HomeMy WebLinkAboutZBA 1989-05-18 Minutes . MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS MAY 18, 1989 - 7:00 P. M. CALL TO ORDER The meeting was called to order by the Chairman, Ron Hubbard, at 7:00 P.M. ROLL CALL PRESENT: Chairman Vice Chairman Member Alt. Member Dir. Community Dev. Code Enforcement Ofc. P & Z Coordinator Ron Hubbard Forrest Grubb Billy Cypert Tom Duer Danny Taylor Ken Miller Wanda Calvert ABSENT: Harold Schubert Jeff Bunting Jim Kemp CONSIDERATION OF THE MINUTES OF MARCH 16, 1989 Mr. Grubb made the motion to approve the minutes as written. This motion was seconded by Mr. Cypert and the motion carried 3-0 with Dr. Duer abstaining since he was not present at the meeting. . 1. BA 89-4 Request of Chandler Sign Company to vary from the Zoning Ordinance #1080 on a portion of Lot 1, Block 1, Somerset Addition, to be allowed to install a sign on Bedford Euless Road at the entrance to the restaurant. This property is located at 7920 Bedford Euless Road. Chairman Hubbard opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Jim Hagle with Chandler Sign Company came forward. He said he was representing Iva Ward who owns the restaurant. He said they are requesting this variance due to hardship. He showed pictures of the existing signs. Mr. Hagle stated this restaurant was previous the Kettle. Page 2 Z B A Minutes May 18, 1989 . He said the property fronts on Northeast Loop 820, but the entrance and address are on Bedford-Euless Road. Mr. Miller stated they do not have the 50 foot frontage requirement on Bedford Euless Road. Alternate Member Jim Kemp came in at 7:05 P. M. Mr. Hagle stated this would be a 6 feet by 9 feet sign on existing steel and they would take down the "restaurant" sign. He said it is not going to be a neon sign, but it will increase her business 10 to 15%. Mr. Hagle said this lady needs some help. . Mr. Grubb asked if the building belongs to La Quinta. He said La Quinta faces both ways. Mr. Hagle said La Quinta owns the property and Ms. Ward owns the business. He said La Quinta has signs on both sides. Mr. Grubb said it would make business better for La Quinta, also. Dr. Duer asked if La Quinta approves of putting the sign there. Mr. Hagle said they do and he could get written approval if needed. Chairman Hubbard called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. . Chairman Hubbard asked if there had been any correspondence. Mrs. Calvert said there had been none. Page 3 Z B A Minutes May 18, 1989 . BA 89-4 APPROVED Dr. Duer made the motion to approve BA 89-4 with the stipulation that it meet the sign ordinance. This motion was seconded by Mr. Kemp and the motion carried 5-0. 2. BA 89-5 Request of James M. Knight to vary from the Zoning Ordinance #1080 on Lot 21, Block 3, Western Oaks Addition, to be allowed to install a fence beyond the side building line. This property is located at 7708 Rolling Ridge Court. Chairman Hubbard opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Mr. Knight came forward. He said he bought the house about 6 months ago and now wishes to put up a fence. He said he has a list of property owners in the area who are in favor of this request. Mr. Knight said the iron rods are 10 to 11 feet from the curb which would mean there would be about 30 feet of yard that he could not fence. He said he would only have the width of one fence panel (8 feet) at the southeast corner. Mr. Knight said he is requesting to come out 16 feet, the width of two panels. He said he wishes to enclose some trees in the back yard and he wants to store a small trailer in the back yard. He said he wants to get it out of the driveway. Mr. Knight said he feels this is a reasonable request. . Mr. Knight said when they were planning his house, they had to redraw the plans 4 times to fit the house on the lot. He said they should have put a two-story on the lot. Page 4 Z B A Minutes May 18, 1989 . Mr. Knight said he got a red tag for not having enough back yard, but they re-figured it. He said he also feels he was miss-informed by the builder. Mr. Knight said the fence would not block the view any more than the house already does. Mr. Grubb asked Mr. Knight if he plans to put in a storage building. He said if he does, please get a permit. Mr. Knight said he would. Mr. Cypert said if he were to buy the lot next door, what would be his building line. Mr. Taylor said the building line for that lot is 25 feet which would be 34~ feet from the curb. . Dr. Duer asked who built the house. Mr. Knight said it was Trendsetter Homes. Dr. Duer said there would be 360 degree visibility. Mr. Cypert stated he was concerned that no one would buy the lot next door if the Board allows this fence beyond the building line. Mr. Knight said it would not block any more view than the house already does. He said he had the inspector, Tom Riney, look at it and he agreed. Dr. Duer stated he does not feel it would be a traffic problem. Mr. Taylor stated this lot was virtually unusable. . Dr. Duer said Mr. Knight had listed two options. He asked Mr. Knight if he would consider option 2. Page 5 Z B A Minutes May 18, 1989 . Mr. Knight said he would not like to. He said he would like to have more space for his trailer. Chairman Hubbard called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Chairman Hubbard asked if there had been any correspondence. Mrs. Calvert stated that she received one letter from Ms. Phillips who had no objection to the request. Dr. Duer stated he felt Mr. Knight is between a rock and a hard place. He said he felt this a hardship. . BA 89-5 APPROVED Dr. Duer made the motion to approve BA 89-5 in accordance with the fence ordinance using option 1. This motion was seconded by Mr. Kemp and the motion carried 4-1 with Mr. Cypert voting against. 3. BA 89-6 Request of Larry P. Arnold to vary from the Zoning Ordinance #1080 on a portion of Lot 16, Block 20, Snow Height Addition, to be allowed to construct a commercial building without the brick requirement. This property is located on the south side of Northeast Loop 820, east of the City of North Richland Hills Public Library. Chairman Hubbard opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Steve Flusche with AIG Architects came forward. He stated he had been hired to do the design for Mr. Arnold. He showed pictures of the proposed building. Page 6 Z B A Minutes May 18, 1989 . Mr. Flusche stated their request is to be allowed to use vinal siding on an office building across the street. He stated the lot is an irregular shape. Mr. Flusche said the building would be a post modern office building with three projected gable roof with flat in between. He said the site is quite a unique background with existing residences and trees. Mr. Flusche said they want the building to be light so it will stand out. He said the building will be small, 2,300 square feet, but will appear to be much larger. Mr. Flusche said they feel the vinal siding is better than wood. He said the roof will be a dark gray or black composition, and the building trim will be a blue color. . Mr. Flusche said they plan to back light the building at night. He said it would be very light and airy. Mr. Grubb asked if this would be a wood frame building. Mr. Flusche said it would be. He said there would be added space upstairs for expansion. Dr. Duer said the NCNB building across the street is entirely brick and looks very nice. Mr. Flusche said since they plan to build in North Richland Hills, they want to build this unique building. He said they would not build this type building just any place. Mr. Grubb asked if they had a tenant. . Mr. Flusche said Mr. Larry Arnold has a State Farm Insurance office at Meadowbrook and 820 and he wishes to move his office here. Page 7 Z B A Minutes May 18, 1989 . Dr. Duer said Farmers Insurance Group has just built a new office on Pipeline Road and it looks like a brick custom home. Mr. Flusche said with the lighter color with the residences in back, it would blend in. He said this is too neat a site to put just anything there. Dr. Duer stated if the Board allowed this, it would open the door for others without masonry. Mr. Flusche said this siding is practically zero maintenance and has a 20 year warranty. He said they used the same material on a building in Burleson. . Chairman Hubbard called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Chairman Hubbard asked if there had been any correspondence. Mrs. Calvert stated there had been none. Mr. Kemp asked someone to define masonry. Chairman Hubbard read from the Zoning Ordinance the requirement: "All buildings constructed in 0-1, LR, C-l, C-2, and OC Districts shall have exterior walls constructed of at least 75% brick, tile, stone, concrete block, or precast or reinforced concrete materials or materials of equal characteristics." . Mr. Grubb said the City let the church build without it being masonry. Page 8 Z B A Minutes May 18, 1989 . Mr. Grubb said this siding has a 20 year warranty. He said you get all wrapped up in enforcing this, but it would not be any better if it was brick. Mr. Flusche showed a picture of a similar building that was white and had a blue tent on the windows. Dr. Duer stated that a month or so ago there was a request before City Council to vary from the brick requirement on two houses Burk Collins built. He asked why did that request not come before ZBA. Mr. Taylor said the Zoning Ordinance states that in residential zoning, it has to go before the City Council. He said the City Council is very strict on the masonry requirement. . Mr. Grubb said Mr. Taylor must have talked to the wrong one. Dr. Duer stated that if the City Council wants different codes, then they should change the ordinance. He said he does not feel this is a hardship. He said he feels it is just for ascetic. BA 89-6 DENIED Mr. Cypert made the motion to deny BA 89-6. This motion was seconded by Dr. Duer and the motion to deny carried 4-1 with Mr. Grubb voting against denial. Dr. Duer said if there are some Council members who feel this ordinance is too restrictive, they should change it. Mr. Grubb stated the City Council knows very little about building. He said Planning and Zoning would consider it first. . . . . Page 9 Z B A Minutes May 18, 1989 Larry Arnold came forward. He said he could put up a tilt wall building which could be an eye sore and there would be nothing anyone could do about it, but he wanted to put up something nice and it does not qualify. He said this building would look nice. Mr. Grubb said it is not a hardship, but it is a unique factor and should have been granted.
