the Chairman called for anyone wishing to speak in opposition to this request to please come forward. There being no one, the Chairman closed the Public Hearing. Mr. Kemp stated that he feels this is a hardship with the ordinances like they are. Chairman Duer said the ordinance is there because of the traffic on collector streets. BA 90-20 APPROVED Mr. Ingham made the motion to approve BA 90-20. This motion was seconded by Mr. Kemp. Chairman Duer said if granted the 4 foot variance, the driveway will have to be on the north side. . The motion was approved by a vote of 4-0. ~ ~ Page 6 Z B A Minutes December 20, 1990 . Mr. Skinner said he would like to make a motion that this Board send a copy of Case Number BA 90-18 to the Planning and Zoning Commission requesting they, with much urgency, look at revising the ordinance regarding TV Satellite Disc Receivers, and that one or more members, preferably the Chairman, be present at the January ZBA meeting. Chairman Duer said he felt something in writing would be sufficient from the Planning and Zoning Commission. Mr. Ingham seconded Mr. Skinner's motion and the motion carried 3-1 with Chairman Duer voting against because he does not feel the P & Z members have to be present at the January meeting. .
