CALL TO ORDER The meeting was called to order by the Vice Chairman, Forrest Grubb, at 7:05 P.M. ROLL CALL PRESENT: Vice Chairman Member Alt. Members Dir. Planning/Dev. P & Z Coordinator Forrest Grubb Billy Cypert Jim Kemp Jeff Bunting Richard Royston Wanda Calvert ABSENT: Ron Hubbard Harold Schubert Jack Roseberry CONSIDERATION OF THE MINUTES OF JANUARY 21, 1988 The approval of the minutes was postponed due to not enough members present. · 1. BA 88-1 Request of Gary Neisler to vary from the Zoning Ordinance #1080 on Lot lOR-I, Block 8, Fossil Creek Trails Addition, to be allowed to build a garage for his motor home beyond the side building line. This property is located at 6216 Riviera Drive. Vice Chairman Grubb explained to Mr. Neisler that there are only 4 members present tonight and you have to have 4 affirmative votes to approve a request. Mr. Neisler said he felt he should have to right to a full five member panel to hear his request. He said this was not explained to him the last time he came in for this request in 1982. Mrs. Calvert stated that Mr. Roseberry will be here, but will be late. · Page 2 Z B A Minutes February 18, 1988 · RECESS Vice Chairman Grubb called a recess at 7:l0 P. M. to give Mr. Roseberry time to get here. BACK TO ORDER The Vice Chairman called the meeting back to order at 7:25 P. M. with the same members present and including Jack Roseberry. Vice Chairman Grubb opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Gary Neisler came forward. He stated he wishes to have his building line changed to 14~ feet so he can build a garage to cover his 35 foot motor home. · Mr. Neisler gave a rough drawing of the area to the members which had names of his neighbors on it. He said none of them objected to his building the garage on a I4~ building line. Mr. Neisler stated it also showed a 6 foot stockade fence between he and his neighbor. He stated the names of the neighbors: Ken Adcock Bill Weihs Joe Dydek Bob Anderson Vernon Landon Fred Jackson Chester Wheeless Mr. Neisler stated these neighbors have all lived there longer than he has and he has been there 9 years. Vice Chairman Grubb asked if there were any neighbors in opposition to the request. Mr. Neisler said not that he knew of. · Mr. Bunting said he did not understand about the set back. Page 3 Z B A Minutes February 18, 1988 . Mr. Royston explained the side yard set back requirement. He said some lots in the area had 15 foot side yard set backs, but in 1984 the set back went to 25 feet, but this property was platted with a 30 foot side building line to match the houses on that side street. Mr. Roseberry stated that when Mr. Neisler came before the Board previously in 1982 he was denied by a vote of 3-1. Vice Chairman Grubb asked how he plans to get that large motor home in that garage. Mr. Neisler stated he plans to dig the present concrete out and make it lower. He said from the house to the street is 50 feet. . Mr. Royston stated the survey shows 45 feet. Mr. Neisler stated there was an insert that allows another 4 feet. He said he plans to build it 36 feet deep for the motor home. Mr. Kemp asked what the dimension of the garage is. Mr. Neisler said he plans to build a 5 car garage. He said he has teenagers with cars. Mr. Royston stated it would be 14 feet off the property line. Mr. Roseberry asked if it can be granted to build only the garage. Mr. Royston said it could be so stipulated. . Mr. Cypert made the motion to approve BA 88-1 with the stipulation that the building line be 14 feet and that it could be for a garage only. This motion was seconded by Mr. Roseberry and the motion carried 5-0. The meeting adjourned at 7:40 P. M. vi;i - Zoning Board of Adjustment
