CALL TO ORDER The meeting was called to order by the Chairman, Mark Wood, at 7:30 P. M. ROLL CALL PRESENT: Chairman Secretary Members Alt. Member Dir. Since there are absentees, Mr. Angle will be voting. CONSIDERATION OF THE MINUTES OF NOVEMBER 9, 1989 Mr. Lueck made the motion to approve the minutes as written. This motion was seconded by Mr. Barfield and the motion carried 5-0 with Mr. Angle abstaining since he was not present at the meeting. 1 . PS 89-23 Request of Centex Real Estate Corp. for replat of Lots 1R and 6R thru 9R, Block 11, Lots 1 thru 4, Block 12R, & out Lots 6 & 7, Fair Oaks Estates, 2nd Filing. PUBLIC HEARING Chairman Wood opened the Public Hearing and called for those wishing to speak in favor of this replat to please come forward. . Dick Perkins with Teague NaIl & Perkins, came forward to represent Centex in their request. Page 2 P & Z Minutes December 14, 1989 · Mr. Perkins said basically, they are just trying to clean up the property. He said it has changed owners several times and they had to change the right of way and width of the road. Mr. Perkins stated they have made some changes since the original platting. Chairman Wood stated the Commission is concerned with the out lots. He asked why they didn't give them to the adjacent property owners. Chairman Wood stated the out lots would cause a traffic problem at the two ends of Bursey Road and Bursey Road South. Mr. Perkins stated the area of that right of way would be just asphalt, not curb and gutter. Mr. Miller stated he could not tell why the City Staff agreed with that in 1985. · Chairman Wood stated it creates an island. Mr. Perkins stated that Bursey Road South is to be used as a driveway access. He said that pavement will be removed. He said some day they plan to vacate and deed back to thp property owners. Mr. Perkins stated that the owner wil~ be required to sign a covenant runnin~ with the land that he would pay his share if Bursey Road South is ever rebuilt. Mr. Barfield stated he has real problems with the street names Bursey Road and Bursey Road South. He said there would be problems with addressing. · Mr. Perkins stated there would not be any houses on Bursey Road South going north, but if you want it renamed, you should contact the people who have lived there for years. He said keeping Bursey Road through the subdivision matches the Thoroughfare Plan. Page 3 P & Z Minutes December 14, 1989 . Adiene Jones, 7512 Bursey Road, came forward. She said her property joins out lots 6 & 7 as shown on the last submission of the replat. She said they had promised to put her in a driveway. Mr. Perkins stated the plans show a concrete driveway up to Ms. Jones' north property line. Ms. Jones stated she does want to discuss this and make sure of what they promise. Mr. Perkins stated that Mr. Stolty with Centex will work with the property owners and if another driveway is needed, they will consider it, but if it gets too far west, they might not want to put two driveways. . Chairman Wood called for those wishing to speak in opposition to this plat to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PS 89-23 APPROVED Mr. Barfield made the motion to approve PS 89-23 subject to the engineer's comments and the portion of old Bursey Road be eliminated, new driveways be built, and a covenant signed for the street. He suggested they get together for a name change of the street. The motion was seconded by Mr. Lueck and the motion carried 6-0. Chairman Wood stated the next two cases will be heard together, but voted on separately. 2. PS 89-27 Request of Owen D. & Mary E. Long for preliminary plat of Lots 1 & 2, Block 33, and Lots 1 & 2, Block 34, Fox Hollow Addition. . Page 4 P & Z Minutes December 14, 1989 . 3. PS 89-28 Request of Owen D. & Mary E. L0n? for final plat of Lots 1 & 2, Block 33, and Lots 1 & 2, Block 34, Fox Hol1o~\1 Addition. Doug Long came forward. He said TU Electric had requested additional easements between Lots 1 & 2, Block 33 and Lots 1 & 2, Block 34. He said he called Mr. Scott at TU Electric requesting to not have to do that and Mr. Scott agreed not to require them. Mr. Long stated that in Commercial Zoning, you can build a building right on the line and he wants to be able to do that. PS 89-27 APPROVED Mr. Lueck made the motion to approve PS 89-27. This motion was seconded by Mr. Bowen and the motion carried 6-0. . PS 89-28 APPROVED Mr. Bowen made the motion to approve PS 89-28. This motion was seconded by Mr. Barfield and the motion carried 6-0. 4. PS 89-29 Request of Sandlin-Barfield Joint Venture for final plat of Thornbridgp Addition, Phase I. PS 89-29 APPROVED Mr. Bowen made the motion to approvp PS 89-29 subject to the engineer's comments. This motion wa.s seconded by Mr. Lueck and the motion carried 6-0. 5. PZ 89-23 Request of Adiene Jones to rezone Lot 1, Block 1, Barlough Addition, from its present classification of C-2 Commercial to 1-2 Industrial. This property is located at the southwest corner of Smithfield Road and Main Street. PUBLIC HEARING . Chairman Wood opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Page 5 p & Z Minutes December 14, 1989 . Adiene Jones came forward. She stated that when they bought the property iTl 1975, it was multiple zoning, but in 1984, the City changed it. She said her husband was sick at that time and they did not contest it. Ms. Jones stated they rented a space to a machine shop, but when it was changed, they took that classification away from them. She stated she was not at the hearing. Ms. Jones stated she is requesting her zoning be changed to 1-2. She stated she had a tenant who paid a deposit, but she had to give the deposit back to him. She said she does not want to have this to happen again. Ms. Jones stated that the adjoining property is 1-2. Mr. Angle asked if she has a machine shop in there now. . Ms. Jones stated they build the building in 1977 or 1978 for a machine shop. She stated the machine shop stayed there for 5 years and moved out; then another one moved in. Shp said they are still there, but sincp 1984, they have been grandfathered. Mr. Angle asked Ms. Jones if she had lost a tenant due to the zoning and had she been able to find a tenant for C-2 zoning. Ms. Jones stated it is hard to find tenants now. She said she has lost tenants several times before because of the zoning classification. Chairman Wood called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. . Mr. Barfield stated there is Industrial zoning across the street and Industrial to the south of this property. Mr. Bowen stated he agrees with Mr. Barfield. He said this is a 4 acre tract with 1-2 around it. Chairman Wood stated that the property owners within 200 feet of this property were contacted and no one showed up in opposition. Mr. Bowen made the motion to approve PZ 89-23. This motion was seconded by Ms. Marin and the motion carried 6-0. The meeting adjourned at 8:05 P. M. Chai Connnission
