MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
NOVEMBER 10, 1988 - 7:30 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, John Schwinger, at 7:30 P.M.

CONSIDERATION OF THE MINUTES
OF OCTOBER 27, 1988
Mr. Wood made the motion to approve
the minutes as written. This motion
was seconded by Mr. Bowen and the
motion carried 7-0.

PS 88-24
Request of Tommy A. Walling for
preliminary plat of Lot 1, Block 1,
Walling Addition.
Owen D. Long, Engineer, came forward.
He said he represents both the owner
and the purchaser of this property.
Chairman Schwinger stated that in the
past the Commission has required a
person to preliminary plat his entire
property.
Mr. Long stated the tax office carries
this as two separate tracts and Mr.
Walling wants to sell his extra tract.
Mr. Wood said the Commission
understands it would be hard for the
purchaser to have to extend the sewer
1200 feet.

Mr. Long said they would pay pro rata
for the water.

Mr. Tucker stated that they could sign
covenants stating that when the city
is ready, they will pay their fair
share for water, sewer, and street.
Mr. Long said he felt the people would
agree to that. He said they would pay
pro rata for water or sign a covenant
and will sign a covenant for the
street.
Mr. Wood asked Mr. Long if he was
saying they would agree to sign
covenants on all, but does not wish to
plat all his property.
Mr. Long said that is correct. He
said Mr. Walling lives on the other
tract and does not want to get
involved with platting his tract.

Chairman Schwinger asked if he would
consider preliminary platting it all.
Mr. Long said he would not.

Mr. Wood made the motion to approve
PS 88-24 subject to the engineer's
comments with the exception of item 5
and subject to receiving a covenant
for water, sewer, and street stating
they will pay their fair share. This
motion was seconded by Mr. Lueck and
the motion carried 7-0.

PS 88-25
Request of Tommy A. Walling for final
plat of Lot 1, Block 1, Walling
Addition.
PS 88-25
APPROVED
Mr. Wood made the motion to approve
PS 88-25 with the same stipulations as
on the preliminary: subject to the
engineer's comments with the exception
of item 5 and subject to receiving a
covenant for water, sewer and street
stating they will pay their fair
share.

This motion was seconded by Mr. Lueck
and the motion carried 7-0.

PZ 88-20
Request of B. H. & L. Joint Venture to
rezone Tracts 2A & 2A3A, S. Richardson
Survey, Abstract 1266, and Tracts lA &
lAl, A. Hood Survey, Abstract 683,
from their present classifications of
R-l Single Family, C-2 Commercial, and
AG Agriculture to R-2 Single Family.
This property is located on the east
side of Keller-Smithfield Road north
of Green Valley Drive.
Chairman Schwinger opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Owen D. Long, part owner and engineer,
came forward. He showed the
Commission a map of the area.

Mr. Bowen stated that at the time this
property was zoned, there was several
hundred acres being considered in the
northern portion of the city.
Mr. Long said at that time there was
R-l to the west and Agriculture to the
east. He said they had planned to
maintain the lakes on the property,
but now, coming from Davis Boulevard
you have Commercial, R-3, R-2, and
then our R-l.
Mr. Long stated that at the time they
requested R-l zoning, there was talk
of allowing retention ponds.

Mr. Long stated he has been working
with the Commissioner for the
East-West Freeway to be located just
north of Wilson Lane and this
property. He said their property in
Cherokee Estates will be greatly
affected by this. He said it will
take some of their R-2 so they want to
change this to have some more R-2.
Mr. Long stated there are very few
trees in the area and without the
lakes, there is very little amenities.

Mr. Long said their plan is to develop
this property, but if someone comes
and wants to buy it, they would
consider it.
Mr. Bowen said Mr. Long had tried to
get R-4-SD next to this R-l.
Mr. Long stated there is no market for
it now.
Mr. Lueck asked what is the difference
in the population of R-l and R-2.
Mr. Long said he was not sure. He
said they had planned to have the
lakes in R-l. He said they might pick
up 2 or 3 lots per acre.
Mr. Lueck said he figured they would
get about 35 more houses.

Chairman Schwinger called for those
wishing to speak in opposition to this
request to please come forward.
Mark Wood, 6932 Glendale Drive, came
forward. He said they were very happy
when this property was zoned R-l. He
said they now live in an R-3 zone and
it is mostly rental property now. Mr.
Wood said R-l would have a better
class of people.

Jack Knowles, 7955 Smithfield Road,
came forward. He said he lives on two
acres of Agricultural property which
is platted. He said all the property
along Bursey Road have large 2,000
square feet and up houses on acreage.
Mr. Knowles stated he had been in
Highland Oaks in Keller just north of
this area which has larger homes and
there seems to be more activity in
buying larger homes. Mr. Knowles said
if the Commission approves the R-2, he
would consider a compromise of 1800
square foot homes in the R-2.

Mr. Long said they would consider
having 1800 square foot houses west of
the proposed Bursey and south of
Bursey and have the other as a buffer.
Mr. Wood asked if having the whole
subdivision 1800 square feet would
cause a problem.
Mr. Long said they would like to have
some 1600 and 1700 square foot houses,
but they could live with 1800.
Chairman Schwinger called for anyone
else wishing to speak to please come
forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

PZ 88-20
APPROVED
Mr. Bowen made the motion to approve
PZ 88-20 with the stipulation that the
house size be 1800 square feet over
the entire area. This motion was
seconded by Mr. Lueck and the motion
carried 7-0.

PZ 88-21
Request of J. B. Johnston to rezone
Lots 1R & 2R, Block 6, Meadow Lakes
Addition, from its present
classification of R-1 Single Family to
O-l-PD Office-Planned Development.
This property is located on the west
side of Rufe Snow Drive at Meadow
Lakes Drive.
Chairman Schwinger opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Bob Frank came forward to represent
Mr. Johnston. He said they are asking
for Planned Development for an office
building with a residential design.

Mr. Wood said the homeowners do not
want any Commercial there. He said
the size of the building is very
large, 8,000 square foot structure.

Mr. Wood stated if the building were
smaller, it might be more agreeable.
Mr. Greene asked if they can make this
project work.
Mr. Frank said they hope to.
George Tucker suggested the Chairman
explain what Planned Development
means.
Chairman Schwinger read from the
Zoning Ordinance about Planned
Development.
Pat Tucker, 4913 Lake Side Circle,
came forward. She asked if this
Planned Development would be spot
zoning.
George Tucker said it would not be.

Chairman Schwinger said it would be
screened.
Pat Tucker said the lots could have
been incorporated into the residential
area.
Mr. Bowen said they came in previously
for Local Retail and Mr. Bowen said at
that time that he would not be in
favor of it going any further south,
and as long as he is on this
Commission it will not happen. Mr.
Bowen stated Planned Development would
not make it spot zoning. He said it
is an appropriate style for the area.
George Tucker called for a point of
order. He said they need to get back
to those speaking for and then those
in opposition.

There being no one wishing to speak in
favor of this request, the Chairman
called for those wishing to speak in
opposition to this request to please
come forward.
Ronald Olman, 6513 Meadow Lakes Court,
came forward. He stated he had
contacted each of the property owners
and have a petition for the City
Council. He said he had bought into
residential and would like these lots
to stay residential. Mr. Olman said
they say they can not sell these lots
as residential, but lots can sell in
Parkridge Estates down the street.

Pat Tucker came forward again. She
said she has been here about 10 times
for zonings in Meadow Lakes since she
bought in 1980. She said she feels
there is enough businesses on the
north side of the loop on Rufe Snow.
Ms. Tucker said if something happened
and this is not built, it could go
bankrupt and the grass would grow up
and look bad.
Vernon Landrum, 4916 Delta Court, came
forward. He said he is number one
going into Meadow Lakes. Mr. Landrum
stated he doesn't have any real
objection to this except for the
fence. lighting, and entrances. He
said he is not speaking for or
against, but he is speaking for a
change in the plan.
Mr. Bowen said the Zoning Ordinance
requires certain lighting.
George Tucker said with Planned
Development, the Commission can
stipulate what they want.

Mr. Landrum said he has a large pool
and he is concerned about the lighting
and the fence. He said he doesn't
want anyone jumping over the fence
into his yard.

George Michero, 6701 Karen Drive, came
forward. He said he lives directly
across the street. He said he has
owned his property for 23 years. He
said he remembers when Rufe Snow was a
two lane country road and he knows the
changes that have been made. Mr.
Michero said if the Commission opens
this to businesses, all the rest will
have the right to it, too. He said he
is against this request; he does not
want south of 820 to be like the north
of 820.

Terry Tice, 6701 La Rue Circle, came
forward. He stated he lives directly
across the street from the property in
question. He said he agrees with Mr.
Michero. He said the traffic is bad.
Mr. Tice said 60% of the time he can
not get out of his drive. He said the
traffic light completely closes that
drive now.
Mr. Tice said in two years when these
Commission members are no longer on
the Board, other houses will expect to
go Commercial. He said there are
houses down the street for sale now.
Dennis Tucker, 4913 Lake Side Circle,
came forward. He said as developers
they are not going to live there like
he is. Mr. Tucker said Planned
Development is a good control, but
after it is built, what then; what
control would we have. He said if it
is changed, it will start deteriorating.
Mr. Landrum asked what the present
zoning is.
Mrs. Calvert said it is R-1.

Mr. Frank said he sent letters to all
the property owners stating what he
plans to do, but got no response. He
said they are not locked in concrete,
but don't believe they will be able to
sell houses on Rufe Snow.

Chairman Schwinger called for anyone
else wishing to speak to please come
forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Mr. Wood said he remembers when this
property was platted. He said the
Commission tried to get Mr. Johnston
to include these lots into the
residential cuI de sac, but he said he
did not want to; then he puts up that
fence and then comes in with a
Commercial request. Mr. Wood said
this Commission made a promise to the
homeowners there would be no
Commercial down the street. He said
this is a good plan, but we have to
consider the homeowners. Mr. Wood
said there are going to be times when
some land can't be developed. He said
he will not be in favor of Commercial
here or down the street.
J. B. Johnston tried to speak from the
audience.
Chairman Schwinger stated the Public
Hearing was closed.
Mr. Bowen stated he may not always be
on the Commission, but as long as he
is here, he will not be in favor of
Commercial down the street.
Mr. Greene made the motion to deny
PZ 88-21. This motion was seconded by
Mr. Bowen and the motion to deny
carried 7-0.
The meeting adjourned at 8:40
M.
