HomeMy WebLinkAboutZBA 1989-12-21 Minutes . MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS DECEMBER 21, 1989 - 7:30 P. M. CALL TO ORDER The meeting was called to order by the Chairman, Tom Duer, at 7:30 P. M. ROLL CALL PRESENT: Chairman Secretary Members Alt. Members Tom Duer Robert Skinner Billy Cypert Ron Hubbard Jeff Bunting Jim Kemp Richard Lawson Danny Taylor Wanda Calvert Dir. Community Dev. P & Z Coordinator Since all members are present, alternate members will not vote. CONSIDERATION OF THE MINUTES OF NOVEMBER 16, 1989 Mr. Kemp made the motion to approve the minutes as written. This motion was seconded by Mr. Huòbard and the motion carried 5-0 with Chairman Duer abstaining since he was not present at the meeting. . 1 . BA 89-31 Request of Joe & Ann Robinson to vary from the Zoning Ordinance #1080 on Lot 4R, Block 2, Richland Oaks Addition, to be allowed to put a small accessory building on this piece of a lot adjacent to their home. This property is adjacent to 8308 Jerri Jo. Chairman Duer opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Ann Robinson came forward. She stated they wish to put an accessory building on this piece of a lot. She said they donated a large wedge of this lot to the city for a drainage ditch. Mrs. Robinson stated the remainder of the lot is not large enough for a dwelling, only for a storage building. Page 2 Z B A Minutes December 21, 1989 . Mr. Cypert asked what size building they plan to put on this property. Mrs. Robinson stated it would be less than 200 square feet and no higher than 10 feet; whatever the requirement is. Mr. Hubbard asked if the neighbors would object. Mrs. Robinson stated there are none very close to it. She said they have neighbor, Loretta Allen, another vacant lot owned by McNary, and a 7 acre tract. Chairman Duer called for anyone else wishing to speak in favor of this request to please come forward. . There being no one, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak the Chairman closed the Public Hearing. Mr. Hubbard asked if the Board is liable if they grant this request and then it floods? Mr. Taylor stated they would not be. Mrs. Robinson stated that before they re-channeled they had water get into the garage, but since that time they have not had water come over the sides of the channel. Chairman Duer asked if they plan to run water and electricity to the building. Mrs. Robinson stated they do plan to. . Mr. Skinner asked if they plan to run a business from this building. Page 3 Z B A Minutes December 21, 1989 . Mrs. Robinson stated they do not. BA 89-31 APPROVED Mr. Cypert made the motion to approve BA 89-31 as requested. This motion was seconded by Mr. Hubbard and the motion carried 5-0. 2. BA 89-32 Request of Joe E. Gray to vary from the Zoning Ordinance #1080 on Tracts 3W1 & 3W, T.K. Martin Survey, Abstract 1055, to be allowed to vary from the brick requirement in residential zoning. He wishes to construct 9 horse stalls 10 feet by 16 feet each. This property is located at 9216 Amundson Road. Chairman Duer opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Joe Gray came forward. He stated he has 500 feet on Amundson Road and his property runs 900 feet south. Mr. Gray stated that in 1985 when Nab Hill Addition was being developed, the developer came to him and asked him to let them try to rezone his property and they might could work up a deal. Mr. Gray stated that is when his property went from Agriculture to Residential. Mr. Gray said he moved overseas and his daughter lived there. He said she is a lover of horses and she wants them to build stalls for horses so she can train and board horses. . Mr. Gray stated he has a letter with four signatures of neighbors who are in favor of the variance. He showed the board where his property is and where each of the neighbors live. He also showed pictures of the proposed stalls he plans to build. He said he wants to build 3 units 16 feet by 32 feet. Page 4 Z B A Minutes December 21, 1989 . Mr. Hubbard asked Mr. Gray if he sai.d his daughter would be teaching horse riding. Mr. Gray said that is true and she plans to board horses. Chairman Duer stated that would be considered as a business and that would have to be done in Commercial zoning. He said even if the Board allowed you to build these stalls, you would not be allowed to run a business. Mr. Skinner stated 1, running a business is not allowed in residential zoning and 2, if the building is over 200 square feet it must be masonry. . Mr. Hubbard asked Mr. Gray if he needs this many stalls if he is not allowed to board horses. Mr. Gray stated he has to have a place for his horses. He said he only has two at present, but he had six at one time. Mr. Skinner asked if the place where he plans to build the stalls is parallel to the house and is it level or will there be a drainage problem. Mr. Gray stated it would be fairly level. He said he plans to put a concrete slab there. Chairman Duer stated that boarding horses will not be allowed. Mr. Cypert asked about the proposed size of the stalls. Mr. Gray stated that each unit is 16 feet by 32 feet. He said he wants to build two or three units. . Chairman Duer asked Mr. Taylor how many portable building are allowed. Page 5 Z B A Minutes December 21, 1989 . Mr. Taylor said he would be allowed two accessory buildings. Chairman Duer said they could not have a common roof. Mr. Taylor said they can not. Chairman Duer called for anyone else wishing to speak in favor of this request to please come forward. There being no one, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. . Mr. Hubbard said he feared the size he wishes to build even though he does not need it all now. He said there is development going on all around. Mr. Hubbard said he sees no hardship because he is allowed two separate buildings. Mr. Skinner stated you are allowed two portable buildings under 200 square feet. Chairman Duer said 412 square feet would house three horses and that is over the 200 square feet. Mr. Gray said he needs room for tack and feed. Chairman Duer asked where is this stored now. Mr. Gray said in a horse trailer and his garage. . Mr. Cypert said, of the four neighbors who signed the letter, how many have horses. '1 Page 6 Z B A Minutes December 21, 1989 . Mr. Gray said only Mr. Fox has horses. He said he has a barn on his property. Mr. Gray said he had a barn on his property, but it fell down. Mr. Bunting asked if he is asking for one building. Chairman Duer stated the one building would be 512 square feet, not 412 square feet. Mr. Hubbard stated with housing being developed around, if the odor was bad, what recourse would the neighboring development have. . Mr. Taylor stated the nuisance ordinance states you cannot be within 100 feet of a residence. He said a person builds a house next to horses, and then they find out there is odor and they call the city. Chairman Duer said Mr. Gray would not have to be here if his property was still Agriculture. Chairman Duer said there is an option to allow a larger building without brick. Mr. Gray said the main reason for the size is you do not have to cut the studs and boards. Mr. Hubbard asked what if the Board allowed only one unit. Mr. Gray stated two units of 16 feet by 32 feet would be acceptable. He said this would house 4 or 5 horses. Mr. Gray said he wants to make the units "L" shaped. Mr. Skinner asked if this would not share a common roof. . Mr. Gray said they would not. Page 7 Z B A Minutes December 21, 1989 . Chairman Duer said this would be over 1,000 square feet for the single purpose of a shelter for horses. Mr. Taylor said the Board needs to make it clear if they plan to allow him two units. Chairman Duer asked Mr. Gray if he plans to have water and electricity. Mr. Gray said he does. Chairman Duer said this would have to be inspected by the city. Mr. Hubbard asked, if allowed, how many units Mr. Gray plans to build. Mr. Gray said 3 units. . Mr. Cypert said 2 units would house 5 horses. BA 89-32 APPROVED/STIPULATIONS Mr. Cypert made the motion to approve BA 89-32 with the following stipulations: There be 2 units 532 square feet and form an "L" shape, not to be under a common roof, height be 10 feet to plate line, and a limit of 5 horses. Mr. Bunting asked how large is needed for one horse. Chairman Duer said approximately 10 feet by 15 feet per horse. Mr. Skinner stated Mr. Gray understands he cannot run a business of boarding horses. This motion was seconded by Mr. Hubbard and the motion carried 5-0. . Page 8 Z B A Minutes December 21, 1989 . 3. BA 89-33 Request of Randall G. King to vary from the Zoning Ordinance #1080 on Lot 12A, Block 5, North Richland Hills Addition, to be allowed to use a trailer for an accessory storage building. This property is located at 7339 Grapevine Highway. Chairman Duer opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Mr. King came forward. He said he is requesting a variance from the masonry requirement. He said this used to be Mr. Transmission. Mr. King said he bought it and is trying to improve the property. He said he is trying to run a transmission shop in an old shop. He said there is no inside storage area. Mr. King said he saw different businesses that had trailers. He said he did not know he had to have a permit. He said he asked the carpet store about getting a trailer since they had one. Mr. King said he has installed several hundred dollars worth of shelves in the trailer. He showed pictures of the area he plans to remodel. He said he plans to tak~ out the garage doors and brick the area. Mr. King said he plans to fence the back to store cars and the trailer. He said he is currently renting a mini-storage building for additional storage. Mr. King said there is so much theft and vandalism and it is harder to get into a trailer. Mr. Cypert asked if Mr. King said he plans to build on to the building. . Mr. King said there is a concrete slab there and he plans to take the garage doors down, brick it, and put in a smaller door. Mr. Skinner asked how long had he been there. Page 9 Z B A Minutes December 21, 1989 . Mr. King said since November, 1987. Mr. Skinner asked how long had the trailer been there. Mr. King said 8 months or so. Chairman Duer asked if he has electricity in the trailer. Mr. King said they use a drop light. Mr. Skinner asked Mr. King if he ever moves the trailer. Mr. King said he does not move the trailer. Chairman Duer said the license plates are 15 years old. . Mr. Skinner asked if the trailer is over 200 square feet. Mr. King said it is. Mr. Skinner asked how many trailers he would have to have if they were under 200 square feet. Mr. King said he was not sure. Mr. Skinner said Kool Air has one under 200 square feet. Chairman Duer asked if it would help if he made the trailer runable. Mr. Taylor said it would not. He said they issued 7 citations to the carpet place before they removed the trailer. Mr. Cypert said if you do it for one, it is hard not to do for others. He said the city has had 7 trailers moved. He said the city has an ordinance and they have to enforce it. . . . . ~ Page 10 Z B A Minutes December 21, 1989 Mr. King said he had hoped the Board would compromise and would give him 8 months to two years to move the trailer. He said times are hard and they can only work on it in their spare time. Mr. Skinner said he needs to list his priorities. Mr. King said he guessed the trailer is. Chairman Duer asked if it could be moved by April 1st. Mr. King said he did not feel he could since they can only do it in their spare time. Mr. Skinner asked Mr. King if he owns or leases the property. Mr. King said he leases it. Chairman Duer asked if he could have it moved by June 1st. Mr. King said he probably could. Chairman Duer called for anyone wishing to speak in opposition to this request to please come forward. There being no one, the Chairman closed the Public Hearing. BA 89-33 APPROVED UNTIL 6/1/90 Mr. Hubbard made the motion to approve BA 89-33 until June 1st, 1990 at which time the trailer is to be removed. This motion was seconded by Mr. Bunting. Mr. Taylor said the electrical is illegal. Mr. Skinner amended the motion to include the electrical must be fixed and inspected. . . .
